parceis in ihis section oithe Ciiy. (Refer to the zaning map attached.) Presently there is a small,
one-story resi�ence and a deiached single�car garage on th� corner Iot. The gaxage wouid need to
be removed for the 1,260 square-foot garage to be constructed.

The driveway is currentiy 80 freet long and unpaved. The applicant is not intendi�g to alter the
driveway's configuration in conjunction with the garage construction, but plans to do so in the
near future. As preseni�ed, the praposa.I meets all of the criteria imposed by the Code, as
addressed in the dimensional requirements above.
Of the criieria listed in Section 1125.OI, Srab. 3 far grantir�g conditional use pernzits, the proposal
appears to satisfy the requirements with the possibl� exception of two:
(2) "The use wi�l be suf�ciently compatibl� or separated by distance or screening frorn
adjacent residentiatly zoned land so that existing homes will nat be depreciaied in value...9'
(3) "The structure and szte shall have an appearance that will not have an adverse effeci
upon adjacent residential properties."

Depending upon one's interpretation of the requ�st in �erms of the "iniensity" of the proposed
garage in comparison ta the exisfing home and neighboring homes, the praposal ma�r be in conflict -
with the two above-noted criteria. Our only concern with this proposal is ihe size of the garage `"'
(1264 sq.ft.) in comparison io the house (660 sq.ft.) The width of the garage frorn the streei
view, however, is similar to the house. The bulk of the garage wsil not be seen from the street. It
is desirable from a community perspective to have property owners imgrove their properties urith
garages since the properties are then usually kept in better order. Present day staff does noi kzao��
how the Planning Camgnission has viewed this issue in the past and is seeking guidarice.
C'one�a�s�o�o
Sta.ff is favorable toward the granting of this CiTP, but is concerned about the size of the garage in
comparison to the home. Staff is requesting guidance from the Planning Commission on this issue
for this case and for future reference. Staff wil� prepare a resolution for the Planning
Commission's next meeting on March S, 1997.

The new lot t�Zat wauld be created as a result af this proposed minor subdivision would be 18,067
square feet with a width of 100.4 feet fro�tzng Krfloliwood Drive. The minimum requ�rements as
stated in the Zoning Code for an interior lot a.re a size of i 1,000 square feet and lot width of 75
feet. Both of ihese conditions wouId be met.
In a letter dated January 24, 1997, staff advised the applicant thai the City would be requiring ih�
dedication of drainage and utility easements for the new lot and possibty for a portion of th�
remainin� lot. The particular dimensions and locations of the necessary easerr�ents have been
dra.fted by sta,ff , a copy of which has 6een sent to the applicant in a Ietter dated February 12,
1997. The City Code requires that notarized easement documents with the appropriate legal
descriptions be provided to the City for recordation with Ra,msey County. The applicant s�ali
provide these documents prior to City Council approval of this minor subdivision. Currently ther�
is a 10-foot north/south NSP easement crossing the property at its midpoint. In addition, there is
a 15-fooi drainage easement at ihe rear of the 30 foot southem extensior� o�the property, bui
daes not e�end through.
Staff varould require that a registered land surveyor bury iron monuments at the comers where the
Iots are proposed to meet to demarcate the new property line.
Contlusion:
Staff'is favorable to this minor subdivision as it does not create a non-confozming lot and is

