MEMORANDUM
TO: PLANNING COMMISSION

SUBJECT: DISCUSSION OF CAR SALES LOTS
The attached survey of Metropolitan communities was conducted by
Staff in order to get a feel for the types of regulations and
conditions being imposed on car sales lots.
Staff would like the Commission to review the survey to determine
which items from each community they would like incorporated into
the Mounds View regulations. Please have your comments ready
Wednesday evening.

CAR SALES LOTS SURVEY
• APPLE VALLEY
Allows new and used car sales lots only in "GB" General Business Districts. Car sales
lots would have to meet requirements/performance standards for all commercial
businesses. These standards include:
1. Exterior finish of face brick or natural stone.
2. Any exterior storage requires Conditional Use Permit.
3. Landscaping must be installed at a value of 2 1/2% of the estimated cost
of construction.
4. Parking for auto sales: 10 customer parking spaces, plus 1 additional
customer space for each 800 square feet of floor areas over 1,000 sq. ft.
plus 1 additional space for every 2 employees.
BLOOMINGTON
Motor vehicle sales are divided into Class I, II, III, IV, based on the State's definition.
Certain zoning districts allow certain motor vehicle sales.
BROOKLYN CENTER
A license is required for the buying, selling, business of buying, displaying or offering
for sale new or used motor vehicles. Conditions of the license:
1. No Class A motor vehicle dealer license will be issued to any person who
does not possess and operate under a new car franchise or contract in and
for the City of Brooklyn Center, except in the case of an enclosed garage,
showroom or other car display or rental structure on the land, which
structure is required to have a City Assessor's value equal to at least twice
the value of land used by the licensee in the sale of new and used cars.
2, Every Class A licensee is required to provide, operate and maintain in the
City of Brooklyn Center at least one equipped and manned repair shop or
facility capable of repairing the motors, engines, brakes, lights, tires
electrical and other operating equipment of any motor vehicle sold by such
dealer.
3. No vehicle license will be issued if taxes are delinquent on the records of
the Hennepin County Auditor.
4. Sufficient parking space on the auto sales premises for all motor vehicles
repaired or processed must be provided.
5. The license applications must be submitted with a detailed map, plat or
drawing of the place of business showing the address, location, type and
dimensions of any building, fence and lighting equipment thereon, the
intended plan of all vehicle parking, the location and dimensions of
processed car storage space; all curb openings; all driveways and
alleyways therein and thereon, and a certificate by the City Engineer
approving the drainage and paving on such place of business.
6. Appropriate payment must be made.
• 7. The approval and filing of the bond set forth for Class A licenses.
BROOKLYN PARK
• Automobile sales and show rooms have specific requirements:
SETBACKS AND LOT REQUIREMENTS
1. Building setbacks shall be as required under the Code.
2. Parking - A minimum 25 foot wide landscaped yard is required, and
maintained between any public street right-of-way and parking lots
(including maneuvering area).
A minimum side and rear landscaped yard of 7 feet must be maintained
adjacent to Business, Limited Industrial and General Industrial Districts;
and 25 feet along Residential and Multiple Dwelling Districts.
3. Contiguous Site - Motor vehicle sales must be one lot or contiguous lots
not separated by a public street, alley or other use.
4. The minimum lot width is 150 feet at the minimum required front yard
setback.
5. Lot Area- The minimum lot area of 2 acres is required.
LANDSCAPING
1. A screen is required to be erected and maintained along all property lines
separating the site from any Residential District. The screening required
consists of a fence or wall not less than 4 feet nor more than 6 feet in
height or such equivalent as is approved by the Building Inspector.
Screening is also to include landscaping (trees, shrubs, grass, etc.) of a
type (layout, species, height, size and density) approved by the Building
Inspector. All waste material, debris, refuse, junk or damaged vehicles
are required to be kept in an enclosed building or area completely
screened from public streets and adjacent property.
2. A landscaped yard is required to be provided and maintained on all areas
of the site not devoted to the building or parking areas. Landscaped yard
• areas may be required at various locations on the site.
3. Interior poured-in-place concrete curbs are required to be constructed
within the property to separate all vehicle storage, driving and parking
surfaces from landscaped areas and curb islands. Interior curbs are to be
6 inches in height. Gutter locations and the use of rolled poured-in-place
curbing is at the discretion of the City Council and made part of the
Conditional Use Permit.
