Call To Order called to order by Chair Peterson at 7: 04 p.m. on January 4, 1995. MEMBERS PRESENT: Commissioners Ruggles, 2. Roll Call Colleen, Johnston, Stevenson, Miller, Nelson and Chair Peterson. ALSO PRESENT: Planning Associate Pruitt and Recording Secretary Benesch were also present. Motion/Second: Ruggles/Nelson to 3 . Consideration present. of Resolution No. 409-95 The Planning Commission reviewed the Regarding the request by Reginald and Sharon Nelson Variance for a variance to allow 14 cats on their Request of premises at 8242 Greenwood Drive. The Reginald and Planning Commission reviewed the letter Sharon Nelson, received from Dr. Newman, a 8242 Greenwood veterinarian, who suggested that the cat Drive, Planning waste be placed in plastic bags and Case No. 404-94 disposed of with the everyday household waste. Mr. Nelson indicated that they would be following this suggestion and would even be double-bagging the cat waste. The Planning Commission briefly discussed the FIP (Feline Infectious Peritonitis) virus noting that in order to catch the disease, there must be a live host or carrier (i.e. , live cat) • present and that the disease could not be transferred through a vector (i.e. feces) . The Planning Commission, however, did request that the suggestion by Dr. Newman regarding the bagging of waste be added to proposed Resolution No. 409-95. The Planning Commission also requested that the owner notify the City upon the death of all 14 cats which were exposed to the FIP virus and the variance would then become void. Motion/Second: Stevenson/Nelson to approve Resolution No. 409-95 as amended, approving the variance request of Reginald and Sharon Nelson, 8242 Greenwood Drive. 7 ayes 0 nays Motion Carried The Planning Commission informed the applicant that upon death of all 14 cats he would be required to comply with existing Code requirements regarding kennel licensing. Conditional Use Permit Request Motion/Second: Nelson/Miller to approve of Colonial Resolution No. 410-95 as amended, Village recommending approval of a conditional Manufactured use permit to allow display and sale of Home Park, 2075 model homes at Colonial Village Rustad Lane, Manufactured Home Park. Planning Case No. 391-94 The Planning Commission deliberated on the question of how many model homes could be available for sale at any one time. It was questioned as to whether or not the park should be restricted on • the number of new or used homes displayed for sale. Planning Associate Pruitt informed the Commission that she spoke with the City Attorney who advised her that a model home is defined as new or used. Mr. Liggett explained to the Planning Commission that State law requires that the seller of a manufactured home provide the buyer with a statement, known as a safety disclosure, verifying that the home is up to Code. Mr. Liggett also expressed that it is to the City's advantage to grant this request because it would upgrade the park. He further expressed that the primary goal of management is to keep the park full. Further discussion again ensued by the Planning Commission on the number of homes that would be allowed to be available for sale at any one time. The Planning Commission concurred that the number of homes offered for sale shall not exceed six percent of the licensed lots in the park. The Commission requested that the applicant provide, on Mounds View Planning Commission January 4, 1995 *Regular Meeting Page 4 a monthly basis, a current list of properties upon which model homes are offered for sale. The Planning Commission also decided that this conditional use permit should be reviewed after one year. 7 ayes 0 nays Motion Carried The applicant was informed of February 27th as a tentative Public Hearing date. Since staff and the Commission were unsure of the exact meeting date, the applicant was informed that he would be contacted by City Staff and informed of a definite date. (Commissioner Colleen left the meeting at 8:14 p.m.) • Planning Associate Pruitt informed the Planning Commission that they would need 8. Staff Report to vote on a Chair and Vice-Chair. Motion/Second: Stevenson/Ruggles to nominate Jerry Peterson as Chair and Danny Nelson as Vice-Chair. 6 ayes 0 nays 1 abstention Motion Carried (Chair Peterson abstained. ) Chair Peterson made a motion to nominate Danny Nelson as Chair and Gary Stevenson Motion Failed as Vice Chair. The motion failed due to lack of a second. Members present at the December 21,. 