for the development of a duplex at Lot 1, Block 1,
Dailey Knolls, and then reopen the meeting for
Planning Commission action. It was the consensus of
the Planning Commission to leave the meeting open and
continue with the discussion of this proposal.
It was noted that Mr. Michael Jordan and Mr. Craig
Rushmier, representing the Accessibuilding
Corporation, were present.
Planner Harrington provided the Planning Commission
with a copy of the site plan, planning application
and letter of intent from Accessibuilding Corporation
regarding the construction of a duplex on Silver Lake
Road (Dailey Knolls, Lot 1, Block 1) .
Chair Mountin requested that in the future a
landscape plan be provided for duplex proposals.
Chair Mountin inquired as to the setback requirements
of the proposed duplex on Silver Lake Road. Mr.
Jordon indicated he would like to set the structure •
back 10 to 15 feet further than required on Silver
Lake Road and have a "U" shaped driveway to allow
easier accessibility to Silver Lake Road.
Planner Harrington indicated that according to City
Code, a 30 foot setback from the right-of-way line of
Silver Lake Road is required. He also informed the
Planning Commission that there were no adjoining
structures that would figure into the setback
requirements .
Commissioner Miller questioned the option of two
driveways as noted on the proposed resolution, and if
it is possible to have a "U" shaped driveway.
Planner Harrington indicated a "U" shaped driveway is
allowed by Code on the property.
Commissioner Burgers questioned the need for a single
driveway. Planner Harrington informed the Planning
Commission that with two driveways, 40 feet was
needed between them. With configuration of the
structure and easement requirement, the required 40
feet could be obtained. Mr. Jordan stated that he
and Planner Harrington would visit the site to
determine the best access option.

a drainage easement be provided on site, a landscape
plan be approved by the City Forester, and a final
grading plan be approved by the City Engineer.

SUBJECT: VARIANCE REQUEST, 2149 PROGRAM AVENUE, NORB YENISH
Mr. Norb Yenish, 2149 Program Avenue, has requested a variance to
allow the placement of a 50'-0" pedestal sign on his property.
Chapter 39 of the Mounds View Municipal Code limits the height of
signs to 35'-0".
This item was reviewed at the July 17, 1991 Planning Commission
Agenda session. At that time, staff was directed to research the
adjoining properties to determine if the topography on said
properties had been altered in any way to contribute to the
hardship as expressed in the applicants letter of request.
Upon review of previously approved developments, staff has found
• that the City approved grading plan for the properties which are
now Taco Bell and Kentucky Fried Chicken indicates that the
elevations of those parcels was increased by 10'-0" at the time
of development.
Pursuant to these findings, staff has prepared Planning
Commission Resolution No. 316-91 for your review and
consideration.

RESOLUTION APPROVING VARIANCE REQUEST BY NORB YENISH,
2149 PROGRAM AVENUE, PLANNING CASE NO. 324-91
WHEREAS, Mr. Norb Yenish has requested a variance to
allow the construction of a sign at a height which is greater
than that which is allowed by the Municipal Code; and
WHEREAS, Mr. Yenish is requesting a 15 '-0" variance
from the height limits for a sign on his property; and
WHEREAS, the Planning Commission has determined that
the property has a uniqueness to it not of the applicant's
making; specifically, properties adjacent to the parcel were
allowed to increase their elevations by 10 '-0" , thus, creating a
hardship for the applicant; and
WHEREAS, no reasonable alternatives for the height of
the sign exist; and
WHEREAS, the requested variance is the minimum needed •
to alleviate the hardship; and
WHEREAS, the granting of the variance will not confer a
privilege to the owner which is not enjoyed by other residents .
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission grants a 15 '-0" variance for height of a sign
at 2149 Program Avenue.

RESOLUTION RECOMMENDING DENIAL OF A REZONING REQUEST FOR
2740 HIGHWAY 10, CONOCO, INC. , PLANNING CASE NO. 326-91
WHEREAS, Conoco, Inc. has made application to rezone the
property located at 2740 Highway 10 from B-2, Limited Business, to B-
3, Highway Business; and
WHEREAS, Chapter 40 .25, Subdivision A(5) , provides that the
Planning Commission shall consider possible adverse effects of the
proposed amendment. It further states that judgement shall be based
upon, but not limited to, the following factors:
1. Relationship to Municipal Comprehensive Plan
2 . The geographical area involved
3 . Whether such use will tend to or actually depreciate
the area in which it is proposed
4 . The character of the surrounding area
5 . The demonstrated need for such use; and
WHEREAS, the Mounds View Planning Commission has reviewed
the request in relation to the aforementioned criteria; and •
WHEREAS, the rezoning request is inconsistent with the
City's current Comprehensive Land Use Plan designation for this
property which is mixed use planned unit development; and
WHEREAS, the request is inconsistent with the proposed
Comprehensive Land Use Plan designation for this property which is
Limited Business .
NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning
Commission recommends denial of the request to rezone the property at
2740 Highway 10 from B-2, Limited Business, to B-3, Highway Business .
BE IT FINALLY RESOLVED that the Planning Commission directs
Staff to forward this resolution to the City Council prior to approval
of the minutes .

