called to order by Chair Mountin at 8:48
p.m. on June 16, 1993 .
MEMBERS PRESENT: Commissioners Nelson, 2 . Roll Call
Peterson, Ruggles, Colleen, and Chair
Mountin. Commissioners Stevenson and
Miller had excused absences.
ALSO PRESENT: Planner Harrington,
Recording Secretary Asleson, and
Councilmember Rickaby.
• Chair Mountin noted for the minutes that 3 . Consideration
this special meeting had been called to of Resolution
order at the request of the applicant's No. 363-93 ,
representative, Tom Boulay of Husky, Regarding
Inc. The applicant, Keith Carlson, was Variance and
not present. Conditional Use
Permit Request
Planner Harrington stated the facts of of Gateway
the case for the minutes. Gateway Foods Foods, 2390
is requesting a Conditional Use Permit Highway 10,
to allow a car wash as an accessory use Planning Case
at 2390 Highway 10. The applicant also No. 362-93
is requesting a valiance to locate the
car wash at a 20' setback from a
residential area where a 40' setback is
required by code. This case had been
previously discussed by the Planning
Commission at agenda sessions.
Mr. Boulay explained that a car wash has
become a basic function of a convenience
store and that a store's competitive
position is weakened without one. He
explained that the only way that a 40'
setback requirement could be met would
be to move the car wash to the center of
0 the lot - something that can't be done
because that is where underground gas

tentatively scheduled to be presented to
the Council on July 26th.

Resolution No. 361-93 , recommending
revocation of the Conditional Use
Permits previously issued for 3030
County Road J.

Planner Harrington reviewed the next 7. Consideration
case, variance request of Simon T. Simon of Resolution
for a reduction in the number of parking No. 362-93 ,
spaces required at 2840 Highway 10. The regarding
variance had previously been denied by variance
the Planning Commission. At the City request of
Council level, Mr. Simon was directed to Simon T. Simon,
obtain an easement from MNDot to use 2840 Highway
• some of their right-of-way for parking 10, Planning
purposes. Mr. Simon obtained this Case No. 358-92
easement, but it did not grant him much
by way of increased parking spaces.
Also, the easement agreement contained a
clause which allows the agreement to be
cancelled by either party with 60 days
notice. Since a variance stays with a
property forever, the Planning
Commission had expressed some discomfort
with this easement agreement.
Mr. Simon was not in attendance, but had
indicated that he wished to have the
case proceed forward in his absence.
Motion/Second: Miller/Peterson to app-
rove Resolution No. 362-93 , reiterating
the stance of the Planning Commission
regarding the request for variance by
Simon T. Simon, 2840 Highway 10.

Staff has recently met with the applicant regarding the request for
Conditional Use Permit at 2806 Highway 10. Following discussion of
the issues raised by the Commission, the applicant provided Staff
with the attached letter.
I have prepared Resolution No. 364-93 for your review and
consideration. This resolution is designed to be a "boiler plate"
and is open to discussion by the Commission as a whole.

STATE OF MINNESOTA
RECOMMENDATION TO THE CITY COUNCIL APPROVING THE
CONDITIONAL USE PERMIT REQUEST BY RON SCHMIDT,
2806 HIGHWAY 10, PLANNING CASE NO. 365-93
WHEREAS, Ron Schmidt has requested City approval to
operate a Minor Auto repair facility at 2806 Highway 10 ; and
WHEREAS, the Mounds View Municipal Code allows minor
auto repair facilities in a B-3 , Highway Commercial District; and
• WHEREAS, the Planning Commission has reviewed the
following documents regarding this proposal:
a) Site plan dated June 4, 1993
b) Letter of request dated May 28, 1993
WHEREAS, the Planning Commission has determined that
•
the proposal is in conformance with the requirements of the
Municipal Code, specifically Chapter 40.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends approval of the conditional use
permit with the following conditions:
1. A storm water control plan shall be submitted by
the applicant and approved by the appropriate City
Staff.
2. There shall be no outside loudspeakers at this
facility.
3 . Only minor repairs and maintenance will be allowed
on site excluding major engine overhauls,
transmission replacement, and body work.

