Iv�r. Peter Linder, representing L,inder's Greenhouses, has applied fbr a. conditional use psr�mit
(CCTP} to a.ilow the operation of an outdoor sales operation a� Iviounds View Square. Linder's was
previously issued CUPs for the I995 and 1996 growing season. No changes are proposed in the
locatioq layo�t and operation from previous years.
In his letter of applica�ion, Mr. Linder requests that ihe City consider allowing the ope�°ation to
hook up to a fire hydra,nt on the property in order to get waier for the flora. This was done last
year with no associated problems. The charges for permitting such water tasage include a$100
hydrani deposit, a$20 wrench deposit and a$20 adapter valve deposifi. These deposiis are
refundable. The applicant's request to connect to the fire hydra.nt has been approved by the
Departm�ni of Public works, subject to receiving the appropriate deposi�s. In addition, fh�
applicant will be billed $1.00 per day for water service.

Mr. Linder is expecting io operate the Flower �Iart from April 15 to June 30, 1997, but would like
the CUP to be effective from March 15 to July I5, 1996, to accommodate for seasonal fluctiaations
and assembly/disasseinbly. Linder's Flower Mart is a p�rennia.i Mounds View business, having
been at the same location for fhe past four years. Staff is not aware of any problems associated
with this operation.
The flower mart will be located at the edge of the Mounds View Square parking Iat, alongside of
Highway 10. The closest residential neighbors at this point axe the homes behind the shopping
center and the Wildwood Manor senior apartments across Highway lfl to the south. The
residences, separated from the flower mart by the shopping center and the highway, should bear no
discernabie impaci from the use.
The flower mart is related #o th� needs of the residents of Mounds View in that there are no
greenhouses within the City. The zoning for the shopping center is B-4 (Regzonal Business
District} which allows outdoor sa.les as a conditionat use. The area of Iv%unds V'iew Square is
identified as Highway Commercial within the City's Comprehensive Plan, a designation not
inconsistent with the shopping center and proposed flower marC. Traffic in the area should not
noticeably increase as a result of this use as it will draw much of its cusiomer base from th�
Mounds View Square shoppers and commuters traveling east and west on Highway 10.
Given these considerations and the previous experience with Linder's Greenhouse, stafffeels
approval of the conditional use permit is appropriate.

The Planning Commission recommend to City Council approval oithe cond'ztional use with
conditions as to startin� and ending dates, anoperationf oepration. A resolution to this effect will
be prepared for your regular meeting on Febnaary 5.

The Mounds View N�aisance Code enumerates as a nuisance "all no�ous weeds, "tall �asses"
defined as anythzng over eight inches (8") in height, and other ran.k growths." The properiy ai
8380 Greenwood has an axea in the rear yard where it is boggy and wetland grasses grow if ii is
left undisfcurbed. It is our understanding tha� prior to 1996, staffwas not requiring ifiat this area
be mo�,ved. In 1996, staff notified the property owner, IVir. I�eith King, that the rear yard had to
be mov�ed in response to a compla.int from a neighbor that ihe Kings were was no� complying
with the ordinance.
Present day stai�had an opporiunity to view this area unmaw�z and did not find it objec�iot�able.
It is native wetland vegefatiorn and not weeds. The Kings keep it well-managed and it is separaied
from any adjacent property lines. Staff is proposing thai an exemption far this type of vegetation
be added io the Nuisance Code.

The Children'.s Home Society has approached the City asking wheiher they could lease space u1
the Bel Rae. The Children's Home �ociety would grovide day care for appro�cimateiy 100
children. The property where the Bel Ra.e is located is zoned B-3. A review of the Zoning Code
revealed that day care is not listed as a permitted or conditional use in any of the business or
indusirial districts in Mounds View. Whefher or not the Children's Home Society proposai goes
forward, sta$'feels this is an opportune time io consider adding day care and grQUp nurseries to
the business arfd industrial districts as a conditional use.
According to the Mounds View Zoning Code, day care and group nurseries are defined as "a
service provided to the public in which chiidren of school or preschoal age are cared for during
established business hours." Home day care is defined as "a family dwelling in wluch foster care,
supervision and training of children of school or preschool age is provzded for during established
business haurs. The Zoning Code does not use numbers of children in defining �hese two uses.
According to IVlinn�sota Staie Statutes, however, care of 12 children or less is to be regarded as a
permifited single farnily residential use. Care of 13 to I6 children is to b� regarded as a permitted
multifamily residential use, for which a conditional use pernut may be required by the I�cal zoning
authority.