4. The entire site on which motor vehicle sales is located, other than that
devoted to buildings and structures or landscaped areas shall be paved or
blacktopped and maintained to control dust and drainage and such paving
or blacktopping is subject to the City Engineer.
5. All outdoor illumination on sales lots is to be provided with lenses,
reflectors, or shades, which will concentrate light upon the premises so as
to prevent glare or direct rays of light therefrom being visible upon any
adjacent highway or street or any private property occupied for residential
purposes. Lighting from any source is not to exceed 3 foot candles as
measured from the centerline of any adjacent street nor 3 foot candles at
• any property line which is not also a public right-of-way line.

• PARKING
1. A minimum of 5 customer parking spaces are required for every acre of
total site area.
2. A minimum of 5 customer service parking spaces are required for every
acre of total site area.
3. A minimum of 1 employee parking space is required for every employee.
4. The maximum areas permitted for outside storage of automobiles, new or
used, can not exceed 2 square feet of outside storage area to each 1 sq.
ft. of enclosed ground floor area. Not more than 1 automobile can be
stored on each 400 square feet of outside storage area. No rooftop
parking is permitted.
ACCESSORY BUILDINGS
Accessory Buildings used only for sales offices are not permitted. Accessory
buildings which are permitted to be of the same type of materials as the main
structure.
BjJRNSVILLE
New and used car sales lots are allowed in the following districts as either Conditional
Uses or as part of a Planned Unit Development in B-3, General Business; B-4, Highway
Commercial and I-i, Industrial Park.
1. Site design standards for B-3 and I-1 districts require 25% of the site in
landscape greenspace with an adequate amount of trees and, shrubs.
2. B-3 and B-4 districts require a brick or brick and stucco exterior, whereas
the I-i standards allow concrete to be integrated into the overall building
design.
3. Lighting is subject to the exterior lighting ordinance which states all
lighting must be a down-cast style, the illumination source cannot be
directly visible from surrounding properties or create a source of glare or
"hot spots." Lighting can not exceed 1 footcandle onto adjacent properties
or .5 footcandles onto residentially zoned or dissimilar zoned properties.
3. No additional screening of the display lot is required in B-3 and I-1
districts.
B-4 standards require screening of the display lots, as listed below:
• Open sales lots must have a permanent structure on the
parcel.
• Car lots must have landscaped screened to a height of the
headlights of vehicles on the display lot.
• 8% of the interior of the sales lot must be landscaped.
Said landscaping counts toward meeting the 25%
requirement for the site. All parking delineation islands
and peninsulas must be landscaped with a minimum of one
ornamental or one overstory tree per island or peninsula.
• Open rental and sales lots shall only be considered for
• vehicles of a noncommercial nature
CHAMPLAIN
. New and used car sales lots are allowed by Conditional Use Permit in C-1, C-2, C-N and
C-Hwy Districts and commercial designated land in Planned Unit Developments.
1. General provisions are for all commercial districts are applicable to car
sales lots.
2. General provisions for all commercial districts are applicable for auto
sales lots.
COLUMBIA HEIGHTS
Auto sales lots are allowed by Conditional Use Permit in Retail Business Districts. Auto
sales lots must be a minimum of 3 acres. Only area that auto sales are a permitted use
is the General Business District, (This area doesn't really exist- only about 1/2 of a
• block in the City). Standards for all auto sales lots:
1. The required yard abutting the public right-of-way must be landscaped and
the landscaping must be separated from the usable portion of the lot by a
curb or fence.
2. All of the lot other than the portion occupied by building or landscape
treatment is to be surfaced in order to control dust and drainage.
3. _Lots are required to be constructed according to a grading plan approved
by the City Engineer.
4. When a lot is abutting a lot located in the "R" District, a fence of
acceptable sign is required to be erected along the property line.
5. The outdoor lighting system for a sales lot is to be designed so that no
• direct source of light is visible from the public right-of-way or adjacent
land.
6. Should a public address system be installed, the volume of the sound
transmitted can not be over 50 decibels at 75 cycles per second at the
property line.
7. A site plan for the lot showing access isles, parking, storage, fencing and
other necessary features required to understand the operation must be filed
for approval by the City.