Design: The one-story building is proposed to be 32 feet #all and oriented to face out toward
Cora.t Sea Street. The north and west elevations would be completely screened by the existing tree-
cover, as wouid be the north end of the parking area. Five laading docks are shown on the
bui�ding's southern elevatian. The building wouId be constnacted of precasi concrete "tip-up"
panels with a vertically raked finish. Narrow blue and yellow horizontal accent stripes are proposed
near the top of the buiiding. The entrance to ihe building would be surrounded a 324 square-foot
section oi framed glass enclosed within a protruding wall section finished with a stucco-like
material. Access to the site would be from Coral Sea Street.
Wetland and Drainage: The site is located on the southwest corner of County Road J and Coral
Sea Street and covers 3.94 acres, A small portion ofthe southwest c�rner of the site is wetland.
Because of the wetland and the fact that the si#e is larger than 2'/a acres, the applicani will aeed a
pemut from the Rice Creek Watershed District to proceed with this project. The drainage plan
daie stamped Feb. 7, I997, shows thu water nan-off directed to the southwest comer of the lot
following the pavement until it reaches a 4 foot break in the curbing. A ihis point the nan-ofi is
directed into a 6 foo� wide bituminous flume wlzich empties into ti�e proposed on-site holding pond.
The purpose af the pond is to allow for the removal of sedimentation prior to the water entering �he
adjacenf wetiar�d. Copies of the drainage a.nd utility pian have been sent to SEH �o� review.

Landscapin�: The siie plan shows that much of the existing tree-cover will be preserved. The
following trees and pla.Y�ts are propos�d to be added to the site to compliment the existing tree4
cover: Black Hill Spruce, Hackberry, �unburst Honeylocust, and upright and spreading Japanese
Yew. 4�Iith regards to the planned landscaping, City Forester Rick Wrisky thoughi the Hackberry
trees were accepta6le, but considered our elz�nate tao harsh for the S�anburst Honeylocusts. He
suggested Shader�zasier Honeylocusts as a substitute for these, He cautianed against using smaller
ornamental trees because they may sustain damage irom plowing and other winteriime adversities.
E�sting Tree Cover: The City Forester wa�ied to knovv when the developers were thinlcing of
breaking g�our�d, because spring would be ihe most vulnerable time for the ex�sting trees. T'o
protect the trees that are io rremain on site, the develapers should either stake out or snowfence �n
area beyond which eazth-movers and other heavy equipment would be restricted, The area to be
delineaied for such purpose shouid be the dripline af ihe irees praposed to be saved, which varies
deper�ding upon the tree's heighi ana' canopy width. ihe onset of oak wilt couId wipe out alI of th�
remaining trees if ihe tre� roots become damaged as a result of the development.

The site pi�t� shows two Iight standards ai the east edge of �he parlang area fronting Coral Sea
- Stre�t. Wall pack �ghting will be mounted upon the building itself with recessed lighting within the
:} canopy at the build�ng's enirance. These fixtures should be mounted and shielded so that the light
is casi dawnward and against the building, to prevent glare to passing motorists.
Si a e:
The only signage shown for the site will be the oval "ZEP" company logo attached to the upper left
corner of the building's east elevation. The ovai measures approximately six %et high and nin� freet
wide which is approximately 40 square feei. The �ign Code allows for a iotal of 100 square feet of
wall type signage.
Other Referral Agency Comments:
Mark Bishop, Fire IVlarshat for Spring Lake Park/Blaine/I�/lounds View Fire Department, stated that
the building needs to be served 6y adequate fire suppression equipment as required by Code. In
addition, there should be an e}cterior fire department water conr�ection accessible year-round and
s�ggests thai it be located on the building's sauth elevation near the service shop as shown on the
site pian. With regaxds to the access and circulation oithe site, the access to the parkir�g area is
shown on the site plan to be 24 feet wide. Mr. Bishop suggests this to 6e increased to 28 feet to
facilitate the movements af fire trucks and oiher larger emergency vehicies.

