SUBJECT: CONDITIONAL USE PERMIT - 7312 PARK VIEW DRIVE
GERALD SETTERHOLM, PLANNING CASE NO. 364-93
Gerald Setterhoim, 7312 Park View Drive, has made application for
a Conditional Use Permit to allow the construction of an addition
to an existing garage which will bring the total square footage to
a number which falls within the allowable range for a single family
garage.
The Planning Commission has reviewed this item at their May 19,
1993 , regularly scheduled agenda session. At that time, it was
determined that the request meets all applicable sections of the
Mounds View Municipal Code. Based on the findings of that meeting,
Planning Commission Resolution No. 360-93 recommending approval of
110 the request is attached for your review and consideration.

RESOLUTION RECOMMENDING APPROVAL OF A CONDITIONAL
USE PERMIT. TO ALLOW AN OVERSIZED GARAGE FOR GERALD SETTERHOLM
7312 PARK VIEW DRIVE, PLANNING CASE NO. 364-93
WHEREAS, the Mounds View Planning Commission has
reviewed the request of Gerald Setterholm for an oversized
accessory building(garage) ; and
WHEREAS, the Mounds View Zoning Ordinance allows, by
conditional use permit, up to 1,264 square feet of accessory
building(garage) square footage on one lot; and
WHEREAS, the proposed total garage/accessory building
square footage on the lot is 1, 008 square feet which is below the
maximum allowed; and
WHEREAS, the proposed building meets all applicable
setback requirements.
• NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends to the City Council approval of
the requested conditional use permit for an oversized accessory
building by Gerald Setterholm, 7312 Park View Drive, contingent
upon the following:
a) The conditional use permit be recorded with Ramsey
County.
b) The building be designed and maintained to provide a
uniform appearance with the dwelling unit.
G)----Should—the use charge for what the—permit wac granted
for, the permit will become null and void.
d) That no additional accessory buildings shall be allowed
on the property per Chapter 40. 10 Subdivision D 6 (c) of
the Mounds View Municipal Code.

BE IT FINALLY RESOLVED that the Planning Commission
directs Staff to forward this resolution to the City Council
prior to approval of the minutes.

SUBJECT: REVOCATION OF CONDITIONAL USE PERMIT
3030 COUNTY ROAD J
Within the past year, City Staff has documented violations of a
Conditional Use Permit issued for an oversized accessory building
at 3030 County Road J. Specifically, conditions imposed on the
permit prohibiting the storage of automobiles other than licensed
collector vehicles within the accessory building have been
violated. Also, impervious surface required to be removed as part
of the permit has not been removed. The owner of the property has
been issued -an Administrative Offense in the past for these
violations, however, the conditions of the permit remain
unaddressed.
As was decided at the May 19, 1993 Planning Commission meeting,
staff will be drafting a resolution recommending revocation of the
Conditional Use Permit for the consideration of the Commission.
This resolution will be provided Wednesday evening.

SUBJECT: CONDITIONAL USE PERMIT - 2390 HIGHWAY 10
GATEWAY FOODS, PLANNING CASE NO. 362-93 ,
At the May 19, 1993 Commission meeting, Staff was asked to contact
the City Attorney for an opinion on the code relating to accessory
structures on a commercial property.
Specifically, was an accessory building allowed on a commercial
property or, did it need to be tied in to the principal structure?
After review of the City Code, it was the determination of the
Attorney that there was no provision prohibiting the placement of
an accessory structure on a commercial property. The only
stipulation covered in the Code is that the accessory structure
cannot exceed 30% of the floor areaof the principal structure.
411 Staff has reviewed this requirement with the applicant and
preliminary figures indicate that the requested car wash facility
will be less than the allowed 30%. However, more exact figures on
the square footage of the existing principal structure will be
needed in order to make a definitive judgement on compliance.
The Commission also requested that the applicant explore
alternative locations on the property for the facility. Taking
into consideration traffic patterns on the site, noise generated
from stacked vehicles and removal of excess water from vehicles
prior to them leaving the site, the applicant has submitted the
attached alternative plan.
The applicant has indicated to Staff that a grading plan for the
site is forthcoming as requested. All other information received
as part of the application can be found in your packet for the
meeting of May 19.

SUBJECT: VARIANCE - 2840 HIGHWAY 10
SI SIMON, PLANNING CASE NO. 358-92
At the January 6, 1993, Planning Commission meeting, Planning
Commission Resolution No. 355-92 was adopted by the Commission.
This resolution denied the request for variance of Simon T. Simon
for a reduction in the required number of off-street parking spaces
on his property at 2840 Highway 10. Mr. Simon appealed this
decision to the City Council as allowed per City Code.
The Mounds View City Council, in their review of the request, asked
the applicant if any effort had been made to acquire additional
space on his property via an easement from the Minnesota Department
of Transportation (MnDOT) . The applicant stated that he was in the
111 process of negotiating an easement. At that point, the Council
tabled the item pending the outcome of the negotiations for
easement.
Mr. Simon has now acquired an easement from MnDOT. Because the
Council felt that the additional area now available to the
applicant changes the original request somewhat, this item has been.
referred back to the Planning Commission for review.
I have included a drawing provided by the applicant for your
review. I will be putting together a drawing on AutoCAD for the
Wednesday evening meeting which further illustrates the easement
