Call To Order called to order by Chair Peterson at 7 : 30 p.m. on July 6, 1994 . MEMBERS PRESENT: Commissioners Nelson, 2 . Roll Call Ruggles, Miller, Stevenson, Colleen, and Johnston. Chair Peterson had an excused absence. ALSO PRESENT: Planner Harrington and Recording Secretary Benesch were also present. Motion/Second: Ruggles/Miller to 3 . Approval of approve the minutes of June 1, 1994 . Minutes: June • 1, 1994 6 ayes 0 nays Motion Carried There were no resident requests or 4 . Resident comments from the floor. Requests and Comments Planner Harrington reviewed the 5 . Consideration conditional use permit request by Vince of Resolution Meyer reminding the Planning Commission Nos. 389-94 that Mr. Meyer is requesting to Regarding the construct an oversized garage. Mr. Conditional Use Meyer is requesting 976 square feet (the Permit Request Code allows up to 1264 square feet with of Vince Meyer, a conditional use permit) . 8380 Spring Lake Road, Planner Harrington informed the Planning Case Commission that Mr. Meyer has already No. 381-94 constructed the garage. He also noted that the additional permit fees for the larger garage have been paid. Consideration Planning Commission that this item had of Resolution been discussed at their June 15th Agenda No. 390-94 Session. He reviewed Resolution No. Regarding 390-94 reading aloud the contingencies Conditional Use stated therein. He also informed the Permit Request Planning Commission that the applicant of Rodney & would be required to submit a Victoria Certificate of Survey showing side yard Schultz , 5505 setbacks . Quincy Street, Planning Case Motion/Second: Miller/Johnston to No. 382-94 approve Resolution No. 390-94 , recommending approval of the conditional use permit request of Rodney and Victoria. Schultz , 5505 Quincy Street. 6 ayes 0 nays Motion Carried • Planner Harrington reviewed this case 7 . Consideration and explained that the applicant, Harold of Resolution Ihnot, was requesting a variance to No. 391-94 allow for a second driveway for health Regarding reasons . Variance Request of The Planning Commission discussed the Harold Ihnot, contingencies that would be included in 7900 Greenfield the resolution. It was the consensus of Avenue, the Planning Commission that the Planning Case variance shall become nu31 and void 10 N . years after its adoption, a copy shall be recorded with Ramsey County, and the width of the driveway shall not exceed 12 feet. It was also noted that the property owner would be responsible for the removal of the driveway upon expiration of the Sunset clause. Planner Harrington distributed the proposed resolution to the Planning Commission. Motion/Second: Stevenson/Colleen to • approve Resolution No. 391-94 , recommending approval of the variance UNAPPROVED Mounds View Planning Commission July 6, 1994 0 Regular Meeting Page 3 request of Harold Ihnot, 7900 Greenfield Avenue. Discussion ensued regarding the variance request. It was noted by the Planning Commission that variances were not presidential. The Planning Commission was concerned about the clause in the resolution which stated that granting the variance would not confer special privileges on the applicant that are not enjoyed by other property owners in the same district, and asked that this statement be removed from the resolution. They also requested that the statement indicating that the literal interpretation of the provisions of this code would deprive the applicant of rights commonly enjoyed by other properties inthe same district under the terms of the code also be removed . from the resolution. The Planning Commission was concerned about the location of the proposed driveway'. Planner Harrington indicated that the curb cut would be located 40 to 50 feet east of the present berm curb. Planner Harrington reminded the Planning Commission that this resolution would require a 2/3 vote for its adoption. 5 ayes 1 nay Motion—Garricd Ken Sjodin, representing Citywide 8 . Consideration Developers, Inc. , was present. of Resolution No. 392-94 Planner Harrington reminded the Planning Regarding Major Commission that this item was discussed Subdivision at their June 15th Agenda Session. Request of Planner Harrington informed the Citywide Commission that he had contacted Short- Developers, Elliott-Hendrickson, the City's XXXX Highway Consulting Engineers, regarding the 10 , Planning issue of storm water drainage. Case No. 387-94 Planner Harrington discussed the contingencies noted in the proposed . Mounds View Planning Commis' `bn�� L ' July 6, 1994 "' Regular Meeting Page 4 resolution. A third contingency regarding Park Dedication fees was added. The Planning Commission expressed concern about the upkeep of the outlot. Planner Harrington explained that the City would keep control of the outlot to prevent rank growth on the property. Planner Harrington read aloud proposed Resolution No. 392-94 . He noted that the legal descriptions will be attached to the resolution. The applicant informed the Commission that the date of the most recently revised plat was June 10 , 1994 , and the most recent Utility Plan is dated June 15th. Motion/Second: Ruggles/Johnston to • recommend approval of Resolution No. 392-84 , recommending approval of the Major Subdivision request of Citywide Developers, Inc. 6 ayes 0 nays Motion Carried Planner Harrington informed the applicant that a preliminary hearing would be held at the July 25th City Council