Call To Order called to order by Chair Peterson at 7 : 03 p.m. on October 4, 1995. MEMBERS PRESENT: Commissioners 2 . Roll Call Stevenson, Miller, Ruggles, Johnston, and Chair Peterson. Commissioner Colleen had an excused absence. (Commissioner Nelson joined the meeting at 7: 05 p.m. ) ALSO PRESENT: Planner Harrington and Councilmember Trude were also present. Motion/Second: Stevenson/Ruggles to 3 . Approval of approve the minutes of August 2, 1995. Minutes: • August 2, August 16, and September 30, 1995 5 ayes 0 nays Motion Carried Motion/Second: Johnston/Miller to approve the minutes of August 16, 1995. 4 ayes 0 nays 1 abstention Motion Carried (Commissioner Stevenson abstained because he was not at the August 16th meeting. ) Motion/Second: Miller/Ruggles to approve the minutes of September 20, 1995. 5 ayes 0 nays Motion Carried (Commissioner Nelson joined the meeting. ) There were no resident requests or 4. Report of Chair At this time Councilmember Trude announced that she had been contacted by residents who wished to discuss amending of the nuisance ordinance. The Chair noted a full agenda was planned for the next work session. There being no further business before 8. Adjournment the Commission, Chair Peterson adjourned the meeting at 7: 32 p.m. Respect ubmitted, /7 , „„ ,/ /Paul Harrin • Community Development Coordinator 110 RESOLUTION NO. 426-95 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF THE REQUEST BY RICHARD AND JULIE OLIVERIUS FOR A CONDITIONAL USE PERMIT TO ALLOW A RESIDENTIAL DOG KENNEL AT 8426 GROVELAND ROAD, PLANNING CASE NO. 423-95 WHEREAS, the Mounds View Planning Commission has reviewed the request of Richard and Julie Oliverius for a Conditional Use Permit to allow the establishment of a residential dog kennel at 8426 Groveland Road; and WHEREAS, the Planning Commission has reviewed the Mounds View Municipal Code and recognizes that the Code allows for residential dog kennels with a Conditional Use Permit; and WHEREAS, Chapter 1125.01 Subdivision 3 b (1-6) outlines the criteria by which all Conditional Use Permit requests are reviewed; and WHEREAS, no complaints relating to animals have been • received on the property. NOW, THEREFORE BE IT RESOLVED that the Mounds View Planning Commission recommends to the City Council approval of the requested Conditional Use Permit based upon the following: 1. The use will not create an excessive burden on existing parks, schools, streets and other public facilities and utilities which serve or are proposed to serve the area. 2 . The use will be sufficiently compatible or separated by distance or screening from adjacent residentially zoned or used land so that existing homes will not be depreciated in value and there will be no deterrence to development of vacant land. 3 . The structure and site have an appearance that will not have an adverse effect upon adjacent residential properties. 4 . The use, in the opinion of the Planning Commission, is reasonably related to the overall needs of the City and to the existing land use. 5. The use is consistent with the purposes of the Zoning Code and the purposes of the zoning district in which the 411 applicant intends to locate the proposed use. 0 • Resolution No. 426-95 Page Two 6. The use is not in conflict with the Comprehensive Plan of the City. 7. The use will not cause traffic hazards or congestion. 8 . Adequate utilities, access roads, drainage and necessary facilities have been provided. BE IT FURTHER RESOLVED that the Planning Commission recommends approval with the following conditions: 1. Adequate facilities continue to be provided for the humane treatment of the animals. 2 . Control and restraint of the animals continue to be provided on the kennel site. 3 . After a period of one year, the Conditional Use permit will be subject to review. BE IT FINALLY RESOLVED that the Planning Commission 411 directs Staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 4th day of October, 1995.
