THANK YOU. **************************************************************** p • MEMORANDUM • TO: PLANNING COMMISSION FROM: PAUL HARRINGTON, PLANNER ?' �� DATE: June 25, 1992 SUBJECT: CONDITIONAL USE PERMIT, MARY NIEZGOCKI 8261 RED OAK DRIVE, PLANNING CASE NO. 338-92 Attached please find a copy of Chapter 40 .25 Subdivision C (1-6) which outlines the criteria by which all conditional use permit applications are reviewed. At the June 17, 1992 Planning Commission meeting, it was agreed that each Commission member would visit the proposed dog kennel site prior to the July 1 meeting in order to review the application against the requirements contained within Chapter 40.25. In addition to the aforementioned, I have also included a copy of police reports that have been filed on the property relating to dogs. These reports should be taken into consideration when • reviewing the request. If you need additional information, please let me know and I will contact the Police Department. Planning Commission Resolution No. 340-92 has been included for your review. The correct wording for the resolution can be decided on Wednesday Evening. • 40 . 25 ( 8) The City Council shall not grant a conditional use permit until they have received a report and recommendation from the Planning Commission and the City staff or until sixty ( 60 ) days after the. first regular Planning Commission meeting at which the request was considered . • ( 9 ) Upon receiving the report and recommendation of the Planning Commission and the City staff , the City Council shall place the report and recommendation on the agenda for the next regular meeting . Such reports and recommendations shall be entered in and made part of the permanent written record of the City Council meeting. ( 10 ) Upon receiving the report and recommendation of the Planning Commission and the City staff, the City Council shall hold a public hearing and shall make a recorded finding of fact and shall impose any conditions it considers necessary to protect the public health, safety and welfare. ( 11 ) Amendments of this Code , the official zoning map or a conditional use permit shall require passage by a four-fifths ( 4/5) vote of the full City Council . • ( 12 ) The City Clerk-Administrator shall notify the applicant of the Council ' s decision in writing . Subd . B Amendments - Initiation. The City Council or Planning Commission may upon their own motion , initiate a request to amend this Code or the official zoning map. Any person, owning real estate within the City may initiate a request to amend this Code or the official zoning map as it affects the real estate owned by said person. Subd. C Conditional Use Permit. ( 1 ) Purpose. The purpose of a conditional use permit is to provide the City of Mounds View with a reasonable degree of discretion in determining the suitability of certain designated uses upon the general welfare , public health and safety. (2 ) Criteria for Granting Conditional Use Permits. In granting a conditional use permit, the City Council shall consider the advise and recommendations of the Planning Commission and the effect of the proposed use on the Comprehensive Plan and upon the health, safety and general welfare of occupants of 411 surrounding lands. Among other things, the City Council shall make the following findings where applicable: • 40. 25 a. The use will not create an excessive burden on existing parks, schools, streets and other public facilities and utilities which serve or are proposed to serve the area. b. The use will be sufficiently compatible or separated by distance or screening from adjacent • residentially zoned or used land so that existing homes will not be depreciated in value and there will be no deterrance to development of vacant land . c . The structure and site shall have an appearance that will not have an adverse effect upon adjacent residential properties. d . The use , in the opinion of the City Council , is reasonably related to the overall needs of the City and to the existing land use. e.- The use is consistant with the purposes of the Zoning Code and the purposes of the zoning district in which the applicant intends• to locate the proposed use. f. The use is not in conflict with the Comprehensive Plan of the City. g. The use will 'not cause traffic hazards or congestion. h. Adequate utilities, access roads, drainage and necessary facilities have been or will be provided. ( 3 ) Additional Conditions. In permitting a new conditional use or the alteration of an existing conditional use, the City Council may impose , in addition to these standards and requirements expressly specified by this Code , additional conditions which the City Council considers necessary to protect the best interest of the surrounding area or the community as a whole. These conditions may include , but are not limited to the following: a. Increasing the required lot size or yard dimension. b. Limiting the height, size, or location of buildings. c. Controlling the location and number of vehicle access points. 40. 25 i d . Increasing the street width. e. Increasing the number of required off-street parking spaces. f. Limiting the number, size, location or lighting of signs. g. Requiring diking, fencing , screening , landscaping or other facilities to protect adjacent and nearby property. h. Designating sites for open space. The Zoning Administrator shall maintain a record of all conditional use permits issued including infor- mation on the use, location, and conditions imposed by the City Council; time limits, review dates and such other information as may be appropriate. ( 4 ) Reconsideration. Whenever an application for a conditional use permit has been considered and denied by the City Council , a similar application for a conditional use permit affecting substantially the same property shall not be considered again by the Planning Commission or City Council for at least six (6 ) months from the date of its denial; and a subse- quent application affecting substantially the same . property shall likewise not be considered again by the Planning Commission or City Council for an additional six (6 ) months from the date of the second denial unless a decision to reconsider such matter is made by not less than four-fifths ( 4/5 ) vote of the City Council. (5 ) Lapse of Conditional Use Permit by Non-Use. Whenever within one (1 ) year after granting a conditional use permit the work as permitted by the permit shall not have been completed , then such permit shall become • null and void unless a petition for extension of time in which to complete the work has been granted by the City Council. Such extension shall be requested in writing and filed with the City Clerk-Administrator at least thirty ( 30 ) days before the expiration of the original conditional use permit. There shall be no charge for the filing of such petition. The request for extension shall state facts showing a good faith attempt to complete the work permitted in the conditional use permit. RESOLUTION NO. 340-92 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL/DENIAL OF THE REQUEST BY MARY NIEZGOCKI FOR A CONDITIONAL USE PERMIT TO ALLOW A RESIDENTIAL DOG KENNEL ON HER PROPERTY AT 8261 RED OAK DRIVE PLANNING CASE NO. 338-91 WHEREAS,the Mounds