Call to Order The meeting was called to order by Vice-Chairperson Stevenson at 7:09 p.m., November 18, 1998. 2. Citizens' Requests and Comments on Items Not on the Agenda There were no citizens' requests or comments on items Not on the Agenda. 4. Planning Case No. 538-98 Property Involved: 2400 Highway 10 Public Hearing and Consideration of Resolution 561-98, A Resolution Approving a Variance to • Allow a Five-Foot Parking Lot Setback. Applicant: Donatelle's Supper Club Mounds View Planning Commission November 18, 1998 • Special Meeting Page 2 Ericson gave his report as follows: The Public Hearing notices for Planning Case No. 538-98 were not mailed out in time for residents living within 350 feet of the proposed project. Staff was recommending that the public hearing for Planning Case No. 538-98 be continued to the next Planning Commission meeting. The Case will be renoticed for the required 10-day-minimum lead time. Brasaemle suggested resolving all Planning Commission concerns in regard to Planning Case 538-98 at this meeting and vote on the issue at the next meeting. The Commission concurred unanimously. Ericson continued his report: Donatelle's is proposing improvements to the northeast part of their parking lot that fronts Highway 10. The parking lot will be repaved and upgraded with new curb and gutter. The access to Highway 10 will be removed and the southeast corner of the property will be paved. The effect of the proposed work will be to add ten parking stalls to the site and access to Highway 10 will be shifted to the Theater parking lot and its right-in/right-out turn lanes. The proposed work will also give Donatelle's cosmetic improvements, new curb and gutter, and better control of drainage on the site. SThe Rice Creek Watershed District has given the proposal its blessing. The entry into Donatelle's from County Road H-2 will be addressed when the road is reconstructed. Brasaemle expressed his concern that traffic from the theater may try to cut through Donatelle's parking lot to get to County Road H2, causing a safety hazard for the Donatelle's patrons. Jeff Weyek, representing Donatelle's, said that signage would be put in their parking lot to the effect that their parking lot entry was for "customers only." Wendell Smith, representing Anthony Properties, Inc., stated Donatelle's has access to their property (the Theater Project), but that the Theater site does not have access to the Donatelle site. "From a legal standpoint, if there was a problem, they would have the right to shut the access point down," Smith said. He also informed the Commission that he would not be able to attend the next Planning Commission meeting and asked if they would informally indicate their"leanings" as to this request. No Commissioners expressed any reasons which would warrant denial of the variance request. 5. Staff Reports/Information Items • A. Discussion of City Remnant Parcel Jopke gave his report as follows: Mounds View Planning Commission November 18, 1998 • Special Meeting Page 3 With the realignment of Edgewood Road and development of a signalized intersection at Edgewood and Highway 10 for the Theater Project, staff and Council are requesting input from the Planning Commission as to the best use of the 1.5 acre parcel that will be created as a result of this project. Alternate plans have been developed by SEH for staff, Council, and Commission's review. Jopke gave a visual presentation and a lengthy discussion and explanation ensued in regard to these plans. TOLD Development and Anthony Properties have expressed interest in developing the land and have asked the City to send out RFPs in regard to developing the site. TOLD is suggesting a Walgreens Drug store and possible restaurant if they can combine the City owned parcel with the adjacent Midland Videen property which would yield approximately three acres of developable land. Anthony Properties has indicated they would develop the site(s) as an office building similar to what is being developed at the Theater site. Development of the sites would require a rezoning and Comprehensive Plan change. Brasaemle stated, "I personally see an office building fitting better there, but I can't say that I'm opposed to the Walgreens's either." Obert said the City needs to consider what the configuration of the land is going to be, how the City will "guide" it in the Comprehensive Plan, and then let the developers come to the City. He said the Mayor • was right in trying to get more people involved in the process at this point because the process seemed too rushed. Obert stated development should go to the highest bidder and he did not have a preference as whether the development was "retail" or "office." Stevenson stated the City does not have to take the lead in the development of the site. The private sector will take care of that issue. Jopke suggested sending out an RFP on the City owned parcel only. Obert said the parcel has to be defined, appraised, and platted so that Interested developers responding to the RFP will know what they are dealing with. Jopke said the Edgewood Realignment Plan was being brought before the Council at their December Work Scssion. Final plan devclopmcnt should come by the end of the year. The Edgewood realignment construction process should be ready to start in March 1999 with development of the"remnant parcel" being available in the summer of 1999. Stevenson said development opportunities have left the City because of the time delays that have occurred at the Theater Project. This has hurt the City in the eyes of the development community, he said. Jopke asked the Commission for their input in regard to including the Highway 10 Design Theme as part of the development of the "remnant parcel." It was the unanimous consensus of the Commission that any development that occurs along Highway 10, from this point forward, be required to include the design components of the Highway 10 • Design Theme. B. Code Enforcement Update Mounds View Planning Commission November 18, 1998 • Special Meeting Page 4 Ericson gave his report as follows: Staff has been making good progress in resolving the outstanding Code enforcement cases that are on the City's books. Miller noted the majority of these cases are auto parking related. Ericson said the housing related issues are taken care of by City Housing Inspector Steve Dorgan. Brasaemle commended Ericson for his efforts to send "thank you notes" to the people that do bring their properties back to compliance once they are "noticed" by the City. 6. Chairperson and Planning Commissioners' Reports No reports were considered. 7. Adjournment to Agenda Meeting There being no further business before the Planning Commission, Vice-Chairperson Stevenson adjourned the meeting at 8:13 p.m. (The Agenda Session was held immediately following the adjournment of the Special Session.)
