The Mounds View Planning Commission was 1. Call to Order
called to order by Chair Peterson at 7:05 p.m.
on June 5, 1996.
MEMBERS PRESENT: Commissioners 2. Roll Call
Stevenson, Brooks, Miller and Chair Peterson.
(Commissioners Brasaemle and Obert joined
the meeting late).
Commissioner Johnston had an excused
absence.

of Fina are requesting a variance to allow the
placement of a 20'x40' canopy atop a gas pump
island, which would be an 8' encroachment of
the 30' required setback, at 2280 County Road
I. Acting Director Pruitt noted that since the
staff report was written, Staff has consulted with
Attorney Long and if the Planning Commission
feels it is appropriate to have a canopy on the
site of a property zoned as a legal non-
conforming use, then the Planning Commission
may wish to consider an amendment to the
Municipal Code, specifically Chapter 1123
entitled, "Nonconforming Building, Use and
Structures" to exclude canopies as an
enlargement of a legal nonconforming use
property. Acting Director Pruitt reminded the
Commission that the previous variance request,
which was denied by the Planning Commission
and the City.Council, proposed a 24'x44'
• canopy which would encroach 24' into the
required 30' setback. She also noted that
Attorney Long supported the Planning
Commission taking a strict interpretation of
Chapter 1123, thereby denying the previous
variance application based on findings that
adding a new structure, such as the gasoline
pump canopy, would be an enlargement of the
existing structure or use on the site and would
thus be prohibited.
Acting Director Pruitt conveyed to the Planning
Commission that if they would recommend such
an amendment then it would be necessary to
consider the variance request. She also noted
that approving the variance without the Code
amendment may create several unintended
negative impacts.

The Planning Commission agreed that they
should discuss amending Chapter 1123 and
then enter into discussion on the variance
request and that the issue is the nonconformity
of the structure and not the variance.
The Planning Commission discussed how
installing the canopy would improve the
property. (At this time the applicant, Tom
Manke, noted that the gasoline station started
operation in 1952).
Again, the Planning Commission reiterated that
the issue is whether or not the canopy is an
enlargement and should the Code be changed?
If was noted that if the use of the property
lapses for at least six months, the present use
as a gas station could not continue.

The applicant, Mr. Manke, addressed the
Planning Commission stating that he had
started a petition and had received over 300
signatures, approximately 80 percent were
Mounds View residents and 20 percent were
Shoreview residents (see Exhibit 1).
The Planning Commission expressed that
applicant has done his best to do what is
necessary to make this request work.
It was noted that no other gasoline stations in
Mounds View are a legal non-conforming use,
however, many other businesses are.
ActingDirector Pruitt reminded the Commission
that there is a 60-day deadline if they are
considering tabling the item and that
permission must be received by the applicant
or they would have to deny the request. She
informed them that they could approve the
• variance contingent upon receiving a Code

amendment from the City Council. If this
request would proceed as scheduled,
introduction of the ordinance and public
hearing would be held on June 24, the approval
of the ordinance would be on July 8, and it
would take effect thirty days after that. It was
added that if the request is approved using this
schedule, moving the gas pumps and
construction of the canopy could begin August
7, 1996.
The Planning Commission inquired as to
whether or not the variance request could be
brought to the City Council. Acting Director
Pruitt replied that, according to the attorney,
the City Council is a body of appeals only, so
the Council would only consider the variance
request if it was denied by the Planning

Motion/Second: Brasaemle/Stevenson to
recommend to the City Council a Code
amendment stating that a canopy is not
considered an enlargement of a legal
nonconforming use.

The Planning Commission continued
discussion on the criteria for granting
variances. It was suggested that the resolution
could be drafted to be formally adopted at the
next meeting.
Mr. Manke mentioned that, typically, gas pump
canopies are 14'6" and that the size of his lot
makes its difficult to arrange the structure on it.
The Planning Commission noted that the
substandard size and irregular shape of the lot
could be noted in the Resolution No. 448-96.

Acting Director Pruitt added that the proposed
resolution regarding this request would contain
the findings of fact with the contingencies
discussed.

the application fee for the second variance
request by Fina.

Acting Director Pruitt informed the applicant
that the public hearing and introduction of the
Code Amendment is scheduled for June 24th
and if approved, will be adopted on July 8th
and it was suggested that he attend these
• meetings.
The applicant, Kirk Olson of Merryville Farm 6. Consideration of
Market, was present. Resolution No.
449-96 Regarding
Acting Community Development Director Pruitt Conditional Use
reviewed the request by Merryville Farm Market Permit Request of
to sell produce only at the southwest entrance Merryville Farm
of Mounds View Square Shopping Center. Market, Mounds View
She noted that Mr. Olson has submitted a Square Shopping
permission letter from Paster Enterprises for Center, Planning
use of the parking area, verification of Case No. 439-96
insurance, and references.
Acting Director Pruitt noted to the applicant that
a site plan was needed for the alternative site.
Motion/Second: Brasaemle/Obert to approve
Resolution No. 449-96 regarding the request by
Kirk Olson of Merryville Farm Market to operate
outdoor sales of produce at Mounds View
• Square Shopping Center.

