Call To Order The meeting was called to order by Chairperson Peterson at 7:02 p.m., November 19, 1997. 2. Roll Call Members present: Chairperson Peterson, Commissioners Brasaemle, Brooks, Johnston, Miller, Obert, and Stevenson. Planning Case Nos. 501-97 and 502-97 Southeast corner of Highway 10 and Silver Lake Road Applicant: Silverview Estates, Inc. Consideration of Resolution No. 526-97 regarding a Preliminary Plat for the "Silverview Estates" Planned Unit Development reorganizing eight parcels into four parcels, and Consideration of Resolution No. 515-97 regarding a Development Review for the proposed "Silverview Estates" Planned Unit Development consisting of a Holiday Gas Station, Car Wash and Convenience Store; a two-story office building and a one-story office building; and an 82-unit senior residential building. The applicant, Silverview Estates Inc., was present. For discussion purposes Planner Peters asked the Commission to combine agenda item Nos. 4 and 5 and then divide the two issues at the time they are considered for vote. The request was granted by the Commission. • Planner Peters gave his presentation as follows: Ordinance No. 599 approving the Planned Unit Development rezoning was approved May 27, 1997. At an August 20, 1997 Planning Commission meeting it was determined that there were several issues that needed to be resolved before the Planning Commission could take any action on the request to approve the development plan. Additionally, the development team had been awaiting preliminary approval from MN/DOT for the proposed curb cuts along TH 10 as identified on the plat. On October 9, 1997, MN/DOT granted preliminary approval for the requested curb cuts, and as a result of the approval the applicant has proceeded toward completion of the submittal package for consideration by the Planning Commission. Planner Peters continued with the presentation of the Development Review: 1. The square footage of the senior building footprint was incorrect on the original plan. Instead of 84,000 square feet, the building is 115,800 square feet. This modification will require an amendment to the PUD resolution that was approved on May 27, 1997. This will be done prior to City Council action. 2. The amounts and percentages of pervious and impervious surfaces shown • on the site plans for each of the lots within the PUD are inaccurate. The • Mounds View Planning Commission November 19, 1997 Special Meeting Page 3 applicant has submitted corrected data and it was presented to the Commission for their review. 3. Building heights are mislabeled on the latest submission for the proposed Holiday Stationstore. These inaccuracies will also be corrected prior to City Council action. 4. Relevant details for the canopy that shows height, materials and proposed signing was presented to the Commission at the November 19, 1997 meeting. 5. The site plan indicates the required 30-foot set back for the parking lot but there are labels with the plan that show a 10' dimension. These inaccuracies will be corrected by the applicant. 6. A revised landscape plan has been submitted showing the required plant material information, and the applicant will provide a"plant material to be maintained" label for the areas shown as existing vegetation. The City • Forester has reviewed the plan and has recommended three changes to species. These changes are as follows: a. Niobe Weeping Willow will be replaced with River Birch. b. The Chuckles shrub rose will be replaced with Nearly Wild shrub rose. c. The Red Barron crab will be replaced with Red Splendor, Spring snow, Snow- drift and Pink Spires. Commissioner Brasaemle expressed his concern that the birch would be susceptible to birch borcr. Planner Peters told the Commission that the river birch were selected because of their natural immunity to the birch bore. Commissioner Johnston inquired about the City having an easement inside the buffer area in order to properly maintain the vegetation. Planner Peters told the Commission that the easement would be unnecessary as long as it is stated on the PUD plan that the area will be maintained by the City. Planner Peters continued: • Mounds View Planning Commission November 19, 1997 Special Meeting Page 4 7. The Rice Creek Watershed District approved the required permit on October 22, 1997. 8. The City Engineer has identified three issues that will need to be addressed before approving the development. These were listed as follows: a. Lack of distance between the inlet and outlet for the NURP pond on Lot 3. b. Ensure that the culverts under the St. Paul Waterworks right of way function properly. c. Ensure that emergency overflow from the NURP pond on lot 4 is directed away from the underground garages and toward the street. These issues are addressed as conditions of approval to Planning Commission Resolution No. 515-97. 9. The light fixture types missing from the original proposal were addressed and the applicant presented samples of these fixtures for the Commission's • review. Planner Peters stated that there are concerns about off-site glare. The developer of the Holiday Stationstore has been asked to look at ways in which this glare could be reduced. A new photometric analysis was made available for the Commission to review. This analysis shows an approximate 50 percent reduction in glare with the use of a baffle system. Chuck Durand, developer, addressed the Commission and said that the glare could be reduced by the use of a baffle system and presented this baffle system to the Commission for their review. Planner Peters stated that it is SRF's recommendation to use the baffle system and consider a three-month review that is based on the level of complaints that are made by the area residents to the glare of the lights and the baffle system. Mr. Durand reminded the Commission that a well-lit store is a safer store. Planner Peters continued: 10. Snow storage areas not identified on the original plan have been identified. One problem still existing is the snow storage for Lot 4 is shown within the • Mounds View Planning Commission November 19, 1997 Special Meeting Page 5 wetland. The applicant will modify the location of this snow storage area so that it is not within the wetland. 