Based o�x the square-footages provided, our Cod� would require that the applicani provide 84
spaces. This total is based on the applying the parking ratios to the square footages supplied by tl�e
applicani as follows:

Typical parlcing ratios for warehouse space = 1 space per 1000 square �eet; and for office space = 1
space per 250 or 200 square feet. Using these ratias, this development would require 20 spaces �or
ihe warehouse area and 24-30 spaces for the office area, or 44-50 spac�s.
The site plan, date-stamped January 30, I997, shows parl{ing for 41 passenger vehicles and an
outline for the rernait�ing 43 parking spaces to be built if needed. This "Proof of Parking" concept
allows far the designation of parking area to be set asid� fbr future developmeni and maintained as
greenspace irl the meantune. This straiegy was used recenily by 1�lidwest I.�I. a.nd the Seruor
Housing Project. A variance would need to be approved by the Planning Commission to allow for
such a reduction in parking sgaces.
Vaxiance Criteria: The criteria for granting variances are stated in Section 1125.02, Subd.2 and
noted below along with staff comments:

This site is heavily wooded, a portion of which lies in wetland. While there is a.�ple room #o
provide the full amount of parking required by our Code, the applicant would prefer to retain much
of the tree cover and keep the site as natural as possible. Research has shown that our parking
requirements are high in comparison to neighboring communities and communities across the
country. The applicant is not responsible for our high parking requirements,

The granting of this variance will be a benefit to neighboring praperties by preserving an e�rtensi�+��

adjaeent parcels. There are pians in the fuiure to create nature trails and hik�ng paths in the open
area behind the siie. ReYention of this wooded area will allow for a mare opaque screen while
retaining the natural character of the site.
Comclusion:
With the exception of the 15 foot setback of the parking area in the front yard a.�zd their request
for the parkin� area variance, the applicant is meeting aII the conditions unposed by Code.
Staff is favorable toward recommending approval af the development review wiih two conditions:
The applicant obtain a permit from the Rice Creek watershed District and update �he site plan io
show a 4� foot front setback for the parl�ing area. Staff is also favorable toward approving the
parking area variance with the condition that th� parkin� be deveioped at a Ia�er date ii de�med
necessary by the City Council. Staff will prepare resolutions for action at your next Planning

In July of i 994, i�1illiam Li�geti, representing Colonial Village Park, made application to amend the
Zoning Cade relating to the R-5 (Mobile Hom� District} to allow ihe display and sales of model
mobile homes. The Planning Commission approved the Code amendment on November 2, 1994,
sending the amendment on the City Council. Before reachin� the Council, however, Faul
Harrington and Jim Thompson {the City's respeciive community developmen� coordinator and
attorney ai that time) together reinterpreted the Code and decided that the use was a pemutted
conditional us�. Oa January 4, I995, the Planning Commissian approved the CUP appiication,
sending it an the City Council. The Cour�cil approved the CUP on Februaey 27, 1995.

There are six contingencies ait�ched to this CUP. The first requires ihat the CUP be recorded wiih
Ramsey County. Staff has contacted Ramsey County arid verified that the CUP was in fact on file

I coniacted th� League of I+/linnesota Ci#ies to get a status repori on this issue, and ta.lked with
Jim MiIler. I�e said that the League was very involved in coordina�ing th� cities' efforts io dea�
with this issue. The League effort bega.n last summer U.S. �est took legal actian againsi the Cit�
of �edwood Fa11s because of requirements to: -�
put fiber optic cable in concreie ducis to protect it
pay a nominal franchise fee for use of the right-of-way (ROW} �.
U.3. VV°est filed a. lawsuit and they aJ.so filed a complaint with the PubIic Utilitzes Cornenission.
,� The caurt so far has agreed with U. S. at the trial court and appellate court Ievel. The casa wilt ��
on io the Supreme Court. Meanwhile, the League formed a task �'orce and requested voluntary
cantributions from its 813 members ta fund a legislative effori and hire an outside Iobbyist.
Ninety percent of ihe members sent in coatribuiions. Jim did not Imow far sure if ivlound5 V evu
sent a contribution, but he believes we did. Th� League has prepared a model ordinance which
they intended io distribute to their members, but ii has been put on hold since the appellate court
found in favoc of U. �. West. The League is working on revising the ordinance to try a.nd
addressed the points brought up in the court's decision. They hope to distribute it soan.
There are three bills in the legislature. He said that the House appears more sympathetic to the
cities' cause than the Senate. It appears that the House wiii take the lead on tkus issue. The il�re�
biIls represent a ciiy perspective, industry perspective and a comprornise position. The "industz`�'
bill was prepared by the Telephone Association is discussed in a recent League article, which is
attached.

