Call To Order called to order by Chair Peterson at 7 : 34 p.m. on June 1, 1994 . MEMBERS PRESENT: Commissioners Nelson, 2 . Roll Call Ruggles, Miller, Stevenson, Johnston and Chair Peterson were present. Commissioner Colleen arrived at 7 : 44 p.m. ALSO PRESENT: Planner Harrington and Recording Secretary Benesch were also present. Motion/Second: Stevenson/Nelson to 3 . Approval of approve the minutes of May 4 , 1994,. as Minutes: May • amended. 4 , 1994 6 ayes 0 nays Motion Carried There were no resident requests or 4 . Resident comments from the floor. Requests and Comments The applicant, Mr. Michael Hegland, was 5 . Consideration present. Planner Harrington reviewed of Resolution the proposal by Mr. Hegland for a Nos. 385-94 coni lona use perm_ . 'eg an. • originally proposed a variance to allow Conditional Use an accessory structure in excess of the Permit Request square footage allowed by Code (528 of Michael square feet) with the issuance of a Hegland, 7604 conditional use permit. Mr. Hegland Case No. 385-94 has now proposed conditional use permit for a 400 square foot accessory building which is the maximum allowed by Code with a conditional use permit. • Motion/Second: Nelson/Ruggles to approve Resolution No. 385-94 , recommending approval of the conditional Mounds View Planning Commission June 1, 1994 •euiar Meeting Page 2 use permit request of Michael Hegland at 7604 Spring Lake Road. 6 ayes 0 nays Motion Carried Mr. Hegland was concerned about the procedure for recording the conditional use permit with Ramsey County. Planner Harrington clarified the procedure and also informed Mr. Hegland that a public hearing would be held at the June 27th City Council meeting regarding this item. The applicant, Mr. John DeVries, 6 . Consideration representing Prime Builders, was of Resolution present. No. 386-94 Regarding Planner Harrington reminded the Rezoning/ Commission that this item had been Development reviewed at the May 18th meeting and Review Request • that the proposal was in conformance of Prime with applicable City Codes. He also Builders, 2856 reviewed the proposal explaining that Highway 10, the applicant, Prime Builders, is Planning Case requesting approval for a development No. 383-94 review and rezoning to PUD for a proposed 22 unit townhome project at 2856 Highway 10. A concern was raised by the Planning Commission regarding the setbacks of Knollwood Green being less that was required. Issues also brought up were emergency access to the rear of the proper y an. a s orm wa er con ro plan being approved by the City's consulting engineer. Planner Harrington informed the Planning Commission that in the event the proposal is approved, a written statement, signed by the representatives of the Knollwood Green Townhome Association, allowing the applicant to utilize the emergency access on the south end of the Knollwood Green property should be approved. The Commission was concerned as to whether or not the barricade existing at the • emergency access would be removed or remain and that the exit would be used for emergency only. Commissioner Colleen arrived at 7:44 p.m. Motion/Second: Miller/Nelson to recommend approval of Resolution No. 386-84 , recommending approval of the rezoning/development review request of Prime Builders, 2856 Highway 10. 6 ayes 0 nays 1 abstention Motion Carried Planner Harrington informed the applicant that a public hearing would be held at the June 27th City Council meeting regarding this item. The applicants, Mr. Terry Kelm, 7 . Consideration Merchandise Manager for Major Video of Resolution • Concepts, and Mr. Richard Jahnke, Senior No. 387-94 Leasing Representative for Paster Regarding Enterprises, were present. Variance Request of Planner Harrington reminded the Planning Major Video Commission that this item was discussed Concepts, Inc. , at the May 18th meeting. He explained 2537 Highway that the applicant has requested a 10, Planning variance to allow 238 square feet of Case No. 384-94 sign text at their proposed facility in Mounds View Square Shopping Center and that the Code currently only allows 100 square feet of sign area per business occupant of the shopping center. The Planning Commission, at their May 18th meeting, directed Staff to draft a resolution allowing for 185 square feet of sign area which was arrived at based on the demonstrated need by the applicant and also based on the size of the other