THANK YOU. **************************************************************** • MEMORANDUM TO: PLANNING COMMISSION FROM: PAUL HARRINGTON, PLANNER DATE: October 29, 1993 SUBJECT: C.U.P. - RESIDENTIAL DOG KENNEL VICTORIA BOWERS, 8351 GROVELAND ROAD This item has been reviewed by the Mounds View Planning Commission at their October 20, 1993 Agenda Session. At that time, the Planning Commission directed Staff to conduct a background check on the property. The Mounds View Police Department has conducted the requested background check on behalf of Staff and found that there are no documented complaints relating to animals on the subject address. Based on these findings, Staff has prepared the attached resolution • for consideration in this matter. If you have any questions, please do not hesitate to give me a call. c • RESOLUTION NO. 368-93 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF THE REQUEST BY VICTORIA BOWERS FOR A CONDITIONAL USE PERMIT TO ALLOW A RESIDENTIAL DOG KENNEL ON HER PROPERTY AT 8351 GROVELAND ROAD, PLANNING CASE NO. 338-91 WHEREAS, the Mounds View Planning Commission has reviewed the request of Victoria Bowers for a Conditional Use Permit to allow the establishment of a residential dog kennel at 8351 Groveland Road; and WHEREAS, the Planning Commission has reviewed the Mounds View Municipal Code and recognizes that the Code allows for residential dog kennels with a Conditional Use Permit; and WHEREAS, Chapter 40. 25 Subdivision C (1-6) outlines the criteria by which all Conditional Use Permit requests are reviewed. NOW, THEREFORE BE IT RESOLVED that the Mounds View Planning Commission recommends to the City Council approval of the • requested Conditional Use Permit based upon the following: 1. The use will not create an excessive burden on existing parks, schools, streets and other public facilities and utilities which serve or are proposed to serve the area. 2 . The use will be sufficiently compatible or separated by distance or screening from adjacent residentially zoned or used land so that existing homes will not be depreciated in value and there will be no deterrence to development of vacant land. 3 . The structure and site have an appearance that will not have an adverse effect upon adjacent residential properties. 4 . The use, in the opinion of the Planning Commission, is reasonably related to the overall needs of the City and to the existing land use. 5. The use is consistent with the purposes of the Zoning Code and the purposes of the zoning district in which the applicant intends to locate the proposed use. 6. The use is not in conflict with the Comprehensive Plan of the City. • 7. The use will not cause traffic hazards or congestion. • Resolution No. 368-93 Page Two 8. Adequate utilities, access roads, drainage and necessary facilities have been provided. (ATTEST) Chairman (SEAL) Planner • • •- • MEMORANDUM TO: PLANNING COMMISSION FROM: PAUL HARRINGTON, CITY PLANNERN� DATE: October 29, 1993 SUBJECT: MAJOR SUBDIVISION WATSON PROPERTY - N1/2 SEC 5 TWP 30 RNG 23 Based on the discussion at the October 20, 1993 Planning Commission Agenda Session, Staff contacted the applicant and corrected those items which needed to addressed. In particular, the plat will only contain four (4) lots and an Outlot rather than the five (5) plus the Outlot that were originally shown. The request meets all other requirements as outlined in Chapter 42 "Subdivision Regulations" of the Mounds View Municipal Code. Staff has prepared the attached resolution for Planning Commission consideration. Please note that, as agreed to by the Mounds View Park and Recreation Department, the applicant will be dedicating • the Outlot to the City in lieu of Park Dedication Fees. ATTEST: Chairman (SEAL) Planner • MEMORANDUM TO: PLANNING COMMISSION FROM: PAUL HARRINGTON, CITY PLANNER DATE: October 29, 1993 SUBJECT: ON-SITE PARKING EXPANSION, ROBERT'S OFF 10 2400 COUNTY ROAD H2 Bob and Greg Waste, proprietors of Robert's Off 10, have requested City approval for the expansion of on-site parking facilities at their establishment at 2400 County Road H2 . The request, if approved, would grant a variance for the location of off-street parking at a zero lot-line setback along the East property line (Greenfield Avenue) , allow the scaling down of a City required berm along the West property line (Edgewood Drive) and approve the addition of impervious surface (parking area) . This item has been reviewed by the Mounds View Planning Commission 0 at their October 20,. 1993 Agenda Session. At that meeting the Planning Commission asked, in response to resident concerns, that Staff provide information regarding 1) the storm water drainage control capabilities of the site and surrounding area, 2) the impact of the proposed expansion and variance on snow removal and storage, 3) effects of the request on the existing berm and landscaping and, 4) the possible need for speed bumps on the property. In response to these requests, Staff has met with the City Forester (item 3 , memo attached) , City Consulting Engineer (item 1, memo forthcoming) and the Public Works Supervisor (item 2 , memo forthcoming) . In response to the necessity for speed bumps, Staff consulted the "Traffic Engineering Handbook" put out by the Institute of Transportation Engineers. They do not recommend the use of speed bumps in parking lots because they may create a hazard to pedestrians walking through the lot. Staff will be providing the remaining memorandums on Wednesday evening in addition to an updated site plan. Also at that time, a resolution will be provided for Planning Commission consideration. Please keep in mind that the Planning Commission will only take official action on the request for variance. The City Council will act on the alteration of the berm at a later date.
