The Mounds View Planning Commission was 1. Call To Order

p.m. on September 1, 1993 .
MEMBERS PRESENT: Commissioners Nelson, 2 . Roll Call
Peterson, Miller, and Chair Mountin.
Commissioners Ruggles and Stevenson had
excused absences.
ALSO PRESENT: Planner Harrington and
Recording Secretary Asleson.

subject to a one year review. Planner
Harrington replied that the one year
review provision is usually reserved for
commercial uses, but that revocation of
the permit would occur if violations
were noted.

approve Resolution No. 366-93 ,

Commissioner Miller asked how cars would
exit the property from the car wash.
Keith Carlson, of Gateway Foods,
answered that the cars would have the
option of exiting onto Highway 10,
Greenfield Avenue, or County Road H2 .
Commissioner Colleen asked about how the
stacking would be handled - would the
entrance to Highway 10 be blocked?
Planner Harrington stated that staff had
the applicant plan for about 1/2 hour
worth of washes, or about six cars.
These may block the Highway 10 entrance,
although this can be alleviated somewhat
by striping (such as Phillips 66 has
done) .
Chair Mountin asked about how the water

Mr. Boulay answered that the blower will
rid cars of most of the water and that
there would be a heated apron at the car
wash exit.
Commissioner Miller inquired about the
adequacy of parking on the site.
Planner Harrington replied that no
additional off-street parking is
required for a car wash facility.
Commissioner Nelson asked Mr. Boulay if
the car wash had any space for outdoor
merchandising of accessories. Mr.
Boulay replied that there was no space
for this, although there will be pay-
per-use vacuums outside of the car wash.
These vacuums will not be attached to
the car wash nor will they be in the
stacking area. Chair Mountin asked that
the vacuum's placement be shown on the
final plans.
• There was some discussion among the
Commissioners regarding the compati-
bility of the primary and secondary
uses, in this case being a convenience
store and a car wash. The Commission
wished to avoid a scenario in the future
where the car wash would be an accessory
use to a fast food store, for example.
A condition was placed in the resolution
that nullifies the car wash permit if
the primary use of the property changes.
Motion/Second: Nelson/Peterson to
approve Resolution No. 368-93 ,
recommending approval of a Conditional
Use Permit for a prefabricated car wash
at 2390 Highway 10.
Commissioner Miller questioned the
requirement that a blower be used in the
winter months - would this be an
additional charge? Planner Harrington
stated that the operators of car washes
often work the cost of the dry into the
• basic cost of a car wash.

Chair Mountin voted against approval of
the resolution - not because she has
objections to the plan as presented, but
rather that she objects to the principle
of allowing accessory buildings in comm-
ercial districts. The language of the
code is fairly vague in the past, it
has been interpreted as allowing acces-
sory buildings, but Chair Mountin feels
that this interpretation sets a bad
precedent. Also, while accessory uses
are allowed in the code, Chair Mountin
does not feel that this use is "reason-
able and incidental" to the principal
use of the property. She stated that
the applicant has done a good job
working within the constraints of the
site, but she cannot vote in favor of
this proposal given the above concerns.
Planner Harrington reported that Everest 7 . Staff Report
Development had withdrawn its requests
• regarding the proposed expansion of
Multi-Tech. Everest has asked for a
refund of its planning fees, which staff
feels is reasonable given that minimal
staff time was spent on the proposal.
Motion/Second: Miller/Nelson to
recommend to the City Council that all
planning fees regarding the Multi-Tech
expansion be refunded to Everest
Development.

Chair Mountin stated that she was 8 . Reports of
pleased to see that the Park-and-Ride at Chair and
County Road H was being expanded, but Commissioners
wondered why there had been no Planning
Commission review of the proposal.
Planner Harrington answered that the
area is technically out of the
jurisdiction of the City, as it
completely highway right-of-way.
Commissioner Peterson announced that the
next meeting of the Golf Course Task
• Force would be September 9th at 6: 00

results of the land negotiations and
bond sale.
Chair Mountin announced formally that
she would be resigning from the
Commission as of September 30th so that
she may attend graduate school in the
evening.
Commissioner Nelson thanked Chair
Mountin for her assistance and
mentoring. The rest of the
Commissioners concurred.
There being no further business before 9 . Adjournment
the Commission, Chair Mountin adjourned
the meeting at 8: 53 p.m.

