SUBJECT: C.U.P. - OVERSIZED GARAGE
RANDY D. BENNETT, PLANNING CASE NO. 355-92
This item has been reviewed by the Planning Commission at their
November 18, 1992 meeting and found to be in conformance with all
applicable sections of Chapter 40 of the Mounds View Municipal Code
governing Conditional Use Permits.
Staff has prepared Resolution No. • 351-92 for your review and
consideration. Please note that the resolution for approval
stipulates that no additional accessory buildings may be located on
the property(per Chapter 40 . 10 Subdivision D 6c) .

RESOLUTION NO. 351-92
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION RECOMMENDING APPROVAL OF A CONDITIONAL
USE PERMIT TO ALLOW AN OVERSIZED GARAGE FOR RANDY D. BENNETT,
8308 KNOLLWOOD DRIVE, PLANNING CASE NO. 355-92
WHEREAS, the Mounds View Planning Commission has
reviewed the request of Randy D. Bennett for an oversized
accessory building(garage) ; and
WHEREAS, the Mounds View Zoning Ordinance allows, by
conditional use permit, up to 1,264 square feet of accessory
building square footage on one lot; and
WHEREAS, the proposed total accessory building square
footage on the lot is 1,008 square feet which is below the
maximum allowed; and
WHEREAS, the proposed building meets all applicable
setback requirements .
411 NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends to the City Council approval of
the requested conditional use permit for an oversized accessory
building by Randy D. Bennett, 8308 Knollwood Drive, contingent
upon the following:
a) The conditional use permit be recorded with Ramsey
County.
b) The building be designed and maintained to provide a
uniform appearance with the dwelling unit.
c) Should the use change for what the permit was granted
for, the permit will become null and void.
d) That no additional accessory buildings shall be allowed
on the property per Chapter 40 . 10 Subdivision D 6 (c) of
the Mounds View Municipal Code.

BE IT FINALLY RESOLVED that the Planning Commission
directs Staff to forward this resolution to the City Council
prior to approval of the minutes.

SUBJECT: VARIANCE - FRONT YARD SETBACK
ROSS TARANTINO, PLANNING CASE NO. 356-92
This item has been reviewed by the Planning Commission at their
November 18, 1992 agenda meeting. At that time, it was the
consensus of the Commission that no reasonable alternatives for the
location of the garage existed on the property. As per Planning
Commission direction, staff has prepared Resolution No. 352-92 for
your consideration.
Because two Commission members were unable to attend the meeting at
which this item was discussed, staff will be doing a follow-up
review of the proposal on Wednesday Evening.

RESOLUTION NO. 352-92
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION APPROVING THE SETBACK VARIANCE REQUEST BY
ROSS TARANTINO, 2199 TERRACE DRIVE,
PLANNING CASE NO. 356-92
WHEREAS, the Mounds View Planning Commission has
reviewed the request of Ross Tarantino for a variance to allow
the construction of a 20'x 20 ' accessory building at a thirty-
five foot (35' ) front yard setback where a forty-nine foot (49 ' )
setback is required by Municipal Code; and
WHEREAS, the applicants property is subject to setback
requirements stipulated in Chapter 40.05 Subdivision C (a) of the
Mounds View Municipal Code; and
WHEREAS, the Planning Commission has reviewed the
criteria used to evaluate all variance requests; and
WHEREAS, the applicant has presented a hardship
• statement to the Planning Commission; and
WHEREAS, the literal interpretation of the provisions
of this code would deprive the applicant of rights commonly
enjoyed by other properties in the same district under the terms
of this Code; and
WHEREAS, the special conditions of the property do not
result from the actions of the applicant; and
WHEREAS, granting the variance would not confer special
privileges on the applicant that are not enjoyed by other
property owners in the same district; and
WHEREAS, the variance requested is the minimum
necessary to alleviate the hardship.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission approves the request of Ross Tarantino, 2199
Terrace Drive for a fourteen foot ( 14' ) variance into the front
yard setback based on the following findings of fact:
1) A City required 5' utility easement is located on
the Eastern property line precluding building in
that area.
• 2) Insufficient building area is located on the west
side of the property.

