THANK YOU. • MEMORANDUM • TO: PLANNING COMMISSION FROM: PAUL HARRINGTON, PLANNER DATE: July 1, 1993 SUBJECT: CONDITIONAL USE PERMIT, MINOR AUTO REPAIR 2806 HIGHWAY 10, PLANNING CASE NO. 365-93 Ron Schmidt has made application for a Conditional Use Permit to allow the construction of a minor auto repair facility at 2806 Highway 10. The Mounds View Municipal Code allows this type of operation in a B-3 , Highway Business district with the issuance of a Conditional Use Permit. This request has been reviewed by the Commission at their June 16, 1993 meeting. At that time it was determined that the request met all applicable requirements set forth in the Code. Staff will be meeting with the applicant prior to the Wednesday • meeting to clear up some outstanding issues (hours of operation, services to be provided, etc. ) . An appropriate resolution will be drafted and forwarded to the Commission following that meeting. If you have any questions, please do not hesitate to give me a call. • MEMORANDUM . III TO: PLANNING COMMISSION FROM: PAUL HARRINGTON, CITY PLANNER r`\ DATE: July 1, 1993 SUBJECT: REVOCATION OF CONDITIONAL USE PERMIT 3030 COUNTY ROAD J Within the past year, City Staff has documented violations of a Conditional Use Permit issued for an oversized accessory building at 3030 County Road J. Specifically, conditions imposed on the permit prohibiting the storage of automobiles other than licensed collector vehicles within the accessory building have been violated. Also, impervious surface required to be removed as part of the permit has not been removed. The owner of the property has been issued an Administrative Offense in the past for these violations, however, the conditions of the permit remain unaddressed. • As was decided at the May 19, 1993 Planning Commission meeting, staff will be drafting a resolution recommending revocation of the Conditional Use Permit for the consideration of the Commission. Following consultation with the City Attorney on its' wording, the resolution will be provided Wednesday evening. If you have any questions on this matter, do not hesitate to give me a call. • 111 MEMORANDUM TO: PLANNING COMMISSION FROM: PAUL HARRINGTON, CITY PLANNER DATE: July 1, 1993 SUBJECT: VARIANCE - 2840 HIGHWAY 10 SI SIMON, PLANNING CASE NO. 358-92 As directed by the Planning Commission at their June 16, 1993 meeting, staff submits the attached resolution for consideration. PLANNING COMMISSION RESOLUTION NO. 362-93 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION REITERATING THE STANCE OF THE MOUNDS VIEW PLANNING COMMISSION REGARDING THE REQUEST FOR VARIANCE OF SIMON T. SIMON, 2840 HIGHWAY 10, PLANNING CASE NO. 358-92 WHEREAS, Mr. Simon T. Simon made application for a variance to allow a reduction in the required number of off- street parking spaces at 2840 Highway 10; and WHEREAS, the Mounds View Planning Commission reviewed the request and failed to approve it by the required two-thirds affirmative vote thereby rendering a decision of denial; and WHEREAS, Mr. Simon, as allowed by the Municipal Code, appealed the decision of the Planning Commission to the City Council; and WHEREAS, the Mounds View City Council reviewed the applicant's request and suggested that an attempt be made to secure an easement from the Minnesota Department of Transportation (MnDOT) for the purposes of providing additional off-street parking on the site; and WHEREAS, the applicant secured the requested easement from MnDOT; and WHEREAS, based upon the securing of the easement, the Mounds View City Council referred the request back to the Planning Commission for reconsideration; and WHEREAS, the Mounds View Planning Commission has reconsidered the request as directed by the City Council; and WHEREAS, the Mounds View Planning Commission finds that the request is not significantly different from the original request for the following reason: The new request can provide for a maximum of 21 parking spaces versus 17 under the original request which is significantly less than the required 34 spaces; and WHEREAS, the Planning Commission has reviewed the easement agreement secured by the applicant and has determined that it is not viable as it allows for the cancellation of the agreement by either party with 60 days written notice. NOW, THEREFORE, BE IT RESOLVED that based upon the findings listed above, the Mounds View Planning Commission denies Resolution No. 362-93 111 Page Two the request for variance of Simon T. Simon for a reduction in the required number of off-street parking spaces at 2840 Highway 10. BE IT FINALLY RESOLVED that the Mounds View Planning Commission directs staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 7th day of July, 1993 .