Staff is just finishing up the graphics for the Comprehensive
Plan Update and the completed document will be provided to you
either Monday or Tuesday. The appropriate resolution will be
prepared by staff and distributed at the Wednesday evening
meeting.
One additional item regarding the Update. On page two of the
Corridor Plan, paragraph three references a figure(map) of the
residential properties abutting the Corridor. Due to the need to
reduce larger maps to 8 1/2" x 11" size, the quality of the
reduction was very poor for this particular map.
Staff is recommending that this particular map be eliminated from

the Update.

SUBJECT: VARIANCE REQUEST, 2901 HIGHWAY 10, DAHL AND ASSOCIATES
Mr. Roger Axel, representing Dahl and Associates, has made
application for a variance to allow the placement of a 10 ' x 18 '
product recovery building on the property located at 2901 Highway
10. The applicant has indicated to staff that the structure will
be temporary and, will be removed from the site upon completion
of cleanup activities .
Chapter 40 . 05, Subdivision C of the Mounds View Municipal Code
specifies that the sideyard setback for structures within a B-3

residentially zoned property. The applicant is requesting that

Dear Mr. Harrington:
Re: Pollution Abatement Accessory Building to be Located at 2901 Highway 10,Mounds
View, Minnesota.
This letter is to request the City of Mounds View to grant Dahl &Associates,Inc. a variance
of the sideyard setback requirement of 20' to 5' from the northwest property line for the
purpose of constructing a pollution abatement accessory building (10' x 18' x 10' high). The
product recovery building would be built with split face masonry blocks. Shrubs and/or
other landscaping could be planted on the residential side of the recovery building if the
• City of Mounds View requested such plantings.
The product recovery building will be built according to requirements of the Uniform
Building Code and the Uniform Fire Code. When the Minnesota Pollution Control Agency
has determined that the corrective action design implemented has reached acceptable levels,
the building and equipment will be removed. The product recovery building will not
become a permanent structure on the property.
Kunz Oil Company is currently marketing the property for development so the location of
future buildings has not yet been determined. Dahl & Associates, Inc. does not want to
affect Kunz Oil Com•an •• •. . • • • ••. • • . .• _ _
route for a new building. This is the main reason for our request for a variance.

SUBJECT: VARIANCE REQUEST, MOUNDS VIEW SQUARE, PASTER
ENTERPRISES
Jim Everson, representing Paster Enterprises, has requested a
variance to allow the elimination of required parking at Mounds
View Square in order to construct a City required garbage
dumpster enclosure.
On July 8, 1991 the Mounds View City Council adopted an amendment
to Chapter 104 of the Mounds View Municipal Code which required
all multi-family and commercial properties within the City to
construct enclosures for garbage dumpsters used on the parcels .
• In October of 1989, the Mounds View City Council approved a
rezoning and conditional use permit/planned unit development for
Mounds View Square in order to allow the construction of a fast
food restaurant with drive-thru facilities . At the time of
approval, the proposed parking for the site was heavily
scrutinized in order to determine its conformance with the
applicable sections of the Mounds View Municipal Code. According
to Code, the site required 537 parking spaces for the uses
existing and proposed. The site plan for the parcel indicated
that only 503 spaces were to be provided. Both the Planning
Commission and the City Council chose to, by resolution, waive
the requirement that 537 spaces be provided and allow the
propo -d 503(please see attached copies of resolutions) .
The applicant is asking that a variance to eliminate 26 parking
spaces be granted. All of the proposed spaces to be eliminated
are located behind the main structure on the property(please see
attached site plan) .