meeting. Planner Harrington outlined the request 9 . Consideration of Wolf and Associates to construct a of Resolution 9 , 566 square foot addition to their No. 393-94 existing facility at 4860 Mustang Regarding Circle. Consideration of this case. He reminded the Planning of Resolution Commission that Church Upon the Rock was No. 394-94 granted a conditional use permit in 1988 Regarding to allow for the continued use of a Conditional Use temporary accessory structure on Permit residentially zoned property. Planner Harrington introduced to the 11 . Staff Report Commission and welcomed aboard Joyce Pruitt, Planning Associate. Commissioner Stevenson informed the Planning Commission that the name of the new golf course is "The Bridges at Mounds View" . There being no further business -before 13 . MEMORANDUM TO: PLANNING COMMISSION FROM: PAUL HARRINGTON, PLANNER DATE: July 15, 1994 SUBJECT: VARIANCE REQUEST, TOWNSEDGE TERRACE 5001 OLD HIGHWAY 8 In March of this year, Townsedge Terrace Manufactured Home park made application with the City for a variance to allow the construction of a 2000 square foot storm shelter on their property at 5001 Old Highway 8 . The requested variance would allow construction of the Shelter at an 11 foot setback where a 30 foot setback is required by the Municipal Code. Following discussion at the Planning Commission level , representatives of the Park were asked to explore other options relating to the siting of the structure on the property. The attached letter dated July 13 , 1994 , was provided by the applicant in response to that request. Staff has also contacted the Mounds View Police Department to get their input on the location of the shelter. It is their opinion that any on-site shelter is a vast improvement over the current emergency shelter plan which requires that the residents of the Park travel to City Hall to obtain shelter. I have included a copy of all materials originally received as part of this application as well as the July 13 , 1994 letter. A copy of the site plan will be available Wednesday Evening. • N. We have considered all the possible locations on the property and have determined that the proposed • site is the only feasible site . The only other available land is the playground area. This is a small area and would require the removal of all the playground equipment . There is also no available parking at this location. PAUL, PLANNING CASE NO. 389-94 Darwin Lindahl, representing Saturn of St. Paul, has made application for a Development Review/C.U.P. Amendment to allow the expansion of the Saturn Car Dealership at 2375 Highway 10. In 1992 , Saturn was granted a Conditional Use Permit for their current operation. At that time, a portion of the property upon which the facility is located was left unimproved for possible future development as an extension of Jackson Drive to the North. The extension of Jackson has since been deemed unnecessary. Saturn has now approached the City with a request to utilize this unimproved area of their property to meet current needs and demands of the • • facility. The proposed expansion would add approximately 45 parking spaces for display purposes, relocate existing landscaping to the East line of the site and install an additional row of lighting. Staff has had a preliminary meeting with the applicant and found all items in the request in order. A copy of the plan has been sent to the City Consulting Engineer for review and comment. All other requirements of the Municipal Code have been met by the applicant As you will recall, the City passed Ordinance No. 533 in March of this year which placed a moratorium on the location of any new car dealership operations within the City for a period of 18 months. This moratorium did not, however, preclude the continued use or expansion of any currently licensed facility in the City. Therefore, this request is allowed to be submitted and is subject to current requirements contained within the Municipal Code. INTRODUCTION Saturn of Saint Paul has been serving Mounds View area customers from their Mounds View Facility since the summer of 1992, and are planning to expand their vehicle display lot in order to better service their customers. This proposal requests site plan approval by the City of Mounds View for this vehicle display lot expansion project. IL GENERAL EXPANSION PLAN A. Site Conditions The proposed expansion is a 60 foot wide strip of land along the entire east side of the property. During the original plan approved by the City of Mounds View in 1992 this land was set aside for a future drive connecting Highway 10 with County Road H2 which is no longer under consideration. The total site area (less County Road H2 easement) is approximately 2.488 acres. B. Land Use/Density The entire site is zoned B-3 (highway business district) which motor vehicle sales and minor service is a permitted use with a conditional use permit under the present Mounds View zoning ordinance. A conditional use permit was issued for this use in 1992. The building coverage will remain at 6.2 percent of the total site area. C. Setbacks The required lot setbacks are: 30 feet along Highway 10 20 feet along County Road H2 10 feet on east side yard. The proposed vehicle display lot expansion will meet all the required setbacks. • The signage setbacks for the relocated monument sign will be met. 1of3 • D. Project Description The proposed vehicle display lot expansion consists of: 1. Overlaying the existing pavement with a 2 inch bituminous wear course including new concrete curb and gutter. 