SUBJECT: CONDITIONAL USE PERMIT - EXTENSION
7901 RED OAK DRIVE, PLANNING CASE NO. 366-93
Church Upon the Rock, 7901 Red Oak Drive, has made application for
an extension of a previously approved Conditional Use Permit for a
temporary accessory structure. Passed in 1988 , City Council
Resolution No. 2320 contained a "sunset" clause which effectively
revokes the permit after a five year period. The attached letter
more fully explains the applicants request.
For review:
In 1988, the Planning Commission and the City Council gave
• approval for the location of a temporary accessory building at
7901 Red Oak Drive (Resolution No. 2320) . At the time of
approval, both the Commission and the Council had concerns about
the available off-street parking area on the site, the lack of an
improved surface for those existing parking facilities and, the
proposed use for the accessory building.
In order to somewhat address those concerns, the approval for the
temporary structure included the aforementioned sunset clause.
The specific language of the Resolution stipulated that the
temporary structure be removed after a five year period and
replaced with a permanent building. Additionally, at the end of
this five year period, the site (i.e. parking facilities and
surface) were required to be upgraded to meet current City codes.
The concern with the use of the building was addressed in a
separate resolution.
At this time, the applicant is requesting that an extension to City
Council Resolution No. 2320 be granted to allow more time for the
Church to assess its needs and options in relation to the site.
I have provided all materials received as a part of this request in
addition to all documents referenced in this memorandum.

Dear Commissioners:
Church Upon the Rock hereby respectfully requests a two-yeai extension oS
Resolution No. - � 0, The accessory structure is being usedby the Church and

the related school as classrooms and is vital to both entities.
The requested extension is needed because the Church, which had planned to
move prior to the expiration of Resolution No. 2320, has been delayed in its
plan to move. .
Because of marked growth over the last several years and because of the
limitations of the Church's current facility, the Church and School have been
seeking a new home. The Church believed its hopes were realized when in
December 1992, the Church purchased Rice Creek Center in New Brighton. The
Church and School's plan and desire was to co-habitate in the retail center
with the existing businesses; but to this day, the Church has failed to obtain
• the appropriate special use permits from the City of New Brighton.
The Church has several options to pursue in the midst of its struggle to find
an adequate home. These options include:
A. Sell the Rice Creek Center and begin our site search from square
one; or
B. Perhaps, trade the Center for land and buildings; or
G. (and this is what the church least desires to do) liti 'ate with the
• City of New Brighton.

RESOLUTION APPROVING CONDITIONAL USE PERMIT FOR A
TEMPORARY ACCESSORY STRUCTURE TO BE PLACED IN AN R-1
DISTRICT AT 7901 RED OAK nr._VE, CHURCH UPON THE ROCK
WHEREAS , the Church Upon the Rock, 7901 Red Oak Drive , has
requested a conditional use permit to erect a temporary classroom
•
in an R-1 District; and
WHEREAS , this structure will be treated as a temporary
accessory structure with a six foot setback from the principle
building except for a temporary passageway connecting the two -
buildings; and
WHEREAS, this temporary structure will be allowed on the
property for a time period not to exceed five years from City
" Council approval provided that the use as a classroom does not
change;
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Mounds View approves a conditional use permit to
40 for the erection of a temporary classroom not to exceed five
years from City Council approval for Church Upon the Rock, 7901
Red Oak Drive, legally known as Spring Lake Park Hillview, Lots
113 and• 114, contingent upon the following:
1 . After the five-year time period , the temporary structure .
is to be removed and a permanent structure put in its
place requiring. the site and building to be brought up to
. Code, pending approval by the City Council .
2. If -the principle building is sold or vacated , the
conditional use permit for this structure becomes invalid
and the structure would be removed .
