Call To Order called to order by Chair Peterson at 7 : 34 p.m. on May 4 , 1994. MEMBERS PRESENT: Commissioners Nelson, 2 . Roll Call Ruggles, Miller, Stevenson and Chair Peterson were present. Commissioner Colleen had an excused absence. ALSO PRESENT: Planner Harrington, Recording Secretary Benesch, and Councilmember Wuori were also present. Motion/Second: Stevenson/Nelson to 3 . Approval of approve the minutes of April 6, 1994, as Minutes: April amended. 6, 1994 i 5 ayes 0 nays There were no resident requests or 4 . Resident comments from the floor. Requests and Comments Tim Nelson and Dick Hill, representing 5 . Consideration C. G. Hill, were present. of Resolution Nos. 379-94, Planner Harrington presented a revised 380-94, 383-94, parking plan. No. 380-94 The Planning Commission inquired as to whether or not our City Forester had reviewed the plan. Planner Harrington assured the Planning Commission that it had been reviewed by the Forester. The Planning Commission expressed concern about screening of the dumpsters from view of KFC and Taco Bell. Mr Nelson indicated that the applicant would prefer that no additional landscaping be required but would consider additional shrubbery if necessary. It was also noted that the Mounds View Inn did not voice any concern regarding the desire for more landscaping. Councilmember Wuori • announced her concerns regarding the illumination from the headlights of the employees' cars shining in the motel windows. Mr. Nelson indicated this would not be a problem. The applicant informed the Planning Commission that they hoped to be operational by mid to late October, 1994 . Motion/Second: Nelson/Miller to approve Resolution No. 379-94 , recommending approval of the rezoning/development review/major subdivision request of C. G. Hill, Mounds View Business Park East. 5 ayes 0 nays Motion Carried At this time, Planner Harrington brought before the Planning Commission the request of Multi-Tech for the Planning Commission to reaffirm the previous approval of Resolution No. 372-93 • approving a 60, 000 square foot building expansion. Planner Harrington indicated that the tax increment financing issues Mounds View Planning Commission May 4, 1994 "regular Meeting Page 3 regarding this proposal had been resolved. He also noted that the applicant would be rezoning only a portion of the property that pertained to the expansion. At this time Planner Harrington distributed copies of the site plan pertaining to this request which are the same at those approved by the Planning Commission on December 1, 1993 . Mr. Nelson advised the Planning Commission that Multi Tech would be purchasing 6. 414 acres instead of the entire property as was originally proposed. He explained that the two parcels would be subdivided into two new parcels to be known at Mounds View Business Park West Addition. He also added that the proposed expansion has been revised from 30, 000 square feet to 60, 000 square feet and that the parking • improvements on the property increased from 73 , 000 square feet to 133 , 000 square feet. Mr. Nelson expressed his desire to have the Planning Commission take action on this item at this time which would enable him to bring the proposal to the Council at their next meeting. Planner Harrington advised the Planning Commission that the City Attorney had reviewed this proposal and it meets all subdivision requirements. He also noted that the plat would need to be recorded within 30 days and that park dedication fees would need to be submitted. The Planning Commission was reminded that the property under consideration, Lot 2 , Block 1, Mounds View Business Park West Addition, would need to be rezoned to PUD to be consistent with the rest of the Business Park. Planner Harrington made note of the previous resolution, No. 372-93 , which Mounds View Planning Commission May 4, 1994 410Regular Meeting Page 4 had been approved by the Planning Commission on December 1, 1993 . Motion/Second: Ruggles/Nelson to reaffirm the approval of Resolution No. 372-93 , recommending approval of the development request of Multi-Tech, 2205 Woodale Drive. Motion Carried 5 ayes 0 nays Motion/Second: Stevenson/Nelson to recommend approval of Resolution No. 380-94 , recommending approval of a major subdivision for Everest Development. 5 ayes 0 nays Motion Carried Motion/Second: Nelson/Miller to recommend approval of Resolution No. 383-94 , recommending approval of a rezoning request of Everest Development, to rezone the property known as Lot 2 , Block 1, Mounds View Business Park West Addition, from B-3 , Highway Business, to PUD, Planned Unit Development. 