Call To Order called to order by Chair Peterson at 7 : 35 p.m. on November 3 , 1993 . MEMBERS PRESENT: Commissioners Nelson, 2 . Roll Call Ruggles, Stevenson, Colleen, Miller, and Chair Peterson. ALSO PRESENT: Planner Harrington, Recording Secretary Asleson, and Councilmember Trude. Motion/Second: Stevenson/Nelson to 3 . Approval of approve the minutes of October 6, 1993 Minutes: as amended. October 6, 1993 • 6 ayes 0 nays Motion Carried . There were no resident requests or 4 . Resident comments from the floor. • Requests and Comments The applicant, Victoria Bowers, was 5 . Consideration present. of Resolution No. 368-93 Planner Harrington explained that Ms. Regarding Bowers was applying for a Conditional Conditional Use Use Permit which will allow her to keep Permit Request three dogs at her home at 8351 Groveland for Residential Road. A background check showed that no Dog Kennel at complaints related to animals have been 8351 Groveland documented by the Police Department. Road, Planning Ms. Bowers is meeting the provisions of Case No. 369- the Conditional Use Permit by providing 93 . indoor shelter for the dogs and by erecting a fence on her property to provide for control and restraint of the dogs. In one year, the Conditional Use Permit will be subject to review to ensure compliance. • Commissioner Nelson asked about the review process. ! If the inspection reveals problems, the Conditional Use Permit will be subject to further review or revocation. Motion/Second: Nelson/Stevenson to approve Resolution No. 368-93 , recommending approval of the Conditional Use Permit request for residential dog kennel at 8351 Groveland Road. 6 ayes 0 nays Motion Carried Planner Harrington explained the 6. Consideration subdivision plat had changed somewhat of Resolution from the version presented at the No. 369-93 previous Work Session. The revised plat Regarding Major contains four. lots and an outlot, and Subdivision meets all other requirements of the code Request of Doug with respect to subdivisions. Watson, • Planning Case It was noted that the applicant, Doug No. 370-93 Watson, was present. Commissioner Stevenson asked that copies of the revised plat be available for the next Golf Course Task Force meeting. Motion/Second: Miller/Ruggles to approve Resolution No. 369-93 , recommending approval of the major subdivision request of Doug Watson. 6 ayes 0 nays Motion Carried Planner Harrington reviewed memos from 7 . Consideration City Forester Wriskey, Public Works of Resolution Supervisor Ulrich, and Consulting No. 370-93 , Engineer Keehn regarding the recommended Regarding requirements for the variance at Variance Robert's Off 10, 2400 County Road H2 . Request of Robert's Off Chair Peterson asked if the applicant Ten, 2400 planned to build a fence along the south County Road H2 , line of the property. Planning Case No. 363-93 Planner Harrington replied that the Commission could either grant a variance for a six foot fence at the same time • •Mounds View Planning Commission November 3 , 1993 Regular Meeting Page 3 that the setback variance is granted or the six foot fence could be a contingency of the setback approval. The applicants, Robert and Greg Waste, were in attendance. Greg Waste indicated that he has been working with the neighbors on this and that they are in favor of the six foot high fence. Commissioner Ruggles asked what kind of a hardship statement the applicant was making. Chair Peterson stated that this case is a bit unusual in that the parking problems at Robert's are more of a hardship on the neighborhood than a physical property hardship. Commissioner Nelson expressed concerns about the storm sewer run-off - if the • added burden of water damages the storm sewer, would the City be financially responsible? . Greg Waste stated that if the City requires gating, it will actually lessen the burden on the storm sewer from existing levels. Planner Harrington clarified that this particular area of the City has a very limited storm sewer capacity. It cannot handle the run-off from 100 year storm levels; however, adding the additional parking will not add to the problem if the gating control measures are installed. Commissioner Nelson commented that while the gating control measures may decrease the water discharge rates, they will not keep out the additional pollutants that will results from the extra run-off. Commissioner Stevenson noted that the water capacity is already a problem that the City Council will have to address. The question in his mind was whether the UNIAPPROVED •Mounds View Planning Commission November 3 , 1993 Regular Meeting Page 4 Commission should be allowing extra parking at this establishment. Robert Waste stated that the bar has an occupancy maximum of 515 people. If a person assumes one and a half people per car, the added 50 spaces will still only allow enough off-street parking for 275 people. Greg Waste stated that the bar has never had a capacity crowd since the City imposed restrictions on off-street parking last year. The discussion shifted back to the issue of water management, specifically the effect that the extra impervious surface would have upon area ponding and pollution levels in the ponding. Greg Waste stated that the only time that cars will be parked on the extra spaces is on Friday and Saturday nights and that he did not feel that there would be • substantial pollutant drainage from cars to cause the denial of the variance. He is trying to solve the parking problem that occurred when the City imposed on- street restrictions. Chair Peterson asked about the Surface Water Management Plan and when Edgewood storm sewer capacity would be improved. Councilmember Trude stated that the area is listed as a high priority after the improvement of Ardan Avenue, which has actual water run-off in homes. Commissioner Ruggles questioned the principle of denying Robert's this parking area