RESOLUTION NO. 366-93
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION RECOMMENDING APPROVAL OF THE REQUEST BY DONALD
PEDERSON FOR A CONDITIONAL USE PERMIT TO ALLOW AN OVERSIZED
ACCESSORY BUILDING AT 8368 SPRING LAKE ROAD,
PLANNING CASE NO. 368-93
WHEREAS the Mounds View Planning Commission has reviewed
the request of Donald Pederson for a conditional use permit to
allow an oversized accessory building at 8368 Spring Lake Road; and
WHEREAS, the Planning Commission has reviewed the Zoning
Code and recognizes that the Code allows up to a 400 square foot
accessory building with a conditional use permit; and
WHEREAS, the proposed accessory building is 400 square
feet which is within the square footage allowed with a conditional
use permit.
NOW, THEREFORE BE IT RESOLVED that the Mounds View
• Planning Commission recommends to the City Council approval of the
requested Conditional Use Permit contingent upon the following:
1. The Conditional Use Permit is recorded with Ramsey
County.
2 . The building shall be maintained to provide a uniform
appearance with the dwelling unit.
3 . The accessory building does not exceed 400 square feet.

5 . The accessory building must conform with sections 40. 04 ,
Subd. F and 40. 10, Subd. C(2) of the Zoning Code.
6. Should the use for which the permit was granted be changed,
the permit shall be subject to reconsideration, revocation
or other action as regulated by Chapter 40.25 of this Code.
7 . There will be no improved driving surface leading up to the
accessory structure.

BE IT FINALLY RESOLVED that the Planning Commission
directs Staff to forward this resolution to the City Council prior
to approval of the minutes.

CITY OF MOUNDS VIEW

STATE OF MINNESOTA
RECOMMENDATION TO THE CITY COUNCIL REGARDING
CONDITIONAL USE PERMIT REQUEST BY GATEWAY FOODS,
2390 HIGHWAY 10, MOUNDS VIEW PLANNING CASE NO. 362-93
WHEREAS, Gateway Foods has requested City approval
to construct a free standing, pre-fabricated, fully automated,
self-service car wash in the City of Mounds View; and
WHEREAS, Chapter 40 of the Mounds View Municipal
Code allows car wash uses in the B-3 , Highway Commercial
-
Distr'ict; and
WHEREAS, the development, as proposed, requires a
conditional use permit; and
WHEREAS, the Planning Commission has reviewed the
following documents regarding this development proposal:411 .
a) Site Plan Dated August 2 , 1993
b) Building Elevations Dated April 30, 1993
WHEREAS, the Planning Commission has determined that
the conditional use permit request is in conformance with the
requirements of the Municipal Code, specifically Chapters 40,
42 , 49 and 49A and State Statutes.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends approval of the conditional use
permit contingent upon the following:
1. A Certificate of Survey, showing the location
of all existing and proposed buildings on the
property, be provided by the applicant,.
2 . Landscaping, as approved by the City Forester,
shall be installed along the South property
line.
3 . The facility must, at all times, be in
compliance with State Laws and Minnesota
Pollution Control Agency Standards for air
quality and noise.

4 . The hours of operation shall be 24 hours.
After one year of operation the City shall hold
a public hearing to solicit input on the hours
of operation. If there are any negative com-
ments, the hours of operation may be reduced.
5. The car wash facility shall include a blower
system designed to remove as much water as
feasible from the vehicle before it is allowed
to exit the facility. This equipment shall
operate as a customer option from April 16 to
October 14 and as a mandatory service from
October 15 through April 15.
6. A performance bond shall be provided by the
applicant to ensure plantings are installed per
City Forester recommendation.
7 . Should the primary use (Gas Station) of the
site change, the Conditional Use Permit shall
become null and void.
BE IT FINALLY RESOLVED THAT the Planning Commission
110 directs Staff to forward this resolution to the City Council
prior to approval of the minutes.