3) The proposed structure will not encroach upon the
standard 30 ' front yard setback.

CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
ESTABLISHING MEETING AND TIMELINE SUBMISSION DATES FOR 1993
WHEREAS, the Mounds View Planning Commission will be
holding two business meetings per month during 1993 with the
exception of Special Meetings; the first being a regular
meeting and the second an agenda session; and
WHEREAS, the Planning Commission has requested to
review regular business meeting agenda items at their agenda
session, a minimum of two weeks prior to the regular business
meeting; and
WHEREAS, developers, citizens or other interested
parties should be advised of deadlines for materials used by
staff to prepare a report and used by the Planning
Commissioners to decide on a particular development issue; and
WHEREAS, a display of meeting dates and submission
deadline dates be established to provide an orderly system for
use by the Planning Commission, staff and general public;
NOW, THEREFORE, BE IT RESOLVED that the Planning
Commission of the City of Mounds View establishes meeting and
submission timetable dates setting deadlines for submission of
materials for agenda sessions of the Planning Commission and
also setting the dates of the regular business meetings and
agenda sessions;
BE IT FURTHER RESOLVED that Exhibit 1 becomes an
integral part of this resolution;
BE IT FINALLY RESOLVED that if the Planning Commis-
sion is required to or desires to hold special meetings, they
will do so in accordance with State law, Code requirements and
the Bylaws.

SUBJECT: SIDE YARD SETBACK - PARKING SURFACE
At their October 21, 1992 meeting, the Planning Commission - per
City Council direction - reviewed the City setback requirements for
improved, off-street parking areas. At that time, staff provided
the Commission with the attached survey of surrounding communities'
requirements. Following discussion, it was the determination of
the Commission that the existing side yard setback (5 ' for improved
parking surfaces) was appropriate and reasonable.
I have drafted Resolution No. 354-92 for your review and
consideration. Following adoption of the Resolution, staff will
forward a copy to the City Council.

RESOLUTION NO. 354-92
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION RECOMMENDING MAINTAINING THE REQUIRED FIVE FOOT (5' )
SIDE YARD SETBACK FOR IMPROVED, OFF-STREET PARKING AREAS
WHEREAS, the Mounds View Planning Commission - at the
direction of the City Council - has conducted a detailed review of
the side yard setback requirements for improved, off-street parking
areas; and
WHEREAS, the Planning Commission reviewed the
requirements of the City of Mounds View against the requirements of
communities in the surrounding area; and
WHEREAS, the Mounds View Planning Commission found that
the requirements of the City of Mounds View are comparable to those
of the surrounding communities; and
WHEREAS, it is the Planning Commissions opinion that the
existing five foot (5 ' ) side yard setback for improved, off-street
parking areas is reasonable and appropriate.
• NOW, THEREFORE BE IT RESOLVED that the Mounds View
Planning Commission recommends to the City Council that the
existing five foot (5' ) setback for improved, off-street parking
area be maintained based on the following findings of fact:
1. The location of a large number of utility easements along
side property lines within the City would require the removal
and replacement of impervious surface in the event
maintenance is needed.
2 . The five foot (5' ) side yard setback provides necessary area
for—the—storage of snow from the impervious surface.
BE IT FINALLY RESOLVED that the Planning Commission
directs Staff to forward this resolution to the City Council prior
to approval of the minutes.
Adopted this 2nd day of December, 1992 .

Due to a miscommunication between the applicant and myself(mostly
myself) , this item was not put on the November 18, 1992 agenda
session. I am requesting that this item be both reviewed and acted
upon at the upcoming meeting. I will provide all materials related
to the case on Wednesday Evening.
