Call To Order called to order by Chair Peterson at 7:30 p.m. on September 7, 1994. MEMBERS PRESENT: Commissioners 2 . Roll Call Stevenson, Nelson, Miller, Johnston, and Chair Peterson. Commissioners Colleen and Ruggles had excused absences. ALSO PRESENT: Planning Associate Pruitt and Recording Secretary Benesch were also present. Motion/Second: Nelson/Miller to approve 3 . The applicant, Brady Neumann, was 6. The Planning Commission revised the proposed resolution to reflect that the garage could not exceed 1, 264 square feet. It was also noted that since the applicant is proposing a garage to exceed 1, 000 square feet, the existing shed on the property must be removed prior to final building permit approval. Mr. Neumann expressed his concern regarding the maximum square footage allowed for his garage. The Commission explained that they realized his lot was unique in that it was larger than most Mounds View lots, however, the Planning Commission agreed that the maximum square footage allowed by Code was appropriate for Mounds View. Motion/Second: Stevenson/Nelson to approve Resolution No. 400-94, recommending approval of the conditional 1110 use permit request of Brady Neumann, 8425 Spring Lake Road. Mr. Neumann expressed his concern about time constraints and wondered if the process could be hastened. He informed the Planning Commission that he would be calling Mr. Harrington, Community Development Coordinator, the following day. There was no staff report. 7. Adjournment the Commission, Chair Peterson adjourned the meeting at 7: 54 p.m. Respectfully Submitted, 1 / � � oyce Pruitt Planning Associate 1111 MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 399-94 411 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING A MINIMUM BUILDING SEPARATION VARIANCE AT 5299 CLIFTON DRIVE, PLANNING CASE NO. 394-94 WHEREAS, the Mounds View Planning Commission has reviewed the request of Larry and Susan Potts for a variance to allow a reduction in the minimum building separation at 5299 Clifton Drive; and WHEREAS, the Mounds View Municipal Code requires that all structures be separated by a minimum of six (6) feet; and WHEREAS, the applicant's request for variance would allow construction of an addition to their single family home which would be four (4) feet from an existing detached garage; and WHEREAS, the Planning Commission has reviewed the criteria used to evaluate all variance requests; and WHEREAS, the Planning Commission has determined that no reasonable alternatives for the location of the house addition are available; and WHEREAS, the variance requested is the minimum necessary to alleviate the hardship; and WHEREAS, the Uniform Building Code allows structures closer than six (6) feet to one another with proper installation of fire walls. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission approves the request of Larry and Susan Potts for a variance to allow a four (4) foot setback between structures on their property contingent upon the following: 1. Co unity Development C ordinator MOUNDS VIEW PLANNING COMMISSION • RESOLUTION NO. 400-94 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF A CONDITIONAL USE PERMIT TO ALLOW AN OVERSIZED GARAGE FOR BRADY NEUMANN, 8425 SPRING LAKE ROAD, PLANNING CASE NO. 395-94 WHEREAS, the Mounds View Planning Commission has reviewed the request of Brady Neumann for an oversized garage; and WHEREAS, the Mounds View Zoning Ordinance allows, by conditional use permit, up to 1,264 square feet of garage square footage on one lot; and WHEREAS, the applicant is proposing a garage not to exceed 1,264 square feet, which is the maximum allowed; and WHEREAS, the proposed building meets all applicable setback requirements. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends to the City Council approval of the requested conditional use permit for an oversized garage, not to exceed 1,264 square feet, by Brady Neumann, 8425 Spring Lake Road, contingent upon the following: a) The conditional use permit be recorded with Ramsey Co. b) The building be designed and maintained -to provide a uniform appearance with the dwelling unit. c) That an 8'x 8' accessory building currently located on the property be removed prior to construction of the garage addition. BE IT FINALLY RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes.
