Call To Order called to order by Chair Peterson at 7 : 30 p.m. on July 6, 1994 . MEMBERS PRESENT: Commissioners Nelson, 2 . Roll Call Ruggles, Miller, Stevenson, Colleen, and Johnston. Chair Peterson had an excused absence. ALSO PRESENT: Planner Harrington and Recording Secretary Benesch were also present. Motion/Second: Ruggles/Miller to 3 . Consideration Planning Commission that this item had of Resolution been discussed at their June 15th Agenda No. 390-94 Session. He reviewed Resolution No. Regarding 390-94 reading aloud the contingencies Conditional Use stated therein. Consideration and explained that the applicant, Harold of Resolution Ihnot, was requesting a variance to No. 391-94 allow for a second driveway for health Regarding reasons. Variance Request of The Planning Commission discussed the Harold Ihnot, contingencies that would be included in 7900 Greenfield the resolution. It was the consensus of Avenue, the Planning Commission that the Planning Case variance shall become null and void 10 No. 384-84 years after its adoption, a copy shall be recorded with Ramsey County, and the width of the driveway shall not exceed 12 feet. It was also noted that the property owner would be responsible for the removal of the driveway upon expiration of the Sunset clause. Planner Harrington distributed the proposed resolution to the Planning Commission. Motion/Second: Stevenson/Colleen to 411 approve Resolution No. 391-94 , recommending approval of the variance Mounds View Planning Commission July 6, 1994 •Regular Meeting Page 3 request of Harold Ihnot, 7900 Greenfield Avenue. Discussion ensued regarding the variance request. It was noted by the Planning Commission that variances were not presidential. The Planning Commission was concerned about the clause in the resolution which stated that granting the variance would not confer special privileges on the applicant that are not enjoyed by other property owners in the same district, and asked that this statement be removed from the resolution. They also requested that the statement indicating that the literal interpretation of the provisions of this code would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of the code also be removed from the resolution. • The Planning Commission was concerned about the location of the proposed driveway. Planner Harrington indicated that the curb cut would be located 40 to 50 feet east of the present berm curb. Planner Harrington reminded the Planning Commission that this resolution would require a 2/3 vote for its adoption. 5 ayes 1 nay Motion Carried Ken Sjodin, representing Citywide 8 . Consideration Developers, Inc. , was present. of Resolution No. 392-94 Planner Harrington reminded the Planning Regarding Major Commission that this item was discussed Subdivision at their June 15th Agenda Session. Request of Planner Harrington informed the Citywide Commission that he had contacted Short- Developers, Elliott-Hendrickson, the City's XXXX Highway Consulting Engineers, regarding the 10, Planning issue of storm water drainage. Case No. 387-94 • Planner Harrington discussed the contingencies noted in the proposed Mounds View Planning Commission July 6, 1994 Regular Meeting Page 4 resolution. A third contingency regarding Park Dedication fees was added. The Planning Commission expressed concern about the upkeep of the outlot. Planner Harrington explained that the City would keep control of the outlot to prevent rank growth on the property. Planner Harrington read aloud proposed Resolution No. 392-94 . He noted that the legal descriptions will be attached to the resolution. The applicant informed the Commission that the date of the most recently revised plat was June 10, 1994 , and the most recent Utility Plan is dated June 15th. Motion/Second: Ruggles/Johnston to recommend approval of Resolution No. 392-84 , recommending approval of the Major Subdivision request of Citywide Developers, Inc. 6 ayes 0 nays Motion Carried Planner Harrington informed the applicant that a preliminary hearing would be held at the July 25th City Council meeting. Commissioner Stevenson informed the Planning Commission that the name of the new golf course is "The Bridges at Mounds View" . There being no further business before 13 . Adjournment the Commission, Chair Peterson adjourned the meeting at 8 : 36 p.m. Respectfully Submitted, r G aul Harrington Community Development Coordinator 411 4. • MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 389-94 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF THE REQUEST BY VINCE MEYER FOR A CONDITIONAL USE PERMIT TO ALLOW AN OVERSIZED GARAGE AT 8380 SPRING LAKE ROAD, PLANNING CASE NO. 381-94 WHEREAS the Mounds View Planning Commission has reviewed the request of Vince Meyer for a conditional use permit to allow an oversized garage at 8380 Spring Lake Road; and WHEREAS, the Planning Commission has reviewed the Zoning Code and recognizes that the Code allows up to a 1264 square foot garage with a conditional use permit; and WHEREAS, the proposed garage is 976 square feet which is within the square footage allowed with a conditional use permit. NOW, THEREFORE BE IT RESOLVED that the Mounds View Planning Commission recommends to the City Council approval of the requested Conditional Use Permit contingent upon the following: 1. The Conditional Use Permit is recorded with Ramsey County. 