Call To Order called to order by Chair Peterson at 7 : 35 p.m. on August 3 , 1994 . MEMBERS PRESENT: Commissioners Nelson, 2 . Roll Call Johnston, Miller, Ruggles, Colleen, Stevenson and Chair Peterson. ALSO PRESENT: Planner Harrington and Recording Secretary Benesch were also present. Motion/Second: Miller/Johnston to 3 . Requests and Comments (Commissioner Ruggles arrived at 7:38 p.m.) Planne-r Harrington reviewed the variance 5 . Consideration request by Townsedge Terrace Mobile Home of Resolution Park. The Planning Commission inquired as to using the old water tower property for construct a storm shelter. Planner Harrington informed the Commission that this property has two water mains running through it which precludes any construction on the site. 5 ayes 0 nays Motion Carried (Commissioner Colleen n arrived at 7:40 p.m . ) The applicant, Mr. David Tanner, was 6 . Mr. Harrington reviewed of David Resolution No. 396-94 explaining that Tanner, 7935 the applicant is requesting a Sunnysdie Road, conditional use permit to allow for an Planning Case oversized garage. He also explained No. 388-94 that in order for the applicant to keep the existing shed on his property, the proposed garage could not exceed 1, 000 square feet. Planner Harrington clarified that the 1, 264 maximum square footage allowed by Code is the combination of both garage and shed areas. Motion/Second: Nelson/Ruggles to approve Resolution No. 396-94 , recommending approval of the conditional use permit request of David Tanner, 7935 Sunnyside Road. Planner Harrington explained that any addition to an existing garage is defined, by Code, as garage area. Planner Harrington informed the applicant that this item would be on the August 22nd City Council agenda. (Mr. Harrington also indicated the date of the City Council meeting may be changed to August 29th) . (Commissioner Stevenson arrived at 7:47 p.m.) Mr. Jim Price, representing the 7 . Consideration applicant, was present. of Resolution No. 397-94 Planner Harrington informed the Regarding Commission that the applicant, Saturn of Development St. Paul, has found the need to increase Request of its Mounds View facility and reminded Saturn of St. them that this case was reviewed at the Paul, 2375 Planning Commission's July 20th meeting. He also indicated that this item is currently being reviewed by the Engineer to assure proper drainage off site. Motion/Second: Ruggles/Stevenson to approve Resolution No. 397-94 , recommending approval of the development review request of Saturn of St. Paul, 2375 Highway 10 . 7 ayes 0 nays Motion Carried Planner Harrington informed the applicant that this item would be on the August 22nd (or August 29th) City 410 Council Agenda . Consideration of Resolution Planner Harrington reviewed the variance No. 398-94 request by Mr. Bogie. He explained that Regarding the applicant is requesting a variance Variance to construct an attached garage with a Request of setback of 2 feet from the property line Bruce Bogie, when 5 ' is required by Code. Mr. 2572 Ardan Harrington explained that the lot was Avenue Planning subdivided after the construction of the Case No. 390-94 house which now sets on the lot in an unique position. The applicant indicated that he__has discussed his situation with the affected neighbor who indicated that he had no objections . Commissioner Stevenson informed the Commission that he made a site inspection of the property and also spoke with the neighbor in question who indicated that he is opposed to the 2 ' setback request. Mr. Stevenson also demonstrated that if the garage was constructed, the Lilac bushes now existing on the west side of the garage would need to be cut in order to walk on that side. The driveway code was mentioned by the Planning Commission which requires that written permission be obtained by an adjaccnt property owner for construction of a (temporary) driveway closer than 5 feet to the property line but not less than one foot. It was also noted that a concrete driveway could be not closer than 5 feet to the property line. The Commission briefly discussed alternative locations for the garage on the lot. (It was also noted that the property was subdivided prior to adoption of the setback ordinance. ) The applicant informed the Commission that it would not be practical to have the 411 garage on the other side of the house. Mounds View Planning Commission August 3 , 1994 Regular Meeting Page 5 Motion/Second: Stevenson/Ruggles to recommend approval of Resolution No. 3398-94 , recommending denial of the variance request of Bruce Bogie, 2572 Ardan Avenue. 