Call to Order The meeting was called to order by Chair Peterson at 7:02 p.m. 2. Roll Call Members present: Chair Peterson; Commissioners Brasaemle, Brooks, Johnston, and Miller. Members absent: Commissioners Stevenson and Obert had excused absences. Also present: Community Development Director Jopke; Planning Associate Ericson; • Council Liaison Koopmeiner; and Recorder Dave Hix. 3. Approval of Minutes a. August 20, 1997 b. September 3, 1997 Chairman Peterson requested a motion to approve the minutes. Motion/second: Miller/Brasaemle to approve the August 20,1997(Special) and September 3, 1997(Regular)meeting minutes as submitted. Ayes - 5 Nays - 0 Motion carried. Citizen Requests and Comments on Items Not on the Agenda No citizen requests or comments on items not on the agenda were considered. 5. Planning Case No. 505-97 xxxx Program Avenue Applicant: Everest Group, Ltd. Consideration of Resolution No. 531-97 Regarding a Major Subdivision Combining Four Parcels into One for the Proposed Building N Development, Mounds View Business Park East Second Addition. The applicant, Everest Group, Ltd., was absent from the meeting. Associate Ericson gave the Commission a brief background report on the Planning Case as follows: He told the Commission that the original site plan was approved by the City • on October 24, 1994. At that time the plat was not filed with Ramsey County within the time frame allowed. Because of this fact the site plan needs to be reviewed again by the Planning Commission and reapproved by the City Council. Associate Ericson referred to an October 1, 1997 Planning Commission meeting where easement vacation, easement dedication, the possibility of additional right of way would be needed, the park dedication fee and the reapproval of the Development review were discussed. Associate Ericson told the Commission that these items have been addressed and the that the Planning Commission approve Planning Commission Resolution No. 531-97, recommending approval of the major subdivision request of Everest Group, Ltd., for the Mounds View Business Park East 2nd Addition plan, with stipulations. Commissioner Miller asked if the building footprint is the same square footage as was on the original plan. Associate Ericson confirmed that it was, adding that the new development shows six fewer parking spaces. He continued stating the decrease in parking spaces may be due to increased drainage or runoff necessities. • • Mounds View Planning Commission October 15, 1997 Special meeting Page 3 Commissioner Johnston told the Commissioners that upon reading the October 1994 meeting minutes that refers to this project, he noticed that the Planning Commission at that time made note that the driveway entrance on the south side of the development site was to close too the adjacent curve. As a condition of approval, Everest Group, Ltd., at that time had agreed to move the driveway opening farther to the north. Associate Ericson stated that a full development review would assure that any changes in the plan that had been agreed to previously were made. Chair Peterson said it was his feeling that the Planning Commission should review the plan at which time it might be possible to do an accelerated reapproval process; review the plan and approve it at the same meeting. Associate Ericson told the Commission that it was his intent to send the plan to the City Council only if the Planning Commission wanted to do a full review process. Associate Ericson told the Commission that the resolution approving the development review was not contingent upon buildout within any set period of time. • Commissioner Miller stated her concern that the language in Resolution 531-97 did not clearly state the intent of the Resolution in its title. Chair Peterson suggested changing the word "property" to "properties" at the first sentence beginning with Whereas in the resolution. Commissioner Miller said she would like to see the inclusion of the words "four parcels into one" in the title of the resolution. .. block 1 of Mounds View Business Park East 2nd Addition," into the last Whereas paragraph on page 1 of Resolution 531-97. The Commissioners agreed unanimously. Motion/second: Brasaemle/Johnston moved to recommend approval of Resolution No. 531-97, a Resolution Recommending Approval of the Final Plat for Mounds View Business Park East 2nd Addition; Planning Case 505-97, as amended. Ayes - 5 Nays - 0 • Motion carried. • Mounds View Planning Commission October 15, 1997 Special meeting Page 4 6. Staff Reports/Information Items Associate Ericson referred to the City's code book and a printout from that code book that was distributed to all of the Commission members at the start of the evening's meeting. This code printout made reference to grade elevations and surfacing as was discussed at the