1994, agenda session included 9. Report of Chair Commissioners Johnston, Miller, Nelson, Ruggles, and Chair Peterson. Commissioners Colleen and Stevenson had excused absences. Also present were 411 Planner Harrington and Councilmember Wuori. Adjournment the meeting at 8: 19 p.m. Respectfully °Submitted, 9117/1 4755 Joyce Pruitt Planning Associate RESOLUTION NO. 408-95 1111 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RECOMMENDATION TO THE CITY COUNCIL APPROVING THE CONDITIONAL USE PERMIT REQUEST BY LINDER'S GREENHOUSES, MOUNDS VIEW SQUARE, PLANNING CASE NO. 405-94 WHEREAS, Pete Linder, representing Linder's Greenhouses, has requested City approval to conduct open and outdoor sales at Mounds View Square Shopping Center; and WHEREAS, the open and outdoor sales would take the form of a temporary greenhouse facility on the site; and WHEREAS, the Mounds View Municipal Code allows open and outdoor sales in a B-4, Regional Business with the issuance of a conditional use permit; and WHEREAS, the Planning Commission has reviewed the following documents regarding this proposal: a) Site plan dated December 13, 1994 b) Letter of request dated November 29, 1994 WHEREAS, the Planning Commission has determined that e the proposal is in conformance with the requirements of the Municipal Code, specifically Title 1100. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval of the conditional use permit with the following conditions: 1. The facility shall be allowed to operate from March 20, 1995 to July 15, 1995. 2 . The hours of operation of the facility shall not exceed 8: 00 a.m. to 9: 00 p.m. BE IT FINALLY RESOLVED that the Planning Commission directs staff to forward this resolution to the City Council prior to approval of the minutes. ATTEST: b _ 9,, ,, Chairman Va-ij (SEAL) 4111 _.it _ Lz_______ __________ o.., unity Develop nt Coordinator MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 409-95 CITY OF MOUNDS VIEW III COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING A VARIANCE TO ALLOW 14 CATS AT 8242 GREENWOOD DRIVE, PLANNING CASE NO. 404-94 WHEREAS, the Mounds View Planning Commission has reviewed the request of Reginald and Sharon Nelson for a variance to allow the present 14 cats on their residential property located at 8242 Greenwood Drive; and WHEREAS, the Mounds View Municipal Code allows up to four (4) cats on a residential property; and WHEREAS, the applicant has submitted a letter of hardship outlining the need for the variance due to all 14 cats being exposed to the Feline Infectious Peritonitis (FIP); and WHEREAS, the Planning Commission has reviewed the criteria used to evaluate all variance requests; and WHEREAS, the Planning Commission has determined that exceptional • circumstances apply to the property which do not apply generally to other properties in the vicinity and result from circumstances over which the owners of the property have had no control. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission approves the request of Reginald and Sharon Nelson for a variance to allow the present 14 cats on their residential property contingent upon the following: 1) The cats shall be kept inside the principal structure on the property at all times. 2) The cat waste be placed in plastic bags and disposed of with the everyday household waste. 3) The owner shall notify the City upon death of all 14 cats exposed to the Feline Infectious Peritonitis (FIP) virus. RESOLUTION NO. 410-95 - - CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF A CONDITIONAL USE PERMIT TO ALLOW DISPLAY AND SALE OF MODEL HOMES AT COLONIAL VILLAGE MANUFACTURED HOME PARK, PLANNING CASE NO. 391-94 WHEREAS, Colonial Village Manufactured Home Park has made application to allow the display and sale of model homes within the Park; and WHEREAS, the applicant has submitted the following items as part of the application: 1. Planning Application dated June 29, 1994 _ 2. Letter outlining proposal dated December 6, 1994 -3. Site Plan dated December 6, 1994 WHEREAS, Title 1100 of the Mounds View Municipal Code allows the display and sale of model homes within a manufactured home park with the issuance of a Conditional Use Permit; and WHEREAS, the Mounds View Planning Commission has • reviewed the request against the criteria listed in Title 1100 governing issuance of Conditional Use Permits. - NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends to the City Council approval of the requested conditional use permit for the display and sale of model homes at Colonial Village Manufactured Home Park, contingent upon the following: 1) A copy of this Conditional use permit shall be recorded with Ramsey County. 2) Number of units available for sale at any one time shall not exceed 6% of licensed lots. 3) Units offered for sale shall be installed in compliance with all applicable City and State regulations governing Manufactured Homes. 4) A current list of properties, updated monthly, upon which model homes are offered for sale shall be provided by the applicant and kept on file at City Hall. 5) Marketing of the model homes including walk-throughs 4111 and open houses shall be limited to the hours of 8 a.m. to 9 p.m. Monday through Friday; 8 a.m. to 6 p.m. - Resolution No. 410-95 4111 Page Two Saturday and; 11 a.m. to 6 p.m. Sunday. 6) This Conditional Use Permit is subject to review after one year by the City. BE IT FINALLY RESOLVED that the Planning Commission directs -Staff to forward this resolution to the City Council prior to approval of the minutes.
