Call to Order The meeting was called to order by Chair Peterson at 7:04 p.m. 2. Roll Call Members present: Commissioners Miller, Obert, Stevenson, Johnston, Brasaemle, Brooks and Chair Peterson. Also Present: Community Development Director Sheldon and Planning Associate Ericson. 410 3. Citizen Requests and Comments on Items Not on the Agenda There were no resident requests or comments from the floor. Planning Case No. SP-001-96 Ordinance No. 588, Commercial Wireless Telecommunications Towers and Antennas Planning Associate Ericson explained that the Planning Commission was reviewing the second and final draft of the telecommunications ordinance. Mr. Ericson reviewed the changes made at the last meeting and additional recommendations made this evening by the Staff. 411 Mounds View Planning Commission December 18, 1996 Special Meeting Page 2 Chair Peterson asked the audience if they had any comments. Mr. Jaymes Littlejohn of Hessian, McKasy and Soderberg, indicated that he had a concern with Page 5, Subd. 2 A, regarding any building expansion matching the design and features of the existing accessory equipment building and the expansion having an interior wall to keep separate the competing providers equipment and having a separate building entrance for each provider's space. Mr. Littlejohn explained that he understands that the City would like everything to be clustered, but the buildings are going to be owned by more than one party and the problem that would be created would be that of a townhouse or condominium regarding maintenance and repair but without an association to repair it. He also had a concern with Page 8, Subd. 4, and why the City requires proof of insurance and considers it an administrative burden to track. He added that they have more than 1200 sites operational in 14 states. Discussion continued with the Planning Commission regarding these concerns. The Planning Commission directed Staff to work on the wording regarding how accessory buildings are handled with the objective to cluster them as much as possible, but recognize there are some logistical problems with sharing buildings and to allow alternatives. • Director Sheldon responded to Mr. Littlejohn's request regarding insurance and indicated that she felt the suggestion was a good one that in order to minimize paperwork that they be required to have insurance in place and if the City requested proof and they did not provide it, then they would be in violation. They would not have to send the City paperwork every year. The Planning Commission agreed with this suggestion. Mr. Littlejohn also had some concerns with the hold harmless statement contained in the ordinance. He thought it to be an overly restrictive provision and cited examples of a gas station where the tanks could explode wiping out a City block and of a shopping center where nearly thousands of residents shop weekly generating a much greater risk of injury or accident and asked whether the City required a hold harmless clause for these sites. Director Sheldon suggested that we contact the City Attorney for his opinion regarding the requirement of a hold harmless statement and if recommended by the attorney, the requirement could be deleted from the ordinance. Mr. Greg Korstad of Larkin, Hoffman, Daily and Lindgren, appeared on behalf of American Portable Telcomm. He informed the Commission that APT is one of the wireless PCS licensees that has recently received a license and is developing a system in the Metropolitan Twin Cities region. He indicated he wanted to address • height and co-location. He explained that because the technology his client uses is more sensitive to line-of-sight interference, they require taller antennas and • Mounds View Planning Commission December 18, 1996 Special Meeting Page 3 suggested that the height limitations in the Code were too low. He indicated that his client would like to erect a 165 foot tall tower in the City of Mounds View. He added that on the issue of co-location, he likes the idea, but is not sure that the co- location system that the City has set up will be workable. Mr. Matthew Danielson of SBA, Inc. stated that he was happy with the ordinance as drafted and thanked Staff for their hard work and dedication. The Planning Commission wanted the word "painted" to be removed from 1126.05, Subd. 5, to allow for galvanized material to be used. Commissioner Miller asked that the word "immediately" be changed to "immediate" in 1117.04, Subd. 1, and 1118.03, Subd. 1. The Planning Commission discussed the height limitations to be included in the proposed ordinance, and decided they would leave the ordinance as is and let the City Council decide if they wanted to change the height allowance. Motion/Second: Stevenson/Brasaemle to adopt Resolution No. 491-96 as iamended recommending to the Mounds View City Council adoption of Ordinance No. 588, an ordinance amending Chapter 1126 of the Mounds View Zoning Code relating to the location and design of commercial wireless telecommunication services and facilities within the City of Mounds View. Planning Associate Ericson added that if the Planning Commission revisits the height issue, they may have to look at how they handle co-location. Motion carried: 7 ayes, 0 nays 5. Community Development Director r'r.a.2s+..As .7t..e... a0%,..L caa+'.m.` iL =x`."•" 4' '= -1r+ .zF'e.''= �- - MOUNDS VIEW PLANNING COMMISSION 410 RESOLUTION NO. 491-96 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDIN(TO THE MOUNDS VIEW CITY COUNCIL ADOPTION OF ORDINANCE NO. 588,AN ORDINANCE AMENDING CHAPTER 1126 OF THE MOUNDS VIEW ZONING CODE RELATING TO '173E LOCATION AND DESIGN OF COMMERCIAL WIRELESS TELECOMMUNICATION SERVICES AND FACILITIES WITHIN THE CITY OF MOUNDS VIEW WHEREAS, the Mounds View City Council enacted a moratorium on the new use, development or construction of commercial wireless telecommunication services within the City of Mounds View in order to provide an opportunity for the study of this issue and the development of an ordinance to regulate such services; and, WHEREAS, the Mounds View Planning Commission has conducted research, examined ordinances from other jurisdictions, and received information from industry representatives and the North Suburban Cable Commission regarding this issue; and, WHEREAS, the Mounds View Planning Commission has conducted a series of work sessions on September 18, October 23, December 4 and December 18; and, WHEREAS, it is in the best interest of the community, and a protection to health, safety and welfare for the City to enact regulations on the location and design of commercial wireless telecommunication services and facilities. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission does hereby recommend adoption of Ordinance No. 588 as shown in Exhibit"A" attached hereto and made a part of this resolution by this reference. BE IT FURTHER RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes.
