The Mounds View Planning Commission was 1. Call To Order
called to order by Chair Peterson at
7:44 p.m. on September 20„ 1995.
MEMBERS PRESENT: Commissioners Miller, 2 . Roll Call
Ruggles, Johnston, Stevenson, and Chair
Peterson. Commissioner Colleen had an
excused absence. Commissioner Nelson is
on Leave of Absence.
ALSO PRESENT: Community Development
Coordinator Harrington was also present.
The applicants, Gary Krig and Fran 3 . Consideration

is an advisory committee only and the
City Council will need to take formal
action regarding this request at a
public hearing.
There being no further business before 4 . Adjournment
the Commission, Chair Peterson adjourned
the meeting at 7:52 p.m.

RESOLUTION NO. 425-95

STATE OF MINNESOTA
RESOLUTION RECOMMENDING DENIAL OF A REZONING REQUEST BY
GARY KRIG/FRAN DEGROSS, PLANNING CASE NO. 422-95
WHEREAS, Gary Krig and Fran Degross have made application to
rezone the property located at 5497 Adams Street from B-2, Limited
Business to B-3 , Highway Commercial; and
WHEREAS, the property is legally known as:
The West 54 feet and the South 16 feet of Lot 1, Block 4 and; the
East 30 feet of the North 1/2 of Lot 4 , Block 4 and; all of Lot
2 , Block 4 ; All in Spring Lake Park Highlands; and
WHEREAS, Chapter 1125. 01, Subdivision 1 (e) of the Mounds
View Municipal Code provides that the Planning Commission shall
consider possible adverse effects of the proposed amendment. It
further states that judgement shall be based upon, but not limited to,
the following factors:
1. Relationship to Municipal Comprehensive Plan
2 . The geographical area involved
3 . Whether such use will tend to or actually depreciate
the area in which it is proposed
4 . The character of the surrounding area
5. The demonstrated need for such use; and
WHEREAS, the Mounds View Planning Commission has reviewed
the request in relation to the aforementioned criteria; and
WHEREAS, the rezoning request is inconsistent with the
City' s Comprehensive Land Use Plan designation for this property which
is Limited Business.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning
Commission recommends denial of the request to rezone the property
legally known as:
The West 54 feet and the South 16 feet of Lot 1, Block 4 and; the
East 30 feet of the North 1/2 of Lot 4 , Block 4 and; all of Lot
2 , Block 4 ; All in Spring Lake Park Highlands
from B-2 , Limited Business to B-3 , Highway Commercial.

BE IT FINALLY RESOLVED that the Planning Commission directs
Staff to forward this resolution to the City Council prior to approval
of the minutes.