11. Sign types for Lots 2 & 4 have been submitted. However, no sign detail was submitted for the Holiday Stationstore. The applicant provided information at the November 19, 1997 meeting which showed design considerations as requested by the Commission. The applicant will also show on the plan the required 10' sign setbacks. 12. As requested by the Commission, the RV vehicle service facility has been relocated to the rear of the Holiday Stationstore. Containment and disposal of waste from the RVs is to be done through the City's sanitary sewer system. An amendment to the PUD will need to be made to allow for the operation of the RV facility. Commissioner Brooks expressed her concerns about the station operating on a 24-hour basis and having the RV facility in the rear of the building where security might not be as available. Mr. Durand told the Commission that an average RV facility collects approximately 100 gallons a day during the summer months. Commissioner Johnston suggested that the City Engineer make a recommendation in regards to the proposed dumping of the waste directly into the City's sanitary sewer system. Associate Ericson told the Commission that he had asked the City Engineer about the dumping situation and the City Engineer told Ericson that the proposed dumping wouldn't negatively impact the system. Commissioner Stevenson asked the developer how they planned to curtail abuse of the dumping system. Commissioner Miller suggested that the dump facility could be operated on a lock-and- key basis. Ralph Durand agreed saying that this lock-and-key operation is how most RV facilities are run. Planner Peters suggested that the lock-and-key operation be made a condition of • approval. Mounds View Planning Commission November 19, 1997 Special Meeting Page 6 Planner Peters continued: 13. The reference to "NERP" ponds, an incorrect spelling, will be corrected to read "NURP" prior to City Council action. 14. Three additional handicap parking stalls are required to be shown on Lot 2 adjacent to the building's main entrance. In addition, site plans must be modified, in accordance with ADA requirements, to show one handicap parking space per every 25 parking spaces in the underground parking facility. The applicant has agreed to make these revisions. Commissioner Johnston asked if the parking stalls, as shown on the plan,met City requirements. Planner Peters told the Commission that there were an adequate number of parking spaces to meet City Code and added that the PUD itself is over-parked. Planner Peters continued: • 15. Parking stalls on Lots 2-4 meet the minimum 180 square feet size but are 10'x18' instead of the standard 9'x20'. It is recommended by SRF that the extra width is desirable and the loss in length will not be detrimental to on- site parking. The PUD will be amended to reflect this change. Commissioner Brasaemle brought to the Commission's attention the fact that the site plan and elevation plan show the ramp on different sides of the building where as the plans should both show the ramp in the same location. - - . ..• •: : •s correct-and this inaccuracy was an oversight on his part and the drawings would be corrected to reflect current conditions. Planner Peters continued: 16. Conflicts in the landscaping plan will be amended so that planting details will appear only on sheet 1 of the Landscaping Plan and on sheet L1 for the Holiday Stationstore. 17. The PUD agreement will be amended so that language is included that reflects the owners intent to recycle at least 60 percent of the water used in • the car wash facility. • Mounds View Planning Commission November 19, 1997 Special Meeting Page 7 18. The Fire Marshall has reviewed the plans and requires that the fire department connection to the senior housing building and the two-story office building be accessible year-round at all times. In addition, an adequate sprinkler system must be installed where combustible materials are present. Also, an additional fire hydrant is required on the east side of Silver Lake Road toward the south end of the senior building. Lastly, the fire hydrant to be located in front of Lot 4 on Highway 10 shall be kept free of any winter snow storage. Mike Black, the developer's representative, requested that the developer be given the opportunity to talk directly with the Fire Marshall in regards to the additional fire hydrant that is being requested on the east side of Silver Lake Road. Tunneling under Silver Lake Road to get to the water main which is located on the west side of the road would be very cost prohibitive and the developer would like to explore alternative approaches to solve this problem. Planner Peters continued: 19. The applicant will label the easement dimensions for the future gateway element on the Preliminary Plat. 20. Ramsey County has required an additional three feet of right-of-way for that part of Silver Lake Road adjacent to proposed Lot 4 be dedicated and an additional ten feet of right-of-way dedicated adjacent to Lot 1. The PUD resolution should be modified to allow for a reduced setback of 27 feet for the senior housing structure and site. 21. The Preliminary Plat shows a ten-foot drainage and utility easement along TH 10. A similar ten-foot drainage and utility easement along Silver Lake Road will need to be added to the plat. Associate Ericson told the Commission that the City staff is in discussion with the City Engineer to find out if the County right-of-way would be adequate for any utility