Call To Order called to order by Chair Peterson. at 7: 35 p.m. on December 1, 1993 . MEMBERS PRESENT: Commissioners Nelson, 2 . Roll Call Ruggles, Stevenson, Miller, and Chair Peterson. Commissioner Colleen had an excused absence. ALSO PRESENT: Planner Harrington, Recording Secretary Asleson, and Councilmember Trude. Motion/Second: Ruggles/Nelson to 3 . Approval of approve the minutes of November 3, 1993 Minutes: as amended. November 3 , • 1993 5 ayes 0 nays Motion Carried There were no resident requests or 4 . Resident comments from the floor. Requests and Comments Planner Harrington briefly reviewed 5. Consideration Everest's requests as previously of Resolutions discussed at the November Agenda 371-93 and 372- Session. Everest Development is 93 , Regarding applying for rPzoning of the property Rezoning and located immediately West of the current Development business park in order to construct a Review Requests 59, 970 square foot expansion of the of Everest existing Multi-Tech facility. He noted Development, that the legal description of the 2205 Woodale rezoning would not include a portion of Drive, Planning the land originally included in the Case No. 367-93 application. A replatting of the land will need to take place before this portion of the land can be rezoned. Tim Nelson, representing Everest Development, was present to answer any • remaining questions. This should be reviewed by Staff prior to submission to the City Council. Planner Harrington replied that drainage is reviewed only in terms of impervious surface added. The proposed loading dock will replace existing impervious surface. Mr. Nelson said that Everest will review the matter for their own benefit. Chair Peterson asked about the width of the curb cut opening and its adequacy for handling semi truck traffic. Planner Harrington replied that the size of the curb cut openings have been set to accommodate truck traffic and the proposal meets the standards as outlined in the City Code. • Motion/Second: Stevenson/Nelson to approve Resolution No. 371-93 , recommending approval of the rezoning request of Everest Development. 5 ayes 0 nays Motion Carried Motion/Second: Stevenson/Nelson to approve Resolution No. 372-93, recom- mending approval of the development request of Multi-Tech at 2205 Woodale Drive. 5 ayes 0 nays Motion Carried Planner Harrington presented Resolution 6. Consideration No. 373-93 , which establishes an 18 of Resolution month moratorium on the establishment of No. 373-93 , new car lots in the City. This Regarding Car resolution would not affect the Lots Within the existence or expansion of lots already City licensed for operation. Chair Peterson asked if the attorney had • been consulted on this matter - can the City legally establish this moratorium? Mounds View Planning Commission December 1, 1993 •egular Meeting Page 3 Planner Harrington stated that such moratoriums are legal, provided that the City intends to study the impacts of the use during the moratorium. There is currently a moratorium on the establishment of adult uses. Commissioner Nelson asked about the timetable for the study of the car lot issue. Planner Harrington replied that the Growth, Development, and Business FOCUS 2000 group will be making their recom- mendations by March; the Planning Comm- ission should wait for those conclusions prior to beginning their own study. Commissioner Stevenson asked whether it would be more appropriate to specify a moratorium on "dealerships" rather than "lots" . The Commissioners discussed this point at length. Planner Harrington stated that many different chapters of the code affect car sales, some dealing with lots and others with dealer licensing. In this case, the intent of the moratorium is to cease a land use, not the issuance of a license. Chair Peterson noted that this is only a recommendation and wording can be chang- ed by the City Council if necessary. Commissioner Ruggles made several wording changes to the proposed resolution. Deadline Dates 5 ayes 0 nays Motion Carried Planner Harrington reported that the 8 . Staff Report new, recodified code books are due to be delivered by the end of the year. The codifiers have not changed the content of the current code, but have double- checked for inconsistencies, conflicts with State Law, and ordinance omissions. Attendance at the November 17, 1993 9. Report of Chair Agenda Session included Commissioners Nelson, Colleen, Ruggles, Stevenson, 411 Miller, and Chair Peterson. Councilmember Trude updated the 10. Report of Commission on the status of the Victoria Council Liaison Bowers case. At the Public Hearing, several of Ms. Bowers' neighbors stated that the dogs bark a lot and that they receive inadequate care. The Council tabled a decision on the Conditional Use Permit until a study by the Humane Society can be performed. Councilmember Trude suggested that the Planning Commission review Chapters 40 and 91 on animals to determine the criteria for granting such requests. There being no further business before 11. Adjournment the Commission, Chair Peterson adjourned the meeting at 8: 18 p.m. Respectfully Submitted, Paul Harrington City Planner MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 371-93 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF A REZONING REQUEST OF EVEREST DEVELOPMENT, PLANNING CASE NO. 367-93 WHEREAS, Everest Development has made application to rezone the property located South of County Road H2 and Northeast of Highway 10 from B-3 , Highway Business to PUD, Planned Unit Development; and WHEREAS, the property is legally known as: That part of the Southwest Quarter of the Northwest Quarter of the Southeast Quarter lying northeasterly of U. S. Highway No. 10, and the Northwest Quarter of the Northwest Quarter of the Southeast Quarter, all in Section 8, Township 30, Range 23, Ramsey County, Minnesota, according to the United States Government Survey thereof; and WHEREAS, Chapter 40. 25, Subdivision A(5) , provides that the Planning Commission shall consider possible adverse effects of the proposed amendment. It further states that judgement shall be based . upon, but not limited to, the following factors: 1. Relationship to Municipal Comprehensive Plan 2 . The geographical area involved 3 . Whether such use will tend to or actually depreciate the area in which it is proposed 4 . The character of the surrounding area 5. The demonstrated need for such use; and WHEREAS, the Mounds View Planning Commission has reviewed the request in relation to the aforementioned criteria; and WHEREAS, the rezoning request is consistent with the City's current Comprehensive Land Use Plan designation for this property• which is mixed use planned unit development; and WHEREAS, approval of the request will provide for a zoning designation which is consistent with the current and proposed land use. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval of the request to rezone the property legally known as: That part of the Southwest Quarter of the Northwest Quarter of 110 the Southeast Quarter lying northeasterly of U. S. Planning Application dated October 29, 1993 2 . Site/Landscape Plan dated October 4, 1993 3 . Grading, Drainage and Erosion Control Plan dated October 14 , 1993 4. ATTEST: Chairman 0 J (SEAL) Plana -1-7 • MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 373-93 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING THE ESTABLISHMENT OF A MORATORIUM ON NEW AND USED CAR LOTS WITHIN THE CITY OF MOUNDS VIEW WHEREAS, at the direction of the City Council, the Mounds View Planning Commission has conducted an in-depth review of the requirements for establishment of new and used car lots within the City; and WHEREAS, the Planning Commission review included review of Chapters' 40, 59 and 109 of the Municipal Code; and WHEREAS, the Planning Commission has determined that there exists a need for further review and possible amendment of the existing regulations governing the operation of new and used car lots within the City; and 411 WHEREAS, the Planning Commission recognizes the fact that groups have been formed as part of the FOCUS 2000 project to . study issues that are facing the City including land use and business establishment; and WHEREAS, the findings of these study groups may provide direction for both the Planning Commission and City Council on issues of land use within the City; and WHEREAS, the Planning Commission wishes to incorporate these findings in their further review of the new and used car lot issue. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends the placement of an 18 month moratorium on the establishment of additional new and used car lots within the City of Mounds View.