WHEREAS, the Planning Commission has reviewed the
requested rezoning from B-4 to B-3, conceptual stage
Conditional Use Permit/Planned Unit Development and
Conditional Use Permit for the convenience food restaurant
to be located at the Mounds View Square Shopping Center site
(PIN 07-30-23-11-0001 ) .
WHEREAS, the Planning Commission has reviewed the
proposed rezoning request as a separate issue from the site
development plans; and
WHEREAS, the Planning Commission has reviewed the
criteria for all proposed rezonings ; and
WHEREAS, the Planning Commission has determined that
the proposed rezoning is in conformance with the
Comprehensive Plan; and
WHEREAS, the Planning Commission has determined that
the proposed rezoning will not have an adverse impact on the
surrounding properties ; and
WHEREAS, the Planning Commission has reviewed the
geographical area involved; and

proposed use will not tend to or actually depreciate the
area in which it is proposed; and
WHEREAS, the Planning Commission has taken into
consideration the character of the surrounding area; and

WHEREAS, the Planning Commission has reviewed the
requested conceptual stage Conditional Use Permit/Planned
Unit Development to allow for the addition of another
principal building on this site; and

WHEREAS, the Planning Commission has also reviewed
the Conditional Use Permit for the convenience food
restaurant with drive-through facilities and the proposed
development site plans associated with the new structure;
and
WHEREAS, the Planning Commission has reviewed the
parking and circulation for the entire Mounds View Square
Center site and has determined that the site plan provides
503 parking spaces when 537 parking spaces are required for
a shortage of 34 parking spaces; and
WHEREAS the Planning Commission has determined that
they approve of waiving of the installation of 34 additional
parking stalls as permitted with a CUP/PUD district ; and
WHEREAS, the Planning Commission has reviewed the
traffic and parking study done by Benshoof and Associates ;
and
WHEREAS, the Planning Commission has reviewed the
City Engineer ' s memo regarding the traffic and parking
study; and
IlkWHEREAS, the PlanningCommission
is in
agreement with the City Engineer ' s and Benshoof ' s traffic
and parking study; and
WHEREAS, the Planning Commission has reviewed the
City Forester ' s recommendations dated September 15th and
agrees with the proposed recommendations ; and
WHEREAS, the Planning Commission has reviewed the
proposed sign request which is in conformance with the City
sign code and determines that it is acceptable.
NOW, THEREFORE, BE IT RESOLVED that the Planning
Commission recommends to the City Council approval of the
requested rezoning from B-4 to B-3, the conceptual
Conditional Use Permit/Planned Unit Development and the
Conditional Use Permit for the convenience food restaurant
with drive-through facilities contingent upon:
1 . The developer enter into and sign a development
agreement with the City.
2 . There shall not be excessive noise as a result
of the drive through restaurant outdoor menu
board.
3. All requirements of the City Forester. dated
September 15 , 1989 are complied with.

SUBJECT: DISCUSSION OF MINUTES
As was requested at the August 7, 1991 Planning Commission
meeting, I have included a copy of the Planning Commission Bylaws
for your review.

MOUNDS VIEW PLANNING COMMISSION •
BYLAWS
AUTHORITY. These Bylaws are established in accordance with City
Ordinance 32.05, Subdivision D, "The Commission shall adopt bylaws
for its governance and for the transaction of its business." There shall
be no conflict between the Bylaws of this Commission and the provi-
sions of the City Charter and the Municipal Code.
II. MEETINGS. The regular meetings of the Commission shall be held
on the first and third Wednesday of each month as established by
resolution of the Planning Commission. Regular or agenda meetings •
may be added or cancelled by the chairperson or vice-chairperson.
Special meetings may be added by the chairperson or vice-chairperson.
A. The first Wednesday of the month shall be a regular business
meeting for the purpose of making recommendations to the City
Council, conducting public hearings, convening the Board of Adjust-
ments and Appeals, and other official business.

• B. The third Wednesday of the month shall be a regular agenda
meeting for the purpose of informational review of applications for
planning consideration, drafting of reports, and for other discussion not
requiring action (i.e., vote) by the Commission.
III. INFORMATIONAL PACKETS. Each commissioner shall receive an
informational planning report for the items to be placed on the follow-
ing month's regular business meeting agenda no later than the Friday
preceding the agenda meeting. Each commissioner is responsible for
reviewing the material within the packet prior to the regular agenda
meeting.
IV. A1"1'bNDANCE. Commission members shall advise the designated
Staff member or chairperson of an anticipated absence from any
regularly scheduled Planning Commission meeting. Any member not
attending 20 regular scheduled meetings per year without consent of
the commission shall be deemed to have vacated his office, and such
vacancy shall be filled by the City Council pursuant to Chapter 32.09 of
the Municipal Code. A leave of absence may be granted by the
consent of the commission.

