Adjournment • • • 4/".4t.pio-cektde PROCEEDINGS OF THE PLANNING COMMISSION • CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA Regular Meeting June 19, 1996 Mounds View City Hall 2401 Highway 10, Mounds View, MN 55112 The Mounds View Planning Commission was 1. Call to Order called to order by Acting Chair Miller at 7:06 p.m. on June 19, 1996. MEMBERS PRESENT: Commissioners 2. Roll Call Brooks, Obert, Brasaemle and Miller. Commissioners Stevenson, Marshall and Chair Peterson had excused absences. ALSO PRESENT: Acting Community • Development Director Pruitt. Acting Director Pruitt reviewed the request 3. Discussion of • noting that Ryan Construction Company of Development Review Minnesota, the Design Builder for Sysco, is Request by Ryan requesting a development review to construct a Construction, on 868'x80' (5,440 square feet) expansion to their behalf of Sysco, 2400 existing truck facility at 2400 County Road J. County Road J, Planning Case No. Acting Director Pruitt explained that since Ryan 447-96 Construction has already ordered the materials and since the 68'x80' expansion is so similar to the phased development which was approved in 1988, the applicant is requesting that the Planning Commission call to order on this item and make a formal recommendation to the City Council. Acting Community Development Director Pruitt informed the Commission that the applicant had • called earlier to explain he could not attend the meeting due to prior committments. Mounds View Planning Commission June 19, 1996 Special Meeting Page 2 • Staff requested that if the Planning Commission approves Resolution No. 445-96 recommending approval of the development review, the following contingencies be added: 1. All necessary permits be obtained from Rice Creek Watershed District. 2. Ryan Construction, on behalf of Sysco, enter into a development agreement with the City of Mounds View. The Planning Commission clarified that the proposal is for two new bays, conversion of an existing wash bay to a new wash bay, and a two wheeler storage area. The Planning Commission inquired whether there was adequate environmental protection for a new wash bay. Acting Director Pruitt explained the wash bay proposed is to be , environmentally sound. The Planning Commission clarified that a canopy exists on the west side of the building. Motion/Second: Brasaemle/Brooks to approve Resolution No. 445-96 with the two contingencies. Commissioner Miller noted a change to the resolution where it stated, the Mounds View Planning Commission recommends approval of the development review request "with the following conditions" to be replaced with "contingent upon." 4 ayes 0 nays Motion Carried Acting Community Development Director Pruitt 4. Discussion of introduced this item stating that the applicant, Variance Request by • Mounds View Planning Commission June 19, 1996 • Special Meeting Page 3 Bioclean Mobile Wash, Inc., is requesting an Bioclean Mobile extension on a variance granted on July 5, Wash, 2151 Mustang 1995. She added that the variance was to Drive, Planning Case allow construction of an addition to their No. 450-96 existing facility at a thirty-foot rear yard setback where a forty-foot setback is required by Municipal Code. Acting Director Pruitt went on to explain that if Resolution No. 456-96 is approved, she would recommend placing a contingency in the resolution that if the work is not completed within one year the variance would be null and void unless an extension is granted by the Board of Variances and Appeals. Mr. Greg Kelly, a representative for Bioclean, explained that no cleaning occurs on site and the operation is mobile in nature. • Commission Brasaemle suggested that • Resolution No. 456-96 state, "WHEREAS, on July 5, 1995, the Planning Commission adopted Resolution No. 420-95 granting the variance." Director Pruitt explained that if the variance was approved by the Planning Commission it would be a completed process and would not be forwarded to the City Council. The Planning Commission discussed with the represenative that the industry has until August 15 to ensure that wash water does not enter into the storm sewer. The applicant notified the Planning Commission that they are the only mobile wash company which uses a vacuum system which prohibits water from going down the sewer system for customers who request it. The applciant then explained they are now required by federal law to prevent wash water from entering into the storm sewer. Mounds View Planning Commission June 19, 1996 Special Meeting Page 4 Motion/Second:Brasaemle/Obert to approve Resolution No. 456-96 approving an extension of the variance request by Bioclean Mobile Wash, 2151 Mustang Drive, and to include in the resolution that the first whereas refer back to the previously approved Resolution No. 420-95 and also include the contingency that if the work is not completed within one year of the date of variance approval, the variance will become null and void unless an extension is Motion Carried granted by the Board of Variances and Appeals. 