5 ayes 0 nays Motion Carried The applicant, Michael Hegland, was 6. Consideration present. of Resolution No. 381 -94 Planner Harrington informed the Planning Regarding Commission that he had prepared two Conditional Use resolutions regarding this proposal; one Permit/Variance approving the request, the other denying Request of it. Planner Harrington reviewed the Michael proposal reminding the Planning Hegland, 7604 Commission that the applicant was Spring Lake requesting a variance to allow an Road, Planning accessory structure in excess of the Case No. 374-94 square footage allowed by Code with the issuance of a conditional use permit. Planner Harrington explained that the applicant is requesting to use his existing 528 square foot garage as a . storage building and construct a new 780 square foot attached garage to his house. Discussion ensued regarding the Mounds View Planning Commission May 4, 1994 .Regular Meeting Page 5 nature of this request. It was noted that 400 square feet is the maximum with a conditional use permit and the applicant is requesting 528 square feet. Mr. Hegland took the floor and demonstrated to the Planning Commission his hardship. He stated the he believes that the Code is written to accommodate new construction, not existing properties. He also stated that due to the dimensions of his lot and the layout of his house, it would not be possible for him to build an attached garage to the maximum allowable square footage of 864 square feet. Discussion continued by the Planning Commission. Planner Harrington reminded the Planning Commission that a 2/3 vote by the Commission would be necessary to approve the resolution. • Motion/Second: Stevenson/Nelson to recommend approval of Resolution No. 381-94 , recommending denial of a variance to allow for an oversized accessory structure at 7604 Spring Lake Road. 5 ayes 0 nays Motion Carried The Planning Commission discussed the applicant's hardship statement dated March 29, 1994 , and reviewed the criteria for granting variances. They amended the resolution to include findings-of-fact to support the denial of the variance. The applicant's hardship statement was made a part of the resolution. The applicant was informed at this time of his options; he could either appeal the decision to the City Council or submit a new request. 111 Jeff Huggett, representing Westminster 7 . Consideration Corporation, was present. of Resolution Mounds View Planning Commission May 4, 1994 Regular Meeting Page 6 Planner Harrington reminded the Nos. 382-94 and Commission that this proposal was 384-94 discussed at the April 6th meeting. The Regarding Commission agreed at that time to take Rezoning/ action regarding the parking on the Development site. It was pointed out that the Review Request applicant approached Rice Creek of Westminster Watershed District regarding their Corporation, requirements for the redelineation of 2701 County the wetland surrounding the property. Road I, Planner Harrington distributed revised Planning Case drawings. The parking issue was No. 375-94 discussed at length. Other items regarding the proposal were also discussed. The applicant informed that Planning Commission that soil borings had been done and that the water table for the site was high. He also noted that a topographical survey will be available by the end of next week. It was noted that the revised plans indicate that the walking path is • eliminated and the commons area is reduced by 20 percent. The Commission discussed the parking for the site. They agreed that additional overflow parking is needed. It was advised that a bond be required to secure that adequate parking for the site is acquired. Planner Harrington suggested that the parking situation be reviewed on a yearly basis. Discussion continued regarding this proposal. One item of concern was that no sidewalk would be available to residents. It was agreed that a condition would be placed in the resolution that a provision for safe crossing of County Road I be provided. Staff Report Administrator Orduno to present to the Planning Commission. the recommendation to consolidate the City's existing tax increment financing districts into one total district encompassing the entire City. It was requested that the Planning Commission make a motion regarding this item. Motion/Second: Nelson/Peterson to recommend approval of consolidating the entire City as a tax increment financing district. 