DATE: April 30, 1992 SUBJECT: C.U.P. - 3009 COUNTY ROAD H STEVE BORDEN, PLANNING CASE NO. 342-92 Steve Borden, 3009 County Road H, has made application for a Conditional Use Permit to allow the construction of an accessory building in the designated flood plain. Chapter 49 of the Mounds View Municipal Code allows for construction within the flood plain with a Conditional Use Permit. City Engineer Ric Minetor has reviewed the request and found it to be in conformance with the guidelines for development set forth in Chapter 49 . This item has been reviewed by the Planning Commission at their April 15, 1992 agenda session. Staff has included Resolution No. 335-92 for your consideration. If you have any questions, please 111 do not hesitate to call. • MOUNDS VIEW PLANNING COMMISSION • RESOLUTION NO. 335-92 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF A CONDITIONAL USE PERMIT TO CONSTRUCT AN ACCESSORY STRUCTURE WITHIN THE FLOOD ZONE, STEVE BORDEN, 3009 COUNTY ROAD H, PLANNING CASE NO. 342-92 WHEREAS, the Mounds View Planning Commission has reviewed the request by Steve Borden for a conditional use permit to construct an accessory structure in the flood plain zone; and WHEREAS, Chapter 49 of the Mounds View Municipal Code allows for the construction of an accessory building in the flood plain zone by conditional use permit; and WHEREAS, the City Engineer has reviewed the application and found that impacts to the flood plain would be negligible. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval of the conditional use permit to construct an accessory structure within the flood plain zone. BE IT FINALLY RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 6th day of May, 1992 . ATTEST: Chairman (SEAL) Planner MEMORANDUM • TO: PLANNING COMMISSION o FROM: PAUL HARRINGTON, PLANNER �`- DATE: April 30, 1992 SUBJECT: VARIANCE - 7660 WOODLAWN GEORGE WAGAR, PLANNING CASE NO. 346-92 On July 8, 1991, the Mounds View City Council adopted Ordinance No. 492 which required that "Dumpsters for garbage, rubbish, yard waste and recyclable materials used in conjunction with multiple dwellings and commercial establishments for the convenience of property owner, renters or leasers, shall be stored within an enclosure. " The Ordinance further added that "The design and location of the enclosure shall be in conformance with City approved standards. " George Wagar, 7660 Woodlawn, has made application for a variance to allow the construction of a garbage dumpster enclosure at a six foot front yard setback where a thirty foot setback is required by • City adopted design standards. Constraints on the applicants property preclude the location of the enclosure anywhere on the lot other than the area under consideration. These constraints include a City delineated wetland which encroaches on approximately one- half of the applicants property and, the existing location of structures on the parcel - the removal or relocation of which is not feasible. This request has been reviewed by the Planning Commission at their April 15, 1992 agenda session. I have included Resolution No. 337- 92 for your consideration on this matter. If you have any . 00 . . 0 4 . • - . . 1 - • - - • • not hesitate to •ive me a call. • MOUNDS VIEW PLANNING COMMISSION • RESOLUTION NO. 337-92 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING THE REQUESTED SETBACK VARIANCE FOR GEORGE WAGAR, 7660 WOODLAWN DRIVE, PLANNING CASE NO. 346-92 WHEREAS, the Mounds View Planning Commission has reviewed the request of George Wagar for a variance to allow a garbage dumpster enclosure at a six foot front yard setback where a 30 foot setback is required by Municipal Code; and WHEREAS, the Planning Commission has reviewed the criteria used when evaluating all variance requests; and WHEREAS, the variance requested is the minimum necessary to alleviate the hardship; and WHEREAS, the Planning Commission has considered the reason for the variance is that City Code requires that all garbage dumpsters shall be fully enclosed. NOW, THEREFORE, BE IT RESOLVED that the Mounds View • Planning Commission approves the 24 foot variance. Adopted this 6th day of May, 1992 . ATTEST: Chairman (SEAL) Planner MEMORANDUM • TO: PLANNING COMMISSION FROM: PAUL HARRINGTON, PLANNER I"' (4- DATE: April 30, 1992 SUBJECT: MINOR SUBDIVISION - 8298 KNOLLWOOD ARNOLD SCHOLLJEGERDES, PLANNING CASE NO. 345-92 Arnold Scholljegerdes has made application for a Minor Subdivision of the property located at 8298 Knollwood Drive. The property is legally known as: That part of Lot 35, Auditor's Subdivision No.89, lying East of the West 214 . 07 feet, lying South of the North 180 feet, and lying North of the South 127 feet thereof. All in Ramsey County, Minnesota. At the April 15, 1992 Planning Commission agenda session, staff informed the Commission that measurements on the Certificate of Survey did not seem to correspond to figures contained on the 1/2 section maps for the same area. Upon consultation with the applicants surveyor, the proper land areas were identified and all • measurements were verified. Additionally, utility easements have been provided on the Certificate which have been reviewed by the City Engineer and found to be in conformance with City standards. All other applicable requirements of Chapter 42, "Subdivision Regulations" , have been met or exceeded. I have included Resolution No. 338-92 for your consideration. If you have any questions, please call. • MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 338-92 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF THE MINOR SUBDIVISION REQUEST OF ARNOLD SCHOLLJEGERDES, 8298 KNOLLWOOD DRIVE, PLANNING CASE NO. 345-92 WHEREAS, the Mounds View Planning Commission has reviewed the proposed minor subdivision request by Arnold Scholljegerdes for the property located at 8298 Knollwood Drive, legally known as: that part of Lot 35, Auditor's Subdivision No. 89, lying east of the west 214 . 07 feet, lying south of the north 180 feet, and lying north of the south 127 feet thereof; all in Ramsey County, Minnesota, as shown on the proposed Certificate of Survey dated March 20, 1992, with revisions dated April 16, 1992; and WHEREAS, each of the proposed lots meet minimum lot standards as set forth in Chapters 40 and 42 of the Mounds View Municipal Code.
