Call To Order called to order by Chair Peterson at 7:30 p.m. on November 2, 1994. MEMBERS PRESENT: Commissioners 2. Roll Call Stevenson, Ruggles, Miller, Johnston, and Chair Peterson. Commissioner Nelson had an excused absence, Commissioner Colleen had an unexcused absence. ALSO PRESENT: Planner Harrington, Councilmember Wuori, and Recording Secretary Benesch were also present. He also reminded the Commission that this item was discussed at the October 19th meeting. Mr. Harrington explained that the 6. At that time the Planning Commission requested Staff to contact other cities to find out their policy on allowing the display and sale of manufactured homes within a manufactured home park district. Mr. Harrington informed the Planning Commission that he had contacted 14 cities, 3 of which allowed the display and sale of manufactured homes. Two of the three cities, Blaine and Inver Grove Heights, allowed the display and sales of manufactured homes by conditional use permit. Neither of the two cities have specific conditions set forth in their Code and all conditional use permit requests are reviewed on an individual • basis. He also noted that the cities have expressed no dramatic impact on traffic. Mr. Harrington recommended that the Planning Commission not set specific requirements in the Code. He concurred with the cities of Blaine and Inver Grove Heights in that each request should be reviewed individually. Mr. Harrington advised the Commission that he City Attorney was contacted regarding this issue. He informed Mr. Harrington that there would need to be an ordinance amendment and that the Planning Commission could make the amendment by motion. The applicant, Mr. Liggett, addressed the Planning Commission. He informed the Commission that the selling of the manufactured homes would be done with the homes in place (on each individual lot) . Mr. Liggett presented a chart showing the number of manufactured homes and average age of the homes. He mentioned to the Planning Commission 111 that he also manages manufactured homes parks in both Inver Grove Heights and Maplewood where the sales of Mounds View Planning Commission November 2, 1994 •Regular Meeting Page 4 manufactured homes is allowed. He added that it has been working successfully. He concluded by saying that by allowing the sales of these homes on site, it would keep the parks full and help to upgrade them. Both Mr. Liggett and the Planning Commission expressed concerns about the time constraints. Planner Harrington informed the applicant that ordinance changes require a 30-day period after publication before it would take effect and that he could make application to the Planning Commission for a conditional use permit sometime in late January, early February. Motion/Second: Stevenson/Miller to allow the display and sales of manufactured homes within an R-5 District by conditional use permit. 411 5 ayes 0 nays Motion Carried. Mr. Harrington assured the Planning Commission that these conditional use permits can be amended just like any other request and that the same criteria will be used, only the conditions would differ. Mr. Harrington also indicated that each request would be reviewed after one year and could be amended if need be at that time. Planner Harrington commented that he would consult the attorney as to whether or not Mr. Liggett could apply for a conditional use permit prior to the ordinance change. In other words, he would find out if Mr. Liggett could apply for a conditional use permit that doesn't currently exist in our Code. Planner Harrington informed the applicant that this item would be discussed at the December 5th City Council meeting. Adjournment the Commission, Chair Peterson adjourned the meeting at 8: 10 p.m. Respectfully Submitted, „ / Harrington C Community Development Coordinator • MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 403-94 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF THE REQUEST BY PETER MCINTYRE FOR A CONDITIONAL USE PERMIT TO ALLOW AN OVERSIZED ACCESSORY BUILDING AT 2917 COUNTY ROAD H2, PLANNING CASE NO. 398-94 WHEREAS the Mounds View Planning Commission has reviewed the request of Peter McIntyre for a conditional use permit to allow an oversized accessory building at 2917 County Road H2; and WHEREAS, the Planning Commission has reviewed the Zoning Code and recognizes that the Code allows up to a 400 square foot accessory building with a conditional use permit; and WHEREAS, the proposed accessory building is 308 square feet which is within the square footage allowed with a conditional use permit. NOW, THEREFORE BE IT RESOLVED that the Mounds View • Planning Commission recommends to the City Council approval of the requested Conditional Use Permit contingent upon the following: 1. The Conditional Use Permit is recorded with Ramsey County. 2 . The building shall be maintained to provide a uniform appearance with the dwelling unit. 3 . The accessory building does not exceed 400 square feet. 4 . The only vehicles that may be stored in the accessory building are licensed collector vehicles. 5.
