Planning Case No. 553-99 Property Involved: 7386 Parkview Terrace Consideration of a variance request for a reduced side yard setback for a three-season porch Applicant: Mike& Sandy Leon The applicant was present. Planning Associate Ericson gave the staff report as follows: The applicants,Mike and Sandy Leon, are requesting a variance from the required ten-foot side yard • setback established for principal buildings and living space therein. They would like to replace an existing 10 x 12 square-foot deck with a three-season living space addition of the same size in the same location. The deck, which has existed since the construction of the house, is five feet from the north side of the property. The subject property is located in the Silver Lake Woods single family home development at the northeast corner of County Road H2 and Silver Lake Road, and is only 9,150 square feet in area. This request was first heard at the May 19, 1999 Commission meeting, and after much discussion, staff was directed to explore in greater detail possible language addressing each of the standard criteria for granting a variance. Ericson noted the seven criteria established for consideration of a variance which proves a hardship, stating that a variance may only be granted in those cases where the Code imposes undue hardship or practical difficulties associated with the property which makes a literal interpretation of the Code overly burdensome or restrictive to a property owner. Ericson stated that it appeared to staff that in this case a hardship does exist, and recommended that, if the Planning Commission concurred, a variance could be granted to allow the applicants to construct a living space addition five feet from the north property line. He stated that based upon the discussion at the last Commission meeting, staff had drafted language that related to the criteria in Resolution 579-99, a resolution which approves the Leons' variance request. He stated that he had received correspondence from adjacent property owners who indicated their support for the project. He noted that the date of adoption of the Resolution, listed on Page 3, should be amended to the present date. • Mounds View Planning Commission June 2, 1999 • Regular Meeting Page 3 Commissioner Kaden asked if a permit would be required should the applicant wish to turn the porch into a living space in the future. Ericson stated the resolution is drafted to indicate"living space" since the Code provisions consider the porch to be a living space expansion. Chair Peterson noted that the case number on Page 5 of the Resolution was incorrect, and stated that it should be changed to 553-99. Commissioner Miller stated that Item 7 of the Resolution should identify the neighbor who supported the project as"the neighbor to the north." Commissioner Kaden asked if the neighbors to the north were aware that the applicants planned on using the three-season porch as additional living space. Mike Leon, the applicant, stated they were aware and had seen the construction plans. MOTION/SECOND: Johnson/Berke, to adopt Resolution 579-99, Resolution Approving a Variance from Section 1104.01, Subd. 3, of the Mounds View Zoning Code Pertaining to Setbacks, to Allow for a Reduced Side-Yard Setback for a Living Space Expansion at 7386 Parkview Terrace;Mounds View Planning Case No. 553-99, as amended to change the date of adoption stated on Page 3 to June 2, 1999, to correct the case number on Page 5 to Case No. 553-99, and to identify the adjacent neighbor referred to in Item 7 as"the neighbor to the north." Ayes—9 Nays—0 The motion carried. 6. Planning Case No. 555-99 Property Involved: 7623-7629 Woodlawn Drive Consideration of a development review request for a four-unit residential rental dwelling Applicant: PMJ Group (Mike Juaire) The applicant was present. Planning Associate Ericson gave the staff report as follows: The applicant, Mike Juaire, representing PMJ Group, had requested approval of a development review for the four-plex to be located at 7623 —7629 Woodlawn Drive, currently vacant property. The applicant had purchased this lot and the adjoining formerly tax-forfeited property to the east, and 4110 plans on developing both with four-unit dwellings. The elevations provided for the four-plex show a simple, four-unit back-to-back building with no architectural features to break the building's Mounds View Planning Commission June 2, 1999 • Regular Meeting Page 4 uninterrupted straight lines. The front elevation shows four windows, four garage doors and four entryways. The side elevations do not show any windows, while rear elevation shows three windows per unit. Ericson reviewed the site plan and explained what each area represents. He explained that the site is flat with little, if any, elevation change from one end to the other. He stated that staff has reviewed a preliminary drainage plan for the four-plex, and has found it would be sufficient if there were no other mitigating factors. He stated that there are three four-plexes to the north and an apartment complex to the west of the subject property, which have extensive