purposes. Planner Peters told the Commissioners that the utilities and the drainage are accommodated within the right-of-way and that no additional easements along a frontage would be necessary. Mr. Black added that in either case it would not be a problem to give the extra easement 111111 if it is needed. • Mounds View Planning Commission November 19, 1997 Special Meeting Page 8 Planner Peters continued: The City Planning Staff recommends the Planning Commission approve Resolution Nos. 515-97 and 526-97 recommending approval of the Development Review and Preliminary Plat, respectively, for Silverview Estates with conditions as noted and subject to stipulations. Planner Peters reviewed the list of additional conditions as raised at this meeting: a. Canopy lighting will have the baffles installed and the system will be subject to a complaint based review after a three month period. b. A security lock be installed on the RV service facility pipes. c. A cross easement be prepared for the parking on Lots 2 & 4. d. The ramp on the elevation sheet No. 4 for the senior housing plan be changed to reflect the modified site plan. e. Add language that reflects the Holiday Stationstore owners intent to recycle 60 percent of the car wash water. • Commissioner Miller stated that in Resolution No. 515-97 on the third page, item three, the Fire Marshall's memo, and the additional fire hydrant on the east side of Silver Lake Road was in question by the applicant and the discussion of it being moved to the west side had not been resolved. Planner Peters suggested that the language in the resolution be changed to read that the fire hydrant would be located on Silver Lake Road on the south end of the senior building subject to review and approval of the Fire Marshall. Associate Ericson stated that he would revise the resolution language to include the Commissioner Johnston asked if there would be any cost to the City to develop the access points as needed in the development. Associate Ericson told the Commission that it is the City's intent that all costs to develop these access points will be the responsibility of the developer and this language would be included in the development contract. Mr. Black stated they would be responsible for the cost of the access points. Commissioner Stevenson addressed the applicant asking if they had accepted the park • dedication fee as required by the City. • Mounds View Planning Commission November 19, 1997 Special Meeting Page 9 Mr. Black answered saying that an appraisal of the property has been ordered and the park dedication fee of 10 percent of the appraised value is acceptable. He added his thanks and appreciation for the hard work that was done by the City and all involved Commissions and the City Council. Chairperson Peterson returned the floor to the Commission for questions and comments. Motion/Second: Brasaemle/Miller to recommend approval of Resolution No. 526-97, a resolution recommending approval of the Preliminary Plat for Silverview Estates, Southeast corner of Highway 10 and silver Lake Road, Planning Case No. 501-97. Ayes - 7 Nays - 0 Motion carried. Motion/Second: Johnston/Peterson to recommend approval of Resolution No. 515-97, a resolution recommending approval of the proposed Silverview Estates Planned Unit Development, consisting of a Holiday Stationstore, car wash and convenience store; a two-story office building and a one-story office building; and an 82-Unit senior residential building, as • amended with stipulations and conditions as noted, located at the southeast corner of Highway 10 and Silver Lake Road, Planning Case No. 502-97. Ayes - 6 Nays - 1 Motion carried. Chairperson Peterson recognized Commissioner Stevenson for a statement on his no vote. Commissioner Stevenson stated for the record: After two or three years of looking at this property for redevelopment it was an unanimous opinion of the Commission that a gas station at this location would not serve the best interest of Mounds View. The rezoning of this property to a B-3 use was denied on that basis. The owner has gone with a PUD to get the property developed into a gas station. As long as this property is going to be developed into a gas station facility, Stevenson said, "I am going to be opposed to it." 6. Staff Reports/Information Items There were no staff reports. • 7. Detailed plans shall be required which show the RV service center and the containment measures used to prevent spillage, and the method by which the drains are to be secured. I. Three additional handicap accessible stalls are required on Lot 2 located on either side of the building's main entrance and additional stalls shall be added to the underground parking to satisfy ADA requirements of one handicap space per every 25 spaces or fraction thereof. k. The landscaping detail on the individual site plans shall be removed so as to eliminate any inconsistencies with the master landscape plan. 4. Per the City Engineer's memo dated 11/14/97, the following items will need to be corrected prior to City Council action on this request: a. The outlet from the NURP pond located on Lot 3 shall be moved more to the southwest to provide and longer distance from the inlet to the outlet and prevent a • short-circuiting of the water. b. The overflow from the NURP pond located on Lot 4 shall be positioned so as to ensure emergency overflows drain away from the garage and toward the street. c. The applicant shall work with the St. Paul Water Utility to ensure that the drainage culverts are operational. 3. Per the Fire Marshal's memo dated 11/12/97, the following items will need to be corrected prior to City Council action on this request: a. The fire department connections for the senior residential building and the two-story office building shall be shown on the plans to be readily accessible year round and at all times. b.
