Call To Order order by Chair Mountin at 8:00 p.m. on Wednesday, September 18, 1991 . MEMBERS PRESENT: Commissioners Jones, Nelson, 2 . Roll Call Peterson, Stevenson, and Chair Mountin. Commissioners Burgers, Colleen, and Miller had excused absences . ALSO PRESENT: Planner Harrington and Planning Intern Asleson. Chair Mountin noted for the minutes that this 3. Consideration of special meeting was called to order due to the Resolution 322-91 fact that the case under consideration required Variance Request immediate attention. She also noted that the by Phillips 66, •Ipplicant was not present. 2525 Highway 10 Commissioner Peterson inquired as to whether the City or Phillips 66 would be responsible for landscaping costs incurred as a result of the new street angle at Long Lake Road and Highway 10. Planner Harrington indicated that Phillips would be financially responsible for such costs . Motion/Second: Jones/Stevenson to adopt Resolution No. 322-91 approving the variance request of Phillips 66, 2525 Highway 10, Planning Case No. 329-91. 5 ayes 0 nays Motion Carried There being no further business before the Planning 4 . Consider- Resolution No. 324-91, recommending City ation of Council revision of Chapter 32 of Resolution the Municipal Code. 324-91, Regard- ing Chapter 32 of the Municipal Code 6 ayes 0 nays Motion Carried Planning Intern Asleson noted that staff had 7 . Staff Report contacted the City Attorney regarding the issue of calling to order at a Planning Commission Agenda Session. He concluded that since all meetings, whether regular or agenda session, are published in the same way, calling to order at an agenda session is not a violation of state open meeting laws . Commissioner Peterson stated that all Planning Commission meetings are considered regular meetings, even though the Commission ordinarily • doesn't call to order at agenda sessions, Chair Mountin expressed the desire to inform citizens when the Commission will be calling to order. Planning Intern Asleson offered the Commission the option of inserting the line "Commission will call to order" on the posted agenda when it can be anticipated that calling to order at an agenda session will be necessary. Commissioner Stevenson inquired as to the circumstances under which calling a public hearing would be required. Chair Mountin explained the _ conditions, citing several past cases as examples . Chair Mountin requested that the Commission be 8. Adjournment Planning Commission, Chair Mountin adjourned the meeting at 7 :51 p.m. Respectfully submitted, Paul Harrington Planner III wv 4 MEMORANDUM TO: PLANNING COMMISSION FROM: PAUL HARRINGTON, PLANNER DATE: October 7, 1991 SUBJECT: DEVELOPMENT REVIEW, 4860 MUSTANG CIRCLE John Purves, representing Wolf and Associates, has made application for a development review of a proposed building expansion at 4860 Mustang Circle. The proposal would add approximately 5,000 square feet of production area to the present facility. Chapter 59 . 07 of the Municipal Code requires that all expansions of existing commercial and industrial facilities be reviewed by the Planning Commission and approved by the City Council. Staff has received preliminary plans from the applicant based on a 1987 expansion of the facility. However, these plans do not address the present proposal and staff has asked the applicant to • submit new plans prior to the October 16, 1991 Planning Commission meeting. The requested plans, along with comments from the appropriate staff, will be provided to the Planning Commission the evening of the meeting.
