THANK YOU. * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * c:\wpdocs\plancomm\agenda 12.4 Item #4 • PLANNING COMMISSION MEMO To: Mounds View Planning Commission From: James Ericson, Planning Associate Subject: Commercial Wireless Telecommunications Towers and Antennae Planning Case No. SP-001-96 Date: December 11, 1996 Meeting of December 18, 1996 Issue On August 12, 1996, the City Council approved a 180-day moratorium on the new use, development or construction of wireless telecommunications services within the City(Ordinance No. 587). This moratorium is set to expire on March 8, 1997. The Planning Commission held a special session on October 23, 1996 to discuss this topic at which meeting industry • representatives were present to give short presentations and to answer questions. Staff presented the Commission with a draft ordinance for review on December 4, 1996, which generated additional comments and suggestions. These changes have been incorporated into a revised draft ordinance. Recommendation Staff recommends that the Planning Commission review the attached revised draft of the wireless telecommunications ordinance and make suggestions and or comments as to its content and provisions. If the Planning Commission considers the ordinance acceptable, staff recommends ordinance to the City Council. Analysis A number of changes have been made to the proposed ordinance. Any language that has been added since the December 4, 1996 meeting is shaded. Some language has been deleted as a result of the that meeting and suggestions made by City Attorney Bob Long. Format for Section on Districts Allowing Telecommunications Facilities: The revised ordinance places the text in section 1126.03, Subd. 2 relating to conditional uses into a table that • enhances readability and comprehension. Planning Commission Planning Case No. SP-001-96: Telecommunications Ordinance December 12, 1996 • Page 2 Accessory Buildings: Also in Section 1126.03, Subd. 2, the requirement for CUPs for accessory buildings in the PF and CRP districts was deleted. In a subsequent section of the ordinance, text was added that amends the PF and CRP districts to allow accessory equipment structures only when associated with a CWTS tower and/or antenna as a permitted accessory use. Also regarding accessory equipment structures, text was added to the co-location requirements section that addresses how new buildings would be treated in relation to existing buildings. Landscaping& Screening: Added to the ordinance is a section that makes explicit the landscaping and screening requirements. Basically, a tree-screen of evergreens and ornamental deciduous trees is required to be planted around the fence so that at least 50% of the accessory structure and/or tower base is screened from view. Because some sites may not need landscaping either because existing foliage is sufficient or because the site might be in the middle of an industrial site parking lot, the screening and landscaping requirement can be waived. Procedural Requirements: The other major change to the ordinance from its previous version is the addition of a list of submittal requirements for CUPs, similar to what had been listed under building permit requirements. Those requirements were moved under the CUP heading because the information would be needed in order to approve a CUP. If no CUP is required, then the same information would be required to be submitted with the building permit application. Also in • the procedural section, a clarification was made to the proof of insurance requirement and an abandoned tower clause was added. Co-location: We have removed the requirement for a"letter of intent" which would have required all new towers to allow for co-location. This change was primarily made due to legal considerations. The provision would not be workable anyway, because it was the Planning Commission's desire that an applicant have a signed leased agreement, or other such document, for the second user before they received the height bonus for co-location. If the applicant had a lease in hand, a letter of intent is not necessary. The other changes are minor and can be addressed during the Planning Commission meeting on December 18, 1996, if the Commissioners have any questions. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission does hereby recommend adoption of Ordinance No. 588 as shown in Exhibit "A" attached hereto and made a part of this resolution by this reference. ANTENNA: Equipment used for transmitting or receiving radio frequency signals which is attached to a tower, building-or other structure, usually consisting of a series of - — directional panels, microwave or satellite dishes, or omnidirectional "whip" antennae. BASE TRANSCEIVER STATION: Equipment that provides the link between wireless communications and land-based public telephone switching networks, including radio frequency transceivers, back-up power sources, power amplifiers, and signal processing hardware, typically protected by a small building or cabinet. Subd. 5. CO-LOCATION: The location of wireless communications equipment from more than one provider on one common tower. Subd. 6. Conditional Uses, Specific Districts: CTWS towers and antennae shall be allowed • with the approval of a conditional use permit in the following zoning districts and in accordance with the co-location requirements stated in Section 1126.04, siting requirements and design criteria stated in Section 1126.05. and the procedural requirements stated in Section 1126.06. The height of a tower may be increased up to a maximum of one hundred and twenty feet (120') to allow for the co-location of another provider's antenna, subject to the applicant providing to the City proof of a signed leasing arrangement, shared use agreement, or other like document. Conditional use permits are not required for towers and/or antennae used by the City for City purposes or public agencies for public safety purposes; or for repair or replacement or adjustment of the elements of a CWTS antenna array affixed to a tower, if the replacement does not reduce acceptable safety standards. 1126.04: CO-LOCATION REQUIREMENTS: • Subd. 1. A proposal for a new CWTS tower or antennae shall not be approved unless the applicant can document to the satisfaction of the City that the telecommunications equipment planned for the proposed tower cannot be accommodated on an existing or approved tower or commercial buildings within a one-half mile radius, transcending municipal borders, due to one or more of the following: as The planned equipment would exceed the structural capacity of the existing or approved tower or commercial building. b>> The planned equipment would cause interference with other existing or planned equipment at the tower or building. Subd. 8. Prevention of Radiation: CWTS antennae shall be subject to state and federal regulations regarding non-ionizing radiation and other health hazards related to such facilities. If the federal government adopts new, more restrictive standards, the antennae shall be made to comply or the antenna may be removed by the City at the tower owner's expense. The owner or operator of the tower shall pay any associated costs of compliance verification. Subd. 9. Violations: Deviations from the approved construction plans and CUP is a misdemeanor. 1126.07: EXISTING CWTS ANTENNAE AND TOWERS: CWTS antennae and towers in existence as of the date of enactment of this ordinance that do not meet or comply with the provisions of this Chapter are subject to the following: Subd. 1. Existing towers may continue in use for their existing purpose but may not be replaced or structurally altered to an extent exceeding ten percent (10%) of the tower's fair market value, as determined by the City, without meeting all standards in this Chapter. Subd. 2. If such tower is damaged or destroyed to the extent of fifty percent (50%) or more of its fair market value (said value to be determined by the City) due to any reason or cause whatsoever, the owner of the tower may choose to rebuild or remove the tower. If the owner chooses to rebuild the tower, it shall from and after the date of said destruction be subject to all current and applicable regulations as specified by this Code.
