Discussion of Chapter 39, "Signs and Billboards" • MEMORANDUM i TO: PLANNING COMMISSION FROM: PAUL HARRINGTON, CITY PLANNER DATE: November 24, 1993 SUBJECT: DEVELOPMENT REVIEW/REZONING MULTI-TECH/EVEREST DEVELOPMENT, 2205 WOODALE DRIVE Based on the review conducted by the Planning Commission at their November 17, 1993 Agenda Session, Staff has drafted the attached resolutions for consideration. Two separate resolutions were necessary for the request as submitted. The first deals with the requested rezoning - please note that, as discussed, Staff has not included a portion of the legal description originally included as part of the application. Upon review of that legal description, it was determined that it is not recognized as such by Ramsey County and, therefore, cannot be included as part of the overall request. • The second resolution addresses the development review required by Chapter 59 of the Municipal Code. If you have any questions, please do not hesitate to give me a call. • MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 371-91 411 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF A REZONING REQUEST OF EVEREST DEVELOPMENT, PLANNING CASE NO. 367-91 WHEREAS, Everest Development has made application to rezone the property located South of County Road H2 and Northeast of Highway 10 from B-3, Highway Business to PUD, Planned Unit Development; and WHEREAS, the property is legally known as: That part of the Southwest Quarter of the Northwest Quarter of the Southeast Quarter lying northeasterly of U.S. Highway No. 10, and the Northwest Quarter of the Northwest Quarter of the Southeast Quarter, all in Section 8 , Township 30, Range 23 , Ramsey County, Minnesota, according to the United States Government Survey thereof; and WHEREAS, Chapter 40. 25, Subdivision A(5) , provides that the Planning Commission shall consider possible adverse effects of the proposed amendment. It further states that judgement shall be based upon, but not limited to, the following factors: • 1. Relationship to Municipal Comprehensive Plan 2 . The geographical area involved 3 . Whether such use will tend to or actually depreciate the area in which it is proposed 4. The character of the surrounding area 5. The demonstrated need for such use; and WHEREAS, the Mounds View Planning Commission has reviewed the request in relation to the aforementioned criteria; and WHEREAS, the rezoning request is consistent with the City's curren ompre ensive . - • Use Plan designation for this property which is mixed use planned unit development; and WHEREAS, approval of the request will provide for a zoning designation which is consistent with the current and proposed land use. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval of the request to rezone the property legally known as: That part of the Southwest Quarter of the Northwest Quarter of the Southeast Quarter lying northeasterly of U.S. Highway No. 10, and • the Northwest Quarter of the Northwest Quarter of the Southeast Quarter, all in Section 8 , Township 30, Range 23 , Ramsey County, Minnesota, according to the United States Government Survey thereof. ATTEST: Chairman (SEAL) Planner i • RESOLUTION NO. 372-93 411 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF THE DEVELOPMENT REQUEST OF MULTI-TECH, 2205 WOODALE DRIVE, PLANNING CASE NO.. 367-93 WHEREAS, Multi-Tech has requested City approval to construct a 59,970 square foot addition to their existing facility at 2205 Woodale Drive; and WHEREAS, Chapter 59.07 of the Mounds View Municipal Code requires that a development review be conducted for all commercial and industrial developments within the City; and WHEREAS, the Planning Commission has reviewed the following documents regarding this development proposal: 1. Planning Application dated October 29, 1993 2. Site/Landscape Plan dated October 4 , 1993 3 . Grading, Drainage and Erosion Control Plan dated October 14, 1993 4 . Exterior Elevation Plan dated October 8, 1993 • 5. Floor Plan dated October 27, 1993 6. Electrical Site Plan dated October 27, 1993 7. Illumination Distribution Plan dated October 27, 1993 ; and WHEREAS, the Planning Commission has determined that the proposal is in conformance with all applicable requirements of Chapter 40. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval of the development review request. BE IT FINALLY RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 1st day of December, 1993 . TO: PLANNING COMMISSION FROM: PAUL HARRINGTON, CITY PLANNER \k DATE: November 24, 1993 SUBJECT: NEW AND USED CAR LOTS As directed by the Planning Commission at their November 17, 1993 Agenda Session, Staff has prepared the attached resolution of recommendation to the City Council for your consideration. The resolution suggests the establishment of an 18 month moratorium on the establishment of new automobile dealerships within the City of Mounds View. The resolution cites the need for additional review of the regulations governing automobile dealerships and the possible input of the Focus 2000 project teams as reasons for establishing the moratorium. Please note that the resolution, as drafted, does not suggest the elimination of any existing automobile dealership currently licensed to operate within the City, nor does it preclude the expansion of those facilities as allowed by Municipal Code. 411 MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 373-93 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF. MINNESOTA RESOLUTION RECOMMENDING THE ESTABLISHMENT OF A MORATORIUM ON NEW AND USED CAR LOTS WITHIN THE CITY OF MOUNDS VIEW WHEREAS, at the direction of the City Council, the Mounds View Planning Commission has conducted an in-depth review • of the requirements for establishment of new and used car lots within the City; and WHEREAS, the Planning Commission review included review of Chapters ' 40, 59 and 109 of the Municipal Code; and WHEREAS, the Planning Commission has determined that there exists a need for further review and possible amendment of the existing regulations governing the operation of new and used car lots within the City; and • WHEREAS, the Planning Commission recognizes the fact that groups have been formed as part of the Focus 2000 project to study issues that are facing the City including land use and business establishment;. and WHEREAS, the findings of these study groups may provide direction for both the Planning Commission and City Council on issues of land use within the City; and WHEREAS, the Planning Commission wishes to incorporate these_tindings in their further review of the new and used car lot issue. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends the placement of an 18 month moratorium on the establishment of all new and used car lots within the City of Mounds View. BE IT FURTHER RESOLVED that the Planning Commission does not intend this moratorium to prevent the existing or expanded operation of all currently licensed new and used car lots within the City. Resolution No. 373-93 411 Page Two BE IT FINALLY RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes. TO: PLANNING COMMISSION FROM: PAUL HARRINGTON, CITY PLANNER ‘\ DATE: November 24, 1993 SUBJECT: 1994 MEETING SCHEDULE CALENDAR The attached resolution and calendar are provided for consideration by the Planning Commission. Each year the Planning Commission adopts a calendar by resolution which sets all meeting dates for the upcoming year. In addition, dates are set for the submission of planning application materials. This ensures that Staff has proper time to review and comment on requests which are submitted. MOUNDS VIEW PLANNING COMMISSION • RESOLUTION NO. 374-93 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA ESTABLISHING MEETING AND TIMELINE SUBMISSION DATES FOR 1994 WHEREAS, the Mounds View Planning Commission will be holding two business meetings per month during 1994 with the exception of Special Meetings; the first being a regular meeting and the second an agenda session; and WHEREAS, the Planning Commission has requested to review regular business meeting agenda items at their agenda session, a minimum of two weeks prior to the regular business meeting; and WHEREAS, developers, citizens or other interested parties should be advised of deadlines for materials used by staff to prepare a report and used by the Planning Commissioners to decide on a particular development issue; and WHEREAS, a display of meeting dates and submission deadline dates be established to provide an orderly system for use by the Planning Commission, staff and general public; NOW,. THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Mounds View establishes meeting and submission timetable dates setting deadlines for submission of materials for agenda sessions of the Planning Commission and also setting the dates of the regular business meetings and agenda sessions; BE IT FURTHER RESOLVED that Exhibit 1 becomes an integral part of this resolution; BE IT FINALLY RESOLVED that if the Planning Commis- sion is required to or desires to hold special meetings, they will do so in accordance with State law, Code requirements and the Bylaws.