how public rights of way shouid be
managed. Simply put, it isn't a pretty
sight.

taxes, or similar charges:' The bill
would allow cities to charge permit
fees for work done in rhe rights of
way, but ihe charges would be limited
to the costs directly related to grantin�
and administerins the permie.
"Obviously, sorrteone is going to
pay the cost of occupyino and usin,
the pubiic rights of way," said Milter.
"The telecommunications industry
appears to be happy to reap the
benefits and let the state and [ocal
taxpayers foat the biIt."

"This is a management issue -- n��
a matter of cities trying to con�ol or
discriminate against uti]ities;' said

firsthand the implications of being
forced to give telecommunica�ions
companies carte blanche use of tt►e
ri�h[s of way. The issue came to roose
- quite lieerally - in the frone yards of
many residents. Large metal boxes
used to house telephone fibre-op[ics
equipment popped up in residential
neighborhoods, usually between
sidewalks and curbs on pe�blic rights c��
�vay in front of private propezty --
without the hameowne� approva! or
knowledge. .
How iarge are the boxes? About
six feet tall, four feet four inches wide,
and 18 inches deep, sittinQ on a
concrete pad ehat measures 16 feet
long by eibht Feee wide. The issue is
not unique to Col�rado. San Jose,
Califomia was one of the first areas �o
recoQnize thas a city must develop
rules and re�ulations to pratect the
community from obuusive telecommu-
�nications paraphemalia.

creased risk for workers in a crowded
right of way, increased cflngestion and
delays for drivers, and increased air
and noise pollution. He aiso described

item high on yaur priority list. Staffis in agreement especially since we keep running into
problems wiih the parking ratios. We have ordered ttivo publications �which should assist us in
moving forward with this revision:

which I developed when working in Summit County, CO and have inctuded it in your packet. I
fee! the structure of this code may offer a useful starting point. I have Iisted the iopics below in
an outline forn� for you to go througli and make notes. I have also noted the sectior� numbers
from the Mounds View Code where similar provisions appear. Following the outline is a list of
topics which appear in the Mounds View Code but not the Summit County Code. I ihoughi it
would simply the revision process if the Planning Commission could indicate what topic you want
covered and whether the basic structure is acceptable, so we can go from here rather than starting
from scratch. We may or may not have time to review this informafiion ai your Febnaary 19

I contacted ihe IvletropoIitan Cour�ci� to ask vvhai they ha,ve on file for Ivlounds View for its
Comprehensive Plan. They looked in their files to see wha� was physically there, as v�ell as
checking iheir data base on the computer. ihe only comprehensive plan that they have is original
plan from 1979-1980. They show no submittals since then in the data base.
Mea.nwhil�, there are iiles left from previous sia� members for the followang updates:
i 985, 1986, 1989, 1991.
I called Faul Harringion to ask iu�r if he recalled sending a Comprehens�ve Flan Update to Met
Council in the last 2-3 years. He said that the City was working on one in 1993 or 1994, and i#
was reviewed and approved by the Planning Commission. It was then sent on to the City Council
where it stalled. There w�s a lack of consensus aboui the poficies_ In addition, the City Council
wanted the Housir�g Plan, wYuch 7ennifer Bergman was hired to prepare, to be incorporated into
�be Comprehensive Plan Update before it was adopfed.
I have not been abl� to lacate a fiIe with the 1993 or 1994 Update yei btat will go through the
public book to see if there is a cogy in the book. If any of yau have files on this update, I would
appreciaie getting them so we could make copies of the information.