October 1, 1997 Regular Planning Commission meeting. Continuing, Ericson stated that when the code book was printed a mistake had been made and Subdivision 7 had been incorrectly printed within Subdivision 6. The Commissioners were told that the version of the code before the Commission this evening is how the code is supposed to look and how it will look when the Commission is issued an up-dated version of the code. Associate Ericson introduced Rick Jopke, the new Community Development Director for the City of Mounds View. Director Jopke addressed the Commission stating that the Comprehensive Plan would be one of the future projects that will be getting much attention. He added that there would • be a community meeting to be held at the Pinewood School to discuss the Ring Road Concept. The presentation will be to the community by the University of Minnesota's Design Center for the community's reaction. Associate Ericson added that there will be a neighborhood meeting held at 6:30 p.m.,October 22, 1997 at the City's council chambers by Towle Development. This meeting is being held so that Towle can discuss with the community its plans for the City property on Highway 10 as well as the four residential lots on Eastwood. Commissioner Johnston asked if the Ring Road Project had gotten to the point of funding. Associate Ericson said that TIF dollars would most likely be involved. He added that MNDOT has approved the signaling at the proposed intersection. Director Jopke added that the intersection signal location, to a certain extent, is defined by what happens with the O'Neal/Anthony Properties proposal. He stated that the City is trying to maintain maximum flexibility so that all options for this project can be looked at. Associate Ericson told the Commissioners that the developers of Silver View Estates would be back before the Commission on November 19, 1997. MNDOT has given the • developer approval for their access points. He added that a letter requesting an extension of the process would have to be written to the developer. 1 Mounds View Planning Commission October 15, 1997 Special meeting Page 5 Commissioner Miller asked if Wineke's access problems had been resolved. Associate Ericson told the Commission that MNDOT has allowed the parcel south of Winekes to have its own access on to Highway 10. He added that Mr. Wineke would not allow access through his property. 7. Chairperson and Planning Commissioner's Reports No reports were considered from the Chairperson or the Commissioners. 8. Adjournment to Agenda Session Chairperson Peterson adjourned the special meeting at 7:45 p.m. (The agenda session was held immediately following adjournment of the special session.) Respectfully submitted, • 4 Rick Jopke Community Development Director • PLANNING COMMISSION RESOLUTION NO. 531-97 • CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF THE FINAL PLAT FOR MOUNDS VIEW BUSINESS PARK EAST 2ND ADDITION; PLANNING CASE 505-97 WHEREAS, Everest Group, Ltd. has requested approval of a major subdivision for the properties legally known as: That part of the South 5.acres of Lot 2 lying West of the Easterly 80 Feet of said Lot 2, Block 2, PINECREST ADDITION, lying East of MOUNDS VIEW BUSINESS PARK EAST ADDITION, according to the recorded plats thereof and situate in Ramsey County,Minnesota; Lot 3, Block 3, PROGRAMMED LAND FIRST ADDITION, according to the recorded plat thereof and situate in Ramsey County,Minnesota; Lot 2, Block 1, PROGRAMMED LAND SECOND ADDITION, according to the recorded plat thereof and situate in Ramsey County,Minnesota; • That part of Outlot A,MOUNDS VIEW BUSINESS PARK, lying east of a line beginning at a point on the south line of said Oudot A, said point being south 89 degrees, 19 minutes 21 seconds East, assumed bearing, 409.00 feet from the southwest corner of said Outlot A, thence North 31 degrees, 43 minutes 48 seconds East 19.26 feet to the north line of said Outlot A and said line there terminating. WHEREAS, the above-described properties are zoned PUD, Planned Unit Development; and, WHEREAS, a plat date-stamped 9/8/97 titled MOUNDS VIEW BUSINESS PARK EAST 2ND ADDITION has been submitted by the applicant; and . WHEREAS, the Director of Public Works has reviewed the proposed plat and finds it consistent with the City's street plan in that no additional right of way will be required as a result of this plat and that the proposed easements shown on the plat will be sufficient for the City's utility needs; and, WHEREAS, the Mounds View Planning Commission has reviewed the applicant's request for a major subdivision reorganizing the four lots into one 6.89-acre parcel to be known as Lot 1, Block 1, Mounds View Business Park East Second Addition and found that it is in conformance with all applicable sections of the Mounds View Municipal Code.