because of an inadequate drainage system. The building was there before current code - isn't it now "grandfathered"? Planner Harrington explained that since Robert's is proposing to alter their "grandfathered" condition, the alter- ation must comply with current codes. UNAPPROVED (Wounds View Planning Commission November 3 , 1993 egular Meeting Page 5 Chair Peterson asked the Commissioners for their reactions to the case thus far: Commissioner Miller felt that the City had created the hardship by restricting parking on Clearview and Edgewood. Commissioner Stevenson stated that the City created an economic hardship for the bar by responding to the residents of the neighborhood. Commissioner Nelson felt that the applicant had met all hardship criteria, but would be more comfortable if the Rice Creek Watershed District could review the proposal. Commissioner Ruggles stated that he is more concerned about Mounds View's criteria than Rice Creek's opinion. The • applicant has proven hardship; the variance should be granted. Commissioner Colleen felt that the neighborhood as a whole would be - improved by granting this variance. Chair Peterson said that there are no grounds for the variance if you consider the site alone, but that he feels there is a hardship for the entire neighbor- hood that was created by the City. The Commissioners discussed the timeline for the proposed construction of the parking versus the amount of time required for Rice Creek Watershed review. Report of Chair Course Task Force would be meeting on November 4th at 6: 00 p.m. to discuss course financing, land acquisition, and clubhouse architecture. Attendance at the October 20, 1993 Agenda Session included Commissioners Nelson, Miller, Ruggles, and Chair Peterson. Commissioners Stevenson and Colleen had excused absences. There being no further business before 10. Adjournment the Commission, Chair Peterson adjourned the meeting at 9 : 45 p.m. Respectfully Submitted, Paul Harrington City Planner • MEMORANDUM TO: PLANNING COMMISSION FROM: PAUL HARRINGTON, PLANNER . 1 DATE: November 15, 1993 SUBJECT: DEVELOPMENT PLAN/REZONING MULTI-TECH/EVEREST DEVELOPMENT, 22XX WOODALE DRIVE Everest Development, representing Multi-Tech, has made application for the following within the Mounds View Business Park: 1) Development Plan Review - Review of a proposed 59,970 square foot two-story building/facility expansion of Multi-Tech Systems to be constructed to the West of the existing Multi-Tech building. Staff has reviewed the submitted application and narrative provided by the applicant and found the request meets the intent of the Municipal Code as it applies to this request including land use, setbacks, zoning(if approved) , parking, etc. A review of the provisions for storm water control on the site is currently • underway. Staff anticipates no problems with storm water control on the site as the ponding area constructed as part of the existing Business Park was sized to handle the further development of this. property as well as the property to the immediate West. 2) Rezoning - Currently, the property located immediately West of the Mounds View Business Park is zoned B-3 , Highway Commercial (please see attached map) . The applicant is proposing that the aforementioned property be rezoned to PUD, Planned Unit Development, to accommodate the proposed use of that parcel by Multi-Tech for required parking area. Also, the rezoning would provide consistent zoning for the entire Business Park complex. I have included a very comprehensive application submittal provided by the applicant for your review. S Existing Site Conditions The Multi-Tech expansion site consists of approximately 12 . 19 acres of land, exclusive of County Road H-2 right-of-way, with approximately 870 feet of frontage on the north side of Highway 10 and approximately 650 feet of frontage on the south side of County Road H-2 . Added to the existing Multi-Tech site of approximately 5. 68 acres, the total expanded Multi- Tech site will be approximately 17 .87 acres in area. The expansion site is bordered by County Road H-2 and residential properties to the north. To the east, the site is bordered by Woodale Drive and Buildings E (Multi-Tech Systems) and F within the Mounds View Business Park. Bordering the site on the south is Trunk Highway 10, and to the west is the Saturn automobile dealership. The site also contains, in the southeast corner, Pond "C" , an aesthetic and storm water drainage pond installed during the development of Phase I of Mounds View Business Park. This pond, approximately 1. 5 acres in surface area, was sized, engineered, and located to handle all the drainage from the subject site, in addition to some of the drainage from 111 developed properties to the east. The pond is subject to an existing drainage easement. The site slopes slightly in a north to south direction and has been the subject of engineered filling to bring the site up to the approximate grades of adjacent developed properties. Current zoning of the expansion site is B-3 , Highway Commercial. The existing Multi-Tech building site is zoned P.U.D. Site Accessibility Primary access to the Multi-Tech expansion site will be via the existing driveways and curb cuts from Woodale Drive serving the existing Multi-Tech building. This access provides full site ingress and egress at the Woodale Drive intersection with Highway 10. No additional direct access from Highway 10 is currently planned for the proposed expansion. One driveway access point is proposed at County Road H-2 in the northern area of the site, for automobile traffic only. All truck traffic serving the Multi-Tech expansion site will enter and leave the site via Woodale Drive and Highway 10. • Site Development Plan - P.U.D. Concept and Development Stage Site planning for the proposed Multi-Tech expansion is driven by the desire to maintain the high corporate