COON RAPIDS
Used-autosold in conjunction with new auto sales. New car sales are
allowed by Conditional Use Permit in General Commercial and Community Commercial
Districts.
HOPKINS
Car sales lots are allowable in "B" Districts provided:
1. The sales lot is not to be larger in square footage than the square footage
of the building devoted to the related business.
2. A 20 foot front yard setback in which there shall be no auto parking.
Within this 20 foot setback there must be a permanent barrier of
landscaping.
• 3. Lighting of the sales lot must be totally from indirect lighting.
4. Should the lot abut an R district an acceptable design of screening fence

• five feet in height must be constructed along the abutting lot line.
5. The auto sales lot can not include vehicles over a 9,000 lb. rated weight.
INVER GROVE HEIGHTS
New car lots allowed in B-3, General Business only. New car sales enclosed allowed
by permitted use; all outdoor sales by Conditional Use Permit. The City has no
performance standards specific to auto sales.
100 foot lot width, 30 foot front yard set-back, 20 foot interior lot, 3-foot
corner lot, 30 foot rear yard set back. Setbacks abutting "E" or "R" districts: 75
feet.
35 foot height limitations. Abutting an "E" or "R" District a fence is required,
not less than 301 opaque nor less than 6 feet high (no less than 3 feet nor higher
than 4 feet adjacent to a street).
SIGNAGE:
The aggregate square footage of sign space per lot can not exceed the sum of four
square feet per front foot of building, plus one square foot per front foot of
property not occupied by a building. No individual sign surface can exceed 100
square feet, except Billboards.
The maximum sign height for a property can not exceed the height of the
principal structure on the property my more than 10 feet except billboards.
Heights in excess of this have to be authorized by Conditional Use Permit.
The aggregate square footage of wall mounted signs can not exceed 10% of the
• surface area of the face of the building upon which the signs are to be mounted.
Freestanding signs must be placed at a minimum setback of 10 feet from any
property line. Signs exceeding 100 sq. ft. per side are to be setback a minimum
of 20 feet from any property line.
Pedestal signs are permitted adjacent to the property line at a rate of one sign per
lot with an additional pedestal sign being permitted for each 200 lineal feet of lot
frontage in excess of 200 feet.
Pedestal signs are not to be spaced closer than 200 feet apart.
MINNEAPOLIS
Any person who sells or offers to sell more than 3 motor vehicles in a 12-month period
must have a license.
RICHFIELD
Auto sales are allowed by Conditional Use Permit in Commercial Districts.
Landscape requirements are the same provisions for in all Commercial Districts.
ST. LOUIS PARK
Motor vehicles sales are permitted, by Conditional Use Permit, in "C-2", Commercial
Use Districts, subject to the following conditions:
1. No previously registered but uncurrently unlicensed or non-operable
• vehicles may be stored on the premises.

• 2. A minimum of 50% of the vehicles for sale on the premises must be new
vehicles.
3. All open sales or rental lots must be operated in conjunction with a
building or buildings containing the same or similar materials as displayed
on the open sales or rental lot.
4. The building and the sales or rental lot must be on one contiguous site.
5. All parking and paved areas must meet all of the landscaping and design
requirements of the Code.
6. String lighting is prohibited.
7. The area of open sales or rental lot used for storage and display of
merchandise.can not exceed 2 sq. ft. for every 1 sq. ft. of building on the
site devoted to the same or a similar use or accessory use.
8. No test driving is permitted on local residential streets.
9. No outdoor public address system is permitted.
10. All customer and employee parking must be clearly designated and signed.
11. No motor vehicle transport loading or unloading is permitted on any
minor residential street.
12. No display or storage of motor vehicles is permitted on any public right
of way. .
13. A Bufferyard "C" must be provided along all public ways and along all
property lines of an abutting "0" Use District.
• 14. A Bufferyard "F" must be installed and maintained along all property lines
of an abutting "R" Use District.
15. The storage lot is to be located a minimum of 100 feet from an "R" Use
District.
VADNAIS HEIGHTS
Only new auto sales are allowed in the "C-3", Auto-Orientated Business District. A
Special Use Permit is required for individually owned driveable motor vehicles- known
as "owner to owner" car sales.