5. Petitioner: Gerald and Jane Wall Location: 7441 Park View Terrace PIN No. 05-30-23-32-0034 Zoning Land Use: The property is currently zoned R-2, Single and Two Family Residential. • Applicable Regulations: Section 1104.01, Subd. 3c requires a minimum thirty foot front yard setback from all lot lines for properties on a corner. Attachments: Zoning Map Site Plans A hardship statement from the applicants Application Background: The property is located at 7441 Park View Terrace; a corner lot property. The request is for a variance to encroach two feet into the required thirty foot front yard setback along Park View Terrace. The variance is required to build a family room addition, approximately 352 square feet, which would extend from the southern side of the house. The applicants have provided the following hardship statement: "We'd like to build a family room addition onto our one level home. We live on the corner of a cul-de-sac and are limited to only one direction in which we can build. We feel the two extra feet will enable us to create a functional living space." PAGE TWO OF TWO The proposed addition is in conformance with all other applicable zoning regulations, other than meeting the required 30' front yard setback. The applicants have been made aware that the addition will need to be designed and maintained to provide a uniform building appearance with the original dwelling unit. Recommendation/ Analysis: Based on the discussion at the June 19, 1996 Planning Commission Agenda meeting, Resolution No. 457-96 for approval of the variance request has been drafted for your review and consideration. The following contingency: "Whenever, within one year after granting a variance or appeal, the work as permitted by the variance or appeal shall not have been completed, then such variance or appeal shall become null • and void unless a petition for extension of time in which to complete the work has been granted by the Board of Adjustments and Appeals," has been added to Resolution No. 457-96. • • MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 457-96 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING A FRONT YARD SETBACK VARIANCE FOR GERALD AND JANE WALL, 7441 PARK VIEW TERRACE, PLANNING CASE NO. 444-96 WHEREAS, the Mounds View Planning Commission has reviewed the request of Gerald and Jane Wall for a variance to allow a 352 square foot addition to the southern side of their home to encroach two feet into the required thirty foot setback for a corner lot, which is less than that allowed by Municipal Code; and WHEREAS, the applicants' property is subject to the requirements set forth in Title 1100 of the Mounds View Municipal Code; and WHEREAS, the Planning Commission has reviewed the criteria used to evaluate all variance requests; and WHEREAS, the special conditions of the property, namely, the irregularly shaped lot with the three sides of street frontage, does not result from the actions of the applicant; and WHEREAS, granting the variance would not confer special privileges on the applicants • that are not enjoyed by other property owners in the same district; and WHEREAS, the variance requested is the minimum necessary to alleviate the hardship. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission approves the request of Gerald and Jane Wall for a variance to encroach two feet into the required thirty foot setback for a corner lot to build a 352 square foot family room addition off the southern side of the home, contingent upon the following: 1) Whenever, within one year after granting the variance the work as permitted by this variance shall not have been completed, then this variance shall become null and void, unless a petition for extension of time in which to complete the work has been granted by the Board of Adjustment and Appeals. The request is for a two foot variance from the 48" in height allowance for a fence height. Petitioner: Thomas A. Pick Location: 2725 Sherwood Road PIN No. 06-30-22-13-0059 Zoning Land Use: The property is currently zoned R-1, Single Family Residential. 4, Applicable Regulations: Section 1103.08, Subd. 2, allows for fences not exceeding 48" in height from the grade level lot line for fences located on a corner property lot. Section 1103.08, Subd. 3b, allows for a fence to be installed on the applicants property, but not installed directly over the property line. Section 1103.08, Subd. 5, requires all surfaces of the fence facing adjoining properties or public rights of way to be of finished construction. Attachments: Zoning Map Site Plan Hardship Letter to Planning Commission from Applicant Planning Application Background: The applicant's property is on the corner of Red Oak Drive and Sherwood Road. Thus, since it is a corner property, the fence is not to exceed four feet along the front yard setback (shown in a dotted line on the site plan). PLANNING CASE NO. 446-96 JULY 10, 1996 PAGE TWO OF THREE • The applicant is requesting the two foot variance for reasons of safety. Namely, the safety of his child, any other children who may be visiting, pets and automobile traffic along Red Oak Drive. The applicant attributes these safety concerns to a large mound on the western edge of his property along Red Oak Drive, which is approximately four feet in height at the center. With a fence of only four feet in height, as the Code permits, the applicant feels the situation could create a