Call To Order called to order by Chair Mountin at 8: 37 p.m. on July 21, 1993 . MEMBERS PRESENT: Commissioners Colleen, 2 . Roll Call Stevenson, Nelson, Peterson, Ruggles, Miller and Chair Mountin. ALSO PRESENT: Planner Harrington and Councilmember Wuori. Chair Mountin stated that the purpose of 3 . Consideration this special meeting was to make a of Resolution recommendation regarding a Conditional No. 364-93 , • Use Permit for minor auto repair at 2806 Regarding Highway 10. Planner Harrington reviewed Conditional Use the stipulations of the Conditional Use Permit Request Permit, including the permit would be for Minor Auto subject to review after a period of one Repair at 2806 year. Highway 10, Planning Case The applicant, Ron Schmidt, was present No. 365-93 and received a copy of the proposed resolution. Adjournment the Commission, Chair Mountin adjourned the meeting at 8:40 p.m. Respectfully Submitted, Paul Harrington City Planner • PLANNING COMMISSION • RESOLUTION NO. 361-93 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING REVOCATION OF THE APPROVED CONDITIONAL USE PERMITS GRANTED FOR AN OVERSIZE ACCESSORY BUILDING AND GARAGE AT 3030 COUNTY ROAD J, PLANNING CASE NO. 304-90, CITY COUNCIL RESOLUTION NOS. 4067 AND 4081 WHEREAS, the Mounds View City Council granted Mr. John Engberg conditional use permits to allow for the placement of an oversize accessory building and garage at 3030 County Road J; and WHEREAS, these approvals were given in the form of City Council Resolution Nos. 4067 and 4981; and WHEREAS, these resolutions included specific contingencies upon which the Conditional Use Permit approvals were based; and WHEREAS, in violation of Resolution Nos. 4067 and 4081, certain contingencies outlined in the resolutions have not been met to the satisfaction of the City of Mounds View; and • WHEREAS, the City of Mounds View has, subsequent to the adoption of Resolution Nos. 4067 and 4081, informed Mr. Engberg of these violations of the approved Conditional Use Permits. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends that the previously approved Conditional Use Permits for an oversized accessory building and garage at 3030 County Road J - City Council Resolution Nos. 4067 and 4081 - be revoked due to lack of compliance with contingencies attached to those approvals. BE IT FINALLY RESOLVED that the Mounds View Planning Commission directs staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 7th day of July, 1993 . ATTEST: Chai man/ (SEAL) �/ 411 City Planner • MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 364-93 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RECOMMENDATION TO THE CITY COUNCIL APPROVING THE CONDITIONAL USE PERMIT REQUEST BY RON SCHMIDT, 2806 HIGHWAY 10, PLANNING CASE NO. 365-93 WHEREAS, Ron Schmidt has requested City approval to operate a minor auto repair facility at 2806 Highway 10; and WHEREAS, the Mounds View Municipal Code allows minor auto repair facilities in a B-3 , Highway Commercial District; and WHEREAS, the Planning Commission has reviewed the following documents regarding this proposal: a) Site plan dated June 4, 1993 b) Letter of request dated May 28, 1993 WHEREAS, the Planning Commission has determined that the proposal is in conformance with the requirements of the Municipal Code, specifically Chapter 40. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval of the conditional use permit with the following conditions: 1. A storm water control plan and landscape plan shall be submitted by the applicant and approved by the appropriate City Staff. 2 . There shall be no outside loudspeakers at this facility. 3 . Only minor repairs and maintenance will be allowed on site between the hours of 7: 00 a.m. and 9 : 00 ' p.m. Monday through Saturday and between 11: 00 a.m. and 5: 00 p.m. Sunday. 4. No major engine overhauls, transmission replacement, or body work shall be allowed on the site. • PLANNING COMMISSION • RESOLUTION NO. 364-93 PAGE TWO OF TWO 5. The hours of operation of the facility shall not exceed 6: 00 a.m. to 10:00 p.m. Monday thru Saturday and 10: 00 a.m. to 6: 00 p.m. Sunday. 6. Outside merchandising of accessories shall be allowed only with prior City approval. 6. The conditional use permit shall be reviewed after one year to ensure that applicable conditions imposed on the site effectively control the impact of the site operation on the community. BE IT FINALLY RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 21st day of July, 1993 .