Stiaff is proposing an ordFnance amendment to do the following:
Revise the definitions of home day care and day care and group nurseries need to use the
numerical limits stated in �'viinnesoia Law
Add day care and group nurseries as conditional uses to the R-0, B-I ihrough B-4
districts, and tlze I-1 districi, subject to the same criteria as is stated in ihe resider�iial
districts. These criieria are as follows:
a. No overrught facilities are provided for the children served. Children are delivered
and removed daily.
h. The front yard depth shall be a minirrium of thirty five feet (35'}.
c. Not less than forty (40} square %et of outside play space per child be provided and
that such space be suitably fences and/or screened in accordance wiYh conditions as
specified by the City Council.
d. Adequate off street parking and access is provided in compliance with Chapter
1121 of this Title.
e. Adequa#e off-street loading and sez-vice entranc�s axe provided in compliance wit�
Chapt�r 1122 of this Title,
f. The site and related parking and service sha.11 be served by an arterial or collector
streei of sufficient capaciiy to accommodate the #raffic which will be generated.
g. All signing and informationai or visual cammunication devices shall be in
compliance with the Maunds View Sign Code.
Our e�sting �oning Code regards both home day care and day care and group nurseries as being
either residential uses or compatible with residential districis. Day care centers become a hybrid
between a residential and a commercial uses, with some characteristics associated with family
activities and some associated with a business. La.rge day care centers do not blend very well into
residential neighborhoods because of the number oi children. Placing thezn in a business district
could work betier. Stai� feeis that this option shauld be available, and then the maxketglace
would have more options as to where day care centers are located. The conditional use permit
process will a.ssure that the specific location and site layoui will work, and be campatible with
adjacent uses.

Minnesota 5tate Law defines a sfiaie licensed residen�iai facility providing care of six or %wer
persons as a permiticed single family residential use, meaning that citie� must perrnit such uses in
residential districts wiihout special reguiation. The Minnesoia Depa.rkment of Correciions is on�
of the agencies wliich issues licenses for group homes and group foster homes for the purpose of
treating juveniles who have violated criminal staiutes. The rules goverrung the Department of
Cortectians define group homes and gra�ap foster homes as prvviding care for not more ihan eigh�
chiidren. They will only place six children in a group home or group %ster home unless the local
zoning code allows for tfie additiona.l two children.
In 1996, the Mounds View Zoning Code was amended to aliow a total of eight children in foster
family homes group homes. This amendment was initiated in response to a request from Mr.
Duane Waldoch, who operates a family fosier home for chiidren referred to him by #he
Department of Corrections. His license was for six children, and he wanted to obtain a license
aliowing him �o have eight children. This iicense could nofi be issued without the change in our
Zoning Code.
Mr. Waldoch appiied for the revised license and the Department of Corrections asked us for
evidence that our local Zoning Cade aliowed eighi chiidren. VVi�en we sent a copy of the
amendment, the Department of Corrections responded ihai the way the amendment was wri�ten
did not pernut them to approve the additional children. Staff is proposing � fiarther amendment
which wouid solve ihis problem.

The reference in Subd. 3(i.e. Chapter 9545, Section 9545,0010, Subp. 7) is to Minnesota Ruies
related to the Department of Human Services Licensing of Facilities for Cl�ildren. Subp. 7 reads:
Family foster home (FF�: "Foster family home" means a family home licensed to provid�
one or more of the following types of care for children who are tanrelated to the family and
who are cared for 24 hours a day.
a. emergency shelter home means a FFH designated primariiy for time-limited
emergency placements, usually taster no longer than 30 days for any child;
b. interim home means a FFH caring for children expected to rst�m honne within one
year or to be placed for adoption within two years;
c. pennanent home means a FFH caring for children (whether state wards or not}
under written agreement for planned care until child reaches majority;
d. restricted home means a F�3 licensed for a specific child (an FFH licensed as a
restricted home rnay not accept children other than the specifically named
child(ren));
e. speciai services home m�ans a FFH able to pravide e�raord�nary car� or servic�s,