hazard for children and pets. The six foot fence would, according to the applicant, provide adequate protection to prevent children from falling over the fence, pets from jumping the fence, or other potential mishaps. The applicant has also reviewed the variance criteria and addressed each issue in his letter dated June 03, 1996. As requested by the Planning Commission at the June 19, 1996 Agenda meeting, the applicant has notified Staff that the fence will be 78' back from Sherwood Road. The proposed fence will be French Gothic treated wood. The site plan shows the fence following the perimeter of the property line, but not directly on it. Since the Public Hearing Notices have gone out, Staff has received several inquiries from residents within 350' from this property. All but one call have been in support of the fence. The only call opposed to the fence was from Mrs. Vogt on Red Oak Drive who will be unable to attend the meeting, as she has a broken hip. She is concerned that a fence only a few feet back from the property will create a visual hazard and will create a problem with snow removal blocking the street. Staff did explain to Mrs. Vogt that the fence would be located behind the house and that the Code allows a 4' fence is the same area. Mrs. Vogt still wanted her concerns entered into the record. The primary reason I am requesting this variance is for safety:the safety of my child,any other children who may be visiting us,pets,and automobile traffic on Red Oak Drive.These safety concerns are due to the fact that the property has a large mound on the western edge adjoining Red Oak Drive,which is approximately 4' in height at the center.With a fence of only 4' in height,as the current city code permits,this situation could create a hazard for children and pets.A 6' fence,as I am requesting,would provide adequate protection to prevent children from falling over the fence,pets from jumping the fence,or other potential mishaps. Applicable Regulations: Section 1106.04, Subd. 1, allows churches as a conditional use in an R-1 district with certain provisions. Section 1106.04, Subd. la, requires a minimum front yard depth of thirty-five feet. Section 1106.04. Subd. 1 b, requires a minimum side yard of thirty feet. The request is for a conditional use permit to construct a 6,166 square foot addition. On May 1, 1985, Resolution No. 130-85 was approved which granted a conditional use permit for sanctuary addition to the existing Church at 5472 Adams Street. According to municipal records, it appears the Church had been in place for quite sometime prior to the sanctuary addition. The way the Resolution was drafted reflected that the conditional use permit granted in 1985 was only applicable to the sanctuary addition on the site. Therefore, the proposed addition requires another conditional use permit. Since the addition is new construction, a development review is also required. The request before the Planning Commission now is a 6,166 addition which will be utilized primarily for meeting places for children between services. Staff contacted Attorney Long regarding the parking required for the addition. It was determined that a parking standard used for elementary schools would be appropriate for the classroom space since the use of the rooms will be primarily for children. Ten meeting rooms, one office, a work room, a room for the Pastor and a choir room are proposed in the expansion. A representative from the Church, Dave Olson, has submitted the attached letter requesting that the Planning Commission 111) Aft PLANNING CASE NO. 449-96 VI JULY 10, 1996 PAGE THREE OF FIVE not require any additional parking since the proposed expansion will not create any, additional parking needs which the existing parking area could not adequately provide. He states, the office space on the floor plan would be occupied by only three people; the church Pastor, secretary and Associate in Christian Children. The secretary and A.C.E. would only use the offices during the week. The Church provides grades K thru six, Youth and one Pre School all of which are held between the regular worship services. One meeting room will be designated as the nursery room. The nursery would be occupied during worship services. Section 1121.13 under"Church" states a parking computation for seating, and expressly provides, "Facilities as may be in conjunction with such buildings or uses, shall be subject to additional requirements which are imposed by the Title." An elementary classroom in the Code requires at least one parking space for each classroom plus one additional space for each 50 student capacity. Representatives from the Church have stated that they anticipate having less than 50 children in the expansion. The main worship area has 287.8 lineal feet of seating. The choir has 21 individual chairs. Thus, under the Municipal Code parking requirements, these two facilities would require 46 parking spaces, of which two spaces are required to be accessible spaces. Currently, 53 parking sites are available on the site with three of those spaces (one of which is proposed on the site plan) designated for accessible parking. This is in conformance with State requirements for accessible parking requirements. The