It was noted that this request is similar to the
request recently approved for Linder's
Greenhouses already in progress.
The hours of operation were discussed and the
Planning Commission requested that the
resolution contain the wording, " shall not
exceed the hours of 10:00 a.m. to 6:30 p.m."

Acting Director Pruitt informed the applicant
that the public hearing for this item will be held
on June 24, 1996.
The applicant, Larry Beach, informed the 7. Consideration of

Acting Director Pruitt reminded the Commission Beach, 7775 Spring

agenda meeting. The applicant is requesting a Case No. 440-96
minor subdivision to split one parcel into two
parcels at 7555 Spring Lake Road. She noted
that the applicant has made an agreement with
the legal owner, Mrs. Carlson, to purchase the
property which is zoned R-1, Single Family
Residential, and that the proposed lots each
meet the minimum lot area and width
requirements. Mr. Beach's land surveyor
submitted a signed Certificate of survey as
requested by the Planning Commission but
Staff has requested that a larger Certificate be
submitted.
In reviewing the request, Acting Director Pruitt
noted that a 5' easement is shown on the
survey from the side lot lines and a 10'
easement from the front and rear property lines
• for both parcels. She also noted that a garage

exists on Parcel B within 3.2' of the side
property line, and a shed is within two feet of
the side yard property line and that the
easement will be recorded noting a utility
easement 5' from the side yard property line. If
the garage or shed on the property was to be
torn down or enlarged, the structures will need
to be located outside the required setbacks and
applicable easements. She reviewed the
contingencies as noted in proposed Resolution
No. 450-96: 1) the resolution and Certificate of
Survey be recorded with Ramsey County within
sixty (60) days of final adoption, and proof of
such recording shall be presented to the City of
Mounds View; and 2) the applicant shall pay
the park dedication fee of$100.
The Planning Commission noted that the newly
created Parcel A needs a new address.

approve Resolution No. 450-96 recommending
approval of the minor subdivision request of
Larry Beach for the property located at 7555
Spring Lake Road.

permit to construct an oversized garage to their
proposed new home at 8100 Groveland Road
which is zoned R-1, Single Family Residential.
• She noted that this item was discussed at their

May 15th meeting and that the proposed
garage is in conformance with all applicable
zoning regulations.
She mentioned that the applicants have been
made aware that no other accessory buildings
(for example, a shed) may be located on the
property if the request is approved. Due to a
concern raised by the Planning Commission at
the May 15th meeting, Acting Director Pruitt
noted the applicants showed the drainage/utility
easement on a revised site plan.
Acting Director Pruitt reviewed Resolution No.
451-96 that was drafted with the following
contingencies: 1) the conditional use permit
shall be recorded with Ramsey County within
sixty (60) days of City Council approval, and a
receipt of such recording shall be provided to
• the City; 2) the building shall be designed and
maintained to provide a uniform building
appearance with the dwelling unit; and 3)
should the use change for what the permit was
granted for, the permit shall become null and
void.
Acting Director Pruitt added that the land
purchase by the Clochies' is contingent upon
approval of their conditional use permit request.

Resolution No. 451-96 recommending approval
of the conditional use permit request by Curt
and Amy Clochie', 8100 Groveland Road.

and professional services. She also mentioned
that the National Development Council, who
trains most housing officials and has an
excellent reputation, offers a three-week
training course in housing development and

grant for Housing Inspector Jennifer Bergman
to attend. She noted that the maximum grant
amount is $10,000 and she anticipates asking
MHFA for $5,000 or less depending upon the
cost of the training.

Acting Community Development Director Pruitt 12. Staff Report
informed the Planning Commission that the
interviews for the Community Development
Director position have taken place and two
candidates will be selected this week.
She also thanked Jim Hess for maps that he
produced for the Planning Commission.

Commissioners Miller, Johnston, Stevenson,
Brasaemle, Brooks, and Chair Peterson.

Chair Peterson informed the Planning
Commission that he had received a mailing
from Metropolitan Council regarding a Focus
Group meeting which will be held on June 11th
from 7 to 9 p.m. He continued by saying that
the Focus Group discusses where the Twin
Cities should go in the next 25 years. He will
provide the meeting information to any
Commissioners interested in attending.