View Planning Commission has reviewed the request of Mary Niezgocki for a Conditional Use Permit to allow the establishment of a residential dog kennel at 8261 Red Oak Drive; and WHEREAS,the Planning Commission has reviewed the Mounds View Municipal Code and recognizes that the Code allows for residential dog kennels with a Conditional Use Permit; and WHEREAS,Chapter 40.25 Subdivision C (1-6) outlines the criteria by which all Conditional Use Permit requests are reviewed. NOW, THEREFORE BE IT RESOLVED that the Mounds View Planning Commission recommends to the City Council approval/denial of the requested Conditional Use Permit based upon the following: 1. The use will/will not create an excessive burden on existing parks, schools, streets and other public facilities and utilities which serve or are proposed to serve the area. 2. The use will/will not be sufficiently compatible or separated by distance or screening from adjacent residentially zoned or used land so that existing homes will not be depreciated in value and there will be no deterrence to development of vacant land. 3 . The structure and site have an appearance that will/will not have an adverse effect upon adjacent residential properties. 4. The use, in the opinion of the Planning Commission, is/is not reasonably related to the overall needs of the City and to the existing land use. 5. The use is/is not consistent with the purposes of the Zoning Code and the purposes of the zoning district in which the applicant intends to locate the proposed use. 6. The use is/is not in conflict with the Comprehensive Plan of the City. 7. The use will/will not cause traffic hazards or congestion. • . 8. Adequate utilities, access roads, drainage and necessary facilities have/have not been provided. At the June 17 , 1992 Planning Commission meeting, it was agreed that each Commission member would visit the proposed dog kennel site prior to the July 1 meeting in order to review the application against the requirements contained within Chapter 40 .25 . In addition to the aforementioned, I have also included a copy of police reports that have been filed on the property relating to dogs . These reports should be taken into consideration when 0 reviewing the request. If you need additional information, please let me know and I will contact the Police Department. Planning Commission Resolution No. 341-92 has been included for your review. The correct wording for the resolution can be decided on Wednesday Evening. 411 40 . 25 ( 8 ) The City Council shall not grant a conditional use permit until they have received a report and recommendation from the Planning Commission and the City staff or until sixty ( 60 ) days after the. first regular Planning Commission meeting at which the request was considered. • ( 9 ) Upon receiving the report and recommendation of the Planning Commission and the City staff , the City Council shall place the report and recommendation on the agenda for the next regular meeting . Such reports and recommendations shall be entered in and made part of the permanent written record of the City Council meeting. ( 10 ) Upon receiving the report and recommendation of the Planning Commission and the City staff, the City Council shall hold a public hearing and shall make a recorded finding of fact and shall impose any conditions it considers necessary to protect the public health, safety and welfare. ( 11 ) Amendments of this Code , the official zoning map or a conditional use permit shall require passage by a four-fifths (4/5) vote of the full City Council . • ( 12 ) The City Clerk-Administrator shall notify the applicant of the Council ' s decision in writing . Subd . B Amendments - Initiation. The City Council or Planning Commission may upon their own motion , initiate a request to amend this Code or the official zoning map. Any person, owning real estate within the City may initiate a request to amend this Code or the official zoning map as it affects the real estate owned by said person. Subd . C Conditional Use Permit. ( 1 ) Purpose. The purpose of a conditional use permit is to provide the City of Mounds View with a reasonable degree of discretion in determining the suitability of certain designated uses upon the general welfare , public health and safety. ( 2 ) Criteria for Granting Conditional Use Permits. In granting a conditional use permit, the City Council shall consider the advise and recommendations of the Planning Commission and the effect of the proposed use on the Comprehensive Plan and upon the health, safety and general welfare of occupants of surrounding lands. Among other things , the City Council shall make the following findings where 111 applicable : • 40 . 25 • a. In permitting a new conditional use or the alteration of an existing . - _ - _ . - , -e—Eity Council may impose , in addition to these standards and requirements expressly specified by this Code , additional conditions which the City Council considers necessary to protect the best interest of the surrounding area or the community as a whole. These conditions may include , but are not limited to the following : a. Increasing the required lot size or yard dimension. b. Limiting the height, size , or location of buildings. c. Controlling the location and number of vehicle access points. 40 . 25 411 d. Increasing the street width. e. Increasing the number of required off-street parking spaces. f. Limiting the number, size, location or lighting of signs. g . Requiring diking , fencing , screening , landscaping or .other facilities to protect adjacent and nearby property. h. Designating sites for open space . The Zoning Administrator shall maintain a record of all conditional use permits issued including infor- mation on the use , location, and conditions imposed by the City Council; time limits, review dates and such other information as may be appropriate. (4 ) Reconsideration. Whenever an application for a conditional use permit has been considered and denied by the City Council, a similar application for a conditional use permit affecting substantially the same property shall not be considered again by the Planning Commission or City Council for at least six ( 6 ) months from the date of its denial; and a subse- quent application affecting substantially the same . property shall likewise not be considered again by the Planning Commission or City Council for an additional six ( 6 ) months from the date of the second denial unless a decision to reconsider such matter is made by not less than four-fifths ( 4/5 ) vote of the City Council . ( 5 ) Lapse of Conditional Use Permit by Non-Use. Whenever within one ( 1 ) year after granting a conditional use permit the work as permitted by the permit shall not have been completed , then such permit shall become null and void unless a petition for extension of time in which to complete the work has been granted by the City Council. Such extension shall be requested in writing and filed with the City Clerk-Administrator at least thirty ( 30 ) days before the expiration of the original conditional use permit. There shall be no charge for the filing of such petition. The request for extension shall state facts showing a good faith attempt to complete the work permitted in the conditional use permit.