Minimum setbacks from any C-3 District boundary or public street right-of-way are listed
below:
Building Setbacks:
1. Minor Arterial Street 50 feet
2. Collector Street 50 feet
3. Local Street 50 feet
4. Interior Lot Line 20 feet
5. Residential Zoning Boundary 50 feet
Parking Lot of Circulations Drive:
1. Arterial Street 25 feet
2. Collector Street 25 feet
3. Local Street 25 feet
4. Interior Lot Line 20 feet
• 5. Residential Zoning Boundary 25 feet
Minimum Lot Size: 1 acre
WHITE BEAR LAKE
• New and used automobile, truck recreation vehicle and trailer sales and showrooms are
allowed by Conditional Use Permit in "B-3" District, Auto-Oriented Business District.
Sh I BACKS, BUILDING AND LOT REQUIREMENTS
1. Parking - A minimum of 15 foot wide landscaped yard is required
and must be maintained between any public street right-of-way and
parking lots or buildings.
2. Contiguous Site- Vehicle sales must be on 1 lot or contiguous lots
not separated by a public street, alley or other use.
3. Lot Width- The minimum lot width must be 100 feet at the
minimum required front yard setback.
4. Lot Area - A minimum lot area of 2 acres is required.
• 5. Building Area - A minimum building floor area which is 20% of
the lot area is required.
ACCESS DRIVEWAYS
1. Distance of Driveway from Street Intersection. The distance of
the driveway from the street intersection can not be less than 50
feet provided, however, greater distances may be required to
avoid reasonably anticipated traffic hazards.
2. Minimum Distance Between Driveways. Minimum distance
between driveways must be 50 feet at the curb cut.
• 3. Minimum Driveway Angle to Street. Minimum driveway angle
to street must be 60 degree unless otherwise approved by the City
Engineer.
4. Minimum distance between driveway and adjacent property must
be 5 feet at the curb cut.
5. No driveway can exceed 24 feet in width and no curb cut can
exceed
32 feet in width or as approved by the City Engineer.
SCREENING
A screen must be erected and maintained along all property lines
separating institutional, residential, dwelling, or business and professional
office district or use. The screening required in this section can not be
less than 6 feet in height except along the street frontage utilized for
• vehicle display purposes wherein a fence at least 4 feet in height must be
installed.
LANDSCAPING AND LIGHTING
A landscaped yard must be constructed and maintained on all areas of the
site not devoted to the building or parking areas. A lighting plan with
hooded pole lights must be prepared and approved by the City Planner.
All signs must also be included with the lighting plan.
PLANTING ISLANDS
For each additional 3,000 square feet after the first 3,000 sq. ft. of outside
• display area parking space, 1 parking island of 200 square feet must be
installed within the exterior of the planting surface. All planting islands

• must have 6 inch concrete or asphalt curbs and a landscaped interior
including tree and shrub materials.
CURBING
Interior concrete or asphalt curbs must be constructed within the property
to separate driving and parking surfaces from landscaped areas. Interior
curbs required must be a normal 6 inches in height.
SURFACING
The entire site on which vehicle is located, other than that devoted to
building and structures or landscaped areas,must be hard paved surface •
and maintained for control of dust, erosion and drainage.
PARKING
1. Customer Parking- 8 off-street parking spaces, plus 1 additional
space for each 800 sq. ft. of floor area over 1,000 sq. ft.
2. Employee Parking- A minimum of 2 employee parking spaces are
required for every 3 employees. The required parking spaces must
be shown and designated on a site plan.
3. For Outside Sales and Storage- The maximum area permitted for
outside sales or storage of automobiles, new and used, can not
exceed. 3.5 sq. ft. of outside storage area to each 1 sq. ft. of
enclosed ground floor area. Not more than 1 automobile can be
stored on each 150 sq. ft of outside paved storage/display area.
No rooftop parking is permitted.
SURFACE DRAINAGE PLAN AND IMPROVEMENTS
A drainage plan must illustrate all paved area surface drainage flows.
Catch basin traps and/or settling ponds are required to dispose of interior
parking or display area drainage and are subject to approval by the City
Engineer.
SIGNAGE
Sign requirements for auto sales are the same as the B-3, Auto Oriented
Business District regulations.