V. PROFESSIONAL CONSULTANTS. Advice from, consultation with, •
and/or requests for review by the City Attorney, City Engineer, City
Planning Agency, or other paid consultants shall be in accordance with
the Municipal Code.
VI. ADJOURNMENT. Meetings shall adjourn on or before 11:00 p.m.
unless a two-thirds majority of the members present agree to extend
the time of adjournment.
VII. MINUTES. Approved minutes shall be the official record of the Planning
Commission.
A. The minutes shall state: .
1. The kind of meeting, whether regular business or special
and the date, time, and place.
2. Roll call of members present and whether absent mem-
bers are excused or unexcused.
3. Corrections to and approval of the previous minutes and
the vote taken.
4. Description of each item being discussed, case number,
and name and address of the applicant.
a) Summary of the request.
b) Summary of any previous action.

• c) Summary of staff review.
d) Summary of statements made by the applicant,
particularly concessions or agreements by the
applicant.
5. Motion/Second
a) The motion shall be quoted as accurately as possi-
ble.
b) The motion shall be prefaced with supportive

6. The vote on each motion (ayes, nays, and abstentions), a
statement of reasons for nay votes or abstentions, and
• whether motion carries or fails.
7. Specific concerns addressed to the chairperson for inclu-
sion in the minutes.
8. Reports by members.
9. Date, time, place, and attendance at the preceding regu-
lar agenda meetings.
10. Motion for adjournment, second, vote, and time.
11. Signature of the Staff designated member.
B. All minutes shall be clearly marked to indicate either
"APPROVED" or "UNAPPROVED". Each commissioner shall
receive a copy of the previous regular business meeting minutes

"UNAPPROVED". Approved copies may be obtained upon
request. A copy of the approved minutes shall be filed with the
Municipal Clerk.
VIII. LIAISON TO COUNCIL. In the event of the absence of the Council ex-
officio member, a commission member may be appointed by the chairperson
to represent the Planning Commission at the next regular City Council
meeting.
IX. CONFLICT OF INTEREST. When a conflict of interest may exist for
a commission member or members, the member(s) shall ask to be
excused and step down from the commission prior to discussion on that •
item.
X. SUPPLEMENTARY PUBLICATIONS. All commission members
shall receive a copy of the Municipal Code, Chapter 40, and other
chapters applicable to the work of the commission and a copy of the
Municipal Comprehensive Plan as well as other materials as provided
by the City Council or City Staff. These materials shall be retained by
each commission member and returned to the chairperson upon the
member's resignation or termination of appointment.

Planner Harrington asked if the Planning Commission a .� taff Report
desired to have the meeting closed at this time to "
discuss the proposal from Accessibuilding Corporation
for the development of a duplex at Lot 1, Block 1,
Dailey Knolls, and then reopen the meeting for
Planning Commission action. It was the consensus of
the Planning Commission to leave the meeting open and
continue with the discussion of this proposal.
It was noted that Mr. Michael Jordan and Mr. Craig
Rushmier, representing the Accessibuilding
Corporation, were present.
Planner Harrington provided the Planning Commission
with a copy of the site plan, planning application
and letter of intent from Accessibuilding Corporation
regarding the construction of a duplex on Silver Lake
Road (Dailey Knolls, Lot 1, Block 1) .
Chair Mountin requested that in the future a
landscape plan be provided for duplex proposals.
Chair Mountin inquired as to the setback requirements
of the proposed duplex on Silver Lake Road. Mr. •
Jordon indicated he would like to set the structure
back 10 to 15 feet further than required on Silver
Lake Road and have a "U" shaped driveway to allow
easier accessibility to Silver Lake Road.
Planner Harrington indicated that according to City
Code, a 30 foot setback from the right-of-way line of
Silver Lake Road is required. He also informed the
Planning Commission that there were no adjoining
structures that would figure into the setback
requirements .
Commissioner Miller questioned the option of two
driveways as noted on the proposed resolution, and if
it is possible to have a "U" shaped driveway.
Planner Harrington indicated a "U" shaped driveway is
allowed by Code on the property.
Commissioner Burgers questioned the need for a single
driveway. Planner Harrington informed the Planning
Commission that with two driveways, 40 feet was
needed between them. With configuration of the
structure and easement requirement, the required 40
feet could be obtained. Mr. Jordan stated that he
and Planner Harrington would visit the site to
determine the best access option.
Planner Harrington indicated that it should be
included in the resolution that a landscape

that the compost site was probably locked to help
prevent further dumping.