7 ayes 0 nays Motion Carried Planner Harrington informed the applicant that this item would be on the August 22 (or August 29) City Council agenda. At this time Mr. Richard Gerlach of the Townsedge Terrace Tenants Association, 2200 Kingsway Lane, was identified. He indicated that he was present in favor of the variance request of Townsedge Terrace . He informed the Planning Commission that he and the tenants • association have been working for three years to get a shelter facility for the residents of the park. Planner Harrington distributed the draft 9 . Staff Report of the Nuisance Ordinance (Nuisances, Animals and Refuse) . Mr. Harrington requested that the Planning Commission review the ordinance and make a list of comments to be discussed in two weeks (at their agenda meeting) which would then bP forw- __ Commissioner Ruggles informed Mr. Harrington that he would be leaving for vacation on the 9th of August and returning in October. Planner Harrington informed the Commission that Colonial Village would be before the Planning Commission again in September. He also informed them that Roger Miller, 5064 Irondale Road, who had requested a variance to allow concrete steps within the right-of-way 110 is planning to move the steps back and therefore withdrawing his variance request. Mr. Harrington indicated that Mounds View Planning Commission August 3 , 1994 •Regular Meeting Page 6 he and the Public Works Director will be inspecting the site to verify that the correction to the sidewalk/steps is acceptable. Commissioners Colleen and Johnston had excused absences. There being no further business before 11. Adjournment the Commission, Chair Peterson adjourned the meeting at 8 : 26 p. m. • Respectfully Submitted, Paul Harrington Community Development Coordinator • MEMORANDUM TO: PLANNING COMMISSION FROM: PAUL HARRINGTON, COMMUNITY DEVELOPMENT COORDINATOR DATE: August 15, 1994 SUBJECT: VARIANCE, 5299 CLIFTON DRIVE LARRY AND SUSAN POTTS, PLANNING CASE NO. 394-94 Larry and Susan Potts have made application for a variance to allow the construction of an addition to their home which will be four (4) feet from an existing garage also located on the property. Chapter 1106. 03 Subdivision 1 (c) of the Mounds View Municipal Code states in part that no accessory building shall be closer than. six (6) feet from any other building or structure on the same lot. I have checked with the Mounds View Building Inspector and found that the Uniform Building Code (UBC) - which is adopted by reference in the Municipal Code - allows for structures on the same lot to be located at less than a six (6) foot setback with proper IIIfireproofing of walls. However, because the Municipal Code specifically lists the six (6) foot setback requirement, a variance would be necessary for the construction of the addition as proposed. We moved here in the summer of 1987 and now have three children --w under the age of five. We bought a home that we., could afford on one income so we could have a stable family with the mother mostly staying at home. Our home has only one closet on the first floor and it is located in a bedroom. We need a mud room, bigger dining space. and another bedroom. We considered building off the • back into the backyard, but the cost would be $40,000 and we would still need a mud room for boots and Jackets. By adding to the side of our home, off the back door, we will be meeting all of our needs for about $25,000. We want the :dimensions of * the addition to be 12 feet x 22 feet with basement underneath and a 12 x 12 bedroom above it. We are asking for a variance for our addition to be 4 feet in front of the garage so we can get the maximum length possible. We are limited to a 12 foot width by our driveway. 7936 Greenfield has a very similar addition to the one we want to build and it it 5 feet in front of their garage. - • a - eld also have additions very close to the garage. Four addresses on our block that have 'additions close to their garage are 5337 Clifton Drive, 5352 Clifton Drive, 5338 Clifton Drive, and 5293 Clifton Drive. The building code in Bloomington states a house must be three feet from a garage, and also the universal building code. The Mounds View Municipal Code allows garages up to 1264 square feet with the issuance of a Conditional Use Permit. Mr. Newman's request meets all requirements of the Municipal Code for issuance of the Permit, however, the Code does stipulate that in the event a garage exceeds 1000 square feet (which the applicants' will with the proposed addition) no other accessory buildings shall be allowed on the property (Chapter 1106. 04 Subdivision 6 c) . Currently, an 8'x 8 ' • accessory building is located on the property. In order to meet the intent of the Code, the existing accessory building would need to be removed in the event the Conditional Use Permit is granted. Staff has discussed this. issue with the applicant, however, no decision was made on the matter.
