SUBJECT: CONDITIONAL USE PERMIT REQUEST
MICHAEL HEGLAND, 7604 .SPRING LAKE ROAD
Michael Hegland has made application for a Conditional Use Permit
to allow the construction of a 400 square foot accessory building
on his property at 7604 Spring Lake Road. The request, as
presented, meets all requirements of the Municipal Code.
The Planning Commission has reviewed this item and directed Staff
to draft the attached Resolution for consideration. If you have
any questions, please do not hesitate to give me a call.

CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION RECOMMENDING APPROVAL OF THE REQUEST BY MICHAEL
HEGLAND FOR A CONDITIONAL USE PERMIT TO ALLOW AN OVERSIZED
ACCESSORY BUILDING AT 7604 SPRING LAKE ROAD,
PLANNING CASE NO. 374-94
WHEREAS the Mounds View Planning Commission has reviewed
the request of Michael Hegland for a conditional use permit to
allow an oversized accessory building at 7604 Spring Lake Road; and
WHEREAS, the Planning Commission has reviewed the Zoning
Code and recognizes that the Code allows up to a 400 square foot
accessory building with a conditional use permit; and
WHEREAS, the proposed accessory building is 400 square
feet which is within the square footage allowed with a conditional
use permit.
• NOW, THEREFORE BE IT RESOLVED that the Mounds View
Planning Commission recommends to the City Council approval of the
requested Conditional Use Permit contingent upon the following:
1. The Conditional Use Permit is recorded with Ramsey
County.
2 . The building shall be maintained to provide a uniform
appearance with the dwelling unit.
3 . The accessory building does not exceed 400 square feet.
4 . The only vehicles that may be stored in the accessory
building are licensed collector vehicles.
5 . There shall be no improved driving surface leading up to the
accessory building.

BE IT FINALLY RESOLVED that the Planning Commission
directs Staff to forward this resolution to the City Council prior
to approval of the minutes.

SUBJECT: DEVELOPMENT REVIEW - PRIME BUILDERS
2856 HIGHWAY 10, PLANNING CASE NO. 383-94
Prime Builders has made application for a Development
Review/Residential PUD for their proposed 22 unit townhome project
at 2856 Highway 10 . The Mounds View Planning Commission reviewed
this item at their May 18 , 1994 meeting and found the request in
conformance with applicable City Codes. As directed by the
Commission, Staff has drafted the attached Resolution for
consideration on this matter. Please note that the Resolution
contains contingencies which must be met prior to the project
moving forward. These contingencies are a result of discussions
held at the May 18 meeting.

RESOLUTION RECOMMENDING APPROVAL OF THE REZONING/DEVELOPMENT
REVIEW REQUEST OF PRIME BUILDERS, PLANNING CASE NO. 383-94
WHEREAS, Prime Builders has requested City approval for
a Rezoning and Development Review for their proposed 22-unit
Townhome development at 2856 Highway 10; and
WHEREAS, the proposal is subject to the requirements
contained in Titles 1000, 1100 and 1200 of the Mounds View
Municipal Code; and
WHEREAS, the Planning Commission has reviewed the
following documents regarding this development proposal:
1. Planning Application dated April 29 , 1994
2 . Site Plan dated April 28 , 1994
3 . Grading and Utility Plan dated April 28 , 1994
4 . Building Elevations and Floor Plans
• WHEREAS, the Planning Commission has determined that
the proposal is in conformance with all applicable requirements
of the Mounds View Municipal Code.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends approval of the Rezoning and
Development Review request of Prime Builders contingent upon the
following:
1) Storm Water Control Plans are submitted and approved by the
City Consulting Engineer.
2) The City is provided with a written statement, signed by
representatives of the Knollwood Green Townhome Association,
allowing the applicant to connect to and utilize the
emergency access on the South end of the Knollwood Green
property.

