Call To Order called to order by Chair Mountin at 7: 33 p.m. on June 9, 1993 . MEMBERS PRESENT: Commissioners Nelson, 2 . Roll Call Peterson, Miller, Ruggles, and Chair Mountin. Commissioners Stevenson and Colleen had excused absences. ALSO PRESENT: Planner Harrington, Recording Secretary Asleson, and Councilmember Rickaby. Motion/Second: Nelson/Miller to approve 3 . Requests and Comments Planner Harrington reviewed Planning 5. UNAPPROVED 411 Mounds View Planning Commission June• 9, 1993 Regular Meeting Page 2 Planner Harrington explained that this is included in the resolution as a safeguard against an oversized garage being used as a place of business. It was noted for the minutes that the. applicant, Gerald Setterholm, was not present. Motion/Second: Miller/Peterson to approve Resolution No. 360-93 , recommending approval of a Conditional Use Permit for an oversized garage at 7312 Park View Drive. 5 ayes 0 nays Motion Carried Planner Harrington explained that he had 6. Consideration planned on presenting, for the of Resolution Commission's consideration, a resolution No. 361-93 , which would recommend the revocation of Revocation of 0 the Conditional Use Permit of John Conditional Use Engberg, 3030 County Road J. However, Permit, 3030 staff was unable to contact the City County Road J Attorney to review the resolution prior to this meeting. Because the case could end up in litigation, Planner Harrington asked that this item be tabled to the July 7, 1993 meeting, to give the City Attorney the opportunity to review the wording of the resolution. Staff Report • Attendance at the May 19, 1993 Agenda 8. Reports of Session included Commissioners Peterson, Chair and Nelson, Miller, Stevenson, Colleen, Commissioners Ruggles, Chair Mountin, and Councilmember Rickaby. Commissioner Stevenson had an excused absence. UNAPPROVED 410 Mounds View Planning Commission June 9 , 1993 Regular Meeting Page 3 Chair Mountin noted that the Amoco on Silver Lake Road had been playing music on its loudspeaker and that there were rental vehicles being stored at Bumper to Bumper. Commissioner Miller questioned the vehicle parked at the Birchwood Realty office parking lot. Commissioner Peterson reported that the Golf Course Task Force would be meeting on June 17, 1993 . The results of a market research survey are to be presented at the meeting. All Planning Commissioners were invited to attend. There being no further business before 9 . Adjournment the Commission, Chair Mountin adjourned the meeting at 7: 41 p.m. Respectfully Submitted, Paul Harrington City Planner • MEMORANDUM TO: PLANNING COMMISSION \ FROM: PAUL HARRINGTON, CITY PLANNER DATE: June 9, 1993 SUBJECT: CONDITIONAL USE PERMIT - CAR WASH GATEWAY FOODS, PLANNING CASE NO. 362-93 As a result of the questions raised by the Commission at the meeting of June 9, the applicant will be providing additional drawings in support of their request. Specifically, an accurate depiction of the location of certain items on the lot was requested as well as a comprehensive grading plan for the entire site and, an idea of how to minimize the impact of the proposal on adjacent residential properties through the use of natural vegetative plantings. The applicant will also be attempting to locate the proposed • structure at the setback required by the Municipal Code. If they are unable to move the proposed structure substantially, a variance may be requested. I will be bringing a "boiler plate" resolution to the meeting at the request of the applicant. Based on the findings of the Commission, language can be added to the resolution either approving or denying the request. • • • MEMORANDUM 411 TO: PLANNING COMMISSION FROM: PAUL HARRINGTON, CITY PLANNER DATE: June 9 , 1993 SUBJECT: VARIANCE - 2840 HIGHWAY 10 SI SIMON, PLANNING CASE NO. 358-92 As directed by the Commission at the June 9, 1993 meeting, Staff has drafted the attached resolution for your consideration. 411 • PLANNING COMMISSION • RESOLUTION NO. 362-93 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION REITERATING THE STANCE OF THE MOUNDS VIEW PLANNING COMMISSION REGARDING THE REQUEST FOR VARIANCE OF SIMON T. SIMON, 2840 HIGHWAY 10, PLANNING CASE NO. 358-92 WHEREAS, Mr. Simon T. Simon made application for a variance to allow a reduction in the required number of off- street parking spaces at 2840 Highway 10 ; and WHEREAS, the Mounds View Planning Commission reviewed the request and failed .to approve it by the required two-thirds affirmative vote thereby rendering a decision of denial; and WHEREAS, Mr. Simon, as allowed by the Municipal Code, appealed the decision of the Planning Commission to the City Council; and WHEREAS, the Mounds View City Council reviewed the applicant's request and suggested that an attempt be made to secure an easement from the Minnesota Department of III Transportation (MnDOT) for the purposes of providing additional off-street parking on the site; and WHEREAS, the applicant secured the requested easement from MnDOT; and WHEREAS, based upon the securing of the easement, the Mounds View City Council referred the request back to the Planning Commission for reconsideration; and WHEREAS, the Mounds View Planning Commission has reconsidered the request as directed by the City Council; and WHEREAS, the Mounds View Planning Commission finds that the request is not significantly different from the original request for the following reason: The new request can provide for a maximum of 21 parking spaces versus 17 under the original request which is significantly less than the required 34 spaces; and WHEREAS, the Planning Commission has reviewed the easement agreement secured by the applicant and has determined that it is not viableas it allows for the cancellation of the agreement by either party with 60 days written notice. NOW, THEREFORE, BE IT RESOLVED that based upon the findings listed above, the Mounds View Planning Commission denies Resolution No. 362-93 Page Two the request for variance of Simon T. Simon fora reduction in the required number of off-street parking spaces at 2840 Highway 10. BE IT FINALLY RESOLVED that the Mounds View Planning Commission directs staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 16th day of June, 1993 . As you know, Ihave been working with Amoco Oil Company for over a year on this project . The property is vacant land of approximately 30 , 000 square feet . It is presently zoned B-3 and as far as I know the only history was a house that was removed in 1986 . Amoco has offered all history on this property including environ- mental studies they have had done . It is my goal to build a automotive care facility on this property. It would be a state of the art service facility. Even though I would own the building and property, I would participate with Amoco in their CERTICARE Franchise program. CERTICARE is a national program that is very well respected . When Amoco developed the corner lot east of this property, an access was built on Highway 10 with the understanding • that it would be wide enough for both lots and that it would be the only access for the 2806 Hwy 10 lot . It is my understanding that a cross access agreement was made with Amoco to allow traffic access to Silver Lake Road. While this facility would have parking for 20-25 vehicles , there would be minimal over night parking. This facility would do automobile preventive maintenance and mechanical repairs .
