Chapter 40. 10 Subdivision D (6) of the Mounds View Municipal Code allows for the construction of accessory buildings exceeding 216 square feet but, not larger than 400 square feet, with the issuance of a conditional use permit. Mr. Pederson has made such application for a 400 square foot building. The request, as proposed, meets all other applicable requirements set forth in the Mounds View Municipal Code including, but not • limited to, height, area and setbacks. MEMORANDUM • TO: PLANNING COMMISSION • FROM: PAUL HARRINGTON, PLANNER \\ DATE: August 13 , 1993 SUBJECT: CONDITIONAL USE PERMIT - 2390 HIGHWAY 10 GATEWAY FOODS, PLANNING CASE NO. 362-93 In May of this year, Gateway Foods, representing Brooks Market - 2390 Highway 10, made application for a Conditional Use Permit to allow an automated car wash to be placed on the Brooks property. That application, as originally submitted, also requested the granting of a variance to allow the car wash facility to be located within the required rear yard setback. The Mounds View Planning Commission, after review of the proposal at their May and June Agenda Sessions, denied the request for variance. Specifically, in Resolution No. 363-93 , the Commission cited the lack of a demonstrated hardship on the property; a current, reasonable use of the property; the lack of the request being unique to this property; and, the need being self created as reasons for denial. Following the Planning Commissions' decision, the applicant, as allowed by Municipal Code, appealed their decision to the City Council level. The Mounds View City Council, at their July 12 , 1993 meeting, concurred with the findings of the Planning Commission and directed Staff to prepare a Resolution denying the appeal. Prior to that Resolution being acted upon, the applicant submitted an alternative site plan for consideration. Because no official action has yet been taken on the Conditional Use Permit, the Council has referred the alternative site plan back to the Planning Commission level for reconsideration. The alternative site plan has been included for your consideration and review. If you have any questions, please do not hesitate to give me a call. • MEMORANDUM TO: PLANNING COMMISSION FROM: PAUL HARRINGTON, PLANNER v r\ DATE: August 13 , 1993 SUBJECT: DEVELOPMENT PLAN/PRELIMINARY PLAT AMEND/REZONING EVEREST DEVELOPMENT, 22XX WOODALE DRIVE Everest Development has made application for the following within the Mounds View Business Park: 1) Development Plan Review - Review of the proposed 80, 764 square foot two-story building/facility expansion of Multi-Tech Systems to be constructed to the West of the existing Multi-Tech building. Staff has reviewed the submitted application and narrative provided by the applicant and found the request meets the intent of the Municipal Code as it applies to this request including, land use, setbacks, zoning(if approved) , parking, etc. Staff has met with the applicant within the past week to discuss issues related to the relocation of existing water and sewer lines on the property and will be reviewing those items further with the consulting engineers for the City. Additionally, a review of the provisions for storm water control on the site is currently underway. Staff anticipates no problems with storm water control on the site as the ponding area constructed as part of the existing Business Park was sized to handle the development of this property. 2) Preliminary Plat Amendment - In 1992 , the Preliminary Plat of Mounds view Business Park West was approved by the City Council. The original Plat contained two (2) lots and one (1) Outlot; the amended Preliminary Plat is for three (3) and the elimination of the Outlet. The total land area involved in the Plat is 14 . 11 acres. 3) Rezoning - Currently, the property within the proposed Mounds View Business Par West Addition Plat is zoned B-3 , Highway Commercial. The applicant is proposing that the property to be utilized by Multi-Tech Systems (Lot 3 , Block 1 of the proposed amended Plat) be rezoned to PUD, Planned Unit Development, to accommodate the proposed use of that parcel by Multi-Tech. Also, the rezoning would provide consistentzoning for the entire Multi- Tech complex. I have included a very comprehensive application submittal provided by the applicant for your review.