RESOLUTION DENYING A SETBACK VARIANCE FOR FINA, 2280 COUNTY ROAD I,
PLANNING CASE NO. 442-96
WHEREAS, Thomas Manke and Leon Theis, applicants and owners of Mounds
View Fina, have applied for a variance to permit the construction of a 20 feet by 40 feet
canopy over a gas pump island located at 2280 County Road I in the City of Mounds View;
and
WHEREAS, if the variance were granted it would permit an enlargement of the
existing structure which is a nonconforming use and would encroach 8 feet into the required
thirty foot front yard setback; and
WHEREAS, the Planning Commission of Mounds View met on June 05, 1996 and
held hearing on the requested variance; and
WHEREAS, the Planning Commission has heard the testimony of the applicants and
illhas considered the staff report and the written legal opinion of the City Attorney;
NOW, THEREFORE, the Mounds View Planning Commission makes the following
findings and resolves as follows:
1. That Chapter 1123.01 of the Mounds View Zoning Code (the "Zoning Code")
declares it to be the purpose of Chapter 1123 'that all nonconforming uses shall 15e
eventually brought into conformity."
2. That Chapter 1123.02, Subdivision 1, of the Zoning Code states that a
nonconforming use or structure "shall not be enlarged but may continue at the size and in
the manncr of operation" existing-at the time of a zoning use change.
3. That the applicants' proposed gas pump canopy is a structure as defined by
Chapter 1102.02, Subdivision 105, of the Zoning Code.
4. That no exceptions are found to apply to the applicants' request.
5. That the use of the applicants' property is nonconforming in the B-2 District
where the applicants' property is located and if the variance were granted it would result in
substantial structural enlargement of the existing structure by creating a new structure on
the property contrary to Chapter 1123.
06. That even if the use were conforming, the applicants have not demonstrated
that they would be subjected to undue hardship or practical difficulties in the use of their
property.

RESOLUTION RECOMMENDING AMENDING CHAPTER 1106 OF THE MOUNDS
VIEW MUNICIPAL CODE ENTITLED "R-1, SINGLE FAMILY RESIDENTIAL
DISTRICT,"PERTAINING TO FOSTER CARE FACILITIES
WHEREAS, the purpose of the Zoning Code is to protect the public health, safety and
welfare of residents of the City; and
WHEREAS, this purpose is accomplished by regulating permitted and conditional uses
within zoning districts; and
WHEREAS, the existing Zoning Code restricts the number, ages of children and the
duration of their stay at a foster care facility;
WHEREAS, the Minnesota Statutes 462.3 57 Subd. 7 allows for a state licensed
residential facility serving six or fewer persons; a licensed day care facility serving 12 or fewer
persons; a group family day care facility licensed under Minnesota Rules, parts 9502.0315 to
0 9502.0445 to serve 14 or fewer children as permitted single-family uses; and
WHEREAS, the existing Mounds View Zoning Code is in need of modifications to adequately
meet the Minnesota statute requirements; and
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission reco+nmends
modification to the Chapter 1106, Section 1106.02 entitled R-1, Single-Family Residential
District, to include the following permitted uses:
a. A state licensed residential facility serving six or fewer persons;
b. A licensed day care facility serving 12 or fewer persons;
c. A group family day care facility licensed under Minnesota Rules, parts 9502.0315
to 9502.0445 to serve 14 or fewer children.
d. Residential facilities whose primary purpose is to treat juveniles who have violated
criminal statutes relating to sex offenses or have been adjudicated delinquent on
the basis of conduct in violation of criminal statutes relating to sex offenses shall
not be considered a permitted use.
e. Not withstanding the provision of subdivision 2 of Section 1106.02 herein, foster
family homes as identified in Chapter 9545, Section 6545.0010, Subp. 7 of
Minnesota Rules shall be allowed as permitted uses to serve not more than eight
children per home, not including the foster family's own children.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of

APPLICATION TO THE MINNESOTA HOUSING FINANCE AGENCY FOR HOUSING
RELATED TRAINING
WHEREAS, the Minnesota Housing Finance Agency offers a Capacity Building
Grant annually on a competitive basis; and
WHEREAS, one of the allowed uses under the Capacity Grant is for staff
training related to housing development, housing management, or other subjects
related to the provision of housing or housing services; and
WHEREAS, the National Development Council offers a three week training
course in housing development, management and finance; and
WHEREAS, applying for this grant would allow Staff to attend the training at
• minimal cost to the cost to the City of Mounds View and increase the knowledge of staff
for future housing related projects such as rehabilitation of the existing housing stock;
NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning
Commission supports the submission of this application to the Minnesota Housing
Finance Agency on behalf of the City of Mounds View to increase the knowledge of
staff in the areas of housing management, development and finance.
