If you have any questions, please feel free to call me. • MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 304-91 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA ESTABLISHING MEETING AND TIMELINE SUBMISSION DATES FOR 1991 WHEREAS, the Mounds View Planning Commission will be holding one regular business meeting per month during 1991 with the exception of Special Meetings; and WHEREAS, the Planning Commission has requested to review regular business meeting agenda items at their agenda session, a minimum of two weeks prior to the regular business meeting; and WHEREAS, developers, citizens or other interested parties should be advised of deadlines for materials used by staff to prepare a report and used by the Planning Commissioners to decide on a particular development issue; and WHEREAS, a display of meeting dates and submission deadline dates be established to provide an orderly system for 411 use by the Planning Commission, staff and general public; NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Mounds View establishes meeting and submission timetable dates setting deadlines for submission of materials for agenda sessions of the Planning Commission and also setting the dates of the regular business meetings and agenda sessions; BE IT FURTHER RESOLVED that Exhibit 1 becomes an integral part of this resolution; BE IT FINALLY RESOLVED that if the Planning Commission is required to or desires to hold special meetings, they will do so in accordance with State law, Code requirements and the Bylaws. This request has been reviewed by the Planning Commission at their December 5, 1990 agenda session. The attached resolution No. 305-91 has been submitted for your review and consideration. • 1 MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 305-91 • CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION DENYING VARIANCE REQUEST BY JOHN ENGBERG, 3030 COUNTY ROAD J, TO ALLOW 1,644 SQUARE FEET OF ACCESSORY BUILDING AREA WHERE ONLY 1,264 SQUARE FEET IS ALLOWED BY MOUNDS VIEW MUNICIPAL CODE, PLANNING CASE NO. 304-90 WHEREAS, John Engberg, 3030 County Road J, has requested a variance to allow 1,644 square feet of accessory building area where only 1,264 is allowed by Code; and WHEREAS, Chapter 40.26, Subd. D, of the Municipal Code states the criteria which must be met for granting a variance; and WHEREAS, City Staff and Planning Commission have reviewed the proposal; and WHEREAS, there are no existing extraordinary circumstances as presented which apply to the property which do not apply to other properties in the same zone; and • WHEREAS, the special conditions or circumstances result from the actions of the applicant. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission denies the request by John Engberg for a variance to allow 1,644 square feet of accessory building area where only 1,264 is allowed. ATTEST: 1 Chairman (SEAL) all Planning Technician • ITEM NO: 7 a MEMORANDUM TO: PLANNING COMMISSION FROM: PLANNING TECHNICIAN HARRINGTON DATE: December 20, 1990 SUBJECT: REZONING(R-0 TO B-3) , 2865 HIGHWAY 10, GREG JOHNSON Mr. Greg Johnson has requested a rezoning for the property located at 2865 Highway 10 . Currently, the property is zoned R- 0, Residential Office. The applicant is requesting that the property be zoned B-3, Highway Commercial. Presently, the City of Mounds View's Comprehensive Plan designates this property as Medium Density Residential. This item has been reviewed by the Planning Commission at their December 19, 1990 agenda session. The attached resolution No. 306-91 is submitted for your review • and consideration. . MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 306-91 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING DENIAL OF A REZONING REQUEST FOR 2865 HIGHWAY 10, GREG JOHNSON, PLANNING CASE NO. 320-90 WHEREAS, Mr. Greg Johnson has applied to rezone the property located at 2865 Highway 10 from R-0, Residential- Office District to B-3, Highway Business District; and WHEREAS, Chapter 40 .25, Subdivision A(5) , provides that the Planning Commission shall consider possible adverse effects of the proposed amendment or conditional use. Its judgement shall be based upon, but not limited to, the following factors: 1. Relationship to Municipal Comprehensive Plan. 2 . The geographical area involved. 411 3 . Whether such use will tend to or actually depreciate the area in which is it proposed. 4 . The character of the surrounding area. 5 . The demonstrated need for such use. WHEREAS, the rezoning request is inconsistent with the City's Comprehensive Land Use Plan designation for this property which is medium density residential; and WHEREAS, a B-3 development on this property would be directly adjacent to residential property on the north and east; and WHEREAS, the proposal has been submitted to the City in order to allow the property owner to sell the property and no development is currently before the Planning Commission or City Council for their consideration. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends denial of this request because of the following: 1. The proposed zoning does not conform with the • Comprehensive Land Use Plan. MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 306-91 PAGE TWO 2 . The proposed commercial zoning would be in conflict with residential property to the north and east. 3 . There has been no demonstrated need for the use or no use is currently proposed. BE IT FINALLY RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes . Adopted this 2nd day of January, 1991. ATTEST: Chairman (SEAL) 411 Planning Technician • , • ITEM NO: 8 MEMORANDUM TO: Planning Commission FROM: Planning Technician Harrington DATE: December 27, 1990 SUBJECT: MAJOR SUBDIVISION, 2601 SHERWOOD ROAD WAYNE AND BARB DEPEW Wayne and Barb Depew are requesting a lot split at 2601 Sherwood Road. The area of the parcel is 2 . 11 acres . This are exceeds the maximum 2 acres for a minor subdivision, therefore, this lot split is considered a major subdivision as outlined in Chapter 42 .03( 10) of the Municipal Code. This request has been reviewed by the Planning Commission at • their December 19, 1990, agenda session and was found to be in conformance with the standards as outlined in the Municipal Code. Proposed Resolution No. 307-91 will be provided at Wednesday night's meeting. • ITEM NO: 9 410 _ I MEMORANDUM TO: PLANNING COMMISSION FROM: PLANNING TECHNICIAN HARRINGTON - i DATE: December 27, 1990 SUBJECT: FINAL SITE PLAN REVIEW, 4825 MUSTANG CIRCLE TYSON TRUCKING Everest Development, representing Tyson Trucking, has requested a final site plan review for the property located at 4825 Mustang Circle. This proposal is for the expansion of current warehouse and office space at the above-mentioned property. This proposal has been reviewed by the Planning Commission at their December 19, 1990 agenda session. 41, The attached resolution No. 308-91 has been submitted for your review and consideration. 411 MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 308-91 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING TO THE CITY COUNCIL APPROVAL OF THE FINAL SITE PLAN DESIGN SUBMITTED BY EVEREST DEVELOPMENT, 4825 MUSTANG CIRCLE, PLANNING CASE NO. 266-89 WHEREAS, Everest Development, representing Tyson Trucking, has requested a final site review for an addition to a truck maintenance building located at 4825 Mustang Circle; and WHEREAS, Chapter 59 . 07 of the Municipal Code outlines the requirements of a development review; and WHEREAS, Everest Development has submitted a final site plan dated September 25, 1990, revised November 23, 1990, and received December 7, 1990, henceforth known as Exhibit 1; and WHEREAS, the Planning Commission has reviewed the site plan and determined that it is in conformance with Chapter • 59 .07 of the Municipal Code. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval of the final site plan submitted by Everest Development for 4825 Mustang Circle contingent upon the following: 1. That all permits required by both the Rice Creek Watershed District and the Army Corps of Engineers be applied for and approved. 2- ---That a landscape plan, approved by the Mound Forester, be provided. BE IT FINALLY RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 2nd day of January, 1991.