5 ayes 0 nays Motion Carried Members present at the April 20, 1994, 9 . Report of Chair Agenda Session included Commissioners Nelson, Colleen, Ruggles, Stevenson, Miller, and Chair Peterson. The Planning Commission was informed that the City Council has appointed a new Planning Commissioner, Marshall Johnston, who would start his position at the May 18th meeting. The Commission thanked the City for allowing four of their members to. attend a Planning seminar in St. Cloud. There being no further business before 10. Adjournment the Commission, Chair Peterson adjourned the meeting at 10: 09 p.m. Mounds View Planning Commission May 4, 1994 "'Regular Meeting Page 8 Respectfully Submitted, .4 / Paul Harrington Community Development Coordinator RESOLUTION OF THE MOUNDS VIEW PLANNING COMMISSION CONCERNING THE MOUNDS VIEW ECONOMIC DEVELOPMENT AUTHORITY'S ECONOMIC DEVELOPMENT PROJECT AND TAX INCREMENT FINANCING PROPOSALS WHEREAS, the proposals made by the Mounds View Economic Development Authority to enlarge its Development District Nos. 1, 2 and 3 (the "Development Districts") in order to integrate and make coterminous their boundaries and areas; designate said integrated areas as the Mounds View Economic Development Project; amend the respective Development Programs for the Development Districts to integrate and expand their goals, objectives, activities, and budgets into a single plan for the development and redevelopment of the consolidated project areas; designate said consolidated development program as the Project Plan; and amend the tax increment financing plans for the tax increment financing districts heretofore established within the Development Districts, respectively, to reflect increased development goals, activities, expenses and bonded indebtedness; all pursuant to Minnesota Statutes, Sections 469 . 001 through 469. 047, 469. 090 through 469 . 108, 469. 124 through 469. 134, and 469 . 174 through 469. 179, respectively (collectively, the "Plans") , have been submitted to the Mounds View Planning Commission (the "Commission") ; and • WHEREAS, the Commission has reviewed the Plans to determine the consistency of the Plans with the Comprehensive Plan of the City: NOW, THEREFORE, BE IT RESOLVED by the Mounds View Planning Commission that the Plans are consistent with the Mounds View Comprehensive Plan and the Commission recommends approval of the Plans to the Mounds View City Council. HILL, MOUNDS VIEW BUSINESS PARK EAST, PLANNING CASE NO. 380-94 WHEREAS, C. G. Hill has requested City approval for a Rezoning, Development Review and Major Subdivision for their development on the Mounds View Business Park East site; and WHEREAS, the proposal is subject to the requirements contained in Titles 1000, 1100 and 1200 of the Mounds View Municipal Code; and WHEREAS, the Planning Commission has reviewed the following documents regarding this development proposal: 1. Hill contingent upon the following: 1) Park Dedication Fees for the Major Subdivision are paid per Title 1200 of the Mounds View Municipal Code. 2) Parking stalls on the site shall be a minimum of 20 "feet in depth per Municipal Code. ATTEST: Chairm / (SEAL) f � l ( e ommunity Development Ardinator MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 381-94 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION DENYING A VARIANCE TO ALLOW FOR AN OVERSIZED ACCESSORY STRUCTURE AT 7604 SPRING LAKE ROAD PLANNING CASE NO. 374-94 WHEREAS, the Mounds View Planning Commission has reviewed the request of Michael Hegland for a variance to allow an accessory structure in excess of the square footage allowed for with the issuance of a Conditional Use permit; and WHEREAS, the applicant's property is subject to requirements set forth in Title 1100 of the Mounds View Municipal Code; and WHEREAS, the Planning Commission has reviewed the criteria used to evaluate all variance requests; and WHEREAS, the applicant has presented a hardship statement to the Planning Commission; and WHEREAS, the literal interpretation of the provisions of this code would not deprive the ip applicant of rights commonly enjoyed by other properties in the same district under the terms of this Code; and WHEREAS, the special conditions of the property result from the actions of the applicant; and WHEREAS, granting the variance would confer special privileges on the applicant that are not enjoyed by other property owners in the same district; and WHEREAS, the variance requested is not the minimum necessary to alleviate the hardship.