by virtue of trairung, experience, or special skills; and
f. group family foster home means a FFH provi�ding care for no more than ten
children, including the family's own chi.ldren
The problem arises from the fa.c� that the children being placed in NIr. Waldoch's hom� are not
being referred there by the Department of Human Services but, instead, are being referred to him
by the Department of Corrections. The Minnesota Rules related to the 17epa.rtment of
Corrections has its own definition of group homes, foster homes, or GFH as follows:
"Group horries", "group foster homes," or "GFH" shall mean a residential facility vvhere
not more than eight deiinquent youths are cared for by group fos�er parents or� a 24-hour�
a-day basis. (Chapt�r 2925,0110. Subp. 9)
It appears clear from the informaiioz� in the file that the City Council's int�nt in amending the
ordinance was to accommodate Mr. Waldach's sitiaation. (Please see the attached memorandum
frorn Joyce i'ruitt to the File, and the staff repor�s sent to City Council at the time this ordinance
amendment was presented to them. There was even inforrrial permission given to Julie Snyder ai
Department of Conections to place an additionai cliild at the Waldoch's prior tco formal adoption
of the ordinance.)
�ut the reference in Subd. 3 above is to the definition of foster family home in the rules which
apply to the Department of Human Services rather than the cPefirution of group foster home in tl�e
naies which apply to the Departmeni of Corrections. Julie Snyder has questioned whether the
amendment allows two additional children, if they are being placed in a home being Iicensed by
their department. She has told us that either:
Mounds View needs to state in writing to her department that the reference to the
Department of Human Services rules was intended to include both types of foster homes,
and ihai ihe City regards them as equivalent; or,
Mounds View needs to amend their ordinance.
Our City Attomey has advised us that the ordinance needs to be amended to ciarify that �ubd 3.
includes references to the rules for both the Departmenfi of Corrections and ihe Depa�icment of
Human Services.
I have been contacfed by I�Ii°. Duane VJaldoch who lives at 2935 Hi�hway 10. He has been
operating a fosier home for children referred to hi.m by the Department of Corrections. As Z
understand, from talking with Mr. Waldoch, Minnesota State Law aliows foster care of six ar
fewer children wiihout municipal regulation. It also allows municipaliiies to increase the number
to eighi childcen with local approval.

facility at 2935 ��ighway 10. 3ulie �nyder of the Minnesota DOC Inspectiion Unit and Juvenile
�ervices contacted the City on May 08, 1996 to request the pl�cement of ane additional young
woman at ihe fosier car� faciliiy at 2935 Hi�hway 10.
TJp io this painY, the �Ta.�dach's had heen operating a foster care facility at the property and only
`� permitting six faster children at the home. The State of Ivlinnesota permits six or fewer foster
children in residentiai districts without municipal regulation.
Ms. Snyder made ihe request to add another £oster ctuld %llowing a City Cotancil worksession
discussion to revise ihe fbster care ordinance. The City Council expressed suppori far chartging
the Mounds View foster care ordinance to aIlaw up to eight foster children in residential districts.
Although this new ordinance has not been formally adopted as of yet, I believe it is th� Council's
intention to allow up to eight children at a foster care facility.
The additional child is a female �ander eighteen years of age who stili requires educatian on family
living skills, which Ms. Snyder feels the Waldoch's can provide.
On May 4�, 199b, Ms. Snyder was natified that it wouid be acceptabie to ailow this one
additional chiid into the faster care for the �265 Spring Lake Road facility, prior to the formai
adoption of the amer�ded foster care cod�.

This proposed amendment was braught to the May 06, 1996 City Courzcil work session for �iscussion. City
Council directed staffto work with City Attorney Long to draf� a code amendment ailowing up to eight foster
care chiidren per home, not inciuding the foster family's own children. The Planning Commission has
revlewed thfs amendment and has recommended approval to the Ciiy Counci� in Resolution No. 452-9b.

ann� Waldoch of 2935 Hig�way 10, regaraiing revisirfg N%unds �ew's foster caze ordinance. Th� 2935
I-�ghway i0 properiy is currentiy zoned R-3, Medium Density Residentia.l, which allows foster care as a
germitted use, The Waldoch's have found that the current Ianguage in the Mounds View Zoning Code is
difficult to work with sinc� the ordinance curreniiy restricis the ages of the foster children they can provide
c�re to and for how Iong they can provide foster care to each chiId.
Discussion af a proposed amendment to the faster care ordinance was discvssed at the Nlay 06, 1996 City
Council work session. City Council directed Staff to work witti Attomey Long to draft a code amendment
allowing up to eight faster care ci�.iIdren� per home, not inciud�g th� foster family's owr� civldren.
The Planning Comrnission has reviewed this amendment and has recommended approva.l to the City Council in
Resolution �Io. 452-46, which is attached for your review.
Introducing this ordinance will require a roll cali vote.