site plan shows an additional fourteen parking spaces proposed to the North of the existing parking area. The Church is requesting that they may be allowed to phase in PLANNING CASE NO. 449-96IF JULY 10, 1996 PAGE FOUR OF FIVE this parking at a later date to economic constraints. Based on the discussion at the Agenda Meeting, it appears that the current parking in addition to the proposed fourteen parking spaces along the north of the existing parking area, will be adequate for the proposed expansion. It was also discussed at the meeting that these fourteen parking spaces be phased in later based on demand, rather than requiring a completion date for installation of the additional 14 spaces. The proposed addition meets the required setbacks. The property has two access points from Adams Street. These satisfy Municipal requirements. The site does not need to be reviewed by Rice Creek Watershed District due to its small size (less than 2.5 acres). SEH has provided comments on the expansion that the conversion of the lawn use is consistent with the local water management plan. However, localized drainage may be impacted due to the increase in runoff and changing the runoff flow path. SEH will need verification of the site drainage for final review to assure no negative impact to the surrounding area. With regards to lighting issues, the applicant has been advised that all lighting will need to be reflected away from adjoining properties, abutting residential uses and public rights-of-way. City Forester, Rick Wriskey, has requested three shade trees be planted along the south side of the property and six shade trees be planted in front of the Church on the boulevard along Adams Street (providing that a call to Gopher State One allows plantings in this location). Mr. Wriskey requests that when a landscaping plan is drawn up by the applicants that he review it for approval. If the variance is granted,a conditional use permit to construct an oversized garage(for 1,248 square feet)at 7901 Red Oak Drive Petitioner: Church Upon the Rock Location: 7901 Red Oak Drive PIN No. 06-30-23-42-0029 Zoning Land Use: The property is currently zoned R-1,Single-Family Residential. Applicable Regulations: Section 1106.04 requires a conditional use permit for accessory buildings other than a garage exceeding two hundred sixteen square feet. Section 1106.04,Subd.7c,prohibits an accessory building, with a conditional use permit,from exceeding four hundred square feet. Section 1106.04,Subd.7b,prohibits the combined square footage of all accessory buildings on one lot from exceeding 1,264 square feet. Section 1006.04,Subd.7d,requires the accessory building to be a permanent structure. Section 1106.04,Subd.7e,requires the building to be designed and maintained to provide a uniform appearance with the dwelling unit. Section 1106.04,Subd.6,requires a conditional use permit for a garage exceeding eight hundred sixty four feet. S PLANNING CASE NO.451-96 JULY 10, 1996 PAGE TWO OF FIVE Section 1106.04,Subd.6c,prohibits any other accessory storage buildings if the garage square footage is greater than one thousand square feet. Section 1106.04,Subd.6e,prohibits the width of a garage from exceeding thirty-five feet,and allows for no more than three vehicle accesses. Section 1006.03,Subd.1c,prohibits accessory buildings from exceeding fifteen feet in height and requires all accessory buildings to be five or more feet from all lot lines of adjoining lots and to be six feet or more from any other building or structure on the same lot. Attachments: Zoning Map Site Plan Application Background: The property is located at 7901 Red Oak Drive. The request is for a variance to allow a garage on the site and for a conditional use permit to construct a 24'x 52'(1,248 square feet)oversized garage for storage space. In March 1996,the Mounds View Planning Commission reviewed a request for an extension on Church Upon the Rock's conditional use permit request for temporary, accessory structures on the property. Discussion continued through several meetings regarding the need to remove the temporary structures,used as classrooms,since eight years had been already provided for the temporary structures. The Church was encouraged to investigate other storage options within the church for needed classroom space. Church representatives found that they could indeed use space inside the Church for classroom space if they were able to construct a storage facility for items currently in • storage. • PLANNING CASE NO.451-96 JULY 10, 1996 PAGE THREE OF FIVE At the April 3, 1996,Regular Meeting,Church Upon the Rock withdrew its application for an extension on its conditional use permit for temporary,accessory structures. Church Upon the Rock is now requesting an oversized garage to be used for storage space so that they may free up space,currently used for storage inside the church,for classrooms. The Municipal Code defines private garages as,"a detached accessory building or portion of the principal building, including a carport,which is used for storing vehicles." The garage proposed at the site will not be used for storage of vehicles. The Municipal Code allows for accessory structures exceeding two hundred square feet,but