run-off flowing onto the applicant's property. He stated that this run-off causes pooling and accumulation of storm water on the applicant's property. Ericson stated that one option to the drainage issue would be that with minor grading, the property could utilize the catch basin in County Road I, and a right-of-way could be established to carry run-off into the City storm sewer. He stated that the applicant has no easement for the storm sewer, and suggested that a five foot easement be granted to facilitate the storm water run-off. Ericson stated that there has been much discussion between the applicant and the adjacent property owner in an effort to resolve the drainage issues, and another option might be that the Woodlawn Terrace Apartment complex could divert their run-off from the applicant's 111 property. He stated that because many options do exist, staff feels confident that an acceptable solution will be achieved. Ericson stated that, at this time, the applicant has proposed nothing more than sod and decorative rock for landscaping purposes. He stated that staff recommends that specific plantings be shown on the final site plan in a quantity and quality that would be acceptable to both the applicant and the City. Ericson stated that staff had suggested some simple changes which could be utilized to improve the exterior appearance of the development. First, he suggested that the entryways be moved so that they are at ground level and that they be protected by some type of overhang. Second, there should be an exterior light between each entryway and garage for safety and security purposes. He stated that no exterior lighting is shown in the site plan at this time. Third, with the lowered entryway, there would be sufficient room for a second window for each unit, perhaps in the foyer area. Last, the entryways for the end units could be moved so that access is taken from the sides of the building rather than the front. Ericson stated that these changes, and any others proposed by the Planning Commission, should be incorporated into the site plans for final approval by the City Council. Ericson stated that there were considerations to be taken in regard to the parking situation. He stated that the third unit to the north could not park in front of the garage as there was not enough room. He stated that the applicant could possibly provide on-site parking elsewhere, and though this was not a desirable situation, it could be acceptable if the tenants were made aware of this restriction. Secondly, he stated, there does not appear to be sufficient area for backing out of the complex. He stated that all four units would have to exit the property in reverse, which could be a safety concern. • He stated that these issues would be addressed and staff believed there were means to resolve them. Mounds View Planning Commission June 2, 1999 • Regular Meeting Page 5 Ericson referred to the Certificate of Survey, on-site plans, and a graphic display, stating that two areas of the Woodlawn Terrace Apartment complex encroach upon the subject property, near the southern end,toward Woodlawn Drive. He stated that Woodlawn Terrace's dumpster and parking lot cross the lot line, which is in violation of the City Code. He stated that staff would be meeting with the owner of the apartment complex to discuss this and other issues relative to the development of the four-plex. Ericson stated that there were water and sewer lines in Woodlawn Drive so utilities are available to the site. There are ten-foot drainage and utility easements on the property's north and west sides which will more than likely serve as drainage areas for the development. He stated that he would be consulting with the City Attorney regarding a five-foot side yard drainage and utility easement along the east lot line between the two vacant properties to provide for additional drainage. He stated that the City typically requires that an easement be dedicated for that purpose. He noted that the easement would not be privately owned, but retained by the City. He stated, however, that the developer could be required to maintain the easement and that this would be addressed in his discussion with the City Attorney. • Ericson summarized the issues and stated that staff had drafted a resolution recommending approval of the development review for the four-plex, with stipulations. Mike Juaire,applicant, stated that he had submitted the site plan changes as set forth in the second stipulation of the Resolution. Commissioner Hegland asked if the plans contained anything to address the parking situation on the northern most unit. Mike Juaire stated that it was their intention to create two additional parking spaces in the northeast corner of the site, but the plans had not yet been redrawn. Bill Juaire, applicant, stated the end parking spaces will eliminate the back out movement. He stated they were considering putting up signs and striping a no-parking zone in an attempt to alleviate the problem of congestion. They will also have separate operating procedures as an adjunct to their lease. Commissioner Miller