Call To Order called to order by Chair Mountin at 7: 33 p.m. on July 7, 1993 . MEMBERS PRESENT: Commissioners Nelson, 2 . Roll Call Peterson, Miller, Ruggles, and Chair Mountin. Commissioner Stevenson had an excused absence. ALSO PRESENT: Planner Harrington and Recording Secretary Asleson. Motion/Second: Peterson/Nelson to 3 . Approval of approve the minutes of June 9, 1993. Consideration extensive history of this case. Commissioner Colleen arrived at 7 :42 p.m. Chair Mountin asked Mr. Engberg if he wished to make a statement to be incorporated into the minutes. Mr. Engberg replied that he did not have a statement. Chair Mountin then asked Mr. Engberg if he had received a copy of the proposed resolution; Mr. Engberg acknowledged that he had received one. Commissioner Miller asked if Mr. Engberg was aware of the next steps to be taken with respect to this case. Planner Harrington stated that Mr. Engberg was aware that the City Council 411 has the ultimate authority in matters of • Mounds View Planning Commission July 7, 1993 Regular Meeting Page 3 revocation and that this case is tentatively scheduled to be presented to the Council on July 26th. Motion/Second: Colleen/Ruggles to adopt Resolution No. 361-93 , recommending revocation of the Conditional Use Permits previously issued for 3030 County Road J. 6 ayes 0 nays Motion Carried Planner Harrington reviewed the next 7 . Consideration case, variance request of Simon T. Simon of Resolution for a reduction in the number of parking No. 362-93, spaces required at 2840 Highway 10. The regarding variance had previously been denied by variance the Planning Commission. At the City request of Council level, Mr. Simon was directed to Simon T. Simon, obtain an easement from MNDot to use 2840 Highway some of their right-of-way for parking 10, Planning purposes. Mr. Simon obtained this Case No. 358-92 0 easement, but it did not grant him much by way of increased parking spaces. Also, the easement agreement contained a clause which allows the agreement to be cancelled by either party with 60 days notice. Since a variance stays with a property forever, the Planning Commission had expressed some discomfort with this easement agreement. Mr. Simon was not in attendance, but had indicated that he wished to have the case proceed forward in his absence. Motion/Second: Miller/Peterson to app- rove Resolution No. 362-93, reiterating the stance of the Planning Commission • regarding the request for variance by Simon T. Simon, 2840 Highway 10. 6 ayes 0 nays Motion Carried Planner Harrington reported that a one 8 . Staff Report year review of the residential dog ken- nel permit granted to 8261 Red Oak Drive had been conducted and all provisions of Mounds View Planning Commission July 7, 1993 Regular Meeting Page 4 the Conditional Use Permit were being met to the satisfaction of the City. All Commissioners were encouraged to attend the one of the FOCUS 2000 forums, to be held the evenings of July 21 and 22, and to attend an afternoon Commis- sioner's seminar, to be held on July 22 . Chair Mountin inquired as to the 9. Reports of progress of the proposed point-of-sale Chair and housing inspection program and whether Commissioners the option of contracting out the inspection services had been considered. Planner Harrington answered that of the four cities that had been found to have a POS program, only Hopkins hires out the inspections. He further stated that the Council is very interested in fund- ing a housing inspection program, but that the budget is far from complete and • several cuts will still need to be made. Chair Mountin suggested that the Commissioner lobby their Councilmembers, as she feels this program is vital to the future of Mounds View. Commissioner Nelson reminded staff that Bumper to Bumper still has vehicles stored outdoors. Commissioner Peterson informed the Commissioners that the next meeting of the Golf Course Task Force was scheduled for July 15th at 6: 00 p.m. There being no further business before 10. Adjournment the Commission, Chair Mountin adjourned the meeting at 8: 10 p.m. Respectfully Submitted, /L-7 C Paul Harrington City Planner PLANNING COMMISSION • RESOLUTION NO. 362-93 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION REITERATING THE STANCE OF THE MOUNDS VIEW PLANNING COMMISSION REGARDING THE REQUEST FOR VARIANCE OF SIMON T. SIMON, 2840 HIGHWAY 10, PLANNING CASE NO. 358-92 WHEREAS, Mr. Simon T. Simon made application for a variance to allow a reduction in the required number of off- street parking spaces at 2840 Highway 10 ; and WHEREAS, the Mounds View Planning Commission reviewed the request and failed to approve it by the required two-thirds affirmative vote thereby rendering a decision of denial; and WHEREAS, Mr. Simon, as allowed by the Municipal Code, appealed the decision of the Planning Commission to the City Council; and WHEREAS, the Mounds View City Council reviewed the applicant's request and suggested that an attempt be made to • secure an easement from the Minnesota Department of Transportation (MnDOT) for the purposes of providing additional off-street parking on the site; and WHEREAS, the applicant secured the requested easement from MnDOT; and WHEREAS, based upon the securing of the easement, the Mounds View City Council referred the request back to the Planning Commission for reconsideration; and WHEREAS, the Mounds View Planning Commission has reconsidered the request as directed by the City Council; and WHEREAS, the Mounds View Planning Commission finds that the request is not significantly different from the original request for the following reason: The new request can provide for a maximum of 21 parking spaces versus 17 under the original request which is significantly less than the required 34 spaces; and . WHEREAS, the Planning Commission has reviewed the easement agreement secured by the applicant and has determined that it is not viable as it allows for the cancellation of the agreement by either party with 60 days written notice. • NOW, THEREFORE, BE IT RESOLVED that based upon the findings listed above, the Mounds View Planning Commission denies Resolution No. 362-93 • Page Two the request for variance of Simon T. Simon for a reduction in the required number of off-street parking spaces at 2840 Highway 10. BE IT FINALLY RESOLVED that the Mounds View Planning Commission directs staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 7th day of July, 1993 .
