1. Call to Order
The meeting was called to order by Chairperson Peterson at 7:00 p.m., March 17, 1999.
2. Roll Call
Members Present: Chairperson Peterson, Commissioners Stevenson, Johnson, Berke, Laube,
Hegland, Miller and Kaden.
Members Absent: Commissioner Braathen had an excused absence.
Also Present: Community Development Director Rick Jopke, and Planning Associate Jim
• Ericson.

Consideration of Resolution No. 573-99, a Resolution Recommendation Approval of a
Conditional Use Permit for an Outdoor Flower Mart.
Applicant: Linder's Greenhouses
The applicant was not present.
Planning Associate Ericson reviewed this case explaining that Linder's has received a conditional
use permit for this use at this site for the last five years. He reported that there have been no
problems associated with this use during that time. He went on to say that only two percent of
the parking is used while the City Code requires that accessory outdoor sales and service uses
shall not exceed 30 percent of gross floor area of the principal use. He added that Linders is
about two percent of Mounds View Square, taking up 12 stalls in the parking lot. The flower
mart would operate from about April 15 to July 7. He added that the water for the use is
• obtained from the nearest hydrant and the fees for the water and the appropriate deposits for the
needed equipment are paid to the City accordingly. He added that there has been no impact on
the residential areas. He went on to inform the Commission that Linder's has requested that the
conditional use permit be approved administratively from year to year versus going through the
conditional use permit process each time. He explained that the resolution before them does not
put an expiration date on the conditional use permit, but added that one of the conditions state
that if there are any changes or complaints related to this case, that it would be brought back
before the City for review. He added that the other conditions noted in the resolution are the
same as in previous years and he proceeded to review them. He added that the conditional use
permit would remain in force as long as the conditions are satisfactorily met. He informed the
Commission that Minnesota Statutes indicates that this resolution would be valid.
The Planning Commission made a couple of revisions to the proposed resolution: Item 5, Page 2,
be changed to "....hydrant wrench and adapter valve..."; Item 8, Page 3, be changed by adding
"...be reviewed by the Planning Commission and the City Council..."
Motion/Second: Johnson/Hegland to approve Resolution No.573-99 as amended, Resolution
Recommending to the City Council Approval of the Conditional Use Permit Request by Linder's
Greenhouses, Moundsview Square; Planning Case No. 548-99.

Staff Reports /Items of Information
Associate Ericson explained that Staff would be announcing when upcoming public hearings
would be held, especially since meetings would now be cable-casted. He added the hearings
would be set at a prior Planning Commission meeting, possibly under"Staff Reports". He
informed the Commission that the following public hearings would be held on April 7, 1999:

b. Planning Case No. 549-99, 2791 Highway 10, KinderCare Sign Variance

STATE OF MINNESOTA
RESOLUTION RECOMMENDING TO THE CITY COUNCIL APPROVAL OF THE
CONDITIONAL USE PERMIT REQUEST BY LINDER'S GREENHOUSES,
MOUNDSVIEW SQUARE; PLANNING CASE NO. 548-99
WHEREAS, Peter Linder, representing Linder's Greenhouses, has applied for a
conditional use permit to conduct open and outdoor sales at Moundsview Square Shopping
Center; property zoned B-4, legally described as follows:
That Part Lying Northeasterly of the Centerline of State Trunk Highway 10 of NE'/
of NE'/ (Subject to Roads and Highways) in Section 7, Township 30, Range 23
WHEREAS, the Mounds View Zoning Code allows open and outdoor sales in the B-4
Regional Business District with the approval of a conditional use permit; and
WHEREAS, the Planning Commission has reviewed the following documents regarding
• this proposal:
a) Planning Application
b) Zoning Map
c) Site Plan
d) Greenhouse Design
e) Interior Specifications
f) Letter from Applicant
g) Letter from Property Owner
WHEREAS, The Mounds View Planning Commission makes the following findings that
the criteria for approval in Section 1115.04, Subd. 2 have been met:
a. Outdoor service, sales and equipment rental connected with the principal use is
limited to thirty percent (30%) of the gross floor area of the principal use.
The shopping center contains 102,035 square feet of building area. The applicant
proposes to occupy 2,200 square feet in the parking lot, which is 2.2% of the building
square footage on the site. This criterion has been met.
b. Outside sales areas are fenced or screened from view of neighboring residential
uses or an abutting residential district in compliance with Subdivisions 1103.08(1)
through (5) of this Title.
SThe parking lot fronting Highway 10 does not abut any residential properties. The nearest

• 6. The applicant will be charged the prevailing rate for 1,000 gallons of water per day
for water service, to be paid by the applicant before any deposits are returned.
7. The applicant shall provide the following on an annual basis to the Director of
Community Development:
a. Letter of permission from property owner.
b. Complete set of site plans
c. Narrative description of the proposal.
8. This Conditional Use Permit may be reviewed by the Planning Commission and
City Council if any problems develop or if there are any changes to the operation
deemed substantial enough to warrant such review, in the estimation of the
Director of Community Development or the City Council.
BE IT FURTHER RESOLVED that this Conditional Use Permit shall have no expiration
date and shall remain in force so long as the conditions agreed upon herein are observed.
BE IT FINALLY RESOLVED that the Planning Commission directs staff to forward this
resolution to the City Council prior to approval of the minutes.