asked about the composition of the exterior of the building. Mike Juaire stated that it was comprised of maintenance-free siding and steel doors. Chair Peterson asked if the building location on the lot could be adjusted. Mounds View Planning Commission June 2, 1999 • Regular Meeting Page 6 Ericson stated that it could not, but the building itself could be wider, explaining that there was a 20 foot setback to the west. He stated, however,that this would not increase the function of the parking area or the building itself. Chair Peterson asked if there were plans to develop the second lot in the future. Mike Juaire stated they were preparing paperwork which would be submitted shortly. Ericson stated that the lot was relatively flat but with a one foot change in elevation, proper grading, providing channels and swales, and given the sandy consistency of Mounds View soils, he believed the property would drain but may result in standing water for a short period of time (an hour). Commissioner Kaden asked about the exterior lighting which, he noted, was not indicated in the building plan revision. Mike Juaire stated that there was existing exterior lighting for each entryway, and that floodlighting was planned for the back of the structure. Ericson stated that plan will need to be submitted prior to Council consideration. Commissioner Braathen requested clarification of how they planned to divert the water run-off. He . asked if it would drain onto County Road I, and if so, where from that point. Ericson stated that the driveway could be built up to divert the water to remain on the property, or diverted from the existing building to the west. He stated that the volume of run-off was minimal, and that a major portion of storm water would be absorbed before reaching County Road I. He stated that he had spoken to Public Works Director Ulrich who agreed, and stated that the utilization of the ten inch drainage pipe would sufficiently accommodate the run-off. Commissioner Berke asked if parking was allowed on Woodlawn Drive. He stated that the applicant planned to place a parking stall on the south side, and asked if there would be room for visitor Wig. Bill Juaire stated that he believed parking was restricted on one side of Woodlawn Drive. Ericson stated that the applicant was required to provide only 2.5 parking spaces per unit, and was not required to provide visitor parking. He agreed this level of parking may not be sufficient for an open house event but visitors could park on the street prior to 2 a.m. Commissioner Stevenson stated that he is not satisfied with the landscaping plan and would like the site plan reviewed by the City Forester for additional plantings and landscaping design. He stated that it should be specified that some of the green area on the site plan contain plantings. 1110 Mounds View Planning Commission June 2, 1999 • Regular Meeting Page 7 Ericson stated that the City Forester could make suggestions on specific species that thrive best in Mounds View soils but further direction should be provided. Chair Peterson suggested requiring one tree per unit and possibly some low maintenance shrubs along the foundation. Commissioner Stevenson added that plantings could be placed on each corner of the building to encourage slower traffic. Ericson agreed, stating the property manager of Woodlawn Terrace has indicated there are problems with vehicles running over the edge of the property so, perhaps, landscape plantings will indicate to the driver the demarcation of the property line and entrance points. He suggested staff be allowed to review and approve the landscape plan prior to City Council consideration. Commissioner Hegland asked about plans for snow removal. Bill Juaire stated that they have other units and plan to contract with the same firm to remove snow and place it between the drives and to the west. The sidewalks would be cleared by individuals. Hegland asked if the residents would be informed to move their cars. Mr. Juaire stated that they would be. similar to this four- lex development Chair Peterson asked if the applicant owned other properties p project. Bill Juaire stated that they own an apartment complex in Columbia Heights and a newly rebuilt side-by-side duplex in Fridley. Commissioner Laube asked if there would be plastic or drain tile under the landscaping. Bill Juaire stated that they plan to install drain tile and a sump pump to alleviate the accumulation of water under the concrete slab. He stated that he believed one sump pump per unit would be sufficient for that purpose. Ericson stated that all adjoining properties drain onto the subject property, so the construction of a storm sewer through either 2434 or 2442 County Road I would benefit all properties. Bill Juaire stated that he was attempting to learn more about the drainage situation, and had discussed the matter with City Engineer Hess. Braathen stated that there should be consideration not to jeopardize other properties. He added that the Rice Creek Watershed District would be concerned with possible liability. Ericson stated that the surrounding buildings