SUBJECT: VARIANCE - MAJOR VIDEO CONCEPTS, INC.
MOUNDS VIEW SQUARE, PLANNING CASE NO. 384-94
Major Video Concepts, Inc. has made application for a variance to
allow 238 square feet of sign text at their proposed facility in
Mounds View Square Shopping Center. The Municipal Code only allows
100 square feet of sign area per business occupant of the Shopping
Center.
The applicant proposes to install a wrap-around awning sign on the
Southeast corner of the Center (the old Country Club Market site) .
The total text area on the awning would be 238 square feet -
equally split among the two facias.
• The Planning Commission has reviewed this request and directed
Staff to draft the attached Resolution. Please note that the
Resolution allows for 185 square feet of sign area. This number
was decided upon by the Commission based on the demonstrated need
and the relationship in size to the allowed signage on the
Westernmost end of the Mounds View Square Complex.

STATE OF MINNESOTA
RESOLUTION APPROVING SIGN AREA VARIANCE REQUEST BY
MAJOR VIDEO CONCEPTS, INC. FOR THE PROPERTY LOCATED AT
2537 HIGHWAY 10 , PLANNING CASE NO. 384-94
WHEREAS, the Mounds View Planning Commission has
reviewed the request of Major Video Concepts, Inc. for a variance
to allow the placement of 185 square feet of sign area at 2537
Highway 10 where only 100 square feet is allowed by Municipal
Code; and
WHEREAS, the Planning Commission has reviewed the
criteria used to evaluate all variance requests; and
WHEREAS, the applicant has presented a hardship
statement to the Planning Commission; and
WHEREAS, the literal interpretation of the provisions
411 of this code would deprive the applicant of rights commonly
enjoyed by other properties in the same district under the terms
of this Code; and
WHEREAS, granting the variance would not confer special
privileges on the applicant that are not enjoyed by other
property owners in the same district; and
WHEREAS, the variance requested is the minimum
necessary to alleviate the hardship.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View

SUBJECT: CONDITIONAL USE PERMIT - AUTO CENTRAL
2975 HIGHWAY 10, PLANNING CASE NO. 379-94
Auto Central, 2975 Highway 10, has made application for a
Conditional Use Permit to allow the operation of a minor auto
repair business at their existing facility. Currently, the
applicant operates an automobile dealership on the property.
The request, if approved, would allow the applicant to conduct
minor auto repair (as defined by the Municipal Code) on the
property. The Commission has reviewed the request and found it to
be in conformance with those sections of the Municipal Code which
govern minor auto repair. Based on their review, the Commission
asked Staff to draft a resolution containing the appropriate
language to address the proposed use. The requested resolution is
attached for your consideration. Please note that, as discussed,
Staff has included a letter provided as part of the original
application as Exhibit A. Also, the parking plan for the operation
is referenced as Exhibit B.

COUNTY OF RAMSEY .
STATE OF MINNESOTA
RECOMMENDATION TO THE CITY COUNCIL APPROVING THE
CONDITIONAL USE PERMIT REQUEST BY AUTO CENTRAL,
2975 HIGHWAY 10, PLANNING CASE NO. 379-94
WHEREAS, Auto Central has requested City approval to
operate a minor auto repair facility at 2975 Highway 10; and
WHEREAS, the Mounds View Municipal Code allows minor
auto repair facilities in a B-3 , Highway Commercial District; and
WHEREAS, the Planning Commission has reviewed the
following documents regarding this proposal:
a) Site plan received February 8 , 1993 , revised May
18 , 1994
b) Letter of request dated May 10, 1994
WHEREAS, the Planning Commission has determined that
the proposal is in conformance with the requirements of the
Municipal Code, specifically Title 1200 .
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends approval of the conditional use
permit with the following conditions:
1 . There shall be no outside loudspeakers at this
facility.
2 . Only minor repairs and maintenance will be allowed
on sitc between—the hours of 7 : 00 a .m_ and 9 : 00
p.m. Monday through Saturday and between 11: 00
a.m. and 5 : 00 p.m. Sunday.
3 . No major engine overhauls, transmission
replacement, or body work shall be allowed on the
site.

4 . The hours 'of operation of the facility shall not
exceed 6 : 00 a.m. to 10: 00 p.m. Monday thru
Saturday and 10: 00 a.m. to 6: 00 p.m. Sunday.
5. Outside merchandising of accessories shall be
allowed only with prior City approval.
6. The conditional use permit shall be reviewed after
one year to ensure that applicable conditions
imposed on the site effectively control the impact
of the site operation on the community.
BE IT FINALLY -RESOLVED that the Planning Commission
directs staff to forward this resolution to the City Council
prior to approval of the minutes.
