The Mounds View Planning Commission was 1. Call To Order
called to order by Chair Peterson at
7 : 35 p.m. on August 3 , 1994 .
MEMBERS PRESENT: Commissioners Nelson, 2 . Roll Call
Johnston, Miller, and Chair Peterson.
ALSO PRESENT: Planner Harrington and
Recording Secretary Benesch were also
present.

Planner Harrington reviewed the variance
request by Townsedqe Terrace Mobile Home 5. Consideration

The Planning Commission inquired as to
using the old water tower property for
construction of a storm shelter.
Planner Harrington informed the
Commission that this property has two
water mains running through it which
precludes any construction on the site.

Planning Harrington reminded the Regarding

Session. Mr. Harrington reviewed of David
Resolution No. 396-94 explaining that Tanner, 7935

that in order for the applicant to keep
the existing shed on his property, the
proposed garage could not exceed 1, 000

the City Council meeting may be changed

Planner Harrington informed the Regarding

The applicant, Bruce Bogie, was present. 8 . Consideration
of Resolution
Planner Harrington reviewed the variance No. 398-94
request by Mr. Bogie. He explained that Regarding

The applicant indicated that he has
discussed his situation with the
affected neighbor who indicated that he
had no objections.
Commissioner Stevenson informed the
Commission that he made a site
inspection of the property and also
III spoke with the neighbor in question who
indicated that he is opposed to the 2 '
setback request. Mr. Stevenson also
demonstrated that if the garage was
constructed, the Lilac bushes now
existing on the west side of the garage
would need to be cut in order to walk on
that side.
The driveway code was mentioned by the
Planning Commission which requires that
written permission be obtained by an
adjacent property owner for construction
of a (temporary) driveway closer than 5
feet to the property line but not less
than one foot. It was also noted that a
concrete driveway could be not closer
than 5 feet to the property line.
The Commission briefly discussed
alternative locations for the garage on
the lot. (It was also noted that the
property was subdivided prior to
adoption of the setback ordinance. ) The
applicant informed the Commission that
it would not be practical to have the
11111 garage on the other side of the house.

approve Resolution No. 398-94 , denying
the variance request of Bruce Bogie,
2572 Ardan Avenue.

Planner Harrington informed the
applicant that this item would be on the
August 22 (or August 29) City Council
agenda.
At this time Mr. Richard Gerlach of the
Townsedge Terrace Tenants Association,
2200 Kingsway Lane, was identified. He
indicated that he was present in favor
of the variance request of Townsedge
Terrace . He informed the Planning
Commission that he and the tenants
association have been working for three
years to get a shelter facility for the
• residents of the park.
Planner Harrington distributed the draft
of the Nuisance Ordinance (Nuisances, 9 . Staff Report
Animals and Refuse) . Mr. Harrington
requested that the Planning Commission
review the ordinance and make a list of
comments to be discussed in two weeks
(at their agenda meeting) which would
then be forwarded to the City Council.
Commissioner Ruggles informed Mr.
Harrington that he would be leaving for
vacation on the 9th of August and
returning in October.
Planner Harrington informed the
Commission that Colonial Village would
be before the Planning Commission again
in September. He also informed them
that Roger Miller, 5064 Irondale Road,
who had requested a variance to allow
concrete steps within the right-of-way
is planning to move the steps back and
1111 therefore withdrawing his variance
request. Mr. Harrington indicated that
he and the Public Works Director will be

inspecting the site to verify that the
correction to the sidewalk/steps is
acceptable.
Members present at the July 20th, 1994 ,
Agenda Session included Commissioners 10. Report of Chair
Nelson, Ruggles, Stevenson, Miller, and
Chair Peterson. Commissioners Colleen
and Johnston had excused absences.
There being no further business before
the Commission, Chair Peterson adjourned 11. Adjournment
the meeting at 8 : 26 p.m.

CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION APPROVING A SIDE YARD SETBACK VARIANCE AT TOWNSEDGE
TERRACE, 5001 OLD HIGHWAY 8, PLANNING CASE NO. 376-94
WHEREAS, the Mounds View Planning Commission has
reviewed the request of Townsedge Terrace for a variance to allow
a reduction in the required side yard setback at 5001 Old Highway
8; and
WHEREAS, the applicant's request for variance would
allow construction of a severe weather shelter at an 11 foot side
yard setback where a 30 foot setback is required by Municipal
Code; and
WHEREAS, the Planning Commission has reviewed the
criteria used to evaluate all variance requests; and
WHEREAS, the Planning Commission has considered the
hardship which exists on the entire Townsedge Terrace Community
as a whole; and
• WHEREAS, that hardship requires the residents of
Townsedge Terrace to travel in excess of one mile to seek shelter
from severe weather; and
WHEREAS, the variance requested is the minimum
necessary to alleviate the hardship.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission approves the request of Townsedge Terrace for
a variance to allow the construction of a severe weather shelter
at a side yard setback of 11 feet where 30 feet is required by
Municipal Code.
Adopted this 3rd day of August, 1994 .

RESOLUTION RECOMMENDING APPROVAL OF A CONDITIONAL
USE PERMIT TO ALLOW AN OVERSIZED GARAGE FOR DAVID TANNER
7935 SUNNYSIDE ROAD, PLANNING CASE NO. 388-94
WHEREAS, the Mounds View Planning Commission has
reviewed the request of David Tanner for an oversized garage; and
WHEREAS, the Mounds View Zoning Ordinance allows, by
conditional use permit, up to 1,264 square feet of garage square
footage on one lot; and
WHEREAS, the applicant is proposing a garage not to
exceed 1, 000 square feet, which is below the maximum allowed; and
WHEREAS, the proposed building meets all applicable
setback requirements.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends to the City Council approval of
• the requested conditional use permit for an oversized garage, not
to exceed 1, 000 square feet, by David Tanner, 7935 Sunnyside
Road, contingent upon the following:
a) The conditional use permit be recorded with Ramsey Co.
b) The building be designed and maintained to provide a
uniform appearance with the dwelling unit.
c) Should the use change for what the permit was granted
for, the permit will become null and void.
d) That the total square footage of all accessory
buildings on the property shall not exceed 1,264 sq.ft.
BE IT FINALLY RESOLVED that the Planning Commission
directs Staff to forward this resolution to the City Council
prior to approval of the minutes.

RESOLUTION RECOMMENDING APPROVAL OF THE DEVELOPMENT RE=11 O
SATURN OF ST. .PAUL, 2375 HIGHWAY 10, PLANNING CASE NO, -c -5
WHEREAS, Saturn of St. Paul has requested City approval
to construct an addition to their existing automobile sales
facility at 2375 Highway 10; and
WHEREAS, the proposal would allow the ath ition of
approximately 45 car-for-sale stalls and associated lighting and
landscaping on the site; and
WHEREAS, Chapter 1006 of the Mounds View Municipal CES,e
requires that a development review be conducted for this and
similar proposals; and
• WHEREAS, the Planning Commission has reviewed the
following documents regarding this development proposal
1. Planning Application dated June 24, 1994
2 . Site Plan dated June 24, 1994
3 . Submittal Narrative; and
WHEREAS, the Planning Commission has determined that
the proposal is in conformance with all applicable requirements
of Chapter 1100.
NOW, ThEREFORE, BE IT-RESOLVED that the Mounds View
Planning Commission recommends approval of the development review
request subject to the following condition:
1. The facility shall, following the completion of
the addition, be subject to the conditions
stipulated in the original City Council Resolution
authorizing the use (City Council Resolution No.
4195, dated February 24, 1992) .

yard setback where a five (5) foot setback is required by

WHEREAS, the Planning Commission has determined that no
reasonable alternatives for the location of the attached garage
are available; and
• WHEREAS, the variance requested is the minimum
necessary to alleviate the hardship.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission approves the request of Bruce Bogie for a
variance to allow the construction of an attached garage at a
side yard setback of two (2) feet where a five (5) foot setback
is required by Municipal Code.