The purpose of this neighborhaod meeting was to bring toge#her the residents that surround the O'Nei� praperiy
and the peopie who propose to develop the site, 'She O'IVeil properry is 24 acres in size and is bounded by
Highway 10, Lomg Lake �taad a,nd Couniy Road H2. It is covered by dense, mattare tree �ta.nds and includes a
sizeable wettand alo�ag the west side. Donatelle's Supper Club is located next to the southeast comer of the sifie.
At the meeting, the developers presented their initia( plan for the site. The plan included a si�een screen movie
theater and ihree one-story office buildings, with the possibi�ity of one or %vuo resfiaurants at a later date. The
theater operator would be Carmike, which is reported io be the largest operator of movie theaters in the countty.
In this initial p1an, th� theater was shown located on the south side oi the property, wiih the back of the theater
building facing County Road H2. A 50-foot buffer area between the theater and County Road HZ was proposed,
where the e�sting vegeta.tion wauld be retained. 'The three office buildings were positioned in the center of the
property jusi east of the wetland which rEZns along the west side. 'I'h� development wauld not encroach into the
wetlarid area.
The residents in attendance raised th� following issues, questions and concerns:
� Is theee enough market for 16 screens? Wha,i is the econamic viabili%y of the project?
� Amouni of tra.ffic which would be added to County Road H2; having driveways from the development

To proceed wiYh this project, the developers will need to obtain approval from City Covncii for a change in the
zoning district on this property. The current zoning is B-I, neighborbood business, and R-2, single family and
duplex residential, which do not allaw for theaters. The City Council would maice the decision whether to claange
the zoning a.fter receiving a recommendation from the Planning Commission and holding a public hearing.
Consideration must be given to:

• whether the use wiil �end to or actuaily depreciate the area in which it is propased

This was �he second neighborhood meeting held on a developmen� plan for the O'Neil property. (The
first meeiing was held on December 12, 1996.) The O'Neil property is 24 acres in size and is bounded
by Highway � 0, Long Lake Road and County Road H2. There is a sizeable wetland along the Wesi side
of th� properiy. The main purpose of the tneeiing was for the developer to present a revised plan and
expIain how it addressed the citizen concerns voiced at the first meeting. The developer, Anthony
Properties, was represented by Jay Anthony, Wendell Smii�h of W.R. Smith� & Assoc, and John Pope of
Pope Associates,
The revised proposal show� a lb-screen movie theater and two one-story office buildings containing
approximately 12,000 square feet �ach. A copy of the plan is included with this summary. The movie
theater building has been moved from its ariginal locatian agaznst County Road H2 to approximately
halfway between County Road H2 and Highway 10 on the east side of the wetland. The building does
not encroach into the wetland. The of£�ce buildings have now been placed along the sauth edge of th�
property, atong County Road H2. There is a 7S foot buffer between the edge of the pavemeni on
County Road H2 and the office buildings. The developer intends to leave the e�usting trees in this
buffer area. They are also proposing to build a fence �lortg the south side in between the office
buildings and to the edges of the development, to screen the developmeni from view from County Road
H2. The revisions made by the developer were iniended to orient the development toward Highway 10
and provide a buffer for the residential neighborhood to the south.
The developer has obtained approval from the Minnesota Departmeni of Transportation (Mi�.DOT) io
have a driveway onto Highway 10 approximaiely halfway between Long Lake Road and County Road
H2. At ihis time, the entrance would be righi-in, right-out, meaning ihere would be no break ir� the
median on Highway I0. One of the two driveways onto County Road HZ was eliminated, and the
remaining driveway vaas moved to the east end of the property. The developer thought it would be
possible to eiiminate the driveway on County Road H2, if he could obta.in approval from MnI��T for a
median break and fiall inierseciion on Higl�way 10.
Appro�mately 150 people were in attendance at the meeting. There was general recognition that at
some poin� in the future the property would be developed. Most of the people vvho spoke were
opposed io this project. Two people who spoke indicated that they were favorable. The concerns and
objections raised by the residents included:
• proposal was noi consistent with �he City's comprehensive plan
a proposal did not fit witlz the residents' view that IVIounds View is a bedroom community
• possibie negative impact on the wetIand and the water table

neighborhood
a anticipated increase in crime, trash and noise in neighborhaod
� whether the projec# cause an increase in police and fire services, and how much this would cost?
� effect on property taxes and property values; concem that property iaxes would go up and
property values down
• feeling that there were already enough movie theaters in area
• concem �hat the theaters wauld faii and Ieave an empiry building
� concern that the deveiopment would cause o�her commercial business to be developed in the
neighborhood
• concern about the type of emplayees and cusiomers which would be attracted hy the
deveiopment
� feeling that the location was noi suiiable; too close to a residential neighborhood
The points noted in favor of the project were that it would provide jobs, and enterta.inment and
employment for young people in the community, perhaps within walking disiance to their homes. Ii
would add to #he City's ta�c base and may result in property ta.xes going down, since the City would
receive more revenue. There was a request for rrzore information on the costs and benefits of the
project.
