SUBJECT: CONDITIONAL USE PERMIT, LINDER'S GREENHOUSES
MOUNDS VIEW SQUARE, PLANNING CASE NO. 405-94
Attached is Resolution No. 408-95 recommending approval of the
request for Conditional Use Permit by Linder's Greenhouses. Please
note that this Resolution is the same as that adopted by the
Commission last year for a similar operation.

CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RECOMMENDATION TO THE CITY COUNCIL APPROVING THE
CONDITIONAL USE PERMIT REQUEST BY LINDER'S GREENHOUSES,
MOUNDS VIEW SQUARE, PLANNING CASE NO. 405-94
WHEREAS, Pete Linder, representing Linder's
Greenhouses, has requested City approval to conduct open and
outdoor sales at Mounds View Square Shopping Center; and
WHEREAS, the open and outdoor sales would take the form
of a temporary greenhouse facility on the site; and
WHEREAS, the Mounds View Municipal Code allows open and
outdoor sales in a B-4, Regional Business with the issuance of a
conditional use permit; and
WHEREAS, the Planning Commission has reviewed the
following documents regarding this proposal:
a) Site plan dated December 13 , 1994
b) Letter of request dated November 29, 1994
• WHEREAS, the Planning Commission has determined that
the proposal is in conformance with the requirements of the
Municipal Code, specifically Title 1100.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends approval of the conditional use
permit with the following conditions:
1. The facility shall be allowed to operate from
March 20, 1995 to July 15, 1995.
2 . The hours of operation of the facility shall not
exceed 8:00 a.m. to 9: 00 p.m.
BE IT FINALLY RESOLVED that the Planning Commission
directs staff to forward this resolution to the City Council
prior to approval of the minutes.

SUBJECT: VARIANCE, REGINALD AND SHARON NELSON
8242 GREENWOOD DRIVE, PLANNING CASE NO. 404-94
As directed by the Commission, Staff contacted the Minnesota Animal
Clinic regarding the spread of Feline Infectious Peritonitis (FIP)
as found in the applicants' cats. Staff spoke with a Dr. Newman
who cited a study on infectious diseases which are found in cats.
The study indicated that FIP requires a carrier for transmittal.
The study went on to add that the virus is not hardy on its own and
therefore transmittal through contact with feces is unlikely. Dr.
Newman suggested that the cat waste be placed in plastic bags and
disposed of with the everyday household waste.
The attached Resolution may be amended to include this type of
• disposal requirement should the Commission so desire.

RESOLUTION APPROVING A VARIANCE TO ALLOW 14 CATS AT
8242 GREENWOOD DRIVE, PLANNING CASE NO. 404-94
WHEREAS, the Mounds View Planning Commission has
reviewed the request of Reginald and Sharon Nelson for a variance
to allow 14 cats on their residential property located at 8242
Greenwood Drive; and
WHEREAS, the Mounds View Municipal Code allows up to
four (4) cats on a residential property; and
WHEREAS', the applicant has submitted a letter of
hardship outlining the need for the variance; and
WHEREAS, the Planning Commission has reviewed the
criteria used to evaluate all variance requests; and
WHEREAS, the Planning Commission has determined that
exceptional circumstances apply to the property which do not
0 apply generally to other properties in the vicinity and result
from circumstances over which the owners of the property have had
no control.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission approves the request of Reginald and Sharon
Nelson for a variance to allow 14 cats on their residential
property contingent upon the following:
1) The cats shall be kept inside the principal
structure on the property at all times.

SUBJECT: CONDITIONAL USE PERMIT, COLONIAL VILLAGE
WILLIAM LIGGETT, PLANNING CASE NO. 391-94
Based on discussions held at the December 21, 1994 Planning
Commission Meeting, Staff has drafted the attached resolution for
consideration by the Commission.
Please note that item (b) has been left open for further
discussion. At the meeting on the 21st, the Commission did not
come to consensus on the issue of total number of model homes which
will be allowed to be marketed. When discussing this particular
item further, the Commission should consider whether or not trade-
in homes will be included in the total number. Staff contacted the
City of Inver Grove Heights and was informed that the applicants°
0 Conditional Use Permit to sell model homes in their City contains
a specific number (6) of homes allowed to be marketed at any one
time. From the wording of the Inver Grove Heights resolution, it
appears that all six must be new models.
If you have any questions, please do not hesitate to give me a call

CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION RECOMMENDING APPROVAL OF A CONDITIONAL
USE PERMIT TO ALLOW DISPLAY AND SALE OF MODEL HOMES AT COLONIAL
VILLAGE MANUFACTURED HOME PARK, PLANNING CASE NO. 391-94
WHEREAS, Colonial Village Manufactured Home Park has
made application to allow the display and sale of model homes
within the Park; and
WHEREAS, the applicant has submitted the following
items as part of the application:
1. Planning Application dated June 29, 1994
2 . Letter outlining proposal dated December 6, 1994
3 . Site Plan dated December 6, 1994
WHEREAS, Title 1100 of the Mounds View Municipal Code
allows the display and sale of model homes within a manufactured
home park with the issuance of a Conditional Use Permit; and
• WHEREAS, the Mounds View Planning Commission has
reviewed the request against the criteria listed in Title 1100
governing issuance of Conditional Use Permits.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends to the City Council approval of
the requested conditional use permit for the display and sale of
model homes at Colonial Village Manufactured Home Park,
contingent upon the following:
a) A copy of this Conditional use permit shall be recorded
with Ramsey County.
*b) Number of units available for sale at any one time (to
be decided by the Commission) ???
c) Units offered for sale shall be installed in compliance
with all applicable City and State regulations
governing Manufactured Homes.
d) A current list of properties, updated as necessary from
time to time, upon which model homes are offered for
sale shall be provided by the applicant and kept on
file at City Hall.
• e) Marketing of the model homes including walk-throughs
and open houses shall be limited to the hours of 8 a.m.
to 9 p.m. Monday through Friday; 8 a.m. to 6 p.m.

Saturday and; 11 a.m. to 6 p.m. Sunday.
BE IT FINALLY RESOLVED that the Planning Commission
directs Staff to forward this resolution to the City Council
prior to approval of the minutes.
