SUBJECT: REZONING/DEVELOPMENT REVIEW/MAJOR SUBDIVISION
C.G. HILL, PLANNING CASE NO. 376-94
Following discussion at the April 20, 1994 Planning Commission
meeting, Staff has drafted the attached resolution for
consideration by the Commission. Please note that reference to
parking stalls with a minimum 20 foot depth is made in the
resolution. As you will recall, the site plan submitted by the
applicant showed stalls with 18 foot depths. I have also included
a standard provision in the resolution which requires Park
Dedication Fees to be paid. All other provisions of the Municipal
have been met by the applicant.

STATE OF MINNESOTA
RESOLUTION RECOMMENDING APPROVAL OF THE REZONING/DEVELOPMENT
REVIEW/MAJOR SUBDIVISION REQUEST OF C.G. HILL,
MOUNDS VIEW BUSINESS PARK EAST, PLANNING CASE NO. 380-94
WHEREAS, C. G. Hill has requested City approval for a
Rezoning, Development Review and Major Subdivision for their
development on the Mounds View Business Park East site; and
WHEREAS, the proposal is subject to the requirements
contained in Titles 1000, 1100 and 1200 of the Mounds View
Municipal Code.; and
. WHEREAS, the Planning Commission has reviewed the
following documents regarding this development proposal:
1. Planning Application dated April 14 , 1994
2 . Site Plan dated April 1, 1994
3 . Landscape Plan dated April 1, 1994
4 . Building Elevations dated April 1, 1994
5. Grading, Drainage, Utility and Erosion Control
Plan dated March 23 , 1994
6. Preliminary Plat of Mounds View Business Park East.
• Building M Addition, dated March 30, 1994
WHEREAS, the Planning Commission has determined that
the proposal is in conformance with all applicable requirements
of the Mounds View Municipal Code.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends approval of the Rezoning,
Development Review and Major Subdivision request of C.G. Hill
contingent upon the following:

paid per Title 1200 of the Mounds View Municipal
Code.
2) Parking stalls on the site shall be a minimum of 20
feet in depth per Municipal Code.
BE IT FINALLY RESOLVED that the Planning Commission
directs Staff to forward this resolution to the City Council
prior to approval of the minutes.

SUBJECT: CONDITIONAL USE PERMIT/VARIANCE
MICHAEL HEGLAND, PLANNING CASE NO. 374-94
Based on the discussions held at the April 20, 1994 Planning
Commission Meeting, Staff has prepared the attached resolutions for
consideration by the Commission.
The resolutions - one approving the request, the other denying it -
include the language contained in the Municipal Code regarding
Variance and Conditional Use Permit requests. The Commission may
want to modify the language contained in the Resolutions, however,
they do provide a good starting point for discussion.

CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION APPROVING A VARIANCE TO ALLOW FOR AN OVERSIZE
ACCESSORY STRUCTURE AT 7604 SPRING LAKE ROAD
PLANNING CASE NO. 374-94
WHEREAS, the Mounds View Planning Commission has
reviewed the request of Michael Hegland for a variance to allow
an accessory structure in excess of the square footage allowed
for with the issuance of a Conditional Use permit; and
WHEREAS, the applicants property is requirements
setforth in Title 1100 of the Mounds View Municipal Code; and
WHEREAS, the Planning Commission has reviewed the
criteria used to evaluate all variance requests; and
WHEREAS, the applicant has presented a hardship
statement to the Planning Commission; and
• WHEREAS, the literal interpretation of the provisions
of this code would deprive the applicant of rights commonly
enjoyed by other properties in the same district under the terms
of this Code; and
WHEREAS, the special conditions of the property do not
result from the actions of the applicant; and
WHEREAS, granting the variance would not confer special
privileges on the applicant that are not enjoyed by other
property owners in the same district; and
WHEREAS, the variance requested is the minimum
necessary to alleviate the hardship.

Planning Commission approves the request of Michael Hegland for a
484 square foot accessory building contingent upon the following:

SUBJECT: REZONING/ DEVELOPMENT REVIEW
WESTMINSTER CORPORATION, PLANNING CASE NO. 375-94
At the April 4, 1994 Planning Commission meeting, the Commission
agreed, in principal, to the request by the Westminster Corporation
for an 82 unit Senior Housing Project to be located on County Road
I between• Highway 10 and Silver Lake Road. At that time, the
Commission directed Staff to draft a resolution of approval for the
project with the understanding that the final issue to be resolved
- available parking on the site - would be discussed at the time
of formal action. A second requirement of the Commission was that
the applicant receive any necessary approvals from the Rice Creek
Watershed District (RCWD) . Following discussions with the RCWD,
the applicant has completed a redelineation of the wetland
surrounding the project site and found that there is a slight
. impact to what RCWD considers wetland area. Because of this, the
applicant has made some minor modifications to the overall site
plan. A copy of the modified site plan will be provided Wednesday
Evening. Also, Staff will be drafting a resolution for
consideration which will provide a starting point for discussion on
the modified site plan.