2. Relocating existing trees and scrubs from the present east edge of lot to the east property line. 3. Installation of new site lighting poles and fixtures. All existing site conditions that are not effected by the lot expansion will remain, which includes building, site entrances, landscaping and site lighting. E. Parking On-site parking requirements for this facility were meet during the original plan submitted in 1992. This project will not effect the required parking spaces for customer or service. Total parking for customers and service will remain as approved. The total spaces for vehicle display will be increased from 109 to 154, a net gain of 45 spaces. The total area of impervious surfaces for the area included in the expansion will be reduced by approximately 17 percent from its present condition. All parking spaces are 9 feet x 20 feet with drive aisles of 25 feet at locations required for emergency vehicles, and 23 feet wide drive aisles within vehicle display lot. All parking areas will have bituminous surfacing with concrete curb and gutter. F. Grading/Drainage Presently the north three-quarters of the site drains onto County Road H2, with the remaining south one-quarter drains into the Highway 10 drainage ditch. The drainage of the proposed lot expansion will follow the present drainage directions, with curb cuts and concrete spillways sized to • accommodate the required rate of storm water flows. 2 of 3 • G. Landscaping The landscaping plan for this expansion is to remove the existing trees and scrubs along the existing east vehicle display lot and relocate the same to the new east edge of the vehicle display lot. H. Site Lighting The proposed site lighting will be identical to that of the existing site lighting, both in design and type of light source. I. Signage The project signage will consist of relocating existing monument sign to a new location. Formal application for sign permit will occur at a future date. III. CONSTRUCTION SCHEDULE Saturn of Saint Paul anticipates to start construction of this vehicle display lot expansion as soon as city approval is obtained; with completion occurring in early September 1994. IV. CONCLUSION - - The proposed expansion project is consistent with the goals and general policies of the City of Mounds View. The purpose of this letter is to explain the need for this variance. I apologize for failing to apply for a permit at the time the sidewalk • was installed, and my contractor has agreed to remove or modify it as the City determines. However, I believe there are important reasons why a variance is justified. They have to do with access and with safety. My home is a corner property. It faces Irondale Road, and my address and mailbox are on Irondale. My driveway and garage face County Road H. When the house was built in 1963, sidewalks from the front and side doors were routed to the driveway, and hence onto County Road H. No sidewalk was installed from the house to Irondale road. Since the home was built, traffic on County Road H has increased significantly, making access into and out of the driveway more difficult. One reason the new sidewalk is necessary is because access to the house from Irondale has become more essential. Not only do my wife and I use the Irondale access daily for retrieving the mail, but package and newspaper delivery is always from that side of the house. Guests to our home, and anyone going door to door, regularly use this approach. • The sidewalk provides a safe, level, and solid path to the house from Irondale. This is especially important during winter, when we must • maintain a shoveled path across the yard to Irondale. It is just not possible to shovel a snow-free path across the lawn. Some snow and ice always remain on the path. The sidewalk can be shoveled clear of snow. Also, during spring thaws, the path across the yard from Irondale to the house becomes muddy. This can not only be a nuisance, but also a hazard. As a homeowner, I know I have a responsibility to provide safe access to and from my property. I believe the sidewalk adds not only convenience and value to my home, but that it offers a safe access for the most frequently used approach. Finally, I have a more specific and personal reason for installing the sidewalk and the steps to the street. My wife's parents live nearby, and are frequent guests in our home. They have increasing difficulty crossing the yard to the house from Irondale during the winter. In particular, it is the rise from the level of the curb to the level of the front yard that presents the biggest hazard. This short slope is always slippery during the winter and spring. By installing the sidewalk with two steps down this slope, my wife and I hoped to make the path safer for them. To avoid problems with snow plowing, the steps are set back from the curb and the final section of the sidewalk is laid at curb level. The set-back distance is the same as that of some of the street signs along that side of Irondale. I have included a photo of the sidewalk to illustrate the drop from my yard to the street, and how the steps are set back. I gave additional photos to Rick Jarson when I spoke to him about the sidewalk, and I believe he passed these on to you. Thanks for your assistance on this application for a variance.