signage in the Mounds View Square Shopping Center. The applicants spoke of the need for larger signage due to the competition 4111 with Block Buster Video in Blaine, Columbia Heights and the new facility on I-35E and Highway 96 . Pictures of the Mounds View Planning Commission June 1, 1994 Regular Meeting Page 4 Block Buster signage were shown to the Planning Commission. The applicants explained to the Planning commission that in order for Marios to be successful, it needs a sign package that tells what they sell since it is not a household name as Block Buster Video. They need the words "games" and "video" in larger print. Mr. Jahnke displayed a new drawing and requested signage in addition to the 238 square feet already proposed. The applicants are requesting an additional 8'x3 ' sign (24 square feet) of neon lettering which would be located on the south side of the building to the east of the illuminated awning for a total of 262 square feet. The applicants explained that they want to get the attention of not only Mounds View residents but the surrounding communities as well. • The Planning Commission compared the signage requested by the applicant with signage already existing in Mounds View Square. The applicant also showed a picture of the previous Country Club signage which had been grandfathered in. Planner Harrington explained to the Planning Commission that the resolution would require a 2/3 affirmative vote. Commissioner Miller made a motion to approve Resolution No. 387-94 recommending approval of a variance for sign area of 262 square feet. The motion fails due to lack of a second. Motion/Second: Nelson/Colleen to recommend approval of Resolution No. 387-94 denying the variance request for Major Video Concepts, 2537 Highway 10. Motion Carried 7 ayes 0 nays Planner Harrington informed the applicant that if they wanted to appeal the Planning Commission's decision to Mounds View Planning Commission June 1, 1994 •euiar Meeting Page 5 the City Council it would be discussed at their June 6th meeting and formal action would be taken on June 13th. Motion/Second: Stevenson/Nelson to make a verbal recommendation to the City Council to increase the 100 square foot maximum allowed to 185 square feet on the basis that the privilege of increase signage has been granted to other tenants of the Mounds View Square Shopping Center. 6 ayes 1 nays Motion Carried The applicant, Mr. Jeff Welden , of Auto 7 . Consideration Central, was present. of Resolution No. 388-94 Planner Harrington reminded the Planning Regarding Commission the Mr. Welden has requested Conditional Use a conditional use permit to allow the Permit Request • operation of a minor auto repair of Auto business at their existing facility at Central, 2975 2975 Highway 10, which currently Highway 10, operates as an automobile dealership. Planning Case Planner Harrington read aloud the No. 379-94 conditions contained in Resolution No. 388-94 . The Planning Commission was concerned about trash that would be generated from this operation and its disposal. Planner Harrington demonstrated to the Planning Commission that they would be required to dispose of any garbage and debris in an enclosed dumpster which already exists on the site. Planner Harrington welcomed new Planning Commissioner, Marshall Johnston, to the Planning Commission. Members present at the May 18th, 1994, 9 . Report of Chair Agenda Session included Commissioners Nelson, Ruggles, Stevenson, Miller, and Chair Peterson. Commissioners Colleen and Johnston had excused absences. Commissioner Nelson informed the Planning Commission that he would not be attending the June 15th agenda meeting due to vacation plans. 411 There being no further business before 10 . Paul Harrington Community Development Coordinator • MOUNDS VIEW PLANNING COMMISSION • RESOLUTION NO. 385-94 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF THE REQUEST BY MICHAEL HEGLAND FOR A CONDITIONAL USE PERMIT TO ALLOW AN OVERSIZED ACCESSORY BUILDING AT 7604 SPRING LAKE ROAD, PLANNING CASE NO. 374-94 WHEREAS the Mounds View Planning Commission has reviewed the request of Michael Hegland for a conditional use permit to allow an oversized accessory building at 7604 Spring Lake Road; and WHEREAS, the Planning Commission has reviewed the Zoning Code and recognizes that the Code allows up to a 400 square foot accessory building with a conditional use permit; and WHEREAS, the proposed accessory building is 400 square feet which is within the square footage allowed with a conditional use permit. • NOW, THEREFORE BE IT RESOLVED that the Mounds View Planning Commission recommends to the City Council approval of the requested Conditional Use Permit contingent upon the following: 1. The Conditional Use Permit is recorded with Ramsey County. 