were sufficiently protected from run-off. He stated that staff believes the four- plexes located to the north would not be impacted by the drainage plan, noting that the run-off originated from their property. He added that the plans could address this issue. i Mounds View Planning Commission June 2, 1999 • Regular Meeting Page 8 Kaden asked who would pay for the drainage improvements. Ericson stated that the applicant would be responsible for the cost of the improvements, however, the other impacted property owners might contribute. Chair Peterson asked about the warranty for the drainage plan. Ericson stated that there would be a warranty period to cover repairs should they be needed. In the future, repairs would be the City's responsibility which, in his opinion, would be desirable to private ownership. Miller asked about entrances for emergency vehicles. Ericson stated this was not a deep property and vehicles could ingress and egress without difficulty. He stated that the lots were small enough to insure access. Miller asked where the fire hydrant was located. Bill Juaire stated that it was located at the southern corner of the lot. Hegland asked why there appeared to be a rush to consider this application. Ericson explained that he had been working with the applicant for two months, during which time it was not made known to the developer that they would be required to come before the City Council. He stated that staff was attempting to minimize the impact to the applicant due to not addressing the matter earlier. He • added that if the Planning Commission was not comfortable with adopting the Resolution at this time, they could hold the matter over until the next meeting. Kaden asked what guarantees the requirements would be met if the Planning Commission made their recommendation to the City Council to approve. Ericson stated that if the conditions were not met, staff would bring it forward at the next Council meeting and recommend denial. Hegland requested the addition of Item 2e, to address revisions to the parking lot and providing additional on-site parking spaces. Braathen requested clarification to language regarding the drainage plan. Ericson stated that Page 2 of the Resolution indicates"The final drainage plan will be submitted and will be approved by the City Engineer." Miller requested the word "them" in Item 4 of the Resolution be omitted. Kaden asked if the language pertaining to the landscaping was sufficient. Ericson stated that staff would review the language based upon the discussion, but he believed it was sufficient. Chair Peterson requested that Condition 1 of the Resolution include the statement "approved by City staff and the City Forester." Mounds View Planning Commission June 2, 1999 • Regular Meeting Page 9 Hegland requested the addition on the plan of standard, to-scale, vehicle outlines to indicate the amount of room available in the parking spaces. Ericson stated staff will assure parking spaces are in accordance with the City Code. Stevenson asked if the Commissioners were comfortable with voting at this time. Miller noted that at other times when all items were not as requested, the Commission had asked that the matter be brought back at the next meeting. Chair Peterson stated that although he would prefer two meetings, he could act upon the matter at this time. Kaden stated that he would feel comfortable voting at this time if all of the stipulations were met. He asked when the Resolution was set to go before the City Council. Ericson stated that it was set to go before the Council at their next meeting on June 14. Chair Peterson asked if staff could prepare the paperwork and submit the final draft to the • Commissioners for review prior to the Council meeting. Kaden added that Commissioners could then go before the Council and address any items that were not as requested. Ericson stated that he would submit the plans to the Commissioners for their review prior to the Council Meeting. MOTION/SECOND: Stevenson/Miller to adopt Planning Commission Resolution 580-99, Resolution Recommending Approval of a Development Review for a Four-Unit Multiple Family Residential Dwelling Located at 7623 - 7629 Woodlawn Drive; Planning Case No. 55-999, with stipulations as amended and modified. Ayes— 9 Nays—0 The motion carried. 6. Staff Reports /Items of Information A. Silver View Park Trail Paving Plan Commissioner Stevenson stated that he had attended the last meeting of the Parks and Recreation Committee where discussion took place in regard to the trail surrounding the Silverview Pond. He stated that for several years, there had been consideration of paving the trail, which is at this time comprised of wood chips. He stated that there was unanimous support for the proposed paving project among the neighborhood residents. He stated that the project would require some engineering changes, but would run along the current wood chip trail. Stevenson stated that some of the residents on the north end of the pond had voiced concerns about the boggy nature of the east side of the pond. He stated that there were also inquiries regarding