PROCEEDINGS OF THE PLANNING COMMISSION • CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA Special Meeting August 16, 1995 Mounds View City Hall 2401 Highway 10, Mounds View, MN 55112 The Mounds View Planning Commission was 1. Call To Order called to order by Chair Peterson at 7 :45 p.m. on August 16, 1995. MEMBERS PRESENT: Commissioners Miller, 2 . Roll Call Ruggles, Johnston, Colleen, and Chair Peterson. Commissioner Stevenson had an excused absence. Commission Nelson is on Leave of Absence. ALSO PRESENT: Community Development Coordinator Harrington was also present. A representative for the applicant, Bel- 3 . Consideration Air Builders, was present. of Resolution No. 424-95 Planner Harrington reviewed the Regarding Bel 1111 development review request by Bel Air Air Builders, Builders. He noted that this item was Coral Sea discussed at a previous meeting. Street, Planning Case Motion/Second: Ruggles/Colleen to No. 419-95 approve Resolution No. 424-95, recommending approval of the development review request by Bel Air Builders, 8400 Coral Sea Street. 5 ayes 0 nays Motion Carried There being no further business before the Commission, Chair Peterson adjourned the meeting at 7 :46 p.m. 4. Call To Order called to order by Chair Peterson at 7:44 p.m. on September 20, 1995. MEMBERS PRESENT: Commissioners Miller, 2 . Roll Call Ruggles, Johnston, Stevenson, and Chair Peterson. Commissioner Colleen had an excused absence. Commission Nelson is on Leave of Absence. ALSO PRESENT: Community Development Coordinator Harrington was also present. The applicant, Fran DeGross, was 3 . REQUEST - 8426 GROVELAND ROAD RICHARD & JULIE OLIVERIUS, PLANNING CASE NO. 423-95 Following discussion at the September 20, 1995 Agenda session, I have drafted the attached Resolution for consideration by the Commission. The conditions listed in the Resolution are identical to those developed for residential dog kennels approved in 1992 . If you have any questions, please do not hesitate to give me a call. • • 411 RESOLUTION NO. 426-95 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF THE REQUEST BY RICHARD AND JULIE OLIVERIUS FOR A CONDITIONAL USE PERMIT TO ALLOW A RESIDENTIAL DOG KENNEL AT 8426 GROVELAND ROAD, PLANNING CASE NO. 338-91 WHEREAS, the Mounds View Planning Commission has reviewed the request of Richard and Julie Oliverius for a Conditional Use Permit to allow the establishment of a residential dog kennel at 8426 Groveland Road; and WHEREAS, the Planning Commission has reviewed the Mounds View Municipal Code and recognizes that the Code allows for residential dog kennels with a Conditional Use Permit; and WHEREAS, Chapter 1125. 01 Subdivision 3 b (1-6) outlines the criteria by which all Conditional Use Permit requests are reviewed; and • WHEREAS, no complaints relating to animals have been received on the property. NOW, THEREFORE BE IT RESOLVED that the Mounds View Planning Commission recommends to the City Council approval of the requested Conditional Use Permit based upon the following: 1. The use will not create an excessive burden on existing parks, schools, streets and other public facilities and utilities which serve or are proposed to serve the area. 2 . The use will be sufficiently compatible or separated by distance or screening from adjacent residentially zoned or value and there will be no deterrence to development of vacant land. 3 . The structure and site have an appearance that will not have an adverse effect upon adjacent residential properties. 4 . The use, in the opinion of the Planning Commission, is reasonably related to the overall needs of the City and to the existing land use. 5. The use is consistent with the purposes of the Zoning Code and the purposes of the zoning district in which the • applicant intends to locate the proposed use. • . Resolution No. 426-95 111 Page Two 6. The use is not in conflict with the Comprehensive Plan of the City. 7 . The use will not-cause- traffic hazards or congestion. 8 . Adequate utilities, access roads, drainage and necessary facilities have been provided. BE IT FURTHER RESOLVED that the Planning Commission recommends approval with the following conditions: 1. Adequate, facilities continue to be provided for the humane treatment of the animals. 2 . Control and restraint ,of the animals continue to be provided on the kerinel site. 3 . After a period of one year, the Conditional Use permit will be subject to review. BE IT FINALLY RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 4th day of October, 1995.