image of the existing Multi-Tech facility, with the addition to be consistent with the existing building in architectural style, building materials, and landscape treatment. The proposed addition would extend westerly approximately 160 feet from the west wall of the existing building, taking advantage of the excellent visibility and exposure to Highway 10, with views overlooking the ponding area at the northwest corner of Highway 10 and Woodale Drive. The total floor area of the addition is 59,970 square feet, consisting of a small (3 , 500 square foot) single level addition in the truck dock area at the northeast corner of the building, and a two-level west addition with 28, 299 square feet on the first floor and 28, 171 square feet on the second floor. The addition represents an 81% expansion of the existing building floor area of 73,724 square feet, for an expanded total building area of 133, 694 square feet. The building elevations feature continuation of the double banded window pattern of the existing building, with the addition of 111 a second two-story sky-lit atrium entrance symetrical with and identical to the main entry of the existing building. The existing building is served by 268 parking stalls. The proposed building addition will require the removal of 101 stalls. Construction of 346 new parking stalls will result in a net gain of 245 stalls serving the addition. Total parking spaces available after the addition will be 513 stalls, for a ratio of 4 . 26/1, 000. Site landscaping is to be provided consistent with the existing Multi-Tech site and the remainder of Mounds View Business Park. T Ong inc- des a variety of evergreen and ornamental species to provide year round color. The landscaped berm constructed along County Road H-2 as part of the Phase I development will be continued along the northern portion of the Multi-Tech expansion site. Site drainage will be handled by catch basins in the paved areas and piping to the existing drainage pond in the southeast corner of the site. Delivery service to the building will continue to be provided at truck docks located at the northeast corner of the existing building. The east wall of this dock area will be moved approximately 45 feet further east to allow for a 3 , 500 square foot expansion of the receiving area. No additional truck docks are proposed to be installed with the addition. 110 Other Public Decisions/Approvals Necessary for Implementation of Proposed P.U.D. Plan Rezoning of Acquisition Site from B-3, Highway_Commercial, to Planned Unit Development(P.U.D.) The so-called "Waste" property which Multi-Tech intends to acquire from Commercial Property Investments, Inc. , to accommodate its expansion is currently zoned B-3, Highway Commercial. Applicant requests that the acquisition/expansion site be rezoned from B-3 to Planned Unit Development (P.U.D. ) to accommodate Applicant's intended use of the property for office, manufacturing/production, and distribution/ warehousing. This requested rezoning is consistent with Applicant's use of its existing building at 2205 Woodale Drive, and with the current P.U.D. zoning in place for said property and the other developed properties within Mounds View Business Park. Phasing Schedule 111 The Multi-Tech Systems expansion project is proposed for construction commencing fall, 1993, as soon as necessary project approvals can be obtained, with completion by spring, 1994 . . MEMORANDUM TO: PLANNING COMMISSION FROM: PAUL HARRINGTON, CITY PLANNER DATE: November 15, 1993 SUBJECT: NEW AND USED CAR LOTS - APPLICABLE MUNICIPAL CODES At the request of the Council, Staff has put together a summary of the requirements which apply to the establishment of all new and used car lots located within the City of Mounds View. The guidelines and their corresponding Chapters in the Municipal Code are as follows: Chapter 40 "Zoning" Allows, as a permitted use, the sale of motor vehicles (both new and used) within B-3 , Highway Business and, B-4 , Regional Business Districts. The Chapter goes on to require that any principal or accessory use whichinvolves open or outdoor service, sale or rental of merchandise obtain a Conditional Use Permit for the operation. This requirement applies to most motor vehicle sales operations and leads to the need for Conditional Use Permit review. The Conditional Use Permit review would be subject to the guidelines outlined in Section 40. 25. Chapter 59 "Building Permits and Fees" Section 59. 07 Subdivision (2) requires that all proposed industrial, commercial and residential developments and expansion of existing facilities shall be subject to Planning Commission and City Council review and approval. This requirement does not apply to expansions of facilities where public utilities and streets have previously been installed. These "Development Controls" would be most applicable in the case of a new development. Chapter 109 "New and Used Cars" Chapter 109 covers the licensing of car dealerships within the City. Specifically, it outlines the criteria which must be met in order for a license to be granted for the operation. Of note is Section 109 . 02 Subdivision 3 which states that the • jA) A City Council may " . . . impose any conditions or restrictions it deems necessary or advisable in the public interest in the motion granting any license hereunder, including but not being limited to, conditions relating to the hours of operation, the lighting of the business and the installation and maintenance of shrubbery, fencing and grounds around the business" . Subdivision 4 of Section 109 . 02 goes on to add that "The Council may also impose any such conditions or restrictions by motion at any time after the issuance of a license hereunder" . The Council has directed Staff to discuss with the Planning Commission the possibility of completely eliminating Car Lots as a permitted use within the City.