the construction of a bridge Mounds View Planning Commission June 2, 1999 111 Regular Meeting Page 10 across the narrows of Silver View Pond. He added that the construction of the bridge would not take place at this time due to the need for time-consuming engineering work. Community Development Director Jopke stated that formal action was not required at this time, and he would relay the comments and concerns of the Commission to the City Council. Stevenson stated that a portion of the funds used for paving the trail would come from the park dedication fees paid by the theater. Commissioner Berke stated that he had heard that funds had been provided by a developer for this project several years prior, but the City had spent the funds elsewhere. Stevenson stated that he has served on the Park Commission for 12 years and never heard that comment. Stevenson stated that the maintenance requirements would be lessened for the blacktop trail, explaining that the existing wood chips required higher maintenance. He stated that the issue of snow • removal was discussed at the meeting, and that the paving would not facilitate large snow removal equipment. He stated that he was in favor of proceeding with the project. Commissioner Kaden asked if any of the residents with property next to the trail had objected to the paving project. He noted that increased traffic and activity might be cause for concern regarding loitering and crime. Debbie Jones, 7405 Parkview Drive, stated her home is located on the south side and adjacent to the pond. She stated that she had heard only positive feedback from the other residents in regard to the project. She stated that she believed the occurrence of crime might actually be decreased by the increased activity. She noted that the existing wood chips are difficult to walk or ride a bicycle on. Kaden asked if the residents accepted the idea the paved trail would not be plowed in the winter. Commissioner Johnson stated that there was a mixed reaction among the residents in this area. Commissioner Braathen asked if the proposed paving would be blacktop, explaining that blacktop would facilitate a faster snow melt. Jopke stated that the trails would be paved with blacktop. Braathen asked if there was access to the trails, other than the resident's properties. Chair Peterson stated that there was an access on Long Lake Road, from County Road H2, at the south end of the pond. • Commissioner Miller asked how long the project would take to complete. Stevenson stated that he did not know. Mounds View Planning Commission June 2, 1999 • Regular Meeting Page 11 Chair Peterson asked where the proposed bridge would be located. Ms. Johnson stated that she believed it would be located at the narrows of the pond. Chair Peterson stated that the paving would be a benefit to the neighborhood and would help encourage a higher standard of maintenance which was in the best interest of the park. Commissioner Johnson stated that he agreed. Kaden stated that eleven community members had attended and shown their support for the project. MOTION/SECOND: Laube/Hegland to support utilizing park dedication funds to pave the remainder of the trail that surrounds Silverview Pond. Ayes— 9 Nays —0 The motion carried. B. Previous Council Action • Community Development Director Jopke reported on City Council action from their meeting on May 24. He stated that there were presentations of certificates for the Girl Scout Award recipients and a Resolution of Commendation was presented to retired firefighter, Timothy C. Hawley. He stated that discussion was held in regard to an additional franchise agreement for Reliant Energy/Minnegasco, who were requesting to conduct business within the City of Mounds View. Jopke stated that at the EDA meeting, a public hearing was held for the sale of property located at 6991 Pleasant View Drive to Marquis Builders, Inc. He stated that this property had been purchased by the City for future redevelopment. He stated that the City had expressed the desire to purchase the property located at 2225 Hillview Road for participation in the Housing Redevelopment Program, and they were exploring the possibility of using CDRG or Habitat for Humanity funding to proceed with the redevelopment project. Jopke stated he will be out of town next Wednesday and asked that the study session be canceled. Ericson indicated that public hearing notices had been sent to the Focus Newspaper for publication regarding the Merryville Farm Market CUP. He also stated that on the next Planning Commission agenda would be Merryville CUP, a minor subdivision for property located at 7690/7692 Silver Lake Road and a development review for Juaire's second fourplex on Woodlawn Drive. 410 Mounds View Planning Commission June 2, 1999 • Regular Meeting Page 12 7. Chairperson and Planning Commissioners Report Commissioners Braathen and Stevenson stated that they would be unable to attend the next meeting of the Planning Commission. No other reports were considered. 