2. The building shall be maintained to provide a uniform appearance with the dwelling unit. BE IT FINALLY RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 6th day of July, 1994. ATTEST: Chairman (SEAL) Community DeveloPeW Coordinator • MOUNDS VIEW PLANNING COMMISSION • RESOLUTION NO. 390-94 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF THE REQUEST BY RODNEY SCHULTZ FOR A CONDITIONAL USE PERMIT TO ALLOW AN OVERSIZED ACCESSORY BUILDING AT 5505 QUINCY STREET, PLANNING CASE NO. 382-94 WHEREAS the Mounds View Planning Commission has reviewed the request of Rodney Schultz for a conditional use permit to allow an oversized accessory building at 5505 Quincy Street; and WHEREAS, the Planning Commission has reviewed the Zoning Code and recognizes that the Code allows up to a 400 square foot accessory building with a conditional use permit; and WHEREAS, the proposed accessory building is 320 square feet which is within the square footage allowed with a conditional use permit. NOW, THEREFORE BE IT RESOLVED that the Mounds View Planning Commission recommends to the City Council approval of the requested Conditional Use Permit contingent upon the following: 1. The Conditional Use Permit is recorded with Ramsey County. 2. The building shall be maintained to provide a uniform appearance with the dwelling unit. 3 . The accessory building does not exceed 400 square feet. 4. The only vehicles that may be stored in the accessory building are licensed collector vehicles. 5. ATTEST: Chairman (SEAL) Community Develop u t Coe�,�d D,. 2 o e MOUNDS VIEW PLANNING COMMISSION • RESOLUTION NO. 391-94 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING A VARIANCE TO ALLOW FOR A SECOND DRIVEWAY AT 7900 GREENFIELD AVENUE, PLANNING CASE NO. 38494 WHEREAS, the Mounds View Planning Commission has reviewed the request of Harold Ihnot for a variance to allow a second driveway access to his property at 7900 Greenfield Avenu ;g and WHEREAS, the Planning Commission has reviewed the criteria used to evaluate all variance requests; and WHEREAS, the applicant has presented a hardship statement to the Planning Commission; and WHEREAS, the special conditions of the property (IQ 1,6t_ result from the actions of the applicant; and WHEREAS, the variance requested is the minimum necessary to alleviate the hardship. • NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission approves the request of Harold Ihnot for a second driveway contingent upon the following: 1) The Variance shall become null and void and the second driveway removed 10 years after the adoption of this Variance or upon sale or transfer of the property. 2) The width of the driveway shall not exceed 12 feet. 3) A copy of this Resolution shall be recorded with Ramsey County. ATTEST: -}A3 tj--;,--- Chairman (SEAL) -------- Community Developmen Coordinator 411 MOUNDS VIEW PLANNING COMMISSION 111 RESOLUTION NO. 393-94 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF THE DEVELOPMENT REQUEST OF WOLF AND ASSOCIATES, 4860 MUSTANG CIRCLE, PLANNING CASE NO. 386-94 WHEREAS, Wolf and Associates have requested City approval to construct a 9, 566 square foot addition to their existing facility at 4860 Mustang Circle; and WHEREAS, Chapter 1006 of the Mounds View Municipal Code requires that a development review be conducted for this and similar proposals; and WHEREAS, the Planning Commission has reviewed the following documents regarding this development proposal: 1. Planning Application dated June 2 , 1994 2 . Site Plan dated December 4, 1991 3 . Letter of Request (Attachment A) ; and WHEREAS, the Planning Commission has determined that the proposal is in conformance with all applicable requirements of Chapter 1100. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval of the development review request subject to the following condition: 1. The operation of the facility shall be reviewed by City Staff after one year to determine if landscaping is necessary on the North side of the site abutting the manufactured home park. ATTEST: Chairman (SEAL) / /'CI' - Community Development coordinator MOUNDS VIEW PLANNING COMMISSION • RESOLUTION NO. 394-94 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF AN EXTENSION OF A CONDITIONAL USE PERMIT FOR A TEMPORARY ACCESSORY STRUCTURE, CHURCH UPON THE ROCK, 7901 RED OAK DRIVE WHEREAS, Church Upon the Rock has made application for a Conditiqnal Use Permit to allow for the continued use of a temporary accessory structure at 7901 Red Oak Drive; and WHEREAS, In 1988, the Mounds View City Council gave approval for a Conditional Use Permit for the placement of a temporary accessory structure on the property; and WHEREAS, the approved City Council resolution con- tained a "sunset" clause, which effectively revoked the permit after a five year period; and WHEREAS, in 1993, the City Council granted an exten- sion of one year to the original approval; and 111 WHEREAS, Church Upon the Rock has requested an additional 2-year extension of the Conditional Use permit; and WHEREAS, the Planning Commission has reviewed the request and found it in conformance with applicable City Codes. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval of the requested extension of a Conditional Use Permit for the location of a temporary accessory structure for Church Upon the Rock, 7901 Red Oak Drive. BE IT FURTHER RESOLVED that the Planning Commission directs Staff to forward a copy of this Resolution to the City Council prior to approval of the minutes.
