Call to Order called to order by Acting Chair Miller at 7:06 p.m. on June 19, 1996. MEMBERS PRESENT: Commissioners 2. Roll Call Brooks, Obert, Brasaemle and Miller. Commissioners Stevenson, Johnston and Chair Peterson had excused absences. ALSO PRESENT: Acting Community Development Director Pruitt. • Acting Director Pruitt reviewed the request 3. Discussion of noting that Ryan Construction Company of Development Review Minnesota, the Design Builder for Sysco, is Request by Ryan requesting a development review to construct a Construction, on 68'x80' (5,440 square feet) expansion to their behalf of Sysco, 2400 existing truck facility at 2400 County Road J. County Road J, Planning Case No. Acting Director Pruitt explained that since Ryan 447-96 Construction has already ordered the materials and since the 68'x80' expansion is so similar to the phased development which was approved in 1988, the applicant is requesting that the Planning Commission call to order on this item and make a formal recommendation to the City Council. Acting Community Development Director Pruitt informed the Commission that the applicant had called earlier to explain he could not attend the meeting due to prior commitments. Mounds View Planning Commission June 19, 1996 Special Meeting Page 2 Staff requested that if the Planning Commission approves Resolution No. 455-96 recommending approval of the development review, the following contingencies be added: 1. All necessary permits be obtained from Rice Creek Watershed District. 2. Ryan Construction, on behalf of Sysco, enter into a development agreement with the City of Mounds View. The Planning Commission clarified that the proposal is for two new bays, conversion of an existing wash bay to a new wash bay, and a two wheeler storage area. The Planning Commission inquired whether there was adequate environmental protection • for a new wash bay. Acting Director Pruitt explained the wash bay proposed is to be environmentally sound. The Planning Commission clarified that a canopy exists on the west side of the building. Motion/Second: Brasaemle/Brooks to approve Resolution No. 455-96 with the two contingencies. Commissioner Miller noted a change to the resolution where it stated, the Mounds View Planning Commission recommends approval of the development review request "with the following conditions" to be replaced with "contingent upon." 4 ayes 0 nays Motion Carried Acting Community Development Director Pruitt 4. Discussion of • introduced this item stating that the applicant, Variance Request by Mounds View Planning Commission June 19, 1996 . Special Meeting Page 3 Bioclean Mobile Wash, Inc., is requesting an Bioclean Mobile extension on a variance granted on July 5, Wash, 2151 Mustang 1995. She added that the variance was to Drive, Planning Case allow construction of an addition to their No. 450-96 existing facility at a thirty-foot rear yard setback where a forty-foot setback is required by Municipal Code. Acting Director Pruitt went on to explain that if Resolution No. 456-96 is approved, she would recommend placing a contingency in the resolution that if the work is not completed within one year the variance would be null and void unless an extension is granted by the Board of Variances and Appeals. Mr. Greg Kelly, a representative for Bioclean, explained that no cleaning occurs on site and the operation is mobile in nature. Commission Brasaemle suggested that Resolution No. 456-96 state, "WHEREAS, on July 5, 1995, the Planning Commission adopted Resolution No. 420-95 granting the variance." Director Pruitt explained that if the variance was approved by the Planning Commission it would be a completed process and would not be forwarded to the City Council. The Planning Commission discussed with the representative that the industry has until August 15 to ensure that wash water does not enter into the storm sewer. The applicant notified the Planning Commission that they are the only mobile wash company which uses a vacuum system which prohibits water from going down the sewer system for customers who request it. The applicant then explained they are now required by federal law to prevent wash water from entering into the storm sewer. MOUNDS VIEW PLANNING COMMISSION 411/ RESOLUTION NO. 455-96 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF THE DEVELOPMENT REQUEST OF RYAN CONSTRUCTION OF MINNESOTA ON BEHALF OF SYSCO,2400 COUNTY ROAD J, PLANNING CASE NO.447-96 WHEREAS,Ryan Construction Company of MN,on behalf of Sysco,has requested City approval to construct a 5,440 square foot addition to the existing facility at 2400 County Road J; and WHEREAS,Chapter 1006 of the Mounds View Municipal Code requires that a development review be conducted for this and similar proposals; and WHEREAS,the Planning Commission has reviewed the following documents regarding this development proposal: 1. Planning Application dated June 10, 1996 2. Site Plan dated April 29, 1996 3. A Letter of Request dated June 07, 1996; and WHEREAS,the Planning Commission has determined that the proposal is in conformance with all applicable requirements of Chapter 1100 and 1120. NOW,THEREFORE,BE IT RESOLVED that the Mounds View Planning Commission recommends approval of the development review request,contingent upon the following: 1. The applicant receives all necessary permits from Rice Creek Watershed District. 2. Ryan Construction of Minnesota;on behalf of Sysco,enter into a development agreement with the City of Mounds View. BE IT FINALLY RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 19th day of June, 1996. ATTEST: Chairperson ter (SEAL) Acting C mm ty Deve opment Director,J ce Pruitt • MOUNDS VIEW PLANNING COMMISSION • RESOLUTION NO. 456-96 RESOLUTION APPROVING A SETBACK VARIANCE REQUEST BY BIOCLEAN MOBILE WASH, 2151 MUSTANG DRIVE PLANNING CASE NO. 450-96 WHEREAS, The Mounds View Planning Commission has reviewed the request of Bioclean Mobile Wash for a variance to allow the construction of an addition to their existing facility at a thirty foot (30') rear yard setback where a forty foot (40') setback is required by Municipal Code; and WHEREAS, the Planning Commission granted a variance for a thirty foot setback in Resolution No. 420-95; and • WHEREAS, the Planning Commission reviewed the criteria used to evaluate all variance requests; and WHEREAS, the applicant has presented a hardship statement to the Planning Commission; and WHEREAS, the property was granted a variance in 1981 for a thirty foot (30') rear yard setback; and WHEREAS, as in 1995, the Planing Commission has determined that the applicant cannot reasonably construct an addition to the existing facility at the required forty foot (40') setback given the existing lot dimensions. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission approves the variance request of Bioclean Mobile Wash for a ten foot (10') variance into the required thirty foot setback.