8. Letter from Ken&Anne Stagg,7390 Parkview Dr.,dated 4/21/99 WHEREAS, the purpose of the variance provision in the Zoning Code is to give relief to property owners when the strict enforcement of the zoning code requirements imposes a hardship thereby restricting the improvement of property due to practical difficulties brought about by unique or extraordinary features of the physical property that are beyond the property owner's control; and, Planning Commission Resolution 579-99 Leon Variance June 2, 1999 Page 3 4. Granting a variance to allow a three-season porch or other type of living space addition would not be a special privilege--most properties in this district either have similar types of additions or have the space to construct such additions. 5. The variance requested is the minimum variance which would alleviate the hardship in that the property owners wish to replace an existing deck with the enclosed living space addition. If the addition were to be constructed observing the proper setbacks, it would only be seven feet deep--not enough room for a table and chairs. The five foot variance is the minimum variance that would alleviate the hardship. 6. The purpose of the variance provision in the Code is to give relief to property owners seeking to improve their properties yet are unable to do so because of zoning code requirements and factors beyond their control. Granting this variance for a living space addition would not be materially detrimental to the purpose of this Title or to other property in the same zone. 7. A living space addition of such a limited size(120 square feet) at the reduced side yard setback would not impair a supply of light or increase congestion, nor would it increase • the danger of fire or endanger the public safety or diminish property values. Jerry Peters SI Chairperson ATTEST: Rick pke, Commu ty Development Director (SEAL) N:\DATA\GROUPS\COMDEV\DEVCASES\553-99\579-99PC.RES MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 580-99 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF A DEVELOPMENT REVIEW FOR A FOUR-UNIT MULTIPLE FAMILY RESIDENTIAL DWELLING LOCATED AT 7623- 7629 WOODLAWN DRIVE; PLANNING CASE NO. 555-99 WHEREAS, PMJ Group, represented by Mike Juaire, has requested City approval of a development review for a four-unit multiple family residential structure to be located at 7623 - 7629 Woodlawn Drive, legally described as follows: Lot 9,Block 1,Parkview Terrace Ramsey County,Minnesota WHEREAS, Chapter 1006 of the Mounds View Municipal Code requires that a development review be conducted for all commercial and industrial development and all residential development where more than two dwelling units are being erected within the City; and, • WHEREAS, the Mounds View Planning Commission has reviewed the following documents regarding this proposal: 1. Planning Application 2. Zoning Map 3. Site Plan(Certificate of Survey)date-stamped 5/28/99 4. Elevations,date-stamped 5/24/99 WHEREAS, the Mounds View Planning Commission finds that the site plan date-stamped May 28, 1999 conforms to the general zoning requirements of Chapter 1104 with regard to setbacks, parking requirements, building height, minimum floor space, open space, and floor area; and, WHEREAS, the Mounds View Planning Commission is aware that City staff has reviewed proposed drainage plans and has determined that a suitable method for addressing drainage considerations can be accomplished, yet that plan has not yet been finalized; and, WHEREAS, the Mounds View Planning Commission finds that the building elevations and architectural design of the structure could be improved and has offered a list of requested changes. NOW, THEREFORE, BE IT RESOLVED,that the Mounds View Planning 110 Commission recommends approval of a development review for a four unit multiple family residential structure to be located at 7623 - 7629 Woodlawn Drive, subject to the following stipulations: Resolution 580-99 Juaire Development Review June 2, 1999 Page 2 1. A landscaping plan approved by City staff and the City Forester shall be provided showing all areas to be sodded and those areas where additional plantings will be located with the species and quantities identified, prior to City Council review. 2. The building and site plans shall be revised prior to City Council review as follows: a. The entryways shall be located on the ground floor and the entryways for the two end units shall be relocated to the sides of the building rather than the front. b. An exterior light shall be located on the building adjacent to each entryway. c. Overhangs or some other type of architectural feature shall be added to the structure over each entryway. d. A second window shall be added to the front of the building for each unit. e. Detailed parking plan shall be submitted outlining areas for parking and no parking. and approved bythe Citybefore anybuilding A final drainage plan shall be submittedpp permits are issued. 4. Drainage and utility easements shall be dedicated to the City prior to building permits being issued for those areas to be utilized for drainage purposes where none have been previously dedicated . BE IT FURTHER RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes.
