Call to Order The meeting was called to order by Chairperson Peterson at 7:00 p.m., October 1, 1997. 2. Roll Call Members Present: Chairperson Peterson; Commissioners Brasaemle, Brooks, Johnston, Miller, Obert, and Stevenson. Members Absent: Council Liaison Koopmeiners • Also Present: Planning Associate Ericson; Recorder Dave Hix. 3. Approval of Minutes: a. August 21, 1997 (Special) b. September 3, 1997 (Regular) Motion/second: Brasaemle/Peterson to approve the August 21, 1997 (Special) and September 3, 1997 (Regular) meeting minutes as submitted. Ayes - 6 Nays - 0 Motion carried. Commissioner Obert was absent at the time the vote to approve the minutes was taken. He arrived at the meeting at approximately 7:10 p.m. 4. Citizen Requests and Comments on Items Not on the Agenda • There were no citizen requests or comments from the floor. 5. Staff Reports/Information Items • • Mounds View Planning Commission October 1, 1997 Regular Meeting Page 2 Associate Ericson briefly reviewed the Planning Commission Memo dated October 1, 1997 and told the Commissioners the following: Don Leshovsky, owner of the property located at 2109 Hillview Road, has requested permission from the City to install temporary parking spaces adjacent to the existing improved parking at the stated address. Installation of temporary spaces consisting of class 5 gravel would alleviate the parking problems being experienced. Associate Ericson referred to the Code: Section 1121.09, Subd. 6, which pertains to "Grade Elevations." In summary, the Code states that all driveways and parking areas shall be bituminous, except for temporary surfaces whereby gravel is allowed. Associate Ericson stated that it was his recommendation that the Planning Commission, acting as the Board of Adjustment and Appeals, needs to interpret the Code with regard to gravel parking surfaces in districts other than R-1 and R-2 to determine whether temporary surfaces would be allowed at 2109 Hillview Road, until such time that the Code can be rewritten to clarify this reference. Commissioner Brasaemle stated that in his opinion, because of the reference in the Code to temporary parking, that it was clear that gravel should be allowed in this case. Commissioner Johnston expressed his concern that there wasn't enough room at the specified address to do what the owner has requested. Chairperson Peterson referred to the sentence of the Code that reads "Parking spaces and driveways shall be surfaced with materials suitable to control dust, drainage and erosion, meeting the requirements of Section 902.5 of this Code and shall be installed within one year following issuance of the building permit," and asked if the class 5 gravel would meet the intent of the Code because it, too, emits dust. Associate Ericson stated that the property owner has been sent letters asking him to address the overflow parking that is taking place on the property's grass side yard. Commissioner Stevenson stated that the minimum requirement has already been stated in the Code and class 5 gravel fits that minimum. Chairperson Peterson stated his concern for setting a precedent for temporary parking in the R-3 zones. He suggested making a ruling defining a temporary use that would justify the use of gravel. Commissioner Obert asked if there would be a time period specified along with granting of permission to use the gravel surface. 110 Mounds View Planning Commission October 1, 1997 Regular Meeting Page 3 Associate Ericson expressed concern with setting a precedent with all of the other temporary surface areas now in use. He added that the City currently does not put a time frame on the temporary surfaces that it has allowed. Motion/second: Brasaemle/Obert moved, for this particular situation at the property located at 2109 Hillview Road, that the Planning Commission, acting as the Board of Adjustment and Appeals, interprets the Code to say that class 5 gravel should be allowed as a temporary parking surface. Ayes - 7 Nays - 0 Motion carried. 6. Chairperson and Planning Commissioners' Reports No reports were received from the Chairperson or the Commissioners. 7. Adjournment to agenda session Chairperson Peterson adjourned the regular meeting at 7:30 p.m. (The agenda session was held immediately following adjournment of the regular session.)