not more than four hundred square feet,by conditional use permit in R-1 zoning districts. It appears the Municipal Code does not recognize that churches,allowed by conditional use permit in R-1 zoning districts,may have all the demands for storage that single family dwellings may have. Staff suggests that the impact of an oversized garage on the site would not have any greater impact than a home with an oversized garage would have on the property. If the Planning Commission wishes to consider granting a • variance to allow a garage on the site,then the next issue to consider would be whether to grant a conditional use permit for an oversized garage on the property. Dick Whitney,a representative for Church Upon the Rock, has been made aware that no other structures may be • allowed on the premises. Discussion at the April 03, 1996 meeting by the Planning Commission suggested requiring some type of security to ensure the existing temporary, accessory structures would be removed from the property. A staff report dated April 04, 1988 revealed that the Church requires 98 parking spaces. At that time, it was shown that the site had inadequate parking on-site for its Sunday PLANNING CASE NO.451-96 JULY 10, 1996 PAGE FOUR OF FIVE demand and that on-street parking has prompted complaints from neighbors. At the June 13, 1996 Agenda Meeting,Mr.Whitney reported that he has not observed parking on the street and does not feel that previous parki concerns are an issue now,with the Church using Kinder Kare and Western Bank for overflow parking as needed on Sundays. A revised site plan has been submitted which shows 91 current parking spaces. Mr.Whitney has shown on his site plan(attached)four proposed parking sapces to the west of the property,two proposed spaces along the circle to the west of the property and a possible angle parking spot towards the east of the property. The site plan shows the propsed garage to be located along the east side of thee property. Mr.Whitney proposes to create five new parking spaces along the west side of the garage. Thus,if the angled parking space is included in the total number of parking spaces,the site plan shows 98 parking spaces. The site plan shows the propsed garage to be located where the refuse dumpster currently resides. It is unclear where the dumpster will be moved to on the site plan. Staff has left a message for Mr.Whitney to bring a site plan to the July 10, 1996 Planning Commision meeting showing where the dumpster enclosure will be located. The proposal before you shows the garage to be located on existing an impervious surface,so no additional impervious coverage will be created on the site with this request. Staff has reviewed this proposal and found that is consistent with Chapter 1106,regarding setbacks and requirements for oversized garages. COUNTY OF RAMSEY STATE OF MINNESOTA AN ORDINANCE RELATING TO SIGN VARIANCES AND AMENDING THE MOUNDS VIEW MUNICIPAL CODE BY ADDING A NEW SECTION 1008.11, ENTITLED "VARIANCES"AND A NEW SECTION 1, ENTITLED "R-5 MOBILE HOME DISTRICT" THE CITY OF MOUNDS VIEW ORDAINS: SECTION 1. TITLE 1008, ENTITLED "SIGNS AND BILLBOARDS" shall be amended to add a new Section 1008.11 of the Mounds View Municipal Code to read: Subd. 1 Criteria for granting variances: A variance to this provision of the Section 1008 may be issued by the Board of Adjustment and Appeals to provide relief to the landowner in those cases where the Code imposes undue hardship or practical difficulties to the property owner. A variance may be granted in the event the following circumstances exist: . a. Exceptional or extraordinary circumstances apply to the property which do not apply generally to other properties in the same zone or vicinity and result from lot size or shape, topography or other circumstances over which the owners of the property since the effective date hereof had no control. b. The literal interpretation of the provisions of this Title would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of this Title. c. That the special conditions or circumstances do not result form the actions of the applicant. d. That granting the variance requested will not confer on the applicant any special privilege that is denied by this Title to owners of other lands, structures or buildings in the same district. e. That the variance requested is the minimum variance which would alleviate the hardship. • ORDINANCE NO. 585 1996 PAGE TWO OF THREE f. The variance would not be materially detrimental to the purpose of this Title or to other property in the same zone. g_ The Board of Adjustments and Appeals may consider other circumstances under which the literal interpretation of the provisions of this Title create an undue hardship on the applicant. Economic hardship may be a circumstance for issuance of a variance. Subd.2 Variance requests, fees. All requests shall be made in writing on the form provided by the city and the request shall include the fee specified in the City's Fee Charges. All information required when applying for a sign permit, as outlined in Section 1008.03 shall be required before the request for a variance is considered. SECTION 2. TITLE 1008, ENTITLED "SIGNS AND BILLBOARDS" shall be amended to add a new Section 