2. The building shall be maintained to provide a uniform appearance with the dwelling unit. 3 . The accessory building does not exceed 400 square feet.. 4. The only vehicles that may be stored in the accessory building are licensed collector vehicles. 5. CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF THE REZONING/DEVELOPMENT REVIEW REQUEST OF PRIME BUILDERS, PLANNING CASE NO. 383-94 WHEREAS, Prime Builders has requested City approval for a Rezoning and Development Review for their proposed 22-unit Townhome development at 2856 Highway 10; and WHEREAS, the proposal is subject to the requirerients contained in Titles 1000, 1100 and 1200 of the Mounds View Municipal Code; and WHEREAS, the Planning Commission has reviewed the following documents regarding this development proposal: 1. Planning Application dated April 29, 1994 2. Site Plan dated April 28, 1994 3 . Grading and Utility Plan dated April 28, 1994 4. Building Elevations and Floor Plans • WHEREAS, the Planning Commission has determined that the proposal is in conformance with all applicable requirements of the Mounds View Municipal Code. FOR THE PROPERTY LOCATED AT 2537 HIGHWAY 10, PLANNING CASE NO. 384-94 WHEREAS, the Mounds View Planning Commission has reviewed the request of Major Video Concepts, Inc. for a variance to allow the placement of 262 square feet of sign area at 2537 Highway 10 where only 100 square feet is allowed by Municipal Code; and WHEREAS, the Planning Commission has reviewed the criteria used to evaluate all variance requests; and WHEREAS, the applicant has presented a hardship statement to the Planning Commission; and WHEREAS, the literal interpretation of the provisions of this code would not deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of this Code; and • WHEREAS, granting the variance would confer special privileges on the applicant that are not enjoyed by other property owners in the same district; and WHEREAS, the variance requested is not the minimum necessary to alleviate the hardship. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission denies the variance request of Major Video Concepts, Inc. for the placement of 262 square feet of sign area at 2537 Highway 10 . ATTEST: P� Chairman-- (SEAL) 6Com ity Developme Coordinator • MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 388-94 CITY OF MOUNDS VIEW • COUNTY OF RAMSEY STATE OF MINNESOTA RECOMMENDATION TO THE CITY COUNCIL APPROVING THE CONDITIONAL USE PERMIT REQUEST BY AUTO CENTRAL, 2975 HIGHWAY 10, PLANNING CASE NO. 379-94 WHEREAS, Auto Central has requested City approval to operate a minor auto repair facility at 2975 Highway 10; and WHEREAS, the Mounds View• Municipal Code allows minor auto repair facilities in a B-3, Highway Commercial District; and WHEREAS, the Planning Commission has reviewed the following documents regarding this proposal: a) Site plan received February 8 , 1993 , revised May 18, 1994 b) Letter of request dated May 10, 1994 WHEREAS, the Planning Commission has determined that the proposal is in conformance with the requirements of the Municipal Code, specifically Title 1200. . NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval of the conditional use permit with the following conditions: 1. There shall be no outside loudspeakers at this facility. 2 . Only minor repairs and maintenance will be allowed on site between the hours of 7: 00 a.m. and 9 : 00 p.m. Monday through Saturday and between 11: 00 a.m. and 5 : 00 p.m. Sunday. 3 . The hours of operation of the facility shall not exceed 6: 00 a.m. to 10: 00 p.m. Monday thru Saturday and 10: 00 a.m. to 6: 00 p.m. Sunday. 5 . Outside merchandising of accessories shall be allowed only with prior City approval. 6. The conditional use permit shall be reviewed after one year to ensure that applicable conditions imposed on the site effectively control the impact of the site operation on the community. BE IT FINALLY RESOLVED that the Planning Commission directs staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 1st day of June, 1994 .
