Call to Order called to order by Chair Peterson at 8:33 p.m. on February 7, 1996. MEMBERS PRESENT: Commissioners 2. Roll Call Johnston, Miller, Nelson and Chair Peterson. Commissioners Colleen and Stevenson had excused absences. ALSO PRESENT: Planning Associate Pruitt. Motion/Second: Nelson/Miller to approve the 3. Resident Requests from the floor. and Comments The Planning Commission reviewed Chapter 5. Consideration of 1005, Housing Code, and recommended the Resolution No. following changes: 1) Subd. 5, first page, 440-96 Regarding change "all" to "any", 2) add stipulation that for Recommendation to every administrative offense issued/proven Amend Chapter 1005, guilty in court, another$100 will be added to "Housing Code" the following year's registration fees; and 3) 1005.06, Subd. 3b, add "on every window, other than a fixed window, the owner shall or shall have installed such storm windows not later than November 1 of each year". • Mounds View Planning Commission February 7, 1996 • Regular Meeting Page 2 Motion/Second: Nelson/Peterson to approve Resolution No. 440-96 recommending amending Chapter 1005 of the Mounds View Municipal Code entitled, "Housing Code". 4 ayes 0 nays Motion Carried Motion/Second: Johnston/Miller to approve 6. Consideration of Resolution No. 442-96 recommending to the Resolution No. City Council approval of the conditional use 442-96 Regarding permit request by Linder's Greenhouses, Conditional Use Mounds View Square Shopping Center, Permit Request by Planning Case No. 435-95. Linder's Greenhouses, Mounds View Square, Planning Case No. 435-95 • 4 ayes 0 nays Motion Carried The Planning Commission discussed the 7. Consideration of refund request of Linda Kay Nelson for a Refund Request of conditional use Permit. It was decided that, in Linda Kay Nelson, the interest of providing excellence in customer 7520 Greenfield service, the Planning Commission would direct Avenue, Planning Staff to refund the application fee to Linda Kay Case No. 431-95 Nelson, Planning Case No. 431-95. It was noted that since Ms. Nelson rescinded her application prior to any public notices being sent, the Planning Commission was in favor of awarding the refund. Motion/Carried: Miller/Nelson to refund planning application fee to Linda Kay Nelson, 7520 Greenfield Avenue, Planning Case No. 431-95. 4 ayes 0 nays Motion Carried • Mounds View Planning Commission February 7, 1996 • Regular Meeting Page 3 The Planning Commission reviewed the 8. Consideration of existing By-Laws and recommended no Planning Commission changes at this time. By-Laws Motion/Carried: Nelson/Miller to recommend to no changes to the Planning Commission By-Laws at this time. Motion Carried 4 ayes 0 nays The January 17th agenda meeting was 9. Report of Chair canceled due to inclement weather. An agenda meeting was held prior to the regular meeting this evening, February 7th. • There being no further business before the 10. Adjournment Planning Commission, Chair Peterson adjourned the meeting at 8:43 p.m. Respectfully submitted, � ,� t /-ice's Joyce Pruitt Planning Associate • p " MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 440-96 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING AMENDING CHAPTER 1005 OF THE MOUNDS VIEW MUNICIPAL CODE ENTITLED "HOUSING CODE" WHEREAS, the purpose of the Housing Code is to protect the public health, safety and welfare of residents of the City; and WHEREAS, this purpose is accomplished by establishing minimum standards for dwellings and multiple dwellings; and WHEREAS, the existing Housing Code determines the responsibilities of owners, operators and occupants of dwellings and multiple dwellings and provides for administration, enforcement and penalties; and • WHEREAS, the existing Mounds View Housing Code is in need to modifications in order to adequately meet minimum housing standards; and WHEREAS, the Planning Commission recommends modification to the Housing Code to include the following: a. Stipulation of internal storage standards b. Stricter regulations regarding enforcement measures c. Stricter regulations regarding occupancy standards; and WHEREAS, Ordinance No. 572 amending the Housing Code addresses internal storage and provides for stricter enforcement measures and occupancy standards; NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Mounds View recommends approval of Ordinance No. 572 amending Chapter 1005 of the Mounds View Municipal Code entitled, "The Housing Code." Adopted this 7th day of February, 1996 ATTEST: Chairper (SEAL) Plan ng A ociate • RESOLUTION NO. 442-96 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RECOMMENDATION TO THE CITY COUNCIL APPROVING THE CONDITIONAL USE PERMIT REQUEST BY LINDER'S GREENHOUSES, MOUNDS VIEW SQUARE, PLANNING CASE NO. 435-95 WHEREAS, Pete Linder, representing Linder's Greenhouses, has requested City approval to conduct open and outdoor sales at Mounds View Square Shopping Center, and WHEREAS, the open and outdoor sales would take the form of a temporary greenhouse facility on the site; and WHEREAS, the Mounds View Municipal Code allows open and outdoor sales in a B-4, Regional Business with the issuance of a conditional use permit; and WHEREAS, the Planning Commission has reviewed the following documents regarding this proposal: • a) Site plan dated December 19, 1995 b) Letter of request dated December 15, 1995 WHEREAS, the Planning Commission has determined that the proposal is in conformance with the requirements of the Municipal Code, specifically Title 1100. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval of the conditional use permit with the following conditions: 1. The facility shall be allowed to operate from March 20, 1996 to July 15, 1996 2. The hours of operation of the facility shall not exceed 8:00 a.m. to 9:00 p.m. BE IT FINALLY RESOLVED that the Planning Commission directs staff to forward this resolution to the City Council prior to approval of the minutes. Mr. Whitney also provided an update Mounds View Planning Commission March 6, 1996 • Regular Meeting Page 2 on the tentative plan for more efficient space utilization inside the main structure in order to create additional classroom space. Motion/Second: Johnston/Colleen to table this item, at the applicant's request, until April 3, 1996. 4 ayes 0 nays Motion Carried Planning Associate Pruitt provided an update 6. Staff Report on Planning Commission vacancies; the deadline for applications is April 1, 1996, and the vacancy is being advertised on cable access television and in the New Brighton Bulletin newspaper. 411 The Planning Commission requested the 1996 version of the Mounds View Municipal Directory. Members present at the February 28, 1996, 7. Report of Chair agenda session included Commissioners Miller, Johnston, Stevenson, Colleen and Chair Peterson. (Commissioner Nelson had an unexcused absence). An agenda meeting will be held for discussion of the sign ordinance revision immediately following the regular meeting.
