called to order by Chair Peterson at
7 :40 p.m. on Wednesday, October 19,
1994 .
MEMBERS PRESENT: Commissioners 2. Roll Call
Stevenson, Miller, Johnston, and Chair
Peterson. Commissioners Ruggles,
Nelson, and Colleen had excused
absences.
ALSO PRESENT: Planner Harrington was
also present.
Planner, Harrington reviewed the request 3 . Consideration
• by Everest Development for a development of Resolution
review/major subdivision/rezoning for No. 402-94
the property located at 5xxx Program Regarding the
Avenue. Planner Harrington stated that Development
due to lack of a quorum at the October Review Request
5th Planning Commission meeting this of Everest
item was not able to be acted upon. He Development,
added that the item had been reviewed by 5xxx Program
the Planning Commission at their Avenue,
September agenda session and found to be Planning Case
in conformance with all applicable No. 397-94
provisions of the Municipal Code.
Motion/Second: Stevenson/Miller to
approve Resolution No. 402-94 regarding
the development review request of
Everest Development.

Planner Harrington briefly reviewed the 5. Consideration
request of Peter McIntyre, 2917 County of Resolution
Road H2 , reminding the Planning No. 403-94

applicant has requested a conditional of Peter

new garage on his property.
The applicant has been informed of the

the conditional use permit request of
Peter McIntyre, 2917 County Road H2.

Planner Harrington indicated to the
Planning Commission that this next case
was similar to Mr. McIntyre's. He also
reminded the Commission that this item
was discussed at the October 19th
meeting.
Mr. Harrington explained that the 6. Consideration

Planner Harrington reminded the Planning Liggett for a

within Colonial Village Manufactured Home Park,

Commission that the applicant had No. 391-94
presented his request for a Code Appeal
in July of this year. At that time the
Planning Commission requested Staff to
contact other cities to find out their
policy on allowing the display and sale
of manufactured homes within a
manufactured home park district. Mr.
Harrington informed the Planning
Commission that he had contacted 14
cities, 3 of which allowed the display
and sale of manufactured homes. Two of
the three cities, Blaine and Inver Grove
Heights, allowed the display and sales
of manufactured homes by conditional use
permit. Neither of the two cities have
specific conditions set forth in their
Code and all conditional use permit
requests are reviewed on an individual

basis. He also noted that the cities
have expressed no dramatic impact on
traffic. Mr. Harrington recommended .
that the Planning Commission not set •
specific requirements in the Code. He
concurred with the cities of Blaine and
Inver Grove Heights in that each request
should be reviewed individually.
Mr. Harrington advised the Commission
that he City Attorney was contacted
regarding this issue. He informed Mr.
Harrington that there would need to be .
an ordinance amendment and that the
Planning Commission could make the
amendment by motion.
The applicant, Mr. Liggett, addressed
the Planning Commission. He informed
the Commission that the selling of the
manufactured homes would be done with
the homes in place (on each individual
lot) . Mr. Liggett presented a chart
showing the number of manufactured homes
and average age of the homes. He
4111 mentioned to the Planning Commission
that he also manages manufactured homes
parks in both Inver Grove Heights and
Maplewood where the sales of

manufactured homes is allowed. He added
that it has been working successfully.
He concluded by saying that by allowing
the sales of these homes on site, it
would keep the parks full and help to
upgrade them.
Both Mr. Liggett and the Planning
Commission expressed concerns about the
time constraints. Planner Harrington
informed the applicant that ordinance
changes require a 30-day period after
publication before it would take effect
and that he could make application to
the Planning Commission for a
conditional use permit sometime in late
January, early February.
Motion/Second: Stevenson/Miller to •
allow the display and sales of
manufactured homes within an R-5
• District by conditional use permit.

Mr. Harrington assured the Planning
Commission that these conditional use
permits can be amended just like any
other request and that the same criteria
will be used, only the conditions would
differ. Mr. Harrington also indicated
that each request would be reviewed
after one year and could be amended if
need be at that time.
Planner Harrington commented that he
would consult the attorney as to whether
or not Mr. Liggett could apply for a
conditional use permit prior to the
ordinance change. In other words, he
would find out if Mr. Liggett could
apply for a conditional use permit that
doesn't currently exist in our Code.
Planner Harrington informed the
applicant that this item would be
III discussed at the December 5th City
Council meeting.

SUBJECT: DEVELOPMENT REVIEW, AMOCO OIL
2155 HIGHWAY AVENUE, PLANNING CASE NO. 402-94
Amoco Oil Company has made application for a Development Review for
a proposed addition at their facility at 2155 Program Avenue. The
Mounds View Municipal Code, Chapter 1006, requires in part that all
expansions of commercial facilities within the City are subject to
Development Review. Specifically, the request seeks approval for
a 320 square foot addition to be located on the southwest side of
their existing building (please see attached site plan) .
Staff has reviewed the request against the Municipal Code and found
it to be in conformance with all applicable sections including, but
4111 not limited to, zoning, setbacks, parking and use. All items
received as a part of the application are provided for your review.

SUBJECT: VARIANCE, MARK AHMANN
8165 RED OAK DRIVE, PLANNING CASE NO. 403-94
Mark Ahmann has made application for a Variance to allow the
construction of a third accessory building on his property at 8165
Red Oak Drive. Mr. Ahmann's property currently has on it a single
family home, a detached 576 square foot garage and a 336 square
foot accessory building. Mr. Ahmann's request would allow the
addition of a third, 192 square foot, accessory building. The
Mounds View Municipal Code only allows two (2) accessory buildings
per residential property within the City. Both garages and storage
buildings are defined as accessory buildings by the Code.
I have attached all materials received as part of this application