1008.08, Subd. 21 of the Mounds View Municipal Code to read: • g. B-2 Limited Business District: (1) Signs not exceeding one hundred (100) square feet per business occupant. This includes all types of permanent signs, as defined in Section 1008.01 of this Chapter. (2) Temporary signs as allowed in subdivision 9e of this section. h. B-3 Highway Business District: Signs as allowed in subdivision 2g hereof. i. B-4 Regional business District: Signs as allowed in subdivision 2ereo j. I-1 Light Industrial District: Signs as allowed in subdivision 2g hereof. k. Other Signs As Allowed in Certain Districts: B-3 Highway Business District, B-4 Regional Business District and I-1 Light Industrial District may have, besides the one hundred (100) square feet signage per business occupant, one general pedestal sign not exceeding three hundred forty (340) square feet. WHEREAS,the City of Mounds View finds it necessary to conduct studies to determine if there is a need to amend the City's Zoning Code to its comprehensive plan relating to Towers and Antennas,and if so, adopt the appropriate amendments. WHEREAS,Ordinance No. 587 provides for a 180 day moratorium on the new use,development,or construction of telecommunication Towers and Antennas within the City. NOW,THEREFORE,BE IT RESOLVED that the Planning Commission of the City of Mounds View recommends approval of Ordinance No. 587, an ordinance amending the mounds view zoning code by adding a new chapter 1126 establishing a 180 day moratorium on new use,development,or construction of public commercial wireless telecommunication services within the City of Mounds View. Title 1100 of this Mounds View Zoning Code is amended by adding a new Chapter 1126 to read: Subd. 1. AUTHORITY. This Section is adopted pursuant to the authority granted to the City in Minnesota Statutes, Section 462.335, Subdivision 4, entitled "Interim Ordinance." Subd. 2. P SE O . The City of Mounds View("City") currently does not regulate • wireless transmission and reception facilities through its Zoning Code. The Mounds View Planning • Commission is in the process of reviewing the appropriate zoning for the establishment of new use, development or construction of commercial wireless telecommunications services (hereinafter "Towers and Antennas"), including Towers and Antennas for cellular, personal communication seivices4:PCS_Vspecialized mobilized radio (SMR), enhanced specialized mobilized radio (ESMR), paging, and similar services marketed to the public within the City. Market demand, rapid advances in technology and expanding federal licensure of radio frequencies has resulted in the increased requests to locate Tower and Antennas within the City; and that trend can be expected to accelerate in the reasonably foreseeable future. The City's regulation of Towers and Antennas predates the various types of facilities requiring Tower and Antennas. The City Council is concerned that its • 1 • zoning controls relating to Towers and Antennas may not adequately address issues related to these Towers and Antennas, such as the appropriate locations for the Towers and Antennas and the conditions under which they may be allowed within the City, including structural and construction requirements, co-location, setbacks, and height limitations. The City has received inquiries from companies desiring to construct Towers and Antennas and other facilities in the City. The City Council finds that it is necessary to conduct studies to determine if there is a need to amend the City's Zoning Code or its comprehensive plan relating to Towers and Antennas, and if so, to adopt the appropriate amendments. The City Council finds that there is a need to adopt interim measures for the purpose of establishing an orderly planning process and protecting the health, safety and welfare of its citizens regarding such matters. Subd. 3. MORATORIUM. A moratorium on the new use, development, or • construction of Towers and Antennas within the City is established. During the term of moratorium no application for final site and building plan approval, building permits, and other permits and approvals related to such towers shall be accepted by the City. Neither the Planning Commission nor the City Council shall consider or grant approval of any application of such work. No building permits for such work shall be issued for the development or construction of Towers and Antennas within the City. For—the-purposes of the-moratorium, the term Towers and Antennas shall include any pole, spire, structure, or combination thereof, including supporting lines, cables, wires, braces, and masts, intended primarily for the purpose of mounting Towers and Antennas or similar apparatus above grade, for the purpose of providing commercial wireless telecommunication services to the public. The moratorium shall not apply to (a) the use of existing water towers in the city, or (b) Towers and Antennas work that has received all necessary permits and approval from the City prior • to the effective date of this ordinance. 2 Subd. 4. EXPIRATION. Unless earlier repealed or modified by the City Council, this ordinance shall remain in effect for one hundred eighty(180) days from the date of its effective date. • SECTION 2.
