The Mounds View Planning Commission was 1. Call To Order
called to order by Chair Mountin at 8: 00
p.m. on September 16, 1992.
MEMBERS PRESENT: Commissioners Colleen, 2 . Roll Call
Miller, Nelson, Peterson, Ruggles, and
Stevenson.
Commissioners Burgers had an excused
absence.
ALSO PRESENT: Planner Harrington and
Councilmember Blanchard.
Planner Harrington reviewed Planning 3 . Consideration
• Case No. 349-92, a development review of of Resolution
a proposed office and parking expansion No. 344-92,
at Tyson Trucking, 4825 Mustang Drive. Development
The proposal is in conformance with all Review Request
applicable sections of the Municipal of Everest
Code and will not affect the site's Development for
storm water run off capacity. Tyson Trucking,
4825 Mustang
Chair Mountin noted that Tim Nelson of Circle
Everest Development, was present to
represent Tyson Trucking and had
received a copy of the proposed
resolution.
Motion/Second: Stevenson/Miller to
approve Resolution No. 344-92 ,
recommending approval of the development
request of Tyson Trucking, 4825 Mustang
Drive.

Commissioner Peterson, Planning 4 . Reports of
Commission representative to the Golf Commissioners
Course Task Force, announced that the
• group would be holding a meeting on
September 17 , 1992 at 6: 00 p.m. Members

of the Planning Commission were
encouraged to attend.
Commissioner Stevenson noted for the
minutes that he would be serving on the
Golf Course Task Force with Commissioner
Peterson as a representative of the
Parks and Recreation Committee. Because
of this situation, Commissioner
Stevenson will not be able to serve as
the Planning Commission's alternate.
Commissioner Nelson will serve as the
Planning Commission's alternate
representative on the Task Force.
There being no further business before 10. Adjournment
the Commission, Chair Mountin adjourned
the meeting at 8: 05 p.m.

Commissioners Burgers and Peterson had

ALSO PRESENT: Planner Harrington.
Planner Harrington _presented Planning 3 . Consideration
Case No. 350-92 , a variance request to of Resolution
exceed sign size requirements at Budget No. 345-92,
• Liquor. The applicant has proposed to variance
place two signs, each approximately 172 request of
square feet in size, on the south and Paster
west sides of their store at Mounds View Enterprises,
Square. 2577 Highway 10
John Streetar and Jim Everson of Paster
Enterprises were present to represent
the applicant.
Motion/Second: Stevenson/Colleen to
adopt Resolution No. 345-92 , denying the
variance request of Paster Enterprises
at 2577 Highway 10.

Planner Harrington presented Planning 4. Consideration
Case No. 351-92 , a second variance of Resolution
request for oversized signs at Mounds No. 346-92,
View Square. This sign would be located Variance
at Minnesota Fabrics and would be Request of
approximately 161 square feet in area. Paster
Enterprises,
John Streetar and Jim Everson of Paster 2541 Highway 10
• Enterprises were present to represent
this applicant.

Motion/Second: Miller/Colleen to adopt
Resolution No. 346-92, denying the
variance request of Paster Enterprises
at 2541 Highway 10.

Commissioner Ruggles stated that
although the sign exceeds the limits Motion Carried
allowed by code and no hardship exists,
the request seems reasonable.
Chair Mountin asked that copies of both
resolutions be forwarded to the City
Council prior to approval of these/their
minutes.
There being no further business before
the Commission, Chair Mountin adjourned
the meeting at 8 : 58 p.m.

SUBJECT: REVIEW OF PREVIOUSLY APPROVED VARIANCE\C.U.P.
3030 COUNTY ROAD J, PLANNING CASE NO. 304-90
As per Planning Commission direction, staff has drafted a
resolution reiterating the conditions set forth in Planning
Commission Resolution No. 313-91 (copy attached) . Staff will be
meeting with the City Attorney prior to the Wednesday Evening
Meeting in order to determine the legality of the resolution as it
pertains to enforcement. Staff will provide the resolution to the
Planning Commission following the review by the Attorney.

CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION RECOMMENDING APPROVAL OF A CONDITIONAL USE
PERMIT REQUEST BY JOHN ENGBERG TO CONSTRUCT AN
OVERSIZED GARAGE AT 3030 COUNTY ROAD J,
PLANNING CASE NO. 304-90
WHEREAS, Mr. John Engberg, 3030 County Road J, has
requested a conditional use permit to allow for the construction
of an oversized, garage (900 square feet) ; and
WHEREAS, Mounds View Municipal Code, Chapter 40.10,
Subdivision C(D) provides that the maximum size of a garage in an
R-1 District shall be 864 square feet unless a conditional use .
permit is granted by the City; and
WHEREAS, Mounds View Municipal Code, Chapter 40.10,
Subdivision D(6) A through F, provides a garage may be up to
1,264 square feet when said building is designed and maintained
to provide a uniform appearance with the' principle dwelling unit,
) and if the garage is over 1,000 square feet no other accessory
building will be allowed on the lot; and
WHEREAS, the 'Mounds View Planning Commission has
reviewed the applicant's request for a conditional use permit and
determines that it is in conformance with the aforementioned
conditions .
NOW, THEREFORE, BE IT RESOLVED that the Mounds View _.
Planning Commission recommends approval of a conditional use
permit to allow for an oversized garage of 900 square feet
requested by John Engberg, 3030 County Road J, contingent upon
the following conditions:
1. The accessory building must conform with Section 40.04,
Subdivision F, and 40 . 10, Subdivision C(1) , of the
Zoning Code.
2. The combined square footage of all accessory building
on the lot cannot exceed one thousand two hundred
sixty-four (1,264) square feet. •
3. If the garage square footage is greater than one
thousand (1,000) square feet, no other accessory
building is allowed.
4 . The building shall be designed and maintained to

provide a uniform appearance with the dwelling unit.

5. The width of the building cannot exceed thirty-five
(35) feet nor allow for more than a three (3) vehicle
• access.
6 . Should the use for which the permit was granted be
changed, -the permit shall be subject to
reconsideration, revocation or other action regulated
by Chapter 40.25 of the Zoning code.

7 . The conditional use permit shall be filed with Ramsey
County for recording on the title of the subject
property.
BE IT FINALLY RESOLVED that the Planning Commission
-directs- Staff to forward this resolution to the City Council